' RESOLVED that whereas a formal application for the approval of a subdivision plat entitled "Woodbine Manor" located at Cutchogue was submitted to the Planning Board on October 20, 1986 and filing fee of $110 was paid on October 20, 1986 and, WHEREAS, a public hearing was held on said subdivision application and plat at the Town Hall, Southold, New York, on Monday, November 24, 1986 at 7:30 p.m., and WHEREAS, the requirements of the Subdivision Regulations of the Town of Southold have been met by said subdivision plat and application, NOW, therefore, be it RESOLVED that the application of John and Olivia Felliner-Ihar for approval of said subdivision plat prepared by Howard Young dated as amended February 4, 1986 be approved and the Chairman be authorized to endors~ approval on said subdivision plat. All of the premises hereinabove described shall be known and designated as residential plots. period, seeding lot. 2. No structure shall be erected, altered, placed or permitted to remain on any lot other than one detached single-family dwelling not to exceed 2 stories in height. No dwelling shall be erected, placed or permitted to remain on any lot unless it has an enlcosed garage, attached or unattached, for not less than one car, and all such garages and any accessory building must conform in architectural exterior design with the dwelling. 3. No dwelling shall be erected, placed or permitted to remain on any lot of the ranch-type containing only one story, unless it shall contain a minimum of 1100 square feet of living space, nor any colonial or cape cod-type dwelling containing more than one story unless same shall have a minimum of 1000 square feet of living space on the first floor of said structure, exclusive of open porches and garages. 4. Seeding of grass and landscaping shall be completed within 6 months from the date of the issuance of a certificate of occupancy for any dwelling erected upon any lot; and in the event such seeding and landscaping is not completed within the said 6-month then the developers shall have the right to complete the said and landscaping at the cost and expense of the owner of the 5. No trade or business of any kind shall be advertised from or transacted on the premises, except that this covenant shall not prevent a lawyer, accountant, physician, dentist, podiatrist, chiropractor, chiropodist, optometrist or any other member of the medical, dental, accounting, legal or allied occupation or profession - 2 - on said premises, and except that this covenant shall not prevent the growing of nursery stock or vegetables on the premises. However, veterinary medicine is specifically excluded as a permitted profession. 6. No signs of any kind shall be displayed to public view on any lot, except that one sign of not more than one foot square, upon which shall be inscribed the name, and occupation or profession of the occupant of the premises, and signs used by the builder to advertise his property during the construction and sales period, shall be permitted. 7. No animals, livestock or poultry of any kind shall be raised, bred or maintained on any lot, except for dogs, cats or other household pets, provided that they are not raised, bred or maintained for any commerical purpose. 8. No lot shall be used or maintained as a dumping ground for rubbish, trash or garbage. Ail rubbish, trash or garbage shall be kept inclosed sanitary containers, which containers shall be kept out of the public view and in the rear of the premises. 9. No fence, wall or hedge of over 4 feet in height shall be permitted within 10 feet of a side line, nor within 50 feet of any street line, except that there will be no restriction as to height of fence, wall or hedge or distance from side line as to the north line of Lot Nos. 20 and 21 and east line of Lot No. 17. 10. No clothesline, or other such clothes drying imple- ments shall be maintained other than in the rear yard area of the premises. 11. No building, fence, wall or other structure shall be erected or maintained, nor any change or alteration made therein, unless the plans and specifications therefor showing the nature, kind, shape, height, material, color scheme and location of such structure, and the grading plans of the lot, or plot to be built upon, have been approved in writing by, and a copy thereof as finally approved, lodged permanently with the developers, their heirs, suc- cessors or assigns. 