Gentlemen:
This is to certify that the following action was taken
by the Southold Tam Planning Board on April 4, 1963:
"on motion of Mr. Grebe, seconded by Mr. Unkelbach, it was
"RESOLVED: WHEREAS Paradise (�oint Corporation has petitioned
the Southold Town Planning Board for final approval of their plat
known as "Paradise Point at Bayview" , Southold, New York, and
"WHEREAS the Superintendent of Highways of the Town of
Southold has inspected the map and property and approves the
highway layout, and his report is hereby approved by the Plan-
ning Board, and
"WHEREAS the Southold Town Planning Board, pursuant to due
notice thereof, held a public hearing on the matter of approval
of the plat which time all interested persons were given an
opportunity to be heard, and
"WHEREAS the Southold Town Planning Board waives the provisions
in the Rules and Regulations for the Subdivision of Land requiring
Park and Playground area or cash equivalent; and
"WHEREAS the applicant does not intend to dedicate the high-
ways to the Town of Southold at this time, the highways must meet
the specifications of the Highway Superintendent when they are
offered for dedication to the Town. The requirement for a performance
bond is waived;

"NOW, THEREFORE, BE IT RESOLVED that the subdivision to be
known as "Paradise Point at Bayview" at Southold, New York, con-
sisting of 19.70 acres and owned by Paradise Point Corporation be
approved.
"This plat ishounded and described as follows: Beginning at
a monument at the southwesta ly corner of land of Paradise Point
Corporation and on the easterly line of land of Shelter Island Oyster
Company and at the northerly end of the westerly line of Paradise
Point Road; running thence along said land of Shelter Island Oyster
Company two courses as follows: (1) N. 19° 15' 20" E. 519. 03 feet;
thence (2) N. 18 29' 20" E. 258.31 feet, thence along other land
of Paradise Poin t Corporation four courses as follows: (1) S.
66 13 ' 00" E. 100 feet; thence (2) S. 180 29' 20" W. 49. 79 feet;

Covenants and Restrictions
1. No building or structure shall be erected, altered, placed or
permitted to remain on any residential building lot other than one (1)
single family dwelling house and a private garage for family use.
2. No trailers, tents or camping shall be permitted on said
premises at any time.
3. No structure or structures, including but not limited to,
dwellings, outbuildings and fences, shall be erected or constructed
or allowed to remain unless the plans and specifications therefor and
the location thereof shall have first been submitted to and approved
by the Building Committee of the Paradise mint Corporation, its suc-
cessors and assigns, in writing.
4. No trade, craft, business, manufactory, industry, commerce,
profession or other commercial enterprise, including hotels , motels,
boarding and rooming houses, shall be conducted on the premises, ex-
cepting that nothing herein contained shall prevent the Paradise Point
Corporation or the Paradise Point Association from erecting, operating
and maintaining boat basins, yacht or beach clubs, bath houses and
other recreational facilities or permitting others to do so, with or
without remuneration.
5. No building, structure or structures on, above or below the
surface, other than public utility pipes or lines, shall be erected,
constructed or maintained within twenty (20) feet from the adjoining
property.
6. No fowl, poultry, animals or livestock, other than domestic
household pets, shall be kept on the premises.
7. No outside privies , toilets or waterclosets shall be erected,
permitted or maintained upon the premises . An adequate septic tank or
cesspool shall be erected and maintained to take care of the sewage
disposal at each dwelling and the same shall be of such design and
construction as may be approved by the agency of government having
jurisdiction thereof.
8. Each owner of a lot within said premises, except Paradise
Point Corporation, shall join the Paradise Point Association Inc. and
maintain membership therein and abide by the rules and regulations of
the Paradise Point Association Inc. as set forth in the charter and
by-laws of such association and as determined from time to time by its
governing body.
To the extent that the cost of maintenance of the private
roads within the aforesaid premises, which are subject to a common
right of use by the owners of the lots within the premises , and the
cost of maintenance of the Yacht Club and other structures including
docks, floats and bulkheads and beach property, of which all of the
members of Paradise Point Association, Inc. have use in common, is not
covered by payments made by the Paradise Point Association Inc. in any
calendar year, each owners of an individual lot on the premises shall
be liable pro rata, in accordance with the assessed value of such pro-
perty for the preceding year, for any deficiency.
Provided, however, that any lots owned by Paradise Point
Corporation shall be excluded for purposes of such computation and it
shall not be assessed for any portion of such deficiency.
9. The Paradise Point Corporation, its successors and assigns
may release, alter, amend and annul all or any of these covenants and
restrictions with the consent in writing of all property owners in the
said premises.
10. THESE COVENANTS AND RESTRICTIONS shall run with the land and
shall be construed as real covenants and restrictions attached to and
running with the land.

The Planning Board has been advised to review the few subdivisions
which we have approved and waived performance bond and the construction
of highways upon the owner's statement that he would dedicate to the
Town as soon as possible. The Town, some time ago, established new
specifications for dedication. The Planning Board has been requiring
performance bonds for highway construction in subdivisions. Accord-
ingly, we would appreciate hearing from you as to the condition of
the roads in the subdivision, Paradise Point, located in Bayview,
Southold. we would also like to 3anow what progress you have made
toward dedication of the roads to the Town of Southold, and what progress
you expect to make in the next six months.
