Dear Mr. Cuddy:
The following resolution was adopted by the Southold Town Planning Board at a meeting held
on March 12, 2001:
WHEREAS, the proposed minor subdivision is for 4 lots on 15.973 acres; and
WHEREAS, a final public headng was dosed on said subdivision application at the Town Hall,
Southold, New York on February 12, 2001; and
WHEREAS, all requirements of the Subdivision Regulations of the Town of Southold have been
met; be it therefore
RESOLVED, that the Southold Town Planning Board grant final approval to the surveys dated
November 16, 2000, and authorize the Chairman to endorse the final surveys.
The mylar maps which were endorsed by the Chairman must be filed in the office of the County
Clerk. Any plat not so filed or recorded within sixty (60) days of the date of final approval shall
become null and void.
The Planning Board must be notified at least two (2) days pdor to the commencement or
completion of any work on each stage or operation of the construction of subdivision
improvements.

DECLARATION OF COVENANTS AND RESTRICTIONS
THIS DECLARATION, made this /~day of February, 2001 by and
between NORTH BAYVIEW ASSOCIATES, a partnership having its
principal place of business at 56215 Main Road, Southold, New York
11971, hereinafter referred to as the DECLARANT:
W I TN E S SETH :
WHEREAS, the Declarant is the owner in fee simple of certain
real property situate at Bayview, Town of Southold, County of
Suffolk, State of New York, known and designated on the Suffolk
County Tax Map as District 1000, Section 79.00, Block 08.00, Lot
012.000, and more particularly described on the annexed Schedule A,
and
WHEREAS, therefore and in consideration of continuing the
subdivision approval the Planning Board of the Town of Southold has
deemed it to be for the best interests of the Town of Southold, the
owners and prospective owners of said lots that the within
covenants and restrictions be imposed on said lots, and that said
Planning Board has required that the within Declaration be recorded
in the Suffolk County Clerk's office, and
WHEREAS, the Declarant has considered the foregoing and has
determined that same will be in the best interests of the
Declarant and subsequent owners of said lots,
NOW, THEREFORE, THIS DECLARATION WITNESSETH:
That the Declarant for the purpose of carrying out the
intentions above expressed, does hereby make known, admit, publish,
covenant, and agree that the lots within said subdivision map shall
hereafter be subject to the following covenants and restrictions as
herein cited, which shall run with the land and shall be binding
upon all purchasers and holders of said premises, their heirs,
executors, legal representatives, distributes, successors, and
assigns, to wit:
1. There shall be no further subdivision of said premises, in
perpetuity.
2. The said premises described as the Open Space Easement on
the final map of NORTH BAYVIEW ASSOCIATES will forever be kept open
and free of all buildings and other structions, including fences.
3. No dumping or burning of refuse shall be permitted on the
said premises.
4. The natural resources and condition of the said premises
described as the Open Space Easement shall remain undisturbed and
in its natural state, and to this end no top soil, sand, gravel,
rock or minerals shall be excavated or removed therefrom, no
grading shall be conducted on the said premises and no planting or
fill shall be placed upon the said premises, and nothing shall be
permitted to occur on the said premises which would contribute to
the erosion of the land, and no trees on the said premises shall be
cut or removed and no other plants or vegetation on the said
premises shall be destroyed or removed, except for the removal of
such dead, diseased or decayed trees or vegetation which may be
required for conservation or scenic purposes.
5. The Declarant reserves the right to the exclusive use of
the said premises described as the Open Space Easement on the final
map of NORTH BAYVIEW ASSOCIATES insofar as such use is not
inconsistent with the covenants and agreements hereinabove set
forth, and the Declarant may exclude the general public or any
person or persons from the use of said premises described as the
Open Space Easement on the final map of NORTH BAYVIEW ASSOCIATES
except that the Town of Southold shall have the right to inspect
the said premises described as the Open Space Easement on the final
map of NORTH BAYVIEW ASSOCIATES for the purpose of assuring itself
that the covenants and agreements are not being violated, such
inspection to be at reasonable times and by mutual arrangement, if
possible.
6. All lots of the within Subdivision of NORTH BAYVIEW
ASSOCIATES shall use the common driveway. Lots #1 and #2 shall not
have separate access to North Bayview Road and shall have the right
to traverse Lots #3 and #4, within the area designated as the
common driveway. The owners of the lots in the within Subdivision
of NORTH BAYVIEW ASSOCIATES shall contribute equally for expenses
incident to the upkeep and maintenance of the paved area and the
common driveway.
a) Upkeep and maintenance shall include:
1) Repair of the paved areas;
2) Snow plowing;
3) Removal of litter;
4) all other steps to maintain the roadway and
driveway in good passable condition.
b) The owner of Lot No. ! shall act as Managing Agent
and shall annually collect in June of each year, from each lot
owner in the subdivision an equal share of then anticipated costs
for the coming year, July 1st to June 30th, in connection with the
upkeep and maintenance of the roadway and common driveway. If
sufficient funds are not available to pay the costs then on 30 days
written notice to each lot owner an

