The Board of Assessment Review for the Town of Southold, has duly met to hear
Complaints or grievances on the tentative town assessment roll for the tax year 2006/07,
as prescribed by law.
The Board, having duly convened, has considered each and every complaint or grievance
on the assessments for the tax year indicated, as filed with this Board, as prescribed by
law.
A majority of the Board has determined that all the changes indicated on the attached
page(s) will be made on the assessment roll by the Assessor.

ROBERT SCOTT: My name is Bob Scott and I am the chairman of the Board of Assessors. My

KEVIN WEBSTER: My name is Kevin Webster. I am a member of the Board of Assessors. My

GERARD SCHUL THEIS: Okay are we all set?
LUCK MILLER: Hello, my name is Luck Miller and I live at 1105 Naugles Drive.
DANIEL MCCONLOGUE: Listen, we have to take your testimony under oath so if you just
stand up, I'll swear you in.
LUCK MILLER: Oh.
DANIEL MCCONLOGUE: You do solemnly swear that the testimony you are about to give in
this proceeding is truth, the whole truth, nothing but the truth.
LUCK MILLER: Yes, I do.
DANIEL MCCONLOGUE: And the assessor has already been sworn this morning, which
continues through all of the adjournments. So be seated.
DANIEL MCCONLOGUE: So now you can state your name and home address.
LUCK MILLER: Okay. My name is Luck, L-U-C-K, Miller, M-I-L-L-E-R and I live at 1105
Naugles Drive, N-A-U-G-L-E-S, Drive in Mattituck. My mailing address is Post Office Box is
593.
JONATHAN WIGGINS: In simple terms, what is your grievance.
LUCK MILLER: Well, my house is on the inlet of Mattituck Inlet and it was just renovated and I
had one assessment and then I got a second assessment, $1700 dollars more. The state owns a lot
of property mostly around me except for a little narrow strip. I'm not sure what it is, Philomena
or something owns it.
JONATHAN WIGGINS: What's the tax map number of the strip?
KEVIN WEBSTER: The parcel is 99-4-4
JONATHAN WIGGINS: 99-4 and 4?
KEVIN WEBSTER: 99-4-4 is owned by a private party based out of Hicks vi lie and it's another
vacant lot, 99-4-3, is owned by the state, 99-4-2 is owned by the state 99-4-13.1 as well as 4 and 8
are all owned by the state. There is one parcel that's...
LUCK MILLER: Yeah, they are going to put, they are going to be putting there a boat rack where
people could come and put their boats into the water. That would be sort of... be a driveway in
kind offront of my house. But, the thing was that the Town says it is such a luxury place.
However, when I look out the window I see these ugly trailers, three ugly trailers like
refrigeration trailers, which I have photographs of and then these cages. The only thing that is
pretty is the boat, which is in the water. These are the pictures I have here. This is taken from
one of those cheap throwaway cameras so actually it is much closer then this looks from my
house. It's a lovely place to be but...my mother bought that house in 1949 so it wasn't any
luxury thing that I...I just inherited it from her and then I spent the money I sold my house on the
Main Rd. and made it look better because it was pretty shabby.
DANIEL MCCONLOGUE: So I understand your position, that the fact the neighboring parcels,
boat launching or whatever, reduces the value of your property.
LUCK MILLER: Yeah, I don't know, maybe. It's Peterson's in the back, but of course they have
to drive their cars in front of the house but I'm not sure where that right-of-way is going to be, I
don't know if it's going to be really close to my house, which it can be because if you look at the
map the old right-of-way is next to my house. But, the EP A man said he didn't think he was
going to put it right there but of course I don't know yet. He's going to put it over closer to
where this property.. . anyhow I will have traffic going in front, of course right in front of my
house.
DANIEL MCCONLOGUE: We understand the assessment is based on market value on your
house.
LUCK MILLER: Yes.
DANIEL MCCONLOGUE: They develop the market value by looking at sales very close to your
house.
LUCK MILLER: Well somebody built this unbelievable palazzo up the street; you cannot believe
it. It's so luxurious but he's a multimillionaire. They have built nicer houses in the community
that's very true, very true.
DANIEL MCCONLOGUE: Do you have any sales on your house that show the value that's close
to yours?
LUCK MILLER: No, I mean I guess if they have reassessed, you know, the man next door the
house has been there a long time. He has a better view than I do but I don't want to be picking on
those people. The man across the street has a fabulous view; he doesn't see what I see. He can
see the inlet and the rocks, you know, and it is just beautiful.
