No sanitary disposal facility shall be installed or constructed within 100 feet ofthe top of the bluff. 4. No grading shall be permitted within 50 feet of the top edge of the bluff except that may be necessary to control or r~medy erosion or to prevent storm water from flowing over the edge of the bluff. 6. Clearing and cutting of vegetation within 50 feet of the top edge of the bluff shall be limited to that necessary for maintenance. 7. Access to the beach shall be by means of a suitable structure designed and constructed in a manner that will result in the least disturbance of the stability of the bluff. -3- Any future subdivision of the lands adjoining the aforedescribed minor subdivision to the south, and contiguous thereto, designated on the said minor sub- division map as Segtion 2, shall be referred to the Suffolk County Planning Commission for consideration. 9. Any further subdivision of the Section designated as Section 2 on said minor subdivision map shall have a map of the subdivision filed in the Office of the Clerk of the County of Suffolk. 10. The conditions hereinabove set forth shall be filed as covenants and restrictions in the Office of the Suffolk County Clerk. Woodhouse ~ A~~'"~ ,~, Chai~erson - Planning Board ~ ~~ Town Hall, 53095 Main Road ~ ~ ~'..-- ~'~ Southo~d, New York 11971 Re: ~O~o~n for Nina Stevens SE~ g: 1000-83-02-10 Dear Mrs. Woodhouse: As per a recent discussion with Mark Terry from your office, I have made an inspection of the private road as well as current conditions at the above referenced Minor Subdivision. The reason for this inspection was due to a report that the original drainage design for the road was no longer functioning properly and that a potential hazardous condition may exist. The original "Planning Board approved" road construction to access this four lot subdivision consisted of a 25' wide Right-of-Way with a 16' wide Stone Blend roadway in the middle. Subsurface drainage structures were also required and installed at the Iow points within the roadway. Inspections immediately following the completion of new road indicated that suitable drainage had been installed. In addition, that there were no evident or apparent drainage problems at the time of construction. The first noticeable difference or change in the approved road construction would be that the road has been treated with a course of Oil & Stone. This may have increase the amount of runoff generated by the road surface. However, the original drainage, as installed, and the permeability of the sub-soils present in this area would be sufficient to handle the increased amount of water generated by the additional hardening of the road surface. The additional surface of Oil & Stone is considered an upgrade from the original code requirements and will ultimately reduce maintenance and improve traffic safety. The second noticeable change to the roadway would be the construction of an earth berm along the easterly side of the roadway. This berm, approximately 2' in height on average, has been installed in such a way that it is encroaching upon the edge of road pavement. This new berm is within the limits of the 25' wide Right-of-Way and is adversely affecting the flow of water to the existing drainage inlets. It appears that the resultant standing water in the shoulder of the road after a rain event has been created by the construction of this berm. This standing water will have a negative impact on the roadway and should be addressed. Flooded roads ara hazardous with regard to driving conditions and frozen sections of road surface would be considered even more dangerous. Roads that maintain standing water for long periods of time will also require increased maintenance due to accelerated deterioration of the road surface. In conclusion, I realize that this problem is no longer subject to review by the Planning Board. I hereby offer this report to the Board in an effort to show how even a minor modification to roadway infrastructure may cause major problems to their performance. To resolve this problem, my office would suggest either of two options. First, remove or relocate the berm back away from the Right-of-Way and ratum the shoulder of the road to its previous condition. Or second, install additional drainage in the shoulder of the road to handle the standing water created by the installation of the berm. There seem to be two conditions on this that possibly present a problem. The first one - and I'm not even sure it's a condition and I'm not sure of the language of it - it's the 100 foot set-back. The way I read what was proposed is that is the original 100 foot set-back and there's not another one coming back. Am I misreading that? Mr. Ward: No. There is a 100 foot set-back by code. Ms. Doty: OK. Is the Planning Commission requesting an additional 100 foot set-back? Mr. Ward: No. Not in addition to that. There is a question, our environmental consultant has made a recommendation, that there be a no disturbance zone for grading and severe work between 100 foot and that top of bluff area. Meaning that the building envelope would really have to be back a little further than 100 feet in order to allow bulldozers and other things to work. Ms. Doty: He's not adding an additional 100 feet? Mr. McDonald: No. It's the same 100 feet. Ms. Doty: OK. It's contiguous. (everyone talking) Mr. Ward: Yeah, you envision being out on the right of way. Ms. Doty: Yes. (laughter) My concern, with respect to the non-disturbances, I haven't been up there, and I don't know if you all have been up there, but it's undoubtedly covered with cats briar and poison ivy and brambles, etc. We should, I hope, be given the opportunity to clear that and leaving various ecological plants such as bayberrys or something like that. It's a matter of waterfront property and not being (inaudible) to the water because of the over... Mr. Ward: I don't think the intent is to not do any pruning of trees or things, but I think there is the intent that's in writing right now is non-disturbance. I personally have not had a chance to go out and look at it and I can't really relate to it. If there's a problem with that statement, as it's stated, I believe we'd be willing to go out and take a look at it but it would put if off now until the September meeting. Ms. Doty: OK Mr. McDonald: There are two parts. The County Planning Commission report that we're on doesn't have any language about that at all, so we could proceed with that. Mr. Ward: Well, did you have any further comments on that? Ms. Doty: Well, there was also a question about a single access staircase. I think that was the Planning Commission's recommendation. I would request, and my client requests, that each lot be given the opportunity to put a staircase down. It seems unreasonable in many ways to have the two lots forever linked. And that, in many ways, devalues the property. Mr. McDonald: What are you, about 125 feet there? 100 feet? Ms. Doty: Down? I don't know. Mr. Ward: Top of bluff is roughly 50. Mr. McDonald: Top of bluff is 50? Ms. Doty: I think it's 50. Mr. Ward: Yeah. Mr. McDonald: It's going to be hard to see anything because it's really densely vegitated. The only way we could is the adjacent property has got alot of construction going on and we might be able, if they're kind enough to let us go across. Ms. Doty: We'll be sinking a test well, and we're going to have to clear to get Krieger's truck in there. Mr. McDonald: But you're not going to get anywhere near... Ms. Doty: We'd get to the edge of the building envelope. The left side of the building envelope. That's where the test well is supposed to be sited. That might make sense to do it that way, as to clear that path so that you all don't get lost. (laughter). Mr. Ward: Alright. So at this point then you'd prefer if we were to hold it off, take a look at it and... Ms. Doty: Yes. Mr. Ward: Now, is there anything with the Planning Commission report that would be a problem with the document? Mr. McDonald: It's Stevens. As you know, this subdivision was approved in April of 1981 subject to required road improvements that would be recommended by the Planning Board's Inspector. On September 14, 1992, I sent you a report outlining minimum construction requirements which has been used to design the road and the proposed drainage. The drainage calculations for the 25' R.O.W. are adequate. No drainage calculations were provided for the 50' R.O.W. This section of road must also be constructed at this time and drainage should also be provided. All inlet castings for the proposed drainage shall be set at existing low points. The clearing and grubbing within the 50' R.O.W. should extend a minimum of 3' beyond the limits of the proposed 16' wide stone blend road. As per my last report, the road subgrade should cons.ist of suitable material that is compacted to a mi.nimum depth of six (6) inches. In this memo, the Planning Board recommended that the Right-of-Way be improved prior to issuing any further Building Permits. During our conversation on friday (1/15), you informed me that the Building Permit was issued with the stipulation that no Certificate of Occupancy would be issued until the Right-of-Way has been improved. The Access Requirements in section 100-235 A. of the Code requires that direct access capable of servicing emergency vehicles be maintained at all times. In my opinion, the existing road conditions at the site do not provide for adequate access by emergency vehicles. The existing dirt road is too narrow and several low points in the road are very soft and full of mud during rain or wet weather. In reviewing Items 1 through 11, inclusive, I find that only condition numbered 10 is objectionable. In this regard, these parcels will be offered in a high price range which will necessitate each lot owner making a determination as to the manner in which access to the Sound is gained. If it is required that a single access structure be shared in common by two lots, it will not only cause problems of a practical nature but also problems of a liabil- ity nature. It is my recollection that a similar proposed condition was made in connection with the Whitcom minor subdivision, to which objection was taken, and the Board after due consideration decided that the condition as proposed by the County should not be imposed. In the instant situation, there is absolutely no indication that individual structures for access to the beach with respect to each of the four lots would have any adverse effect on the Sound bluff. I donor think that such a situation could occur with respect to this minor subdivision.