c) In June of each year a majority of the lot owners
shall approve an upkeep and maintenance budget for the following
year. If the budget is arbitrarily rejected then the Managing

attorneys fees, of such proceedings or action shall be borne by the
objecting lot owners.
d) In the event that any lot owner fails to make payment
within 30 days after written notice of non-payment has been given,
then the Managing Agent may commence an action or proceeding to
recover the sum due and all costs of collection including
reasonable attorneys fees shall be included in the amount
collected.
e) By acceptance of a deed each lot owner and his or her
successors, assigns, heirs, distributees and legal representatives
covenant to be bound by all the terms and conditions of this upkeep
and maintenance agreement.
6. These covenants and restrictions, with the exception of
the requirement that there shall be no further subdivision in
perpetuity, can be modified only at the request of the then owner
of the premises with the approval of a majority plus one of the
Planning Board of the Town of Southold after a public hearing.

To the Planning Board,
I want to express my support and appreciation of a 2001 decision declaring several acres as an open
space covenant/easement.The area preserved is located just south of Seawood Drive and west of North
Bayview Road in Southold.A four house cul-de-sac subdivision was wisely apportioned to include the
several protected acres. It is a relatively large wood which is home to: birds, deer, squirrels,turtles,fox,
racoons, and many species of trees. I enjoy its beauty every day. It gives me great peace and joy.
I am thankful to those responsible for making the decision to preserve this special space.With so
much development on Long Island,this wood should be held as an open space in perpetuity. I trust that
the Board will continue successful actions like this in the future.Thank you.

The following statements are offered for your consideration

Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project
or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent-
ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine
significance may have little or no formal knowledge of the environment or may be technically expert in environmental
analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting
the question of significance.
The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination
process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit a project or action.

The Planning Board, in consultation with the Town Attorney, has determined that North
Bayview Associates, c/o Charles Cuddy, should get a $12,000 refund fi.om the park and
playground account. The $12,000 was deposited with the Town Clerk's office on March
12, 2001 to pay the balance of the new $5,000 park and playground fee per lot. However,
they were later found to be exempt fi.om the new fee because they had completed all of
their necessary paperwork before the new fee was established, and were waiting for the

It is not merely disconcerting that this additional

voluntarily created 4-acre lots, it is being penalized.
I hope that the Board will review this matter and
determine that an additional payment for the park and

upon all purchasers and holders of said premises, their heirs,
executors, legal representatives, distributes, successors, and
assigns, to wit:
1. There shall be no further subdivislon of said premises, in
perpetuity.
2. The said premises described as the Open Space Easement on
the final map of NORTH BAYVIEWAS$OCIATES will forever he kept open
and free of all buildings and other struction$, including fences.
3. No' dumping or burning of refuse shall be permitted on the
said premises.
4. The natural resources and condition of the said premises
described as the Open Space ~asement shall remain undisturbed and
in its natural stat~, and to this end no top soil, sand, gravel,
rock or minerals shall be excavated or removed therefrom, no
grading shall be conducted on the said premises and no planting or
fill shai1 be placed upon the said premises, and nothing shall be
permitted to occur on the said premises which would contribute to
the erosion of the land, and no trees on the said premises shall be
cut or removed and no other plants or vegetation on the said
premises shall be destroyed or removed, except for the removal of
such dead, diseased or de~ayad trees or vegetation which may be
required for conservation or scenic purposes.
5. The Declarant reserves the right to the exclusive use of