12. Roads, park and recharge basin a. Construction of roads Woodbine Manor shall install road improvements pursuant to the specifications of the Town of Southold in existence at the time the road is constructed. b. Road easement, use of park - All owners of lots, their guests and invitees, are hereby granted an easement for the purpose of ingress and egress in common with others, at their own risk, over the roads shown on said Map. All owners of lots are hereby granted the right to use (pursuant to reasonable regulations from time to time promulgated by Woodbine Manor or by an association of property owners succeeding to the rights of Woodbine Manor) in common with others, at their own risk, the area shown on the sub- division map as "park"; hereinafter called "park". c. Upkeep of roads~ park and recharge basin - After the installations provided for in paragraphs (a) and (b) above, each lot owner shall be responsible for 1/22 of the cost of snow- plowing, upkeep, repair and maintenance in good condition of the roads and park area, and for 1/22 of the real estate taxes at- tributable to the roads and park area. Ail decisions as to the snowplowing, upkeep and maintenance of the roads and park area, including decisions~as to the extent and cost of any repairs therefor, shall be in the exclusive discretion of Woodbine Manor, or its successors in interest, an assocition of property owners as herein- after provided. (Please note: Duck Pond Road is a public highway, not part of the subdivision). d. Payment of contributions by lot owners While Woodbine Manor holds title to the roads, park and recharge basin, it will pay the taxes and expenses mentioned in paragraph (c) above, and will submit bills to the individual lot owners for their re- spective 1/22 contributions.. Such bills will be paid in full to Woodbine Manor by the then present lot owners within 10 days after said bills have been mailed. e. Maximum contribution of lot owners In no event, while Woodbine Manor hold~ title to the roads, park and re- charge basin, shall any lot owner be required to pay a sum in excess of $100 per annum toward real estate taxes for the roads and park, and snowplowing, upkeep, repair and maintenance of said facilities. f. Property owners' association - 1. If, at any time after 1/3 of the lots have been conveyed by Woodbine Manor, it decides to transfer title to the roads and park to a property owners' association, and if 2/3 of the then lot owners (exclusive of the lots owned by Woodbine Manor) vote to take title to said facilities, the conveyance shall be made. However, Woodbine Manor may withdraw its offer to convey the facili- ties at any time prior to receipt of written notification of the offer's acceptance. 2. If a conveyance is made to a property owners' association pursuant to provision (1) above, then: a. All costs and expenses associated wi~h . the roads and park shall thereafter be born entirely by the property owners' association. b. The Owners of all lots purchased from Woodbine Manor shall be members of the property owners' association; Woodbine Manor shall not be members of the property owners' associa- ' tion. c. Each member of the property owners' association shall be liable, on a per lot basis, for a share of the costs and expenses of the property owners' association. d. Each member agrees to comply with the regulations for the use of the park, and road facilities enacted by the property owners' association. A 2/3 vote shall be required for the enactment of each such regulation. e. Upon a 2/3 vote by the members of the prop- erty owners' association, title to the roads and park shall be dedi- cated to the Town of Southold. 3. For the purposes of provisions (1), (2d) and (2e) above, each lot owner shall have one vote for each lot owned, whether improved or unimproved. g. Conveyance or dedication of roads, park and recharge basin 1. Present intention to convey to property owners' association - - 6 - shall be made, Manor. Woodbine Manor presently intends to convey title to the roads and park to a property owners' association con- sisting of the lot owners. However, when and if such conveyance it shall rest in the sole discretion of Woodbine In lieu of conveying the roads property owners' association, Woodbine Manor reserves Reservation of right to dedicate to the Town of Southold and park to a the right, in its sole discretion to dedicate the roads, park and recharge basin to the Town of Southold without the consent of the owner of any lot or of the holder of any lien thereon or any interest therein. 3. Instruments required for dedication If Woodbine Manor or the property owners' association decide to dedicate the roads, park and recharge basin, and the Town of Southold requires any instruments to be signed by any of the persons referred to in subparagraph (2) above, then such person or persons shall execute such instruments upon written request. If such executed instruments are not receivedw~hinlQdays after the written request was made, the lot owner, lienholder or person with any other interest therein, hereby authorizes Woodbine Manor or the property owners' association to execute the required instruments as its-special agent. 13. Easements for installation and maintenance of utilities and drainage facilities across and under the premises to be conveyed for a distance of 20 feet from the lines of the premises and each lot are hereby reserved to the developers and their heirs, successors or assigns, who may grant permanent easements to public utility companies, - 7 - or to the Town of Southold. 14. All dwellings and structures shall be enclosed within a period of 6 months from the date of the commencement of their construction. 15. If any lot owner, his heirs or assigns, shall vio- late or attempt to violate any of the covenants herein, it shall be lawful for any other person or persons owning any real property situated in said subdivision, to prosecute any proceedings at law, or in equity, against the person or persons violating or attempting to violate~ any such covenant to prevent him or them from so doing, or to recover damages or other relief for such violation. 16. Invalidation of any of these covenants by judgment or court order shall in no way affect any of the other provisions which shall remain in full force and effect. 17. These covenants a~e to run with the land, shall be binding upon all parties a~d all persons claiming under them for a period of 25 years from the date these covenants are recorded, after which time said covenants shall be automatically extended for suc- cessive periods of 10 years, unless an instrument is recorded in the Suffolk County Clerk's Office, signed by the majority of the lots designated on the said Map, said covenants in whole or in part. 18. Reference is made to the map of Woodbine Manor dated 8/12/77 as prepared by Howard W. Young, L~. First of all, the roads as constructed do not meet current Town standards and it is my understanding that the roads are to remain private. With this understanding, the roads appear generally complete and satisfactory. Reference is also made to the last inspection report dated 11/27/84 by the Town Inspector. The outstanding items noted in that report appear to have been taken care of. However, as noted therein, the fine grading of the grassed water-ways and the pavement cross-section are only minimally acceptable. Storm water drainage for this subdivision is dependent on the run-off getting to the two (2) "vertical drains" which were installed. The flat gradient of the swales will certainly result in local ponding adjacent thereto. Also, the grading within these vertical sand drains is uneven and may result in some standing water. This may eventually lead to complaints from future home owners who build within this subdivision. Because of the excessive time it has taken to build this subdivision and the lack of coordinated construction and inspection, it is my recommendation that the developer be required to post a maintenance bond to guarantee proper upkeep of the road and drainage system. The amount of such a maintenance bond is recom- mended at $15,000.00 and should be reviewed annually for up-dating. Page 1 of 2 LouisVC McLean Associates, P. C. Because the roads do not meet Town adopted standards, they would not be acceptable for dedication to the Town. If, at a later date, the developer or the residents of the subdivision should wish to dedicate the roads to the Town, it would be required that the pavement be tested (cored), probably resulting in an asphalt overlay requirement. Also, a more formal storm- water drainage system would have to be installed which would probably consist of a standard leaching pool type design in lieu of the "sand drains" that have been installed. For the record, it should be noted the plan was approved with a pavement width of 36 ft.. The final width as constructed measures approximately 30 to 31 ft. and we are unaware of documentation reflecting this change except for the note in the Town Inspector's report herewith attached. In conclusion, approval of the completed improvements is hereby recommended as noted. If your Board has any questions or would like to further discuss this report, please advise. B) with turnarounds at the ends are located as shown on the plans. The road widths were changed to 29 ft. the road material consists of a so-called soil cement base with a 2" bank run asphaltic top course. Both roads and t~rnarounds are complete with exception of a small area in the top course t~rnaround at Road B. The owner maintains that the soil cement base is 6" in depth. ~5~o test holes in the base showed depths of 2" and 3" where there was no top course. Both roads have depressions in profile, excessive crown and no shoulder fill at the sides, the fine grading was done by the owner. The asphalt contractor could not fine grade the base and placed the top course on the base as he found it. Grassed Wate~a~: All of these swales as shown on the plans have been done. The grading (flowlines) could have been better. There is a 12" corrigated pipe crossing on Road B at the access to the southerly vertical drain and a 24" corrigated pipe crossing at Road A 100 ft. west of the turn- around that meets +-be swale to the northerly vertical drain. These crossings are not on plans. Vertical Sand Drains: The top of the drain bet~een Road A and Road B is higher than the flowline of the swale entering it. The top of the other drain north of Road A is lower than the swale entering it as it should be. Pla~ call for asphalt aprons where swale runoff goes into the vertical sand drains. The aprons have not been installed. Seeding appears to have been done throughout. 1he bond estimate calls for 2 street name signs, 2 stop signs, 2 dead end signs and 2 barriers. None of these installations have been done as required. / The bond estimate also calls for one fire well. I could not find any fire well. ~here is a large irrigation pmmp on th~ property with no equipment to operate it near the sand drain between Road~'a~ Road B. Toere are 2" to 3" caliper trees along Duck Pond Road, both sides cf goad A and B, both sides of all interior grassed swales and access to vertical drains, both ends and back line of pronerty. My tree count was 284. Also, there are small evergreens around the northerly sand drain and on two sides of the To':m recharge basin. The bond estimate calls for 90 trees. C.C. B) with turnarounds at the ends are located as shown on the plans. The road widths were changed to 29 ft. ~he road material consists of a so-called soil cement base with a 2" bank ~m asphaltic top course. Both roads and t~rnarounds are complete with exception of a small area in the top course t:rnaround at Road B. The owner maintains that the soil cement base is 6" in depth. Two test holes in the base showed depths of 2" and 3" where there was no top course. Both roads have depressions in profile, excessive crown and no shoulder fill at the sides, the fine grading was done by the owner° the asphalt contractor could not fine grade the base and placed the top course on the base as he found it. ~assed Waterways: All of these swales as shown on the plans have been done. ~he grading (flowlines) could have been better. Tnere is a 12" corrigated pipe crossing on Road B at the access to the southerly vertical drain and a 24" corrigated pipe crossing at Road A 1OO ft. west of the turn- around that meets the swale to the northerly vertical drain. ~hese crossings are not on plans. Vertical Sand Drains: Uhe top of the drain between Road A and Road B is higher than the flowline of the swale entering it. The top of the other drain north of Road A is lower than the swale entering it as it should be. Plans call for asphalt aprons where swale runoff goes into the vertical sand drains. 1he aprons have not been installed. Seeding appears to have been done throughout. the bond estimate calls for 2 street name signs, 2 stop signs, 2 dead end signs and 2 barriers. None of these installations have been done as required. ~he bond estimate also calls for one fire well. I could not find any fire well. ~here is a large irrigation pump on t~ property with no equipment to operate it near the sand drain between Road ~A/a~ Road B. there are 2" to 3'~ caliper trees along Duck Pond Road, both ~!des cf Road A and B, both sides of all interior grassed swales and access to vertical drains, both ends and back line of property. My tree count was 284. Also, there are small evergreens around the northerly sand drain and on two sides of the Town recharge basin. Uhe bond es*imate calls for 90 trees. C.C. The new map filed on March 23, 1984, consists of a portion of the property (lots fronting on the east side of Duck Pond Road) formerly shown on a previous subdivision map which had received final approval, subject to conditions which were not completed within 180 days from the date of final approval and, accordingly, such final approval expired. (See my January 7, 1983 letter to the Planning Board, copy of which is enclosed). Since the new map has never received either preliminary or final approval prior to May 20, 1983, it cannot be approved with 40,000 sq. ft. lots. (See Section 100-31B of the Zoning Code). However, since the previous map had received preliminary map approval on October 19, 1977, pursuant to Section 100-31B of the Zoning Code, this map can be resubmitted for final approval, which approval would be subject to the completion of all improvements, or at the option of the owner, a bond posted to guarantee the completion of such improvements. Ray nor, Jr., Chairman Southold Town Planning Board Main Road Southold, New York 11971 Re: John Fellinger-Ihar (Woodbine Manor) Dear Henry: On December 7, 1982, I sent you a letter in the above matter. It does not appear from your January 5, 1983 letter that you have read my first letter. Accordingly, a copy is enclosed herewith. Section 277 (1) of the Town Law (Approval of Plats; additional requisites) provides, in part, that "all streets...storm drains... shall be Ynstalied all in accordance with standards, specifiea- ti0ns' and procedure acceptable to the appropriate town departments ...or alternatively that a performance bond sufficient to cover the full cost of the same as estimated by the Dlanning board shall be furnished to the town by the owner...such performance bond shall run for a term to be fixed by the planning board, but in no case for a longer term than three years, provided, however, that the term of such performance bond may be extended by the planning board with consent of the parties thereto." The effect of the above quoted provisions of Section 277 is that the owner has the option of either making the required improve- ments or, in lieu thereof, posting the required performance bond. Mr. Fellinger-Ihar apparently elected to co. mplete the improvements rather than post a bond. He has thio right. However, in so doing, his subdivision map can not receive final approval until the improvements have been completed. In your December 1, 1982 letter to me, you stated that the major subdivision map "is in the preliminary stage." Your January 5, 1983 letter states_that the map "had received final approval of the Planning Board, January 30, 1979". My December 7th Henry E. Raynor, Jr., Chair m~n -2-- January 7, 19.83 · letter dealt with a case of preliminary subdivision approval.. Apparently the m~p had received final subdivision ~sp approval, subject to conditions. Subdivision 4 of Section 276 of the Town? Law provides that "Conditional approval of a final plat shall expire within 180 days after the date of the resolution gra~ting.>i conditional approval unless such requirements hav~ been certified.~' as eompieted". Section A 106-24F(2) of the subdivision~ rog contain a similar provision, but permits not more than two 90 day extensions. Accordingly, the final approval would expire,at the~ latest, 180 days after January 30, 1978 (assumming two, 90 day extensions). With respect to the purported permission of the Town Board to make improvements in lieu of a bond, as indicated above, the owner has this option without eitheP the Tgwn Board or the Plannl! Board approval. -In any event, this can not prevent the Planning.- Board final map approval from expiring 180 days from January 30, 1978. It would be my opinion that. the Planning Board approval of the final map has expired; that the Planning Board can proeeed.wi~ the application for approval of the four-lot minor subdivision; that thereafter, if the owner so chooses, he may submit a new application together with a new revised ~Jor subdivision mp excluding the four-lot minor subdivision and the set-off lot lot 21) and requ~est final approval thereof. (2) me approval of the Suffolk County Department of Environmental Control (which approval has been ob- tained). ($) Lot numbers being placed on the Suffolk County map bg the Rea] Property ~x Agency (which has been com- pleted). (4) Receipt of bond by Town Clerk and receipt of inspection fee by the Town Clerk. As to item #4, there had been, after January 30, 1978, negotiations with the Town relative to the amount of the performance bond and whether there would be a necessity Of obtaining same. It appears that an agreement was made bg the Town and the Fellinger-Ihars that the Fellinger-Ihars would sell to the Town of Southold one acre, more or less, of property located within the pro- posed subdivision plus a drainage easement wherein the Town would pag to the Fellinger-Ihars the sum of $1,500. The parties established that the value of the one acre, more or less, and easement had a value of $13,000 so that the balance of $11,500 would be a gift or dedica- tion to the Town by the Fellinger-Ihars. me agreement further provided that the Fellinger-Ihar's would not be required to post a performance bond but that final ap- proval of the subdivision map would be conditioned upon Town of Southold - Planning Board Henry E. Raynor, lt., Chairman Page 2 the completion of the improvements to the lots, etc., subject to the approval of the Town. The fellinger- Ihars were required to pay a fee in the amount of $2,6a0 to cover the inspection fees as to be made by the Town to verify that the improvements were made satisfactory to the Town specifications. On October 4, 1978, the Town Clerk received the $2,640. I enclose a copy of the receipt for your edification. Bg reason of the economic atmosphere, the real estate market covering vacant lots in the Town of Southold in the area of the location of Woodbine Manor has been poor. As a result, the Fellinger-Ihars have not com- pleted the final surfacing of the roads within the pro- posed subdivision. January 2, 1979 - Resolution setting January 23, 1979 for public hearing on application of Fellinger-Ihar for Soil Removal Permit. March 13, 1979 Resolution granting Soil Removal Permit to Fellinger-Ihar to: remove excess material from their Woodbine Manor Subdivision, which material was removed from a one acre recharge basin, and two additional recharge basins. Permit expired September 30, 1979. The deed referred to above (July 25, 1978) does not contain any agreement relative to waiving or reducing performance bond, and I do not find anything further in the Town Board minutes relative to same.
