RESOLVED: WN~AS: Leeward Acres at Bayview, Inc., Hilltop
Road, Southampton, New York, has petitioned the Southold Town
Plamning Board for final approval of their subdivision "Leeward
A~res at Bayview", located at S/S North Bayview Road & E~S
Jacob's Lane, Southold, New York, and
WHEREAS: The Superintendent of Highways has approved the
lay-out of the roads, and the Planning Board accepts his report,
and
WHEREAS: The Southold Town Board will accept ~ bond in the
amount of $58,000.00 for the roads and other improvements in this
subdivision,
NOW, THEREFORE BE IT RESOLVED: that the Southold Town Planning
Board grant final approval to the subdivision known as "Leeward
Acres at Bayview", subject to the following conditions:
1. Receipt of notice from the Southold Town Board that they
have received and accepted a bond for this subdivision.
2. Developer presenting the Planning Board with subdivision
fee of $2,655.00.
This motion shall include authorization for the Chairman
to sign final maps upon receipt of notice from the Town Board,
and receipt of subdivision fee from the developer.
Vote of the Board: Ayes;-Messrs: Wickham, Moisa,1Raynor,
Coyle, Grebe.
The Planning Board inspected the large scale colored Master
Plan Map prepared for us by the County. It was decided that this
map should be displayed at the next "Information Meeting,"
The Planning Board discussed the date for the next Information
Meeting on the Mas. tot Plan. It was tentatively agreed ~that it should
be held on either March ~ra, 4th, or 5th, preferably the 5th, at the
Southold High School. MOward Terry to call Southold High School to
find out which date will be available to us.

~ng do computations to present to Larry Tuthill for bond estimate,
~putations to show more detail on dikes and drainage plans.
January 12, 1970 preliminary approval was granted to the lay-out
Ubject to revision of drainage.
On February 25, 1970 revised maps showing drainage plans were presented°
Larry Tuthill stated that the drainage was inadequa%e, he was to discuss
it with Alden Young and agreement to be reached between them.
On February 26, 1970, the Planning Board sent letter or transmittal to
the Health Dept. recommending that they grant approval to this subdivision.
On March 24, 1970, it was reported that this subdivision was pending
review by the County Board of Health, Appeals Board.
On Septem~br 29, 1970, the Planning Board was advised that the Health
Dept. had disapproved this subdivision with 20,000sq. ft. lots. Revised
maps, showing lots of 40,000sq. ft. were presented at the Planning Board
meeting on Sept. 29, 1970. Preliminary approval was granted to the revised
maps at this meeting, for the lay-out and park & playground area .

have a letter from the Superintendent of Highways
stating that the highways are in compliance, a copy
of which is attached.

report dated December 28, 1971. We feel that this
should be followed up in some way. Please advise.

above subdivision have been fully completed to the specifications
and requirements of the Southold Town Highway Department.
In the circumstances, we should request that you treat this

posit books placed in trust for the purpose of securing road
performance requirements.
We have discussed this matter with Raymond Dean, Highway

Dear Sir:
In response to a request froze Mr. ~ichard Cron for
a partial release of the bond covering the subject project,
I inspected the promises today together with you. The following
report of our observations is submitted herewith:
The road sections have not yet been oiled and covered
with bluestone chips, as required by Section 12 of Specifications.
All other specifications, including road bed, stabilizing, oiling
and sanding, curbs, shoulder seeding and drainage installation
details have been complied with in a satisfactory manner.
The following items are noted;
The dead end at the easterly end of Leeward Drive
shall be provided with ~ guard rail and sign to be
installed as required by Section 8 of Specifications.
The bounds of %he highways shall be monumented to
conform with thexequ~r~en~s of Section 3 o~' Speci-
fications.
It is reeo~aended that before the bond is completely
released the leaching pools be cleaned and the drain-
age pipes be flushed to remove the accumulated,eroded
material incident to the road construction before the
shoulders were seeded.

