Dear Ms. Moore:
The following resolutions were adopted by the Southold Town Planning Board at
a meeting held on Monday, October 6, 1997:
The final public hearing, which was held at 7:35 p.m. was closed.
The following resolution was adopted:
WHEREAS, Louis Corso and others, Timothy and Jeanne Steele, and Irvin and
Maria Modlin are the owners of the property known and designated as SCTM#
1000-83-2-10,1, 10.3, 10.4, 10,5 & 10.6" located on the north side of Oregon
Rd. in Cutchogue; and
WHEREAS, this application which is for 4 lot line changes, is to subtract 51,020
sq. ft. from a 17.94 acre parcel and to add:
1,188 sq. ft. to existing Lot 1,
17,554 sq. ft. to existing Lot 2,
13,802 sq, ft. to existing Lot 3,
18,476 sq. ft. to existing Lot 4,
and to relocate an existing 50 foot wide r-o-w to run along the southeasterly line
of the revised parcels; and
WHEREAS, the Southold Town Planning Board, pursuant to the State
Environmental Quality Review Act, (Article 8), Part 617, declared itself lead
agency and issued a Negative Declaration on September 15, 1997; and

WHEREAS, as noted in a letter dated September 18, 1997 from Patricia Moore,
Mr. Corso intends to relocate the existing road to the proposed location in the
spring of 1998, and the new road will be constructed in the same manner as the
existing road. The new road will connect to the existing access/driveway on the
Modlin property and the Modlins will continue to have uninterrupted access over
the proposed right-of-way; and
WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice
of Public Hearing, has received affidavits that the applicant has complied with
the notification provisions; and
WHEREAS, a final public hearing was closed on said subdivision application at
the Town Hall, Southold, New York on October 6, 1997; and
WHEREAS, all the requirements of the Subdivision Regulations of the Town of
Southold have been met; be it therefore
RESOLVED, that the Southold Town Planning Board grant conditional final
approval on the surveys dated August 20, 1997, and authorize the Chairman to
endorse the final surveys subject to fulfillment of the following condition. The
condition must be met within six (6) months of the date of this resolution:
New deeds must be filed for all parcels involved (Corso, Modlin and
Steele) reflecting the lot line changes. Copies of the recorded deeds
must be submitted to this office.

In accordance with our discussion at your July 14, 1997 work
session, you asked whether Mr. Corso would consider withdrawing the
separate lot line applications and submit one lot line application
which would add the entire area of 51,434 sq. ft. to one parcel.
Mr. Corso believes that each lot should be made larger, in
conformity to the two acre zoning. The Planning Board's request
would result in a less desirable and less marketable parcel, and a
poor use of the land. Therefore, the lot line proposed by the
planning board is not an acceptable alternative to Mr. Corso and
his family.
The lot-line changes are in conformity with the Town Zoning.
The Planning Board Lot-line process is flawed in that no standards
or procedures have been legislated into the code, and we hereby
request that you proceed with your informal procedures to approve
the Lot-line changes, as submitted, or deny the application so that
my client can pursue his legal remedies.

Dear Pat:
I have been advised that yesterday, Mr. Corso caused the removal and destruction of
the Steele's trees, landscaping and other property along the existing roadway, and
trespassed onto his property to dump the removed material. He has also taken steps to
widen the roadway previously approved by the Town and which has adequately serviced
the access required to the parcels having rights over the right of way, His actions have
further impinged on the farming operation being conducted by Mr. Steele.
Demand is hereby made that all activities being conducted cease immediately, that the
property tampered with be restored to its condition prior to yesterday. Any financial
damages to the Steeles will be sought to be recovered from your client. If any widening
changes are to be made to the right of way, we insist that they be made with the approval
of the Planning Board,

Pursuant to my telephone conversation with Melissa Spiro
regarding the Planning Board's concerns, Mr. Corso intends to
undertake the following action:
1- Relocate the existing road to the proposed location in the
Spring of 1998.
2. The new road will be constructed in the same manner as the
existing road.
3. The relocated road will connect to the existing
access/driveway on the Modlin property.
4. The Modlins will continue to have uninterrupted access over
the proposed right-of-way.
