It appears that the terrain of lot 91 (the approximit 10 acre parcel adjacent to thC Sound) will allow for the development of only 4 lots. In this case a 20' road built to the new Town Specifications will be required. The Board geels that the best way to handle the Right-of-way situation would be to buy theland within the Right-of-way. When parcel 91 is subdivision, the Board will request a 50' East West Right-of-Way along the south boundry for future access. As long as Parcel 1 is subdivided as a minor subdivision (less than 4 lots) the Right-of-Way must be 25' in width. The Planning Board is not in favor of moving the Right-of-Way to the o~her side of the property. The Board is in favor of the layout as was approved on May 9, 198~. Our records show that these existed as separate parcels prior to 1981 and no subdivision or development application is necessary for filing with this office. If the lots are to be further subdivided, a subdivision or develop- ment application will be necessary unless all parcels in the subdivision or development are residential and contain an area of more than 5 acres each.