person or persons from the use of said premises described as the
Open Space Easement on the final map of NORTH BAYVI~W ASSOCIATES
except that the Town of Southold shall have the right to inspect
the said premises described as the open space Easement on the final
map of NORTH BAYVI~WASSOCIATES for the purpose of assuring itself
that the covenants and agreements are not being violated, such
inspection to be at reasonable times and by mutual arrangement, if
~ossible.
6. Ail lots of the within Subdivision of NORTH BAYVIEW
ASSOCIATES shall use the common driveway. Lots $1 and $2 shall not
have separate access to North Bayview Road and shall have the right
to traverse Lots #3 and $4, within the area designated as the
common driveway. The owners of the lots in the within Subdivision
of NORTH BAYVIEW ASSOCIATES shall contribute equally for expenses
incident to the upkeep and maintenance of the paved area and the
common driveway.
a) Upkeep and maintenance shall include:
1) Repair of the paved areas;
2) snow plowing;
3) Removal of litter;
4) all other steps to maintain the roadway and
driveway in good passable condition.
b) The owner of Lot No. __ shall act as Managing Agent
and shall annually collect in June of each year, from each lot
owner in the subdivision an equal share of then anticipated costs

for the coming year, July 1st to June 30th, in connection with the
upkeep and maintenance of the roadway and c~mon driveway. If
sufficient funds are not available tO pay the costs then on 30 days
written notice to each lot owner an additional assessment may be
made to be collected within ~aid 30 day period~ Ail such
assessments shall be liens against a lot until paid in full.
c) In June of each year a majority of the lot owners
shall approve an upkeep and maintenance budget for the following
year. If the budget is arbitrarily rejected then the Managing
Agent shall have the right and power to enforce it by an action or
proceeding at law or in equity and the costs, including reasonable
attorneys fees, of such proceedings or action shall be borne by the
objecting lot owners.
d) In the event that any lot owner fails to make payment
within 30 days after written notice of non-payment has been given,
then the Managing Agent may commence an action or proceeding to
recover the sum due and all costs of collection including
reasonable attorneys fees shall be included in the amount
collected.
e) By acceptance of a deed each lot owner and his or her
Successors, assigns, heirs, distributees and legal representatives
covenant to be bound by all the terms and conditions of this upkeep
and maintenance agreement.
6. These covenants and restrictions, with the exception of
the requirement that there shall be no further subdivision in
perpetuity, can be modified only at ~he request of the then owner
of the premises wi~h the approval of a majority plus one of the

Whenever the Code calls for a public hearing, this section
shall apply. Upon detemining that an application is complete,
the board or commission reviewing the same shall fix a time
and place for a public hearing thereon. The board or commission
reviewing an application shall provide for the giving of notice:
A~ By causing a notice giving the time, date, place and
nature of the hearing to be published in the official
newspaper within the period prescribed by law.
B. By requiring the applicant to erect the sign provided by

In reviewing the bond estimate for the above four-lot subdivision there appear to be several
discrepancies. In reverse order (based on their dollar significance) the items in question are 13, 12,
10 and 9. We enclose a copy of the estimate and note the following:
13. Fire Well - This should be omitted since there is public water
running along North Bayview Road, and a hydrant is located at the
site.
12. Street Light - The cost ofasinglelight seems excessive and the applicant
questions whether there is a need for the light.
10. Topsoil and seed - The unit cost appears to be 50% higher than would be
anticipated.
9. Street trees - There are trees along the road, and, as suggested by the footnote,
this item should be eliminated.

Street lights.
The bond estimate includes two (2) street lights for the proposed
subdivision, with a notation that the street light line item could be
omitted with approval by the Planning Board.
The Planning Board is requiring the installation of one (1) street
light. The street light is to be located at the intersection of the
road proposed for the subdivision and North Bayview Road.
Street trees.
The bond estimate includes 40 street trees, with a notation that the
street tree line item could be omitted if clearing and grubbing of
the site allows for existing trees to remain in such a manner that is
acceptable to, and approved by, the Planning Board.
It is assumed that the 40 street trees included in the bond estimate
were calculated based on the length of the proposed road. The
Planning Board is not requiring the planting of street trees along
the proposed road. Rather, the Board has decided to require street
trees along North Bayview Road. The North Bayview Road street
trees are to be included in the bond estimate. However, as noted in
your original bond estimate, if sufficient existing trees remain in a
manner acceptable to the Planning Board, the Planning Board will
waive the street tree requirement.
Please revise the bond estimate as noted above. Thank you in advance for

