Dear Valerie:
As you will recall, last summer we received approval to
file a replacement deed for a deed that had never been recorded
by which Robert Miller transferred to Rita Cushman in 1980 a .35-
acre parcel between his property and hers on the East End of
Fishers Island (SCTM # 1000-8-1-4.20). Another transfer was also
supposed to have taken place in 1980 pursuant to which Jansen
Noyes was to have conveyed a .46-acre parcel to Mrs. Cushman.
The deed for that transaction was apparently never recorded.
I am writing to request your advice as to whether we
must apply for a lot line change to reconstruct the Noyes
transaction. It has some differences from the Miller situation
in that a separate tax map number was never assigned and Noyes,
unlike Miller, has not subdivided his property. However, the
official FIDCO Map that has now been filed with the County does
show the .46-acre parcel (as well as the .35-acre parcel) as
appurtenant to and merged with the Cushman parcel. Therefore, I
would argue that no further Planning Board action is necessary
and that, as was the situation with the Miller parcel, we may
simply record a replacement deed.
I am also transmitting excerpts from the FIDCO Map and
a 1980 survey showing the areas in question. Please discuss this
matter with the Board and advise me of what further action, if
any, we must undertake before we may properly record a
replacement deed to the .46-acre parcel.

This is in response to your letter to Kenneth Edwards,
dated August 6, 1991. The situation described in the letter was
reviewed with Valerie scopaz, Town Planner.
The Planning Board concurs with Ms. Scopaz's recommendation
that you simply file the deed for the subject lot with the
Suffolk County Clerk's office.
It would be appreciated if you would arrange for two copies
of the filed deed to be sent: one to this office and the other
to the Tax Assessor's office.
I hope this letter addresses all the concerns set forth in
your August 6th letter. If further questions should arise,
please contact Ms. Scopaz.

Dear Ken:
You may recall that some time ago we briefly discussed
the fact that in 1980 I conveyed a small (.35 acre) parcel
of land to Rita Cushman in exchange for a right of way for
a driveway and utilities over the Cushman property from the
existing driveway to a building lot we own on the south
shore of Middle Farms Pond.
For unknown reason the deed does not show up on the
land records, and Mrs. Cushman cannot locate the original.
The Cushmans have asked that I execute a new deed so that
the land records will reflect their ownership of the .35
acre parcel. I am willing to do so if I can without
violating town or county requirements for a lot line change
or anything else that might impair my title or relations
with the authorities. In this connection, I enclose a
letter to me from Steve Ham dated July 26, 1991 in which,
in the second paragraph, he notes the opinion of Ms. Scopaz
of the Planning Board staff to the effect that I can
execute the replacement deed without any further
formalities.
I would note that when our property was subdivided in
the mid-1980's the subdivision excluded the .35 acre parcel
and reflected the rights of way which we retained over it
and which we were granted over the Cushman parcel. The
subdivision was, of course, perfected with the Planning
Board and Heath Department. I understand that the FIDCO
Map that has or will shortly be filed as or in lieu of a
subdivision for the entire east end of the Island reflects
our subdivision as approved - including the fact that the
.35 acre parcel was not part of land subject to the
subdivision.

Dear Bob:
As you know, last winter I confirmed that the deed you
executed in 1980 transferring a .35-acre parcel between your
property and. that of the Cushmans had never been recorded with
the Office of the Suffolk County Clerk. At the time, you asked
me to inquire of the Town of Southold Planning Board as to
whether we could merely record a new deed or would be required to
apply for a lot line change in order to put the deed on the
record.
Last week, I met with Valerie Scopaz of the Planning
Board staff (with whom I had also discussed the situation in
February). She is familiar with your minor subdivision and the
minor subdivision and lot line change made by the Cushmans. It
is her opinion that, since your minor subdivision does not show
this parcel in your ownership and it bears its own tax map
number, we may now simply record a new deed. Nothing further
need be done with regard to real estate taxes for this piece
since it has been assessed to Mrs. Cushman for quite some time
and she continues to pay taxes on it.
Based upon the foregoing, I have prepared and enclosed
a replacement deed to Mrs. Cushman for this parcel. Also
enclosed is a combined Real Property Transfer Gains Tax
Affidavit/Real Estate Transfer Tax Return/Credit Line Mortgage
certificate and a copy of the first page of the 1980 deed which I
obtained from the Assessor I s Office. Please sign the deed and
the combined form before a notary public who should complete the
notarial forms and indicate the date his commission expires.

