Dear Mr. Ward:
At a regular meeting of the Southold Town Planning Board, Monday,
May 10 , 1982 the following actions were taken:
RESOLVED that the Southold Town Planning Board override Suffolk
County Planning recommendation number two, dated March 4 , 1982 re-
garding the minor subdivision entitled Charles E. & Beatrice T. Ward,
located at Southold.
RESOLVED that whereas , a formal application for the approval of a
subdivision plat entitled Minor Subdivision of Charles E. & Beatrice T.
Ward was submitted to the Planning Board on December 11, 1981 and an
application fee of $50 was paid on April 15 , 1982 , and
WHEREAS, a public hearing was held on the map of said subdivision at
the Town Hall, Main Road, Southold, New York, on March 22, 1982 at
7 : 45 p.m. , and
WHEREAS , the requirements of the Subdivision Regulations of the Town
of Southold have been met by said subdivision plat and application,
NOW, therefore, be it RESOLVED that the application of Charles E. &
Beatrice T. Ward for approval of said subdivision plat prepared by
Charles E. Ward be approved and the chairman be authorized to endorse
approval on said subdivision plat subject to meeting the conditions
numbered 1, 3 , 4 , 5 , 6 , and 7 of the Suffolk County Planning Depart-
ment dated March 4 , 1982, and the construction of a dwelling to be no
closer than 37 feet from the edge of th'e bank.

premises and every portion thereof is hereby held arra shall be conveyed subject
to the conditions, covenants and restrictions hereinafter set forth, arra that
every purchaser of said premises, or any portion thereof, by the acceptance of a
deed thereto, covenants and agrees that the premises so purchased shall be held
subject to the covenants, conditions, and restrictions hereinafter set forth.
1. No lot shall be subdivided or its lot lines changed in any manner ,
at any future date unless authorized by the Southold Town Planning Baird.
2. The construction of a dwelling shall be no closer than 37 feet from
the edge of the bank.
3. No stormwater runoff resulting from the development and improvement
of the subdivision or any of its lots shall he discharged down the face of the
bank in any manner or discharged directly into Shelter Islard Sound.
4. Clearing and cutting of vegetation within 50 feet of the top
edge of the bank shall be limited to that necessary for maintenance.
5. No sanitary disposal facility shall be installed or constructed
within 100 feet of the top of the bank.
6. No grading shall be permitted within 50 feet of the top edge of the
bank except that that nay be necessary to control or remedy erosion or to pre-
vent stornwater from flowing over the edge of the bank.
7. That all of the covenants, coalitions and restrictions contained
herein shall be construed as real covenants running with the lard and shall

continue and remain in full force and effect at all times as against the owner
of the premises or any portion thereof ari perpetuity. Said covenants, con-

Re: Application of Charles E. Ward and Beatrice T. Ward for approval of a
subdivision plat.
Premises: Easterly side of Paradise Point Road, Southold, N. Y.
Gentlemen:
As attorney for Charles E. Ward and Beatrice T. Ward, I talked with Mr. Robert W.
Tasker relative to the above matter.
It would seem that in this application you approved the subdivision subject to
the conditions 1, 3, 4, 5, 6 and 7 of the Suffolk County Planning Department dated
March 4, 1982, and the construction of a dwelling to be no closer than 37 feet
from the edge of the bank.
When Mr. Ward prepared the Declaration of Covenants and Restrictions he used a
form that was given to him by someone at your office. It is a printed form and
contains the following wording in condition #1: "No lot or plot as shown and
designated on the Minor Subdivision map approved by and filed with the Southold
Town Planning Board shall be further subdivided.". It is Mr. Ward's understand-
ing that as a matter of law, and a matter of practice, the Planning Board always
has had the power to grant or deny a subdivision and this particular wording might
well be construed that the property involved could never be further subdivided.
This does not follow the condition #1 of the County Department of Planning which
specifically provided that there could be no subdivision unless authorized by the
Southold Town Planning Board. Mr. Ward would like to amend the Declaration of
Covenants and Restrictions so that it would conform with the decision of the
Suffolk County Department of Planning.
The Town Planning Board approved all of the conditions of the County Department
of Planning with the exception of the nearness of the construction of a dwelling
to the edge of the bank. The County required 100 feet and the Town 37 feet.
I am enclosing herewith a proposed Amended Declaration of Covenants and Restric-
tions which will conform, I believe, to your resolution which provided as follows:

WHEREAS, the Declarants heretofore filed a Declaration of Covenants and
Restrictions on May 11, 1982, a copy of which is annexed hereto. Parcel 1 of
the premises set forth above is now owned by John Petrocelli and Joan Petrocelli
and Parcel 2 is owned by Charles E. Ward and Beatrice T. Wand. Your Declarants
have no present intent to further subdivide the premises, and
WHEREAS, the previous covenants and restrictions indicated that the
Declarants intended to subdivide the premises and further contained a condition
restricting future subdivision of either parcel as follows:
"l. No lot or plot as shown and designated on the Minor
Subdivision Map approved by and filed with the
Southold Towyn Planning Board shall be further sub-
divided.", and
WHEREAS, the Declarants had applied to the Planning Board of the Town
of Southold for approval of the subdivision and development of the pranises as a
Minor Subdivision, to contain not mre than four (4) lots or parcels. This was
an error inasmuch as the application was to divide the premises into two (2)
parcels as shown on the annexed survey.
Now, THMM)RE, the Declarants do hereby declare that the aforesaid
premises and every portion thereof is hereby held and shall be conveyed subject
to the conditions, covenants arra restrictions hereinafter set forth, and that
every purchaser of said premises, or any portion thereof, by the acceptance of a
deed thereto, covenants and agrees that the premises so purchased shall be held
subject to the covenants, conditions, and restrictions hereinafter set forth.
1. No lot shall be subdivided or its lot lines changed in any manner
at any future date unless authorized by the Southold Tuan Planning Bawd.
2. The construction of a dwelling shall be no closer than 37 feet frau
the edge of the bank.
3. No stormwrater .runoff resulting fran the development arra improvement
of the subdivision or any of its lots shall be discharged down the face of the
bank in any manner or discharged directly into Shelter Island Sound.
4. Clearing and cutting of vegetation within 50 feet of the top
edge of the bank shall be limited to that necessary for maintenance.
5. No sanitary disposal facility shall be installed or constructed
within 100 feet of the top of the bank.
6. No grading shall be permitted within 50 feet of the top edge of the
bank except that that may be necessary to control or recedy erosion or to pre-
vent stormwrater from flowing over the edge of the bank.
7. That all of the covenants, conditions and restrictions contained
herein shall be construed as real covenants running with the land and shall

continue and remain in full force and effect at all times as against the owner
of the premises or any portion thereof in perpetuity. Said covenants, con-
ditions and restrictions shall be binding upon, inure to the benefit of and be
enforceable by the Declarants, their firs, successors and assigns, any owner of
any portion of the aforesaid premises, their heirs, successors and assigns, and
the Town of Southold, and its successors and assigns, and the failure of any of
the foregoing to enforce any of such covenants, conditions and restrictions
shall in no event be deemed a waiver of the right to do so thereafter.

State Environmental Quality Review Act and 6NYCRR Part 617 , Section
617 . 10 and Chapter 44 of the Code of the Town of Southold, notice is
hereby given that Southold Town Planning Board as lead agency for
the action described below has determined that the project will not
have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of Charles E. & Beatrice T. Ward is a two-
lot subdivision located at Southold.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned.
Because there has been no response in the allotted
time from the New York State Department of Environ-
mental Conservation it is assumed that there is no
objection nor comments by that agency.
The Suffolk County Department of Health Services has
indicated its agreement with the lead agency designation.
It appears that this area has a limited water supply. Based
upon the size and elevations of the proposed parcels, it is
expected that an adequate water supply and sewage disposal
system can be designed.
The project will meet all the requirements of the Code
of the Town of Southold Subdivision of Land Regulations .