Dear Mr. Cuddy:
Please note the following in regard to the above mentioned subdivision:
I reviewed the draft Declaration of Covenants and Restrictions dated
October 1, 1999. The following amendments are required:

The restriction that there is to be no further subdivision in
perpetuity, should be included within the general text of the
document, in addition to within Condition 6 which discusses
future modification to the document.
In regard to the common driveway, it should be noted that all
lots are to use the common driveway, and that Lots #1 and #2
shall not have separate access to North Bayview Road. In
addition, it should be noted that Lots #1 and #2 shall have the
right to traverse Lots #3 and #4, within the area designated as
the common driveway.
The subdivision has been designed with a designated building area
and an open space easement on each lot. Between each building area
and open space easement area, there is an additional area which is
not within the open space easement area. This area is not subject to
the Open Space Easement restrictions. The map must be amended so
that on Lot #2, the area between the building area and the Open
Space Easement Area is not within the 75' wetland buffer area.
As we discussed, it is not necessary to revise the map for this
minor change at this time. However, the change must be made prior
to the Planning Board granting any final approval to the subdivision.

The Final Road and Drainage Plans have been forwarded to the
Engineering Inspector for review. Upon acceptance, you will be
asked to prepare a bond estimate for the road and drainage
improvements.
The Planning Board has received a letter dated July 15, 1999, from
the Southold Fire Department noting that there is adequate fire
protection in the area. The Fire Department's decision is valid for
one year from the date of the letter.
Upon submission of the revised Declaration of Covenants and Restrictions
and the final subdivision maps with a stamp of Health Department
approval, the Planning Board will schedule the final public hearing.

THIS DECLARATION, made this day of October, 1999, by and
between NORTH BAYVIEW ASSOCIATES, a partnership having its
principal place of business at 56215 Main Road, Southold, New York
11971, hereinafter referred to as the DECLARANT:

WHEREAS, the Declarant is the owner in fee simple of certain
real property situate at Bayview, Town of Southold, County of
Suffolk, State of New York, known and designated on the Suffolk
County Tax Map as District 1000, Section 79.00, Block 08.00, Lot
012.000, and more particularly described on the annexed Schedule A,
and
WHEREAS, the for and in consideration of continuing the
subdivision approval the Planning Board of the Town of Southold has
deemed it to be for the best interests of the Town of Southold, the
owners and prospective owners of said lots that the within
covenants and restrictions be imposed on said lots, and that said
Planning Board has required that the within Declaration be recorded
in the Suffolk County Clerk's office, and
WHEREAS, the Declarant has considered the foregoing and has
determined that same will be in the best interests of the
Declarant and subsequent owners of said lots,
NOW, THEREFORE, THIS DECLARATION WITNESSETH:
That the Declarant for the purpose of carrying out the
intentions above expressed, does hereby make known, admit, publish,
covenant, and agree that the lots within said subdivision map shall
hereafter be subject to the following covenants and restrictions as
herein cited, which shall run with the land and shall be binding
upon all purchasers and holders of said premises, their heirs,
executors, legal representatives, distributes, successors, and
assigns, to wit:
1. The said premises described as the Open Space Easement on
the final map of NORTH BAYVIEW ASSOCIATES will forever be kept open
and free of all buildings and other structions, including fences.
2. No dumping or burning of refuse shall be permitted on the
said premises.
3. The natural resources and condition of the said premises
described as the Open Space Easement shall remain undisturbed and
in its natural state, and to this end no top soil, sand, gravel,
rock or minerals shall be excavated or removed therefrom, no
grading shall be conducted on the said premises and no planting or
fill shall be placed upon the said premises, and nothing shall be
permitted to occur on the said premises which would contribute to
the erosion of the land, and no trees on the said premises shall be
cut or removed and no other plants or vegetation on the said
premises shall be destroyed or removed, except for the removal of
such dead, diseased or decayed trees or vegetation which may be
required for conservation or scenic purposes.
4. The Declarant reserves the right ot the exclusive use of
the said premises described as the Open Space Easement on the final
map of NORTH BAYVIEW ASSOCIATES insofar as such use is not
inconsistent with the covenants and agreements hereinabove set
forth, and the Declarant may exclude the general public or any
person or persons from the use of said premises described as the
Open Space Easement on the final map of NORTH BAYVIEW ASSOCIATES
except that the Town of Southold shall have the right to inspect
the said premises described as the Open Space Easement on the final
map of NORTH BAYVIEW ASSOCIATES for the purpose of assuring itself
that the covenants and agreements are not being violated, such
inspection to be at reasonable times and by mutual arrangement, if
possible.
5. The owners of the lots in the within Subdivision of NORTH
BAYVIEW ASSOCIATES shall contribute equally for expenses incident
to the upkeep and maintenance of the paved area and the common
driveway.
a) Upkeep and maintenance shall include:
1) Repair of the paved areas;
2) Snow plowing;
3) Removal of litter;
4) all other steps to maintain the roadway and
driveway in good passable condition.
b) The owner of Lot No. __ shall act as Managing Agent
and shall annually collect in June of each year, from each lot
owner in the subdivision an equal share of then anticipated costs
for the coming year, July 1st to June 30th, in connection with the
upkeep and maintenance of the roadway and common driveway. If
sufficient funds are not available to pay the costs then on 30 days
written notice to each lot owner an additional assessment may be
made to be collected within said 30 day period. All such
assessments shall be liens against a lot until paid in full.
c) In June of each year a majority of the lot owners
shall approve an upkeep and maintenance budget for the following
year. If the budget is arbitrarily rejected then the Managing
Agent shall have the right and power to enforce it by an action or
proceeding at law or in equity and the costs, including reasonable
attorneys fees, of such proceedings or action shall be borne by the
objecting lot owners.
d) In the event that any lot owner fails to make payment
within 30 days after written notice of non-payment has been given,
then the Managing Agent may commence an action or proceeding to
recover the sum due and all costs of collection including
reasonable attorneys fees shall be included in the amount
collected.
e) By acceptance of a deed each lot owner and his or her
successors, assigns, heirs, distributees and legal representatives
covenant to be bound by all the terms and conditions of this upkeep
and maintenance agreement.
6. These covenants and restrictions, with the exception of
the requirement that there shall be no further subdivision in
perpetuity, can be modified only at the request of the then owner
of the premises with the approval of a majority plus one of the
Planning Board of the Town of Southold after a public hearing.

Reasons Supporting This Determination:
An Environmental Assessment Form has been submitted and reviewed,
and it was determined that no significant adverse effects to the
environment were likely to occur should the project be implemented
as planned.
The project has been designed so that there is at least a 75 foot setback from
the wetland area. In addition, the wetland area has been included in an Open
Space Easement to limit any impact.
The applicant will have to comply with the requirements of the Suffolk
County Sanitary Code (SCSC) and all relevant standards of water supply
and sewage disposal systems. Design and flow specification, subsurface
soil conditions and site plan details will have to be approved by the Suffolk
County Department of Health Services (SCDHS). This impact is not
considered significant due to the anticipated project compliance with
established requirements of the SCSC and the SCDHS and the required
relevant permits.