JONATHAN WIGGINS: You feel your property isn't as valuable as some other properties
because of all the industrial promotions going on?
LUCK MILLER: Yes, and you know, they just sit there and they don't even do anything; they
come and look at the place and the boat doesn't go out, it just sits there constantly and in the
summertime, last summer, when they were at the Peterson's and the refrigerator truck,
refrigerators went all night and day then they were working.
JONATHAN WIGGINS: Yeah, it gets very noisy
LUCK MILLER: Yeah it was constant. I think the Greek people got together and complained to
the Town about it but I heard it the most because it was closest to me and it was continual noise
but they haven't put those refrigeration coats on this year because I understand that fishing is not
so good because Taiwan is selling all the fish, the clams to us now, and our clams are all
expensive. That's what the Environmental Protective Agency told me. In the future, will they
start again, start all that refrigeration noise...
JONATHAN WIGGINS: The refrigeration equipment is on the property now?
LUCK MILLER: Yeah, these trucks that they refrigerate.
JONATHAN WIGGINS: Yeah that sounds a little suspicious.
LUCK MILLER: Like I say, they are really closer than this photograph is but these are the
pictures...there's really nothing between me and them.
JONATHAN WIGGINS: Yes this is industrial.
LUCK MILLER: Not that I don't trust them, that's the truth.
GERARD SCHULTHEIS: So ifI understand by your form here that you're saying you believe
the value of your house is $600,000.
LUCK MILLER: Yes, yes.
GERARD SCHUL THEIS: Would you sell it to somebody for $600,000?
LUCK MILLER: Would I sell it to somebody? I'm not selling it; it's my mother's house. I never
really considered that, selling it.
JONATHAN WIGGINS: All right, but you feel the value is $600,000.
LUCK MILLER: Yes, that sounds...yes.
DANIEL MCCONLOGUE: And that is based on...
LUCK MILLER: I think my insurance is much less than that; I should have looked that up
GERARD SHULTHEIS: Do you have a copy of your insurance?
LUCK MILLER: No I don't. I think they had my house at $200,000.
JONATHAN WIGGINS: How much are you being assessed now? What's the assessment?
GERARD SCHUL THEIS: 7,600
JONATHAN WIGGINS: 76
DANIEL MCCONLONGUE: What market value does that throw off?
KEVIN WEBSTER: With the RAR, it comes out to $678,571, which is land and improvement.
GERARD SCHULTHEIS: This picture here, where was that picture taken?
LUCK MILLER: From my house. You know I just look out the kitchen window, right?
GERARD SCHUL THEIS: That picture was taken from...
LUCK MILLER: my kitchen window
GERARD SCHULTHEIS: Looking what direction?
LUCK MILLER: It's actually much closer because I didn't have a zoom camera to show reality
GERARD SCHULTHEIS: Okay this is looking in what direction from your kitchen window?
LUCK MILLER: It's looking west. Northwest, right.
GERARD SCHUL THEIS: So this is on the state land?
LUCK MILLER: Yeah, but no, those trailers belong to somebody named Philomena something.
KEVIN WEBSTER: It is hard to say where those trailers are, if they are on lot 13.1 or they're on
lot 4 because they are both large vacant parcels.
LUCK MILLER: It's kind of a narrow lot, it goes out like that and they put all these stakes there
saying wetlands. I don't know if you could see them they are green. There is one right in front of
my house.
GERARD SCHULTHEIS: The subject lot is lot 14?
KEVIN WEBSTER: Yes. If I may, Mr. Chairman, say that lots 1,2,3,4,13.1, and 8 are all vacant
parcels with no physical improvement on them. What you are seeing there are those trailers,
temporarily trailers.
CARA WELLS: I'm sorry which ones are vacant again?
KEVIN WEBSTER: One is owned by the Town, 2 is owned by the State and 3 is owned by the
State, 4 is owned by a private entity with no improvement on it, 26 and 28 are those right-of-
ways, those are owned by the State, and then 13.1 is owned by the State of New York and they're
all vacant and that's what you are seeing. That view you are seeing is mostly over 13.1 over 4 but
there are a couple of refrigerators, that's temporarily trailers that are there.
LUCK MILLER: Three refrigerators
KEVIN WEBSTER: Yeah you can see from those pictures they are not affixed to the ground but
they're there.
LUCK MILLER: And those trucks are there and these big pipes are there. Two trucks are there.
DANIEL MCCONLOGUE: Mr. Assessor would you just state your name for the record.
KEVIN WEBSTER: Sure, that was Kevin Webster.
DANIEL MCCONLOGUE: Thank you.
GERARD SCHULTHEIS: Do we know what the zoning of those parcels are?
KEVIN WEBSTER: I don't offhand.
DANIEL MCCONLOGUE: Do you have the market value at 678,000?
KEVIN WEBSTER: Yes
DANIEL MCCONLOGUE: And that's sales that's based on?
KEVIN WEBSTER: Well, it's based on the rates that were applied to this property. I could
find...I had sales that would show that's more than reasonable, but it comes out to 678 based on
the rates that were applied there.
JONATHAN WIGGINS: That's a nice house.
LUCK MILLER: Well the house is a nice house. It was on one story but there was a second story
so I could have the... you know.
JONATHAN WIGGINS: Was there any depreciation taken for all the industrial matter that is
going on there?
KEVIN WEBSTER: Well the land has an assessment of, I believe, $800. . . is that what the land is
assessed at on the grievance form? The land has a very reasonable value. The land is assessed at
a value of$71,000; I think it is, which is a buildable parcel in Mattituck with an unobstructed
water view is a little bit reasoned. The reason the assessment was increased is that there was a
$100,000 building permit recently taken out and you can see from, the property card, the photo,
before and after photo the property was expanded with a very large six-figured building permit.
LUCK MILLER: My mother didn't...she lived with me for four years so the house got real
shabby. Before, she used to fix it herself. She lived on a dollar a week.
JONATHAN WIGGINS: Okay, so basically you are saying your house is worth $600,000 and the
assessor is saying it is worth $687,571.
LUCK MILLER: Yes.
DANIEL MCCONLOGUE: The assessment went up because of some addition?
KEVIN WEBSTER: Yes, there was a $100,000 building permit taken out for her roof.
GERARD SCHULTHEIS: The assessment went up how much?
KEVIN WEBSTER: 1,700 I believe. We also had a one-car garage underneath that was not
assessed.
LUCK MILLER: But it went up one time before that when Scott came and did it.
JONATHAN WIGGINS: So after you did your improvements, you were reassessed.
LUCK MILLER: Scott came and looked at it. Yes, and assessed it and then I couldn't believe... I
thought that was it.
JONATHAN WIGGINS: Was your work finished after Mr. Russell did the reassessment?
LUCK MILLER: I didn't hear the first word.
JONATHAN WIGGINS: Was the work completed after Mr. Russell did the reassessment?
LUCK MILLER: Yeah, yes, it was completed. I was living there.
JONATHAN WIGGINS: Nothing has changed?
LUCK MILLER: Yeah, yeah.
JONATHAN WIGGINS: Okay
LUCK MILLER: No, no it wasn't.
KEVIN WEBSTER: I don't think it was because...
LUCK MILLER: It had the attic part, not completely finished yet.
KEVIN WEBSTER: Right, that's correct. There was a $1.00 a square foot taken off for that
being unfinished.
LUCK MILLER: He said I didn't have a garage, which it always had a garage.
KEVIN WEBSTER: And the CO was granted in October 2005, we visited the home in February
2006, saw that the upstairs was finished and then we deducted that dollar that was taken off for
the upstairs being unfinished. So, we just put on the upstairs after it was...
LUCK MILLER: Yeah, I could of gotten it much soonerto get the CO but I just didn't bother, I
didn't realize it was important to get the CO until they told me it was important and I would have
got it.
JONATHAN WIGGINS: Even if Mr. Russell was still in the job, now that the work is completed
in the attic, you would have to be charged for it.
LUCK MILLER: Uh huh, yes that's what Kevin explained to me.
CARA WELLS: And you'd never been charged for a garage, you also have to be charged for a
garage.
LUCK MILLER: Yeah, they just never noticed it
CARA WELLS: That's right, but now that they noticed...
LUCK MILLER: But he said that was not a lot of money.
CARA WELLS: No, it's not but those things are both irrelevant is what you're saying.
LUCK MILLER: Yeah
CARA WELLS: If you're adding an attic which must have gorgeous views...
LUCK MILLER: It is.
CARA WELLS: Then, you have greatly increased the value of your property.
LUCK MILLER: Yeah, the view is nice upstairs, not downstairs.
CARA WELLS: Right.
LUCK MILLER: Downstairs...I wish I brought them up closer so you can see what it really
looks like.
JONATHAN WIGGINS: We're familiar with the area.
LUCK MILLER: There's a little green thing in the brown there where the stake is, the stake, it's
not a lot of property there, and it's just a little property in front of my house. Then from then on
in, it's the state property and then it becomes Philomena's or whoever that strip is there.