AGREEMENT by and between LEEWARD ACRES AT BAYVIEW, INC.,
a domestic corporation with principal offices at Mattituck,
New York, hereinafter referred to as developer, and ROBERT
CASOLA, LORINDA CASOLA and MAURICE CASOLA, all of Southampton,
New York, hereinafter referred to as depositors, and the
PLANNING BOARD OF THE TOWN OF SOUTHOLD, hereinafter referred to
as the Town.
W IT N E S S E TH:
WHEREAS the Town has approved a certain subdivision plat of
the developer to be known as LEEWARD ACRES AT BAYVIEW, INC., and
WHEREAS the Town requires certain improvements to be con-
structed, more specifically roads,
to the Town, and
WHEREAS the Town has estimated
which will later be dedicated
the cost of said improvements
to be in the sum of Fifty-eight Thousand ($58,000.00) Dollars, an
WHEREAS the developer and the depositors in lieu of posting
a performance bond in said amount will deposit cash in the sum of
Fifty-nine Thousand Five Hundred Four and 39/100 ($59,504.39)
Dollars in the form of a savings bank, interest bearing accounts
~with the Town, and
WHEREAS the parties hereto wish to guarantee the faithful
performance of the agreement to complete said improvements,
NOW, in consideration of the covenants, declarations and
mutual promises herein, the parties agree as follows:
1. That the Town agrees to accept a cash deposit of Fifty-
nine Thousand Five Hundred Four and 39/100 ($59~504.30) Dollars
in the form of interest bearing accoun~ from a lending institu~on

said accounts to be held by the Town as security in lieu of a
performance bond on the faithful performance of construction and
completion of the roads of the subdivision of LEEWARD ACRES AT
BAYVIEW, INC., as prepared by Alden W. Young, P.E, & L.B., in
accordance with the plan of subdivision heretofore prepared and
filed with the said Town.
2. That the developer and depositors covenant and agree to
place said accounts as hereinbefore stated, with the Town, and
covenant further that no withdrawals ~om said accounts will be
made until release of said accounts by the Town and upon the
satisfactory completion of the said improvements as hereinbefore
described.
3. That the parties hereto agree that the said improvements
shall be completed on or before three (3) years from the date
hereof.
4. That in the event the

standing shall prohibit the developer and the depositors from
petitioning the Town to release part or portions of the accounts
on deposit from time to time, in accordance with the Town Law of
the State of New York.

Dear Mr. Born;
Please be advised that the Planning Board, in discussing the map
which you presented at our last meeting of November 23, 1970 and as
approved by the County Board of Health, feels that this lay-out is in
most ways inferior to the one which we approved prior to January 1, 1970.
Nevertheless, even though it does not meet our requirements as outlined
to you, we feel that there are some relatively minor changes which would
make it acceptable to the Planning Board.
Spefically, the Planning Board has indicated that it would approve
your map as submitted on November 23, 1970 subject to the following
changes:
1. The park area be left in a natural state of trees, brush, and
fresh water bog, without creating a pond as indicated on your map. This
would leave the park area in basically a wild condition and obviously
would fulfill our requirements as to land area.
2. Provide 10 feet adjacent to Jacob's Lane, the entire length of
Jacob's Lane on your map for "possible dedication to the Town of Southold
for road widening. This to be indicated on the map by a dotted line and
lettered in the area as such.
3. Since your engineer did not provide for a walk way in the super
block as shown on your map, a 10 ft. walk way will be required, it should
be paved at a width of 5 feet, and it should be located between lots 10
& 11, and between lots 35 & 36. we believe that this will create no
undue hardship and require little adjustment in lot lines.
The Planning Board has indicated that they will approve this
subdivision for a hearing upon receipt of map with the above changes.

BIGHWAY SPECIFICATIONS
November, 1968
HIGHWAY SPECIFICATIONS
TOWN OF SOUTHOLD
Any person or persons desirous of dedicating land for town highway purposes shall be re-
quired to file four (4) prints of the proposed layout of such highway with the Planning Board of the
Town of Southold. The Planning Board shall examine such prints and prepare a ~vrittcn report
thereon, containing its recommendations concerning the proposed layout, and file the same with the
Southold Town Board and one copy to the Superintendent of Highways, together with one print of
the proposed layout. The Planning Board shall retain one print for its files and shall return one print
to the applicant. Thereafter, the Town Board shall approve or disapprove such layout and so advise
the Planning Board and the applicant.
After such proposed layout has been approved by the Southold Town Board, the following
specifications shall be complied with: --
1. Any person or persons desiring to dedicate real estate to the Town of Southold for highway
purposes must execute and submit to the Town Board the following: --
a. A duly acknowledged dedication and release, together with the required County Clerk's
recording fees.
b. Proposed consent to the Town Board.
c. Proposