Dear Mr. Lark:
The following took place at a meeting of the Southold Town Planning Board on
Thursday, May 18, 1995:
The final public hearing, which was held at 7:05 p.m. was closed.
The following resolution was adopted:
WHEREAS, Robert A. Graeb and Phyllis A. Graeb are the owners of the
property known and designated as SCTM# 1000-84-1-10, located on the north
side of Middle Road (C.R. 48) approximately 900 feet east of Cox's Lane in
Cutchogue; and
WHEREAS, this proposed set-off is to set off a 2.3780 acre lot from an existing
10.25 acre parcel; and
WHEREAS, the Southold Town Planning Board, pursuant to the State
Environmental Quality Review Act, (Article 8), Part 617, declared itself lead
agency and issued a Negative Declaration on November 21, 1989; and
WHEREAS, a final public headng was closed on said subdivision application at
the Town Hall, Southold, New York on May 18, 1995; and

WHEREAS, ail the requirements of the Subdivision Regulations of the Town of
Southold have been met; be it therefore
RESOLVED, that the Southold Town Planning Board approve and authorize the
Chairman to endorse the final surveys dated Apdl 29, 1995.
Enclosed please find a copy of the map which was endorsed by the Chairman.
The mylar maps, which were also endorsed by the Chairman, must be picked
up at this office and filed in the office of the County Clerk. Any plat not so filed
or recorded within sixty (60) days of the date of final approval, shall become
null and void.

Dy ROBERT A. GRAEB and PHYLIS A. GRAEB, his wife, residing at
22425 Route 48, Cutchogue, New York 11935, hereinafter called the
"De ~ . c±arants.
WHEREAS, the Declarants have title to certain land situate,
lying and being at Cutchogue, Town of Southold, Suffolk County,
New York, said land being more particularly described in Schedule
A attached hereto; and
WHEREAS, the Declarants have applied to the Planning Board of
the Town of Southold for a two lot setoff of the property
described in Schedule A, as shown on "Setoff Map for Robert A.
Graeb and Phylis A. Graeb at Cutchogue, Town of Southold, Suffolk
County, N.Y." prepared by Peconic Surveyors, P.C., dated August 3,
1993, last revised 9/21/94; and
WHEREAS, the Planning Board of the Town of Southold on
February 9, 1994, required certain COvenants and restrictions be
placed on the property described in Schedule A, as a condition for
final approval of the setoff.
NOW, THEREFORE, the premises described in Schedule A shall be
subject to the following COvenants and restrictions:
1. In the event Lot Number 1, as shown on the "Setoff Map
for Robert A. Graeb and Phylis A. Graeb at Cutchogue, Town of
Southold, Suffolk County, N.Y." is subdivided in the future, a 25
foot wide right-of-way to Middle Road (C.R. 48) will be
constructed with a pavement width as required by the Town of
Southold Highway Specifications for road improvements in effect at
the time of construction. Said 25 foot wide right-of-way will
include the present 15 foot wide accessway from Middle Road
(C.R. 48) to Lot Number 2 as shown on the aforesaid setoff map.
2. This subdivision is located near an existing landfill
site and near an existing gun club.
3. These covenants and restrictions can be modified only at
the request of the then owner of the premises with the approval of
a majority plus one of the Planning Board of the Town of Southold
after a public hearing. Adjoining property owners shall be
entitled to notice of such public hearing but their consent to
such modifications shall not be required.
4. The foregoing covenants and restrictions shall bind the
Declarants, their heirs, successors and assigns, and any and all
person or persons who shall succeed to the ownership of said
premises of any part thereof by transfer or otherwise.

WHEREAS, the Declarants have title to certain land situate,
lying and being at Cutchogue, Town of Southold, Suffolk County,
New York, said land being more particularly described in Schedule
A attached hereto; and
WHEREAS, the Declarants have applied to the Planning Board of
the Town of Southold for a two lot setoff of the property
described in Schedule A, as shown on "Setoff Map for Robert A.
Graeb and Phylis A. Graeb at Cutchogue, Town of Southold, Suffolk
County, N.Y." prepared by Peconic Surveyors, P.C., dated August 3,
1993, last revised 9/21/94; and
WHEREAS, the Planning Board of the Town of Southold on
February 9, 1994, required certain covenants and restrictions be
placed on the property described in Schedule A, as a condition for
final approval of the setoff.
NOW, THEREFORE, the premises described in Schedule A shall be
subject to the following covenants and restrictions:
1. In the event Lot Number 1, as shown on the "Setoff Map
for Robert A. Graeb and Phylis A. Graeb at Cutchogue, Town of
Southold, Suffolk County, N.Y." is subdivided in the future, a 25
foot wide right-of-way to Middle Road (C.R. 48) will be
constructed with a pavement width as required by the Town of
Southold Highway Specifications for road improvements in effect at

the time of construction. Said 25 foot wide right-of-way will
include the present 15 foot wide accessway from Middle Road
(C.R. 48) to Lot Number 2 as shown on the aforesaid setoff map.
2. This subdivision is located near an existing landfill
site and near an existing gun club.
3. These covenants and restrictions can be modified only at
the request of the then owner of the premises with the approval of
a majority plus one of the Planning Board of the Town of Southold
after a public hearing. Adjoining property owners shall be
entitled to notice of such public hearing but their consent to
such modifications shall not be required.
4. The foregoing covenants and restrictions shall bind the
Declarants, their heirs, successors and assigns, and any and all
person or persons who shall succeed to the ownership of said
premises of any part thereof by transfer or otherwise.

The Cutchogue Fire Department ]las tested the new fire well
located on your property on Route 48 in Cutchogue. The well is
producing approximately 545 gallons per minute and is thereby
acceptable for fire use.
With reference to the landscaping of the well site, we wish
to know if it meets with your approval. If is does not, we will
retain a landscaper to complete the job. Please advise us, by
return mail, am to either your acceptance of the well
installation or that further landscaping work is required.
Upon receipt of your letter of approval, the Board will
inform the Town Planning Board of our acceptance of the well for
fire use. The District will also refund, to you, any excess

Dear Mr. Graeb:
The following items are necessary for the Planning Board to
proceed with the above mentioned proposed set-off:
The maps must be revised to contain the following
information:
a. A building envelope for Lot Number 1.
b. The location of the firewell.
A statement that if Lot Number 1 is subdivided in the
future, a 25 foot right-of-way will be required, with
a pavement width as required at the time of
construction. The 25 foot right-of-way will include
the area of the 15 foot accessway for Lot Number 2.
(A similar statement is included on the map last dated
August 3, 1993. However, the wording must be revised
as noted above.)
A common driveway must be shown for Lots 1 and 2. Such
driveway will be eliminated upon further subdivision
of Lot 1 when the access road is improved.
A notation must be placed on the map stating that the
subdivision is located near an existing landfill site
and near an existing gun club.

presented in proper legal form. The Declaration must
include the following:
1. The statement required in Letter C above.
2. The statements required in Letter E above.
3. The following paragraph: These covenants and
restrictions can be modified only at the request of
the then owner of the premises with the approval of a
majority plus one of the Planning Board of the Town of
$outhold after a public hearing. Adjoining property
owners shall be entitled to notice of such public
hearing but their consent to such modifications shall
not be required.
A copy of the draft Declaration of Covenants and
Restrictions must be submitted for review by the Planning
Board and the Town Attorney. Once approved, the document
must be filed in the Office of the County Clerk and the
Liber and Page number of the recorded document must be
indicated on the map. ~
You must submit a statement to the Board that you no longer
intend to proceed with your original proposal for 4 lots,
and are instead amending your application to that of a two
lot set-off.
It is understood that you will be working in conjunction
with the Cutchogue Fire Department to install the
required firewell. Prior to any final endorsement of the
subdivision, the firewell must either be installed, or
you must present a performance guarantee to the Town for
your part of the installation costs.
5. Final maps (5 paper copies and 2 mylars), including the
information listed above and a valid stamp of Health
Department approval, must be submitted to the Planning
Board office before a final hearing will be scheduled.

OD December 20 I attended your work session to plead Ny case for
permission to setoff two (2) acres of my property on Route 48 in
Cutchogue. I would like to reiterate the reasons for my request
and to clarify the background infori~tion.
As you are aware my original request was for a minor uubdivision
consisting of three two-acre lots and a 4.5 acre lot for the
greenhouse. Two of these lots already exist; one is where my
home is located and the other has the greenhouse building
situated upon it. The other two lots were to provide building
property for my two unmarried children.
Tentative approval was given subject to the conditions of the
Planning Board, erie of which was the installation of a fire well
,~n the recon~enda'~on of the Cutchogue Fire Department.
In March of 1993 my mother passed away leaving her home in Matti-
tuck to my brother and myself. My daughter will receive my half
of the house and will buy the balance from my brother and will,
therefore, no longer have need of a building lot. Since our
needs changed, we modified our request to only a two-acre lot
setoff. This is the property upon which my house is presently
situated. Again, we received tentative approval from your Board
subject to the requirements of the Cutchogue Fire Department.
On August 3 of this year I wrote a letter to the Commissioners of
the Cutchogue Fire Department asking that they rescind their
recommendation for a fire well as we were no longer planning for
a minor subdivision. On August 17 the Fire District responded by
saying that their recommendation would not be changed. A copy of
each of those letters is attached.
At a public meeting held in Town Hall in the fall, representa-
tives of all of the Fire Districts in Southold Town spoke of
their policies for well installations when and where needed for
minor subdivisions. It was made clear at that time that all
other districts handle the needs for safety and protection--only
Cutchogue has made a policy of having the property owner handle
the cost of well construction. At the eud of the meeting Mr.
Thomas Wickham suggested that we might consider sharin9 the cost
of the well with the District rather than put the total burden on
all taxpayers.

Although I did not brin9 it up at your work session, I met with
Commissioner Doroski in early December in Mr. Richard Lark's
office in an attempt to reach a compromise solution to the
problem. The Fire District had received a quotation from Kreiger
Well Drilling Inc. in the amount of $10,250. At that meeting I
offered that we would pay $4,500 towards the installation of a
fire well and that we would also donate the appropriate amount of
land for construction of same. Mr. Doroski said that he would
advise the commissioners of my offer and let me know their
decision. The response I have received from the Fire District
was a photocopy of the Fire District's December 15 letter
addressed to Mr. Ward. In that letter to Mr. Ward it appears
that the Fire District is no longer requiring a well pursuant to
this application for a setoff based upon the following
statements:
1. "The commissioners refuse to be placed in the position of
preventing the construction of an additional house on this prop-
erty, especially where it involves a family member."
2. "The installation of a fire well has nothing to do with
an additional house being built Oh'%his property.
It is our contention that the installation of a fire well is a
separate issue and should not be part of our application for a
setoff.

Several years ago we applied for and received approval for a
minor subdivision with the provision that we install a fire
well. We have withdrawn our application for the minor sub-
division with the Town of Southold. Instead we have asked for
and received tentative approval for a setoff of our home from
the main parcel subject to the requirements of the Cutchogue
Fire Department. Our intent is to build one private home on
the main property.
As you know, there is an existing fire well on Cox Lane
approximately 800' distant from our home and another one on the
south side of Route 48 approximately 1000' from our greenhouse.
In light of the fact that we are no longer applying for a minor
subdivision and considering the proximity of the existing
wells, we are requesting that the requirement of a new fire

I am writing this letter to you at the request of the Board
of Fire Commissioners of the Cutchogue Fire District. At a
special meeting of the Board held on December 14, 1993, the sub-
ject of fire wells was discussed in general, and in particular
the need for one on the Graeb property on the northerly side of
County Road 48, Cutchogue, New York. Commissioner Robert Doroski
informed the Board he had written a letter on March 27, 1993 to
Councilman Joseph Lizewski concerning the subject of fire wells,
but he had neither received a reply, nor any proposed legislation
to cure the conflicts concerning the requirements by the Southold
Town Officials for fire wells. I am enclosing a copy of this
letter for your review.
As you probably are aware, at the present time the Cutchogue
Fire District does not have any fire hydrants. To adequately
fight fires, the Fire District has to rely on fire wells and the
prudent use of its equipment. The Board of Fire Commissioners
for many years has constructed fire wells in various locations in
the district as the need arises and budgetary constraints allow.
In the last few years the Fire District has been asked by the
Planning Board for recommendations in locating fire wells on
various properties, which were the subject of applications before
the Planning Board.
Recently the Commissioners have learned its recommendations
concerning the location and need for fire wells have in effect
become a mandatory requirement for the applicant. In other
words, the applicant does not get his project approved, unless he
installs a fire well. The Commissioners believe this is not only
unfair to the applicant but avoids placing the responsibility for
this decision where it belongs.

The Commissioners simply want to point out to you belated
requests of the Planning Board in asking for recommendations for
a fire well are ridiculous, when it is the Planning Board or the
Building Department of the Town of Southold that has already in
fact allowed a hazard to be created without the knowledge or
approval of the Fire District. The case in point is the Graeb
subdivision application. The request of Mr. and Mrs. Graeb to
subdivide or now set off their property and place another house
upon same has in reality nothing to do with your request seeking
the Fire District Commissioners recommendation for a fire well.
To make it plain so there is no misunderstanding, a fire well
should have already been constructed on this property by the
landowner to protect his own property. This is a self created
hazard which has been allowed to exist by either the Building
Department or the Planning Board. A search of the Fire District
records indicates there was no request for a recommendation of a
fire well when Mr. Graeb constructed and installed this 15,000±
gallon above ground propane tank on this property to heat his
greenhouse. To make it crystal clear, the Town of Southold
should never have allowed this potentially hazardous condition to
be created without adequate fire protection. Now that it has
done so, the Commissioners refuse to be placed in a position of
preventing the construction of an additional house on this prop-
erty, especially where it involves a family member.
The Board of Cutchogue Fire Commissioners resent the Town
Planning Board and land owners attempts to pressure the Board of
Fire Commissioners to determine whether a fire well should be
installed and who is to pay the cost, in order to construct an
additional house, when one in fact should have been placed on the
land by the owner years ago. The installation of a fire well has
nothing to do with an additional house being built on this prop-
erty, A proper fire well should be placed on the property now to
provide adequate protection for this property and its inhabitants
due to this self imposed condition. The taxpayers of the
District should not have to bear the cost of the incompetence of
the Town of Southold, in allowing the construction of this poten-
tially hazardous condition without adequate fire protection.

The Board of Fire Commissioners understands both the
Planning Board and the landowner are aware that in the event of a
fire involving this above ground tank, the acceptable method of
fighting the fire is to keep the tank cool by spraying large
amounts of water upon it for a lengthy period of time while the
fire burns itself out. If there are any problems with this pro-
pane tank, it is the Town of Southold's Building Department and
Planning Board who will be held responsible for their irrespon-
sible attitude, archaic and confusing regulations in allowing
this hazard to exist without fire protection.
The Commissioners want you to be aware if the Cutchogue
Fire District is involved in any type of litigation concerning
this matter, then the Fire District intends to counter sue the
Town so the proper parties may be held accountable for any dama-
ges that occur as the result of what the Town of Southold, has
allowed to exist.
Fire protection is very important, but it is irresponsible
of the Planning Board to try to say that Mr. Graeb cannot sub-
divide his property by adding another house because he does not
have a fire well to protect an already existing potential hazard.
The construction of another house on this property, in the Board
of Fire Commissioners' opinion, does not create an additional
hazard as a fire well is not needed for this purpose alone. A
fire well is presently needed to protect the Graeb's property
from any potential damage that would occur in the event of a fire
with this existing propane tank. Fortunately, there is no imme-
diate hazard to surrounding properties, due to the fact they are
vacant. This lack of inhabitants on the adjacent properties does
not relieve the Town of Southold for its irresponsible actions in
allowing this potential hazard to exist without adequate fire
protection to the very buildings which they have already granted
approval.
The members of the Board of Fire Commissioners are not
expert in land planning and would appreciate you not asking for a
recommendation which in reality is either to approve or not
approve a minor subdivision under the guise of installing a fire

In response to your March 18, 1993 letter, I think it is a
good idea to clarify the concern surrounding the costs of
installing new fire wel].s. As you know, both yourself and the
Planning Board have complicated this issue in our flre district,
not to mention the existing provisions in the Town Code are
conflicting and confusing. There is no question the original
intent of requiring developer to provide fire wells was noble and
it applied only to major subdivisions. Now the Town Code applies
to site plans and alt subdivisions.
However, the construction of dwellings on minor subdivisions
and the building of commercial buildings in our fire lstrlct
should be looked on a case by case basis. For example: If there
are no existing flre wel].s in tile vicinity of a proposed minor
subdivision mainly because all tile snrrounding acreage is vacant,
the proposed subdivision developer should have to provide a fire
well for the installation of the new homes to be constructed. On
the other }land, if this proposed m{nor subdivision is in an
existing neighborhood where there are presently houses and a fire
well, then a fee per lot would be a fair and equitable way to
assist the fire district in enhancing the fire well program in
that area. The reason for this is simple. Both the pre-existing
houses and the proposed houses in the minor subdivision would
benefit from the installation of a new fire well. Further if
there is adequate fire wells in the neighborhood where an addi-
tional house is to be built on a subdivision, why then should the
landowner be burdened with extra costs when there is already ade-
quate fire protection.
As to the construction of commercial or business structures,
they should be looked at on a case by case basis depending on the
_us_e_ of the property. If they are ]n an existing business
district where there is adeqnate fire protection, then I see no
reason why the land owner should have to bear the cost of a fire
well. On the other hand, if the use is such that would be highly
hazardous or would present flre fighting problems that do not
presently exist in the neighhorhood, then .in all probability a
fire well on this business property would be proper in order for
the district to provide fire protection for a hazard that did not
exist prior to construction or renovation of the new business.

I suggest before you have any Ineeting that you have a draft
of proposed legislation that would smooth out the existing
conflicting legislation and also require in the case of commer-
cial or business buildings, an annual inspection by the Chief of
the respective fire districts to determine tile type of use and
material stored or utilized in the building, so that the fire
district might have adequate notice to handle an emergency.
Again I am suggesting that you present a draft legislation to
all the fire districts on tile Nortl] Fork so they can provide you
input. Then a meeting would have positive results, otherwise
your proposed meeting will be a rehash with no results.

On June 22, 1993 Mr. Graeb met with the Planning Board to
discuss reactivating his currently inactive subdivision
proposal.
One of the issues discussed was the Planning Board's 1989
requirement for the installation of a firewell. In December of
1989 the Cutchogue Fire District reviewed Mr. Graeb's
proposal and recommended that a firewell be installed at the
end of the proposed cul-de-sac.
The road layout that Mr. Graeb wishes to proceed with has been
redesigned With a shorter cul-de-sac. In addition, Mr. Graeb
has informed the Board that there are two existing firewells
in the vicinity of his property. He submitted a marked copy of
the map indicating the location of these wells.
I have enclosed a copy of the maps mentioned above. Please
notify this Board whether or not the Board of Fire Commissioners
recommends that a firewell be installed and the justification
used in making this decision.

think the value is still going to be the same for this

Mr. Orlowski: Well, there again you have to proceed with the
yield map and the engineering and everything else to see if you
have a buildable area.
Mr. Wickham: No, No, because if I set off one lot from the
twenty- five acres.
Mr. Orlowski: It would be a subdivision.
Mr. Wickham: I really the feel the need for someway out with
less than three years, not that the three years bothers me any,
I would just like to be here three years from now.
Mr. Orlowski: I know you will be, I know it.
Mr. Wickham: I wanted to present it all forms. I just feel
that the Planning Board ought to know, that in my opinion
twenty-five years from now, the DEC not withstanding the Town of
Southold is going to be desperate for more access to salt water
recreation.
Mr. Latham: I agree with you.
Mr. Orlowski: O.K., moving on is there any other questions or
comments in the audience?
Mr. Bob Graeb: I appeared before you people several monnn~
ago on the application I have before the board on my
subdivision. I did get a letter from you whereby you did reduce
the width of the road from 20 feet to 16 feet which I
appreciate. The problem is money. Now, you have requested I
put a bond up for $150,000 which I assume what you estimate what
the cost of the improvements would be. Is that correct?
Mr. Orlowski: Yes.
Mr. Graeb: As I explained to you, my only purpose in applying
for this subdivision is to give two lots to two of my children.
The greenhouse is already in place and my house is already in
place. So really what I would be picking up is two building
lots from this subdivision. When I bought the land, I paid
roughly $18,000 an acre so that each of these two lots would
cost $36,000. Now, if I was to spend the $150,000.00 to get
this subdivision what that really means I would be spending
$75,000.00 for each one of those two extra building lots which
would bring the total cost of those building lots to about

$110,000.00. Now, in today's market you know that that is
probably triple what the value of the land is. If I had
$150,000.00, I would probably be better off buying two building
lots in that case. But I don't have $150,000.00. I have lived
there now over a year and a half and we have what you call a
road and I call it a driveway but we put some gravel in and
we've had no problems at all. We've had heavy rains, we had two
heavy snow storms, we plowed it out with no problem. What I am
asking you and I realize that there has to be some terms and
conditions and assume rules to follow however, I have been a
member of the Mattituck school board now for almost twelve years
and we have standard operating procedure, we have school
policies and we have bent those policies when it to the benefit
of all the people, it made common sense. What I am really
questioning is that I be allowed to build two more houses at
some future date and that isn't even in there because my kids
don't have enough money to build a house. But I would like for
them to be able to do it within two or three years. All I am
asking for really is that the requirement for a road be dropped
and to further complicate the situation, I was requested to put
in a firewell and that would cost in the area of $11,000.00
and I had the members of the Cutchogue Fire Department up to the
greenhouse in the early part of the summer so they could see, we
heat by propane so, I wanted to show them where the valve's were
and everything in the event of fire they could handle the
situation. I asked the chief, if my house caught on fire
tonight, how would you fight the fire? He said we could work
out something. I have a swimming pool that has 33,000 gallons
of water so I said why can't you use that? Well, we can't use
that because if we damage you could sue us. I said I would give
them a letter stating I wouldn't. Also, in the greenhouse we
have a six thousand reservoir because our irrigation system
pumps out water faster than the well will replace it so we have
that they could tap into. But no, no they had to have a
firewell. Then I talked to one of the commissioner's, I said,
why do you require this? Well they said the Planning Boara
requires it. I came to the Planning Board and Melissa said no,
and referred us back to the Fire Department. The bottom line
is, I can't afford an $11,000.00 well either but I've got about
three quarters of a million dollars invested in that place
already and I can't borrow anymore money. It just doesn't seem
to make sense to me that here I've got the land, I've got two
kids that are renting, and they can't build houses there. I
have the land but I don't have the money to meet your
requirements. I still think common sense can prevail in
extenuating circumstances and that is my case. If I put the
road in then I have to put in drainage and I don't have a
drainage problem but if I cover it with asphalt then I create
drainage problems then we have to put in drainage wells. Why
don'~ we leave it the way it is. We're on an aquifer on the
North Fork so why contaminate it with oil when we don't have to.
Mr. Orlowski: Well, if your road is hard enough you are not
perculating through the road.

Mr. Graeb: Benny, we heat the greenhouse with propane now we
get loads of 10,000 gallons of propane at a clip and they have
never bogged down. They don't go all the way back, but they go
a third of the way back and I don't know what a load of 10,000
gallons worth of propane weighs but I bet it is a hell of a lot
more than a fire truck. Also, I am willing to put in a
covenant, that in the event, anyone of those building lots are
sold to a non family party, I would be willing to have in that
covenant, could not be sold unless all the town requirements are
met. But, to invest $110,000 in two acres, is ludicrous.
Mr. Orlowski: Well Bob, sometimes the rules we have before us
and what we have done with them, I mean they were a lot stricter
before and we've cut them down as much as we feel we can. There
has never been a case when we have flat out had a subdivision
and said don't worry about building a road because we can't do
that~
Mr. Graeb: I'm not trying to make money on this, in fact, I'm
probably going to have to pay a gift tax to give these lots to
the ikids. So I'm not making money on it. These kids were born
and brought up in this town and they want to stay in this ~own.
Mr. Orlowski: I know, I can feel for you but you know...
Mr. Graeb: I've been on government boards and when common
sense prevails, you usually can work something out.
Mr. McDonald: Benny, he is about to get a governmental run
around but in all honesty I think that since we have done yours,
we've discovered that we didn't even really technically had the
power to give you the sixteen foot road. We don't have the
power to relieve the highway specifications at all, it has to
come from the town board.
Mr. Ward: We'll get back to you on it.
Mr. Graeb: Well, I want to thank you for listening to me and
thank you for anything you can do.
Mr. McDonald: Would you be prepared to readjust the lots
some way to try to solve this problem?
Mr. Graeb: I'm completely adjustable, because I said this is
a family operation. If I had the money, I could buy two lots.

most of the board members know, we had the dedication of our
affordable housing project at Walsh Park on Fishers Island.
It was very impressive and this board had a big part in that
project. Mr. LaValle was there and gave a nice talk and Mr.
Orlowski was suppose to be there and give a nice talk.
Mr. Orlowski: I apologize.
Mr. Edwards: Proceeding the dedication of the project and the
road was the third annual golf tournament which they raised
$7000.00 this year which goes to the open space area. Mr.
Orlowski was registered to play in that tournament but he
didn't make it again.
Mr. Orlowski: Well, how am I going to get there? Well, I'm
glad to see it getting off the ground. It was the fastest
moving affordable housing project in the Town of Southold and
probably the best. I'm sorry i didn't make it but you ~ ........
weather was very bad that day.
Mr. Edwards: I hope you make it next year.
Mr. Orlowski: Any other comments or questions? No further

As requested, the Planning Board has reviewed their
requirement that the access road for the above mentioned
subdivision be built to the alternate road specifications.
The Planning Board is supporting a proposal to revise the
existing road specifications. The proposal before the Highway
Superintendent and the Town Board, which would pertain to your
proposed subdivision, is for a road 16 feet in width without
curbs. It should be noted that all specifications, with the
exception of the width, will be the same as that required for
the current alternate road specifications.
Upon a written response from you indicating that you would
agree to proceed with the above mentioned road width reduction,
the Board will petition for this change from the Highway
Superintendent and the Town Board on your behalf.

The following resolution was adopted by the Southold Town
Planning Board at a meeting held on Thursday, January 18, 1990.
RESOLVED to override the January 5, 1990 Suffolk County
Planning Commission report for the following reasons (numbers
correspond to numbers in report):
The Planning Board has required a road built to the
alternate road specifications to provide access to
all proposed lots.
2. Proper drainage to contain all on-site stormwater has
been required by the Planning Board.
3. A road will be built as described in number 1.
4. The applicant pre-empted the Planning Board's action
by building a greenhouse on the parcel, and scraping
the top soil from the site. Thus the agricultural
value of the site is questionable.
5. The Planning Board will be requiring a statement as
to the location of the nearby landfill.
The Planning Board requests that the following notations be
placed on the final map.
1. The parcel is located near an existing landfill site.
2. The parcel is located near an existing gun club.

900 feet easterly from Cox's Lane, Cutchogue, New York.
Dear Mr. Orlowski:
The Suffolk County Planning Commission at its regular meeting on
January 3, 1990, reviewed the proposed subdivision plat, entitled, "Minor
Subdivision - Robert A. Graeb & Phylis A. Graeb" referred to it pursuant to
Section A14-24, Article XIV of the Suffolk County Administrative Code. After
due study and deliberation it resolved to disapprove said map for the following
reasons:
The proposed subdivision will result in the creation of three
landlocked parcels; that is, parcels that do not have frontage on an
existing or proposed public road. The creation of such lots is
contrary to good subdivision layout principles and creates problems as
far as access by emergency and service equipment is concerned. This
lack of access could result in health, safety and welfare problems for
the future residents of landlocked lots, not to mention potential
disputes over the use and maintenance of any right-of-way over an
adjacent parcel that may be created for the purpose of access.
Creation of landlocked lots also places the Zoning Board of Appeals in
the awkward position of having to gran~ a building permit for the lots
under Section 280-a of the Town Law as the future owners of landlocked
lots cannot be held responsible for the landlocked nature of their
parcels.
There is no provision to contain on-site all stormwater runoff created
by the development of this property.
No information has been provided as to how access for the Site will be

REASONS SUPPORTING THIS DETERMINATION-
An Environmental assessment has been submitted, reviewed
and it was determined that no significant adverse effects
to the environment were likely to occur should the project
be implemented as planned.
Because there has been no correspondence received from the
Department of Health Services in the allotted time, it is
assumed that there are no comments or objections from that
agency.
Because there has been no correpondence received from the
New York State Department of Environmental Conservation in
the allotted time, it is assumed that there are no comments
or objections from that agency.

The following actions were taken by the Southold Town
Planning Board on Monday, October 16, 1989.
RESOLVED that the Southold Town Planning Board grant sketch
approval on the map dated April 5, 1989.
Sketch plan approval is conditional upon submission of
final maps within six months of sketch approval, unless an
extension of time is requested by the applicant and granted by
the Planning Board. The final submission must contain two mylars
and five paper prints, all stamped Health Department approval.
RESOLVED that the Southold Town Planning Board start the
coordination process on this unlisted action. The Board assumes
lead agency status and in that capacity has made an initial

The Planning Board reviewed the revised plans last dated
November 17, 1988 and had the following comments.
1. As indicated on the previous sketch submitted by the
Planning Board on Nov. 17, 1988, the intersection of the
paved area with C.R. 48 must be a 90 degree angle. This
must be indicated on the map.
2. The diameter of the cul-de-sac must be 50', not 25', as
shown on the revised plan.
3. The area of Lots 1-3 must be two acres excluding the
area for the road.
4. Road profiles and a Grading and Drainage plan must be
submitted for review by the Town Engineer.
The Planning Board will proceed with review upon receipt of
revised maps in accordance with the above.

Dear Mr. Campagnola:
The following is to confirm your telephone conversation with
Melissa Spiro of my office on August 3, 1988 in reference to the
above mentioned subdivision.
A curb cut was issued for the above mentioned parcel. This
curb cut is shown as the right-of-way on the proposed subdivision
map (please see enclosed map). The Planning Board has asked that
the right-of-way for both the greenhouse and the proposed
subdivision be located at the easterly corner of the property.
The Board also has asked that this be fifty feet (50') wide
at t~e intersection to allow for the turning radius of large
vehicles that may service the greenhouse.
As per your conversation with Melissa, you have no objection
to revoki~ the previous permit and granting one in the location
as asked for. by'the Planning Board.
Also noted was that th~-plan originally submitted to you
showed the 50' right-of-way located at the westerly border of the
property and at that time it was suggested that the right-of-way
be located a minimum of five feet (5') from the property line and
that it should be used 'as a common access for both the greenhouse
and the subdivision.
As it stands now, the Planning Board will proceed with their
review of the subdivision upon receipt of revised maps submitted
by the applicant as previously requested on June 21, 1988 (see
enclosed correspondence).

The Planning Board has reviewed the above mentioned
proposal and asks for the following revisions:
The entrance to the subdivision should be at the easterly
corner of the property and should be fifty (50) feet in width at
the intersection. The South entrance is asked for to allow a
turning radius for large vehicals. This fifty {50) foot entrance
should continue as a twenty five (25) foot Right-of-way as it
runs along the border of property. A cul-de-sac with a one
hundred (100) foot diameter is necessary between lots 2 and 3.
Upon submission of revised maps the Planning Board will
proceed with review of this application.