KEVIN WEBSTER: Yes, Kevin Webster again, lot 4, which is a vacant parcel, is not owned by
LUCK MILLER: The EPA man told me they don't like us and they're not going to sell to us and
we don't do eminent domain. The EPA says they do not do eminent domain so who knows how
that will ever work out.
JONATHAN WIGGINS: What, the land in front of you?
LUCK MILLER: Yes.
JONATHAN WIGGINS: Yeah, that's pretty much wetlands. I don't know if you can build on it.
LUCK MILLER: Oh, he can't build on that, just got junk there. I don't think you could build
there. They have all the signs everywhere, I don't even know how they're there.
JONATHAN WIGGINS: You've been in this house a long time?
LUCK MILLER: My mother bought it in ]949. She bought the land and built the house herself.
JONATHAN WIGGINS: Has the view improved through the years or gotten worse?
LUCK MILLER: It wasn't always good because you sit in sand and stone there.
JONATHAN WIGGINS: Yeah, they got a lot of
going on there.
GERARD SCHUL THEIS: They moved all the oil tanks
LUCK MILLER: Oh those horrible tanks, they finally took those down, yes. But when they
were first there, of course I wasn't there, and my Uncle Vinny had a fishing dock there where the
crabbers would come in, unload, but then the fishing business went down the tubes in the early
70's. He sold to sand and stone people.
KEVIN WEBSTER: Mr. Chairman, can I say something?
GERARD SCHULTHEIS: Okay
KEVIN WEBSTER: The right-of-way issue was brought up, it appears the right-of-way, go to lot
9 is lots 26 and then it joins in 28 and goes across and it connects to lot 24. It appears that's how
it runs, a good 200 feet off north of the , I guess that's the way how people get to lot
9 is on that right-of-way, they go north and then they go hard right, go east, it's designated there.
LUCK MILLER: Is that where the trailers are?
KEVIN WEBSTER: No, I think that's something you mentioned about Petersen Marina.
LUCK MILLER: Yes, the marina is right in the back.
KEVIN WEBSTER: That's right, that must be lot 9. I have to look that up.
LUCK MILLER: It's pretty big that marina, they're busy.
JONATHAN WIGGINS: She could get comparable assessment; which probably says she's not
assessed more than anyone else.
GERARD SCHULTHEIS: Well that's the comparable assessment is a proof that she can offer.
LUCK MILLER: Uh huh, like the house next door. There are two houses on the same side that I
am before it comes to a mansion, a big assessor house mansion, and then there's little junkie
places.
DANIEL MCCONLOGUE: Assessor, are you saying that $700,000 sale on the waterfront
property with the boat dock, that we were talking about, that also included another lot?
LUCK MILLER: He doesn't know.
KEVIN WEBSTER: I'd have to research that but the house that's in question is nit a waterfront
house, the house that this assessor person bought is lot 17 on the tax map it's 99-4-17, and it's not
on the water. It probably has a water view but it's not on the water.
LUCK MILLER: No, but ifhe goes down the road there, he has
KEVIN WEBSTER: Right, there's a separate lot 27 down there and it might have been included
in the sale, I don't know.
GERARD SCHULTHEIS: Do you have a copy of the deed to show us?
KEVIN WEBSTER: Yeah, we could take a look at that. Do you want me to take a look at those
two lots?
GERARD SCHULTHEIS: Yeah
LUCK MILLER: If it was two separate purchases, I really don't know that. I see the cars going
down there.
JONATHAN WIGGINS: And what's happening with the lot next door to you...the house next
door to you?
LUCK MILLER: 15?
JONATHAN WIGGINS: 15
CARA WELLS: It's the house to the north.
JONATHAN WIGGINS: Before you get to your house.
LUCK MILLER: East you mean? Northeast?
JONATHAN WIGGINS: Yes
LUCK MILLER: They just live there; the people live in New York City and they come out in the
summertime.
JONATHAN WIGGINS: there are a few houses in there, if you could get the property tax cards
on that...
LUCK MILLER: Oh okay, and the next house after it, the log cabin. They just put an extension
on that house, the log cabin.
JONATHAN WIGGINS: Then we could see what their assessments are and we could compare
them to your assessment.
LUCK MILLER: I see.
JONATHAN WIGGINS: They'll give you the cards in the back.
LUCK MILLER: So, should I go and look?
JONATHAN WIGGINS: Yeah, ask him...you want to see those.
LUCK MILLER: Do I have to know the names? Right?
CARA WELLS: No, you don't.
JONATHAN WIGGINS: No, just the tax map number. They'll know which ones you want.