(Please use a notary who has an expiration date for his
commission rather than a Connecticut attorney who I understand
can take acknowledgments and oaths but who would not ordinarily
have an expiration date for his commission. Without an
expiration date, the deed would likely be rejected for
recording.) No witnesses are required in New York.
Finally, I would appreciate it if you would check your
records to determine the consideration agreed upon for the
exchange of this parcel for the right of way. I will need to put
some nominal consideration on the combined form and compute a
transfer tax. The instrument by which you acquired the right of
way should reflect the transfer tax paid in the upper left corner
of the first page. From that figure, I can determine the total
consideration and complete the combined form.

Dear Steve:
Thanks for your letter of July 26 enclosing the
proposed deed from me to Rita Cushman. I have no problem
proceeding as you suggest subject to the following:
1. While I am comforted by the opinion of lis. Scopaz
of the Planning Board staff, I would like to be sure that
the Board agrees that proceeding as you have suggested will
not cause me title problems. Therefore, I am sending a
copy of your letter to Ken Edwards with a request that he
write me a note on behalf of the Planning Board confirming
that no damage will be done by signing the replacement
deed.
2. As we discussed, I granted this parcel to Rita
in exchange for a right of way she granted to me over
property of hers connecting this parcel to the existing
driveway. The indenture conveying that parcel dated lIarch
21, 1980, a copy of which is attached, granted an easement
to use the premises "for all purposes for which a driveway
is ordinarily used including the right to install utilities
therein and the right to grant easements in connection with
such utilities." Since the rights reserved over the .35-
acre parcel were obviously intended to match those granted
~ me under the lIarch 21, 1980 indenture, I will modify
your proposed deed to include reference to utility access
epd easements. -

3. Related to paragraph 2, you asked about the - -
consideration for the exchange. The indenture for the
right of way, like the deed for the .35-acre parcel, refers
to "ten dollars ($10.00) and other value." You will note
from the enclosed copy of the original indenture bearing
recording data that zero consideration was recited for the

transfer tax. I would suggest that you use $10 as the
fiqure.

Pursuant to our phone conversation of this afternoon,
I enclose correspondence to and from Allerton Cushman in
1979 and 1980 which indicates that Hr. Noyes conveyed a
parcel of land to Hrs. Cushman which abutted the small
triangular strip which is the subject of my other letter to
you today. According to my letter to Cush dated August 1,
1980, the deed from Noyes to Hrs. Cushman was dated July 9,
1980.
We will apparently never know why these original deeds
"ere not recorded or what Hr. Cushman did with the
originals, but I reiterate that it seems important for the
Cushmans/Renschlers to attempt to document the Noyes
conveyance. Noyes's access to a high potential building
lot immediately adjacent to the Cushman/Renschler dwelling
"ould have to run across a very narro" strip of land
abutting the "estern end of the Treasure Pond "etland. The
success of efforts by Mr. Noyes or his successors to
develop this potential site under current environmental
regulations might well depend on his ability to use for
access the parcel apparently conveyed to Hrs. Cushman in
1980.

This is in response to your letter of November 18, 1991.
With regard to the Cushman property, the Planning Board
recommends that you issue a replacement deed that includes the
.46 acre portion that was obtained from the Noyes property
(1000-8-1-4.19) as well as the .35 acre portion that was
obtained from the Miller property with the original lot. The
replacement deed should make it clear that the three parcels
comprise one building lot.
The deed for the Noyes property should be corrected also to
reflect the deeding of the .46 acre to Rita Cushman.
When the two new deeds are recorded, it would be
appreciated if you would send copies of them to the Planning
Board office for our records.

Suffolk County Clerk's office.
It would be appreciated if you would arrange for two copies
of the filed deed to be sent; one to this office and the other
to the Tax Assessor's office.

Dear Valerie:
As you will recall, last summer we received approval to
file a replacement deed for a deed that had never been recorded
by which Robert Miller transferred to Rita Cushman in 1980 a .35-
acre parcel between his property and hers on the East End of
Fishers Island (SCTM # 1000-8-1-4.20). Another transfer was also
supposed to have taken place in 1980 pursuant to which Jansen
Noyes was to have conveyed a .46-acre parcel to Mrs. Cushman.
The deed for that transaction was apparently never recorded.
I am writing to request your advice as to whether we
must apply for a lot line change to reconstruct the Noyes
transaction. It has some differences from the Miller situation
in that a separate tax map number was never assigned and Noyes,
unlike Miller, has not subdivided his property. However, the
official FIDCO Map that has now been filed with the County does
show the .46-acre parcel (as well as the .35-acre parcel) as
appurtenant to and merged with the Cushman parcel. Therefore, I
would argue that no further Planning Board action is necessary
and that, as was the situation with the Miller parcel, we may
simply record a replacement deed.
I am also transmitting excerpts from the FIDCO Map and
a 1980 survey showing the areas in question. Please discuss this

Town Planning Board on January 11, 1988 passed a resolution
approving these maps. It is my understanding that the actual
maps for some reason were either lost or not signed by the
Chairman of the Planning Board. It is also my understanding
the Town Attorney's Office would like to have these maps
signed. Accordingly, would you kindly submit same to the
Planning Board Chairman and have him sign them nunc pro tunc
at his earliest convenience and forward me an original signed
set.

Mr. Orlowski: Would like to review this. We have quite a few qUt~ ions.
Ms. Scopaz: I have some comments and I think we'll have to ask the
applicant to bring in Some more supporting documents. We don't have
any copies of the required permits from the NYSDEC or the Army Corps
of Engineers and we have not received a copy of the trustees determina-
tion so I have nothing to compare a decision with.
Mr. Orlowski: We'll hold this one until the next meeting.

Enclosed please find a copy of my final subdivision
map. You will note that both Lot 1 and Lot 3 are
comfortably over 3 acres, but Lot 2 (on which our house is
built) is only 2.03 acres, but adjoins a 5.6 acre
conservation area to which I own the fee (and did prior to
the subdivision). In addition, as you know I purchased
FIDCO Lot 22-5 from Cushman last year, which is also
burdened by a conservation easement.
I have the distinct recollection that the Planning
Board advised me shortly after the zoning "upscaling" from
2 to 3 acres that the conservation easement area would be
considered part of Lot 3 (which it abuts) for "upscaling"
purposes. I would very much appreciate it if you could get
some sort of acknowledgement from the town that this is the
case, and that Lots 1 and 2 therefore remain unaffected.
If you think it would lay this forever to rest by procuring
something recordable in the land records, please do so.

The Southold Town Trustees, as permitting agent for the Town
Board under the Town's Freshwater Wetlands Ordinance (Chapter
97), may not be the best candidate for lead agency of any
proposed comprehensive study of Barlow Pond watershed for the
following reasons:
1. We have only a derivative role of enforcing one code in
the area of Freshwater Protection (Chapter 97 Code of
Southold Town).
2. Lack of funding capability.
3. Lesser area jurisdiction than similar jurisdiction of
NYSDEC, and SCDHS. (75' permit zone town, 100'
NYSDEC, 200' SCDHS)
4. Lesser ability to discover and analyze impacts than
NYSDEC, SCDHS, and SCPD.
5. Individual members with less time available,
professional standing than NYSDEC, Suffolk Planning
and Health Departments.
6. Inability to impose a general moratorium on building
permits.
Presently, the Trustees have only two (2) projects in
jurisdiction within 75' of the pond or its vegetation. As most
projects can be located outside our jurisdiction, we have a
limited "patchwork" ability to induce a Generic Environmental
Impact Statement under local wetland permitting.
The Trustees were the first board to adopt a resolution in favor
of a water study for Fishers Island acquifer in 1987 after the
James Lamborn Pond nourishment project raised much concern.
Although the Trustees have no current formal Board position on
Barlow Pond, we are all very concerned about the lack of
watershed regulation there. One possible partial solution, in
the interim, might be for an inter-agency best-management
practice list to be developed for a large portion of the island
encompassing the pond.

Dear Mr. Minei,
On June 19, 1990, the Town Board discussed your request for
Town assistance as set forth in your letter of May 18th and as
expressed at your meeting of June 13th.
The Town Board remains opposed to the suggestion that it
should assume the position of lead agency. However, it agreed
to provide to the County Planning and Health departments all
available technical and planning information on Fishers Island.
This morning, John H. Thatcher, Jr. of the Fishers Island
Conservancy informed me that he has sent you, under separate
cover, a copy of the "Hydrogeologic Report" of April 1990" by
Ground Water, Inc. He also sent a copy of this report to Arthur
Kunz.
Enclosed please find a copy of The Trust for Public Land's
1987 Report on Fishers Island. This report is the most
comprehensive compendium of planning-type information about
Fishers Island that is available at this time.
The report includes reduced copies of the original maps
that accompanied this report. The original maps could not be
included because the Town does not own them. They are the
property of the Fishers Island civic Association and the Fishers
Island Development Corporation. If you feel that these maps
would be necessary for your study, it may be possible to arrange
for copies to be made.

Other resources that are available from the Planning Board
office are black and white aerial photographs of Fishers Island
from February 1988 at the one inch equals two hundred inch
scale. Since t~e negatives for these prints were shot at the
one inch equals one hundred inch scale, prints can be obtained
at that scale or larger. We also have tax map mylars of Fishers
Island at the ~ne inch equals two hundred inch scale.
And, finally, Bob Villa suggested that Joe Baier of your
agency's Division of Environmental Health may be able to be of
assistance.
After reviewing the Hydrogeologic Report and the Trust for
Public Land report, please send a written list of additional
information needs and a revised estimate of study costs.
Indicate in your letter the probable time frame for completion
and the projected scope of the report. This correspondence
should be sent directly to the Town Board in the care of
Supervisor Harris.
If there are further questions or concerns, please do not

As a result of a long running series of discussions dating
back to the late 70's and early 80's regarding the subdivision
map for FIDCO on Fisher's Island, Roy Reynolds of the Wastewater
Division of the SCDHS will be requesting the Planning Board's
coordination during its environmental reviews of all
applications to build individual lots around the public
reservoirs of Fisher's Island.
If you wish to be a coordinating agency on future
applications for permission to locate septic systems on lots
adjoining public water supply sources on Fisher's Island you
could ask Roy to put the Trustees on his coordination list.
If you need background information as to how and why this
procedure came into existence regarding the FIDCO map you should
talk with Victor Lessard who coordinated the Town's efforts on
-behalf on the Town and Planning Boards in resolving this matter
with the Health Department.

Last month I met with victor Lessard to determine
whether the Town would recognize these lots as two separate
buildable lots. When we looked at the FIDCO map, it was apparent
that their sizes and configurations did not conform to the sizes
and configurations depicted on the FIDCO map (excerpt enclosed).
I discussed this matter with Dick Strouse of Chandler, Palmer &
King and followed up with a letter to Mr. Lessard from whom I
have had no response. A copy of my letter to Mr. Lessard
(including another enclosure) is also enclosed.
Because my clients will be signing a contract to
acquire these lots in the near future, I would very much
appreciate receiving some assurance that the Town will recognize
Lots 44-13 and 44-14 S2 shown on the enclosed survev as separate
and distinct buildable lots despite the fact that they do not
conform exactly to the FIDCO map, do not both meet the minimum
area requirement under the Zoning Code, and will be conveyed by a

Dear Melissa:
My clients, Albert and Susan Stickney, intend to
acquire two adjoining lots in the "Park" on Fishers Island from
the Fishers Island Development Corporation. Enclosed is a
photocopy of a survey of the lots which are designated as Lots 13
and 14 in Block 44 on the FIDCO map on file with the Town.

Dear Mr. Lessard:
Further to our conference of last Wednesday, I have
obtained some additional information from Dick strouse of
Chandler, Palmer & King concerning the size and configuration of
the referenced FIDCO lots. Mr. strouse has advised me that the
FIDCO map in your files (which has Health Department approval)
is based on the old Olmstead plan. Both maps are of a large
scale and in neither case were the lots ever defined with
bearings and distances. Apparently, the exact dimensions of the
lots are created at the time of sale. Because of this, there is
much room for flexibility in defining the lots.
since neither the Olmstead nor the more recent FIDCO
map was intended to physically define the boundaries, lots 44-13
and 44-14, as depicted on the enclosed survey of November 3,
1989, do not apparently conform to the sizes and configurations
as shown on the FIDCO map. Those sizes and configurations will
be fixed at the time FIDCO transfers them to my clients.
However, there will be no greater number of lots created in Block
44 (or, presumably, in other Blocks) than are shown on the
approved FIDCO map. (See the enclosed copy of a 1977 plan of a
portion of Block 44.)
I would appreciate it if you would confirm the
foregoing with the Planning Board, the Town Attorney and any
other Town representatives and send me a letter indicating that

lots 44-13 and 44-14, as shown on the survey made by Chandler,
Palmer & King (dated November 3, 1989), will constitute separate
legal building lots under the Zoning Ordinance of the Town of
Southold, when transferred by FIDCO, whether or not such lots are
placed into single and separate ownership at the time of
conveyance.