Dear Mr. Orlowski:
As requested, we have reviewed the Environmental Assessment Form (LEAF), Part I for the
above proposed subdivision. The project, as proposed, includes the subdivision of an
undeveloped 15.973 acre parcel into four single-family residential lots, all of which are assumed
to include a tennis court, pool and garage for the purpose of this review. The subject property
has been inspected and environmental references have been thoroughly researched. The LEAF
Part I was reviewed and amended as necessary. The LEAF Part II has been prepared by this
office. A synopsis of the project and an analysis of potential environmental issues are presented
below.
ENV1R. O?-IIV~NTAL AND PLANNING CONSI[)ER ATIONS
The project site is located on the south side of North Bayview Road, approximately 150' east of
Seawood Drive, Hamlet of Bayview, Town of Southold, County of Suffolk (SCTM No. 1000-
79-8-12). The property has 513.59 feet of road frontage along North Bayview Road and is
approximately 1,200 feet deep. The project site is currently vacant, and abuts a single-family
residential development to the west, agricultural and residential use to the south towards
Bayview Road and vacant land to the east and north. The site is currently wooded and contains
+/- ½ acre of freshwater wetlands in the form of a small pond in the northeast corner of the site
near North Bayview Avenue.
North Bayview Subdivision
EAF Part I Review
The Applicant is proposing to subdivide the 15.973 acre project site into four lots. The
subdivision has been designed as a clustered subdivision and includes an Open Space Easement
to include the wetland as well as perimeter buffering. The four lots are proposed to be
approximately 1.5 acres each.
The site is zoned Agricultural Conservation (A-C), which requires a minimum lot size of 80,000
square feet. The proposed building lots are in excess of the requirement and in fact the yield is
less than what could be achieved under a conforming yield map. According to the Planning
Board Resolution dated June 14, 1999, the Board allowed this project to be designed as a cluster
to provide for the preservation of open space. This Open Space Easement (OSE) will
permanently reduce the overall yield of the project site, as a Restriction will be placed on each
proposed lot prohibiting future subdivision. Further, the OSE will remain free of buildings or
any other structures. These will be enforced via Covenants and Restrictions placed on the deed.
Land use in this area is single family residential and vacant land. Zoning is residential,
predominantly A-C, and R-40 to the west on Seawood Drive.
The northeast portion of the project site includes a NYSDEC regulated Freshwater Wetland
(SO-43). The survey indicates that the land surrounding this wetland is sloped, however, the
elevations on the survey were not taken from the site, but are from Suffolk County topographic
maps. Therefore, the accuracy of this information is limited. The site inspection found
significant sloping of the land around the wetland. An official delineation of the wetland is not
indicated on the plan. The proposed access road and northeasterly building lot are situated
within 100 feet of the regulated wetland area. The proposed roadway includes a 15-foot grade
change according to the topographic features on the submitted plan. The applicant must request
a wetland delineation for this site. NYSDEC and Southold Town freshwater wetland permits
may be required for this project. A permit should not be needed if all disturbance occurs beyond
100 feet of the wetland delineation. The size of this site makes it possible to avoid disturbance to
the wetland. It is recommended that once the wetland is delineated, consideration should be
given to a project design which avoids impact to the wetland. To accomplish this, the access
roadway can be relocated westward curving around the 100-foot wetland buffer. Runoff from
the roadway should not be allowed to enter the wetland unless there is at least two (2) inches of
retention. The four building lots can be relocated southward, beyond 100 feet of the wetland
boundary. Such a plan would not reduce the OSE acreage, however, it would effectively protect
environmental resources. This could also avoid the necessity of obtaining a freshwater wetland
permit. If this mitigation alternative is not favored by the Applicant or Planning Board, the plan
as shown (subject to wetland delineation) provides the minimum mitigation of the wetland.
The LEAF Part I indicates that private wells are proposed for this subdivision. It is estimated
that this project will utilize approximately 1200 gallons of water per day. The location of these
well(s) have not been provided. All wells for potable water must meet SCDHS setback
requirements ora 150 foot separation between wells and sanitary systems. It appears as though
the lots are of adequate size to conform to these requirements. The subject site is located within
SCDHS Groundwater Management Zone IV which encompasses the North Fork, Shelter Island
and part of the South Fork. The Long Is'la~d Comprehensive Special Gro,ndwater Protection

AreaPlan (LIRPB, 1992) characterizes Zone IV as a shallow flow system. Portions of Zone IV
have been contaminated by agriculture, therefore, all proposed wells must be tested regularly.
The location of the wells and setback from the septic systems should be included on the plan and
will be required by the SCDHS. It is not anticipated that the proposed project will have a
significant impact on water supply resources. With the exception of the northeasterly portion of
the site, the site is relatively flat throughout. The entire site is vacant and mostly wooded. The
majority of the site is composed of Riverhead Sandy Loam (RdA 0-3% slopes, RdB 3-8%
slopes) which is well suited for housing. The area surrounding the wetland is composed of
Carver and Plymouth sands (CpE 15-35% slopes). These soils appear to be located within the
wetland buffer area. As previously indicated that development be relocated away from the
wetland and the sloped area surrounding it.
All sanitary disposal in the vicinity of the site is currently managed by on-site underground
septic systems. The plans submitted by the applicant do not provide details on the septic
systems. Based on the elevation of the wetland and topographic features provided on the survey,
it is estimated that the water table is approximately 10-15 feet below grade in the vicinity of the
proposed houses. Based upon this data, it appears that adequate depth is provided for all septic
systems to meet SCDHS requirements. However, the board should require, the applicant to
provide details on the location of the septic systems. The SCDHS must review and approve all
plans for the septic system and water supply.
The subject site is located within SCDHS Groundwater Management Zone IV which, according
to SCSC Article VI, has an allowable flow rate of 600 gallons per day (gpd) per acre. Therefore,
the allowable nitrogen bearing flow for the site is 9,582 gpd. The sanitary design flow is
computed using the SCDHS manual Stattdard~' fi~r Approval of Plans and Constrttction for
Sewage Disposal Systems for other thatt Single Family Residences. The manual establishes a
design flow for single family houses of 300 gpd per housing unit. Therefore, a flow of 1,200 gpd
can be expected from this project. No adverse impact is anticipated on groundwater resources as
a result of this proposed subdivision.
SUlvlMARY
The use of OSE's and a cluster design is well suited to this project location. These planning
techniques should make it possible to implement this project and limit any impact to the
freshwater wetland on the site. To accomplish this it is necessary for the applicant to have the
wetland delineated. Once delineated, it is recommended that consideration should be given to a
project design to provide a 100-foot buffer around the wetland system. By relocating the access
road slightly to the west and meandering it around the wetland, an access road with added
character and reduced environmental impacts could be constructed. Further, it is recommended
that the cluster development be relocated southward to allow the 100 foot buffer on the southern
portion of the wetland. If these recommendations are followed the project would be located
beyond jurisdiction of Article 24 of the NYS Environmental Conservation Law.

It is also recommended that the applicant provide additional details with regard to the location of
the private wells and septic systems. With these issues addressed, it is our opinion that the
required "hard look" has been taken with regard to the potential environmental impacts of this

Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project
or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent-
Iy, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine
significance may have little or no formal knowledge of the environment or may be technically expert in environmental
analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting
the question of significance.

The Suffolk County Department of Health Services (SCDHS; "Department") has
received your letter dated June 15, 1999 concerning the above-referenced project. The
Department has no objection to your designation as lead agency.
Based on a review of the subject coordination, the Department offers the following
comments. However, the Department wishes to reserve its right to provide more
detailed information within the comment period(s) established for this action. These
comments should not be construed as an implicit SCDHS approval or rejection of the
project. All applications are reviewed thoroughly with respect to Suffolk County
Sanitary Code concerns by appropriate departmental personnel when SCDHS

1. SANITARY CODE
A. Article VI Application Status:
Our agency has not received an application for the above referenced project as
required by Article VI of the Suffolk County Sanitary Code. The project sponsor should
submit an application to our agency's Bureau of Water and Wastewater at the earliest
possible date so that a complete technical assessment of this proposal can be
undertaken.
The applicants must comply with the requirements of the Suffolk County Sanitary

DIVISION OF ENVIRONMENTAL QUALITY
COUNTY CENTER
Code and relevant construction standards for water supply and sewage disposal.

B. SCDHS lurisdiction
The SCDHS maintains jurisdiction over the final location of sewage disposal and
water supply systems. The applicant, therefore, should not undertake the construction
of either system without Health Department approval. Design and flow specifications,
subsurface soil conditions, and complete site plan details are essential to the review of
this project. These considerations are reviewed completely at the time of SCDHS
application.

The following resolutions were adopted by the Southold Town Planning Board at
a meeting held on Monday, June 14, 1999:
WHEREAS, the proposed minor subdivision is for 4 lots on 15.9730 acres; and
WHEREAS, the Planning Board has allowed the subdivision to be designed with
an Open Space Easement on each lot, rather than requiring that the subdivision
be designed as a clustered subdivision; and
WHEREAS, the Planning Board has allowed the subdivision to be designed in
this manner since the Open Space Easements provide for the preservation of
open space, while providing a buffer to the adjacent properties and North
Bayview Road; the overall yield has been reduced; and, a restriction will be
placed on each lot prohibiting any future subdivision in perpetuity; be it therefore
RESOLVED that the Southold Town Planning Board grant sketch approval on
the map dated May 21, 1999 with the following conditions:
All lots within the subdivision shall be subject to a covenant prohibiting
any further subdivision in perpetuity.