LUCK MILLER: Oh, I bring my tax number right?
JONATHAN WIGGINS: Right. You want 15,16, and 17.
LUCK MILLER: What is it?
JONATHAN WIGGINS: 15,16, and 17
LUCK MILLER: 15,16, and 17
JONATHAN WIGGINS: Yeah, you're 14.
KEVIN WEBSTER: Get the cards on those three homes or just what the assessed values are?
JONATHAN WIGGINS: Well the cards, yeah.
KEVIN WEBSTER: We'll get the cards on those. I just wrote down the assessed value.
JONATHAN WIGGINS: Otherwise we need to see what's going on.
KEVIN WEBSTER: Okay
LUCK MILLER: I couldn't find Petersen's but that's the state's. The assessor house overlooks
Petersen's. They built a big stonewall all around the house.
JONATHAN WIGGINS: I'm surprised he doesn't have a boat or a drawbridge.
LUCK MILLER: Yeah. But it's so luxurious. It's made of stone, artificial stone or what. It's so
elegant.
GERARD SCHULTHEIS: Since you finished your addition, have you changed your insurance on
the house?
LUCK MILLER: At first I did change it about two years ago when I had the original assessment,
when I moved in 19...2003, yes.
KEVIN WEBSTER: And 17 there's an apportionment going on with the land but it did sell, that's
the assessor house you were talking about, it did sell for $750,000 in September of '04 which
included lot 17 and lot 27 which is a small parcel of 47 feet on Mattituck Creek and that was a
two parcel deed transfer. I can give you that card as well.
GERARD SCHULTHEIS: That sold for how much?
KEVIN WEBSTER: That sold for 750.
GERARD SCHULTHEIS: And when did that sell?
JONATHAN WIGGINS: All right, and that was with the waterfront?
KEVIN WEBSTER: That was with that, 47 feet on the creek.
GERARD SCHULTHEIS: 750 when?
CARA WELLS: A couple years ago I think.
KEVIN WEBSTER: September of 2004 and the old card will show what was there when it was
sold. I didn't have a chance to review it.
CARA WELLS: And he bought lot 17 and then how many feet on the creek?
KEVIN WEBSTER: There is 47 feet on Mattituck Creek so he bought 17 and 27.
CARA WELLS: Oh I see, okay.
KEVIN WEBSTER: And I also verified that lot 9 is owned by the state as well, so the state owns
all this land in front that's...
CARA WELLS: That EPA cleaned up.
KEVIN WEBSTER: Right
JONATHAN WIGGINS: Seventeen, that's a big piece of land too.
LUCK MILLER: It is.
JONATHAN WIGGINS: It's 125 feet, 300 feet on the water.
KEVIN WEBSTER: Lot 17 has 105 feet wide on Naugles Drive.
JONATHAN WIGGINS: Right and it cuts down 21. It's roughly 125 feet wide.
KEVIN WEBSTER: As far as acreage goes, they're pretty similar.
JONATHAN WIGGINS: Similar to what.. .14?
KEVIN WEBSTER: Fourteen and 17 as far as acreage goes. Seventeen is probably bigger at
acreage because it cuts out. Fourteen has more frontage on the road but it doesn't...
JONATHAN WIGGINS: Yeah
GERARD SCHULTHEIS: Seventeen has got 125 feet of water view...almost over 200 feet of
water view.
KEVIN WEBSTER: Right
JONATHAN WIGGINS: Seventeen is about the number of the little piece at the end.. .is
probably a third bigger.
JONATHAN WIGGINS: Could I see some ofthose cards? Seventeen combined, all right, I see.
So that is the total of this with the is $1,700 in assessment. Can we get the square
footage on the house?
LUCK MILLER: I think my mom had an appraisal.
KEVIN WEBSTER: Which house?
JONATHAN WIGGINS: The subject house here. You can see it's here somewhere.
KEVIN WEBSTER: Mrs. Miller's house is 2,301 square feet of living space with 586 square feet
of open porch on that raised level and...
CARA WELLS: Five hundred eighty on the porch.
KEVIN WEBSTER: Five hundred eighty six of open porch and we have her down as having 60
feet of decking, which is the extension of the porch that's not covered, so it's all the same thing.
So, really you can say it's 586 plus 60 or 646 feet of porch, 60 of that is uncovered, also has a 12
x 15 one car garage underneath, no fireplace, two full bathrooms, and that is a full basement on a
half acre ofland.
JONATHAN WIGGINS: And the square footage of living space, do you have?
KEVIN WEBSTER: 2301