Dear Mr. Raynor:
Thank you for being so courteous to me this morning
in your office.
As I told you we are upset about paragraph 2 in the
March 4, 1982 letter from the Suffolk Department of Planning
and want to get relief from the 100' setback from the top edge
of the bank along the shoreline of Shelter Island Sound. We
would like the setback to be more in keeping with the character
of our existing neighborhood. The average setback of houses
in our area is 37 ' , our house on parcel 1 has a setback of 50' .
I believe the 100 ' setback came about to protect the public in
areas such as the Long Island Sound side where the banks are
much higher and subject to serious erosion.
We do not have erosion because our banks are only
about 30' above the water and are protected with trees and
heavy vegetation. There is a concrete sea wall at the bottom
of the bank . There is a series of wood jetties which have
maintained the ordinary high water line substantially as it
was in May 1910 as shown on a map by Franklin F. Overton,
surveyor.
The Suffolk County Planning Commission did not have
the above information for their meeting March 3, 1982 .
The slope of the present bank on parcel 2 is approx-
imately 1-3/4 : 1 which is stable with vegetation. A house
with a cellar setback 25 ' from the top of the bank and allowing

for perhaps a five foot overcut for the foundation (which is
unlikely) would produce a slope of approximately 4'g : 1.
This would be a perfectly safe slope. A sketch is attached
hereto.
We respectfully request that your board approve a
setback for parcel 2 of 37' from the top of the well established
and stabilized bank, and a setback for parcel 1 of 50 ' .
I understand from Mr. Charles Lind who signed the
March 4, 1982 letter that the county dept. of planning
acts only in an adversary capacity and that your Board has
complete power to change paragraph 2 .
We have a conditional contract for sale of parcel 1
with a closing date of May 17, 1982 subject to having a sub-
division map approved by your planning board. We plan to
build a house on parcel 2 and would like to place it so that
we have the pleasure of seeing and enjoying the beautiful
waterfront.
I would be happy to go over the site with your board
or designee at your convenience . I will also plan to attend
your meeting April 26 .

Dear Mr. Raynor:
The Suffolk County Planning Commission at its regular meeting on March 3,
1982, reviewed the proposed subdivision plat entitled, "Minor Subdivision -
Beatrice T. & Charles E. Ward", referred to it pursuant to Section 1333 of the
Suffolk County Charter. After due study and deliberation it resolved to approve
said map subject to the following seven conditions deemed necessary to help pre-
serve the natural and aesthetic attributes of the shoreline of Shelter Island
Sound:
1. No lot shall be subdivided or its lot lines changed in any manner
at any future date unless authorized by the Southold Town Planning
Board.
2. No new residential structure shall be constructed or otherwise lo-
cated within 100 feet of the top edge of the bank along the shore-
line of Shelter Island Sound.
3. No stormwater runoff resulting from the development and improvement
of the subdivision or any of its lots shall be discharged down the
face of the bank in any manner or discharged directly into Shelter
Island Sound.
4. Clearing and cutting of vegetation within 50 feet of the top edge
of the bank shall be limited to that necessary for maintenance.
5. No sanitary disposal facility shall be installed or constructed with-
in 100 feet of the top of the bank.
,}\ 6. No grading shall be permitted within 50 feet of the top edge of the
�b bank except that that may be necessary to control or remedy erosion
or to prevent stormwater from flowing over the edge of the bank.

Dear Mr. Raynor:
The Suffolk County Planning Commission at its regular meeting on March 3,
1982, reviewed the proposed subdivision plat entitled, "Minor Subdivision -
Beatrice T. & Charles E. Ward", referred to it pursuant to Section 1333 of the
Suffolk County Charter. After due study and deliberation it resolved to approve
said map subject to the following seven conditions deemed necessary to help pre-
serve the natural and aesthetic attributes of the shoreline of Shelter Island
Sound:
1 ' No lot shall be subdivided or its lot lines changed in any manner
at any future date unless authorized by the Southold Town Planning
Board.
2. No new residential structure shall be constructed or otherwise lo-
cated within 100 feet of the top edge of the bank along the shore-
line of Shelter Island Sound.
3:' No stormwater runoff resulting from the development and improvement
of the subdivision or any of its lots shall be discharged down the
face of the bank in any manner or discharged directly into Shelter
Island Sound.
4! Clearing and cutting of vegetation within 50 feet of the top edge
of the bank shall be limited to that necessary for maintenance.
5! No sanitary disposal facility shall be installed or constructed with-
in 100 feet of the top of the bank.
i� 6. No grading shall be permitted within 50 feet of the top edge of the
bank except that that may be necessary to control or remedy erosion
Z or to prevent stormwater from flowing over the edge of the bank.
