John Fellinger/Ihar - Mr. and Mrs. Ihar met with the board requesting
a release of lot #21 on their major proposal.
On motion made by Mr. Orlowski, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board approve a set-off
( 106-13) to the lot designated as. lot #21 on the preliminary subdiv-
ision map of Woodbine Manor, owned by John & Olivia Fellin er/Ihar
subject to receipt of four copies of the final map.
Vote of the Board: Ayes: Raynor, -Latham,- Mullen, Orlowski
Cove Beach Associates- Mr. Richard Cron, Esq. met with the Board to
discuss the proposed covenants and restrictions for this property.
Mr. Raynor read correspondence to Mr,. Richard Cron, from the Town
Attorney, stating that after one-third of the lots within this sub-
division have been conveyed, title to the lots, drainage and, park
areas will be conveyed to a property owners' association, but the
proposed declaration fails to state whose responsibility it is to
organize the property owner's association. Mr. Cron submitted to the
board a additional paragraph (g) regarding the organization of the
property owner' s association.
On motion made by Mr. Mullen, seconded by Mr. Orlowski, it was
RESOLVED that the Southold Town. Planning Board declare itselflead
agency in regard to the State Environmental Quality Review Act in
the matter of the major subdivison known as Cove Beach Associates,
located at East Marion.

On .motion made by Mr. Latham, seconded by Mr. Orlowski, it was
RESOLVED' tha.t the Southold Town Planning Board approve the sketch map

East Marion, _datedFebruary, 28, 1980 and amended October 23 , 1981
and proof of -sanitary and potable water conditions to be submitted to
the Planning Board prior to preliminary hearing being scheduled.

question in the Board's minds as to whether drainage struc-
tures would be necessary for this area because of possible
flooding.

Of your finding with regard to this . We would appreciate a
reply prior to May 16 , 1982 as the Board must make a determin-

Dear Henry:
On December 7 , 1982 , I sent you a letter in the above ratter.
It does not appear from your January 5 , 1983 letter that you
have read my first letter. Accordingly, a copy is enclosed
herewith .
Section 277 ( 1 ) of the Town Law (Approval of Plats ; additional
requisites ) provides , in part , that "all streets . . .storm drains . . .
shall be installed all in accordance with standards , specifica-
tions and procedure acceptable to the appropriate town departments
. . . or alternatively that a performance bond sufficient to cover
the full cost of the same as estimated by the planning board
shall be furnished to the town by the owner . . .such performance
bond shall run for a term to be fixed by the planning board , but
in no case for a longer term than three years , provided , however ,
that the term of such performance bond may be extended by the
planning board with consent of the parties thereto . "
The effect of the above quoted provisions of Section 277 is that
the owner has the option of either making the required improve-
ments or , in lieu thereof, posting the required performance bond .
Mr . Fellinger-Ihar apparently elected to complete the improvements
rather than post a bond . He has this right . However , in so doing ,
his subdivision map can not receive final approval until the
improvements have been completed .
In your December 1 , 1982 letter to me , you stated that the major
subdivision map "is in the preliminary stage . " Your January 5 ,
1983 letter states that the map "had received final approval
of the Planning Board , January 30 , 1979" . My December 7th

letter dealt with a case of preliminary subdivision approval .
Apparently the rap had received final subdivision tap approval ,
subject to conditions . Subdivision 4 of Section 276 of the Town
Law provides that "Conditional approval of a final plat shall
expire within 180 days after the date of the resolution granting
conditional approval unless such requirements have been certified
as completed Section A
contain a 106-24F(2) of the subdivision regulations
similar provision , but permits not more than two 90 day
extensions . Accordingly, the final approval would expire ,at the
latest , 180 days after January 30 , 1978 (assumming two 90 day
extensions ) .
With respect to the purported permission of the Town Board to
make improvements in lieu of a bond , as indicated above , the
owner has this option without either the Town Board or the Planning
Board approval . In any event , this can not prevent the Planning
Board final trap approval from expiring 180 days from January 30
1978 .
It would be my opinion that the Planning Board approval of the
final map has expired ; that the Planning Board can proceed with
the application for approval of the four-lot minor subdivision ;
that thereafter , if the owner so chooses , he
application together with a may submit a new
new revised major subdivision map
excluding the four-lot minor subdivision and the set-off lot
(lot 21 ) and request final approval thereof.

opinion as to how the Planning Board should proceed with an application for a
minor subdivision of four of the lots shown in the major subdivision.
The first question that arises is the status of the major subdivision map. In
this respect, I note that the preliminary subdivision map which you sent me was
received by the Planning Board on August 26, 1977, and I assume that thereafter
a hearing was held thereon and presumably action taken to approve or disapprove
the preliminary map in 1977. Section 1.00-23 E(4) of the subdivision regulations
provides that within six months of the approval of the preliminary plat, the owner
must submit the plat in final form and if not so submitted, preliminary approval
may be revoked by the Planning Board. Section 106-24A(2) of the regulations
provide that a failure to submit the final map for final plat approval within six
months shall automatically cancel the preliminary plat approval unless a request
for an extension of time is granted by the Planning Board. The status, therefore,
of the major subdivision plat is dependent on whether a request has been made to
the Planning Board for an extension of time and such request granted. If no
extension of time has been granted, the preliminary approval would be deemed
revoked.
Assuming that the preliminary approval of the major subdivision is revoked by
the passage of time, then the Planning Board can proceed with the application for
approval of the four-lot minor subdivision in the usual manner. Thereafter,

COMMENTS:
The contours shown and elevations (in red pencil on the attached map)
are from the major subdivision map for John & Olivia Fellinger-Ihar
dated 8/12/77 .
Present runoff in part from lots 3, 4 and all of lot 2 goes to the
swale area down the west side of lots 1 and 2. Some fill has been
placed on lot 3 (Frontage on Duck Pond Road) and also at access
R.O.W. ' s to lots 1 and 4. Fill at the R.O.W. entrances is in the
swale area and lower than Duck Pond Road.
If the swale area was blocked by house construction or grading at
lot 2 , some flooding might occur at lot 2 frontage on Duck Pond Road
before the right-hand turn at Birch Lane.
A house located in the N.E. section of lot 2 between the 48 and 50
contours would not produce a drainage problem provided any grading
done does not block the swale.
Grading in lots 1 and 2 would slope to the Duck Pond Road profiles
and form a runoff swale draining away from the subdivision.
Due to the minus grade on Duck Pond Road and the steeper minus grade
after the right-hand turn, I do not see the necessity for any future
drainage structures by the Town.
There is some 12" & 18" CMP (not installed) alongside the driveway
to the house on lot 1 . The owner may intend to use this pipe for
driveway crossings at Duck Pond Road.
In my opinion flooding this subdivision is hardly possible under
normal conditions . �_ �

Again our board calls upon your assistance regarding the above
captioned matter.
This major proposal had received final approval by the Planning
Board, January 30, 1978, subject to the applicant meeting four con-
itions placed on the property, one of which was receipt of the bond
in the amount of $66 , 000. Our file indicates that this amount was
never approved by the Town Board nor received by the Town of Southold.
I have enclosed correspondence, dated April 10, 1978 in which the
applicant states he received permission from the members of the Town
Board, March 21 , 1978 to make improvements in lieu of posting the
performance bond; we have no indication from our files that this was
approved by the Town Board.
Mr. and Mrs . Fellinger-Ihar have recently filed a minor subdiv-
ision which would result in the removal of four lots within the major
proposal before us . Under Section 106-24 B (2&3) and 106-26 of the
Code of the Town of Southold, please advise if the conditional ap-
proval of the major proposal has expired and how our board should pro-
ceed with both major and minor proposals presently before our board.
If you have any questions concerning either of the files in
question, please call our office .

Mr. and Mrs . Fellinger-Ihar presently have before our
Board a major subdivision map which is in the preliminary
stage. On November 8 , 1982 we granted approval to set-off
the lot designated as lot #21 on same map and stipulated
this lot should be removed from the major proposal when it
reaches the final stages .
On November �, 1982 Mr. and Mrs. Fellinger-Ihar sub-
mitted to the Planning Board Office six copies of a proposed
minor subdivision which consists of four lots on the major
proposal . He has since submitted a short environmental
assessment form and an application for the approval of the
minor subdivision, stating it was imperative that approval
be given prior to January 2 , 1983 as he has set a closing
date.
Based on the fact that we have a proposed major subdiv-
ision for this property, have granted a set-off of one lot,
please advise this board if and how we should proceed with
the application for the section he wishes to subdivide into
four lots.
Enclosed for your review are copies of the maps mentioned

Dear Mr. Wickham:
In accordance with y?�r request the staff has examined the proposed sub-
division layout for a 26.4- acre tract reputedly owned by John and Olivia Fellinger-
Ihar and offer the following comment on the map for your use.
The overall layout of the subdivision is considered to be satisfactory. Mea-
sures, however, should be taken to insure that no stormwater runoff resulting from
the development and improvement of Lots 1 and 2 will flow out onto Duck Pond Road
where it can be carried to Long Island Sound.
It is suggested that consideration be given to requiring a short radius curve
at the southeast corner of the intersection formed by the intersection of Duck Pond
Road with Birch Lane and Vista Place. It is felt that turning movements around the
corner for northbound-eastbound vehicles will be facilitated by the rounding of the
corner.
Staff comments on a preliminary map do not constitute a review of the map by
the Suffolk County Planning Commission. When the map has been finalized it should
be referred to the Commission for review pursuant to Section 1333 of the Suffolk
County Charter.