The Open Space Easements shall be forever kept open and free of all
buildings and other structures, including fences. The Open Space
Easements shall remain undisturbed and no grading shall be conducted
on said premises.
The specific terms of the Open Space Easement shall be described in a
Declaration of Covenants and Restrictions, an example of which is
attached.
The sketch plan has been referred to the Town Trustees for review of the
wetland area. Sketch approval is subject to verification of the wetland
area by the Trustees.
BE IT FURTHER RESOLVED, that the Southold Town Planning Board start the
lead agency coordination process on this unlisted action.
Sketch plan approval is conditional upon submission of final maps within six
months of the date of sketch approval, unless an extension of time is requested
by the applicant, and granted by the Planning Board. The final maps, six (6)
paper prints and two (2) mylars must contain a current stamp of Health
Department approval and must be submitted before a final public hearing will be
set.
The Planning Board has reviewed the property and has decided that it is
inadequate in size for a reservation of land for park and playground use.
Therefore, a cash payment in lieu of land reservation will be required as per
Section A106-38(e) of the Town Code The amount to be deposited with the
Town Board shall be $8000.00. (two thousand dollars per vacant lot in the
subdivision). Payment is required prior to any final endorsement of the
subdivision.
The following information must be submitted for the Planning Board's review:
The final subdivision maps must be revised as follows:
A. The acreage of the wetland area must be indicated.
A 75' buffer area has been indicated adjacent to the wetland area.
A small part of the building area of Lot #2 is within the 75' buffer
area. All of the wetland buffer area should be located within the
Open Space Easement for Lot #2.

The line between the Open Space Easement and the building area
on each lot should be delineated with a line other than a solid line.
Road and drainage plans must be submitted as soon as possible for

A draft Declaration of Covenants and Restrictions must be submitted. The
Declaration must include the conditions mentioned in the sketch approval
and the terms for road management and use. In addition, the typical terms
for modification and enforcement must be included in the document.

As you know, the Planning Board reviewed the above mentioned proposed
subdivision at the April 5th Planning Board work session, at which you
were in attendance. The following information must be submitted in order
for the Planning Board to proceed with review of the proposal:
All information listed in Section A106-40 of the Subdivision
Regulations, must be shown on the sketch map. Most of the required
information is shown. However, there are a few items missing. Please
refer to the above noted section in regard to the missing items.
The wetland area must be shown as such. In addition, a 75' wetland
buffer must be shown.

The proposal submitted shows a common driveway providing access to
the four (4) proposed lots. As per Section A108-15 of the Highway
Specifications, a 16' wide stone blend road (Drawing Number 15-4) is
required.
A Drainage Waiver form was submitted with the application. This
form is being returned to you since road improvements will be
required.
An approximately 10' wide r-o-w is shown from North Bayview Road
to the south side of the subject property. Please indicate if this
r-o-w is indicated in the deed, if it is to be extinguished, etc.

The proposal submitted shows the front yard setbacks as 50 feet.
The A-C zone requires a front yard setback of 60 feet.
In order to complete the application the following information is
necessary:
A. The deed for the property must be submitted.
B. Since the application was submitted by a contract vendee,
authorization from the owner(s) of the property must be
submitted for the contract vendee to proceed with the
subdivision.
The Planning Board will be referring the Long Environmental
Assessment Form to the Board's Environmental Consultant for review.
A $400.00 review fee is required.
Upon submission of the above mentioned information, the proposal will be
referred to the Board of Trustees for review of the wetland area. In
addition, the Planning Board will initiate the environmental review and
will schedule the proposal for a sketch plan determination.

In accordance with my discussion I am enclosing the print of the
Cove Beach subdivision Map which has been amended by Young & Young
to reflect an easement extending from the end of the cul-de-sac to
the subdivided lots formerly owned by Russell and Uhl. This
permits access to those lots. However, the Board should also be
aware that two of these lots have been included in the conservation
easement area deeded to the Peconic Land Trust by Mr. Witteveen.
Therefore there will be limited development at this site. This new
easement is intended to replace the existing easement which ran
north and south through the center of the Cove Beach parcel.
