Dear Mr. Fishbein: On April 30, 1992, Roger Munz of your office called the Planning Board office about a parcel of land that is shown on a filed map as being reserved for a Park for the subdivision of Syloret Estates. Evidently the subdivider has failed to pay the taxes on this parcel and the county has placed a lien on the 3.4 acre park. Mr. Munz's question to the Town was whether the subject property was buildable. I wish to note for the record that the property in question is designated as a "park and playground" on a filed subdivision map. Further, in 1975, this Board wrote to the developer to convey the Town Board's wish that the park and playround of this subdivision be allowed to be combined with any future adjoining park, to which the subdivider responded favorably. See enclosed copies of correspondence and a subdivision map. Accordingly, such land is not considered by the Planning Board to be a building lot; the subdividers, failure to transfer the ownership of the land to the homeowners in the subdivision notwithstanding. Southold Town does not as a rule accept for public dedication park land within subdivisions. These parks are supposed to be owned and maintained by the homeowners or a homeowner,s association. (The Town's Tax Assessor's office has confirmed that each of the property deeds for the lots within Syloret Estates makes reference to th~ 3.4 acre park.) It is the Planning Board's position that the subject parcel ought to be used only as a park; and that the County should make a serious attempt to effectuate a transfer of ownership to the homeowners in this subdivision. Failing that, if the County should place this property on the auction block, the Planning Board asks that prospective bidders be notified that the land currently may be used as park land only. It is my understanding that the Town will issue no building permits for this property. The question is what the property can be used for. When I returned his call I spoke with a member of his staff. The question put to me was whether the property was buildable. I responded by noting that the property was desginated as a "park and playground" on a filed subdivision map. Further, I indicated that it was my understanding that such land is not a building lot, even though the Town had not taken ownership of the land. I also mentioned that the last time the County sold park and playground land such as this to the Town, it was for affordable housing, and that many problems had arisen as a result. I indicated that perhaps you would be in a better position to explain the legal side of this, so expect a telephone call in the next day or two from Roger Munz's office. In the cause of responding to this inquiry, I reviewed the subdivision file. It seems that in addition to the lien against the park land (the County has held the property since 1988 for lack of payment of taxes), there is a performance bond for this property. It seems that the last premium paid to the insmrance company was in 1985. The bond covered the installation of a recharge basin and road improvements, which were not constructed.
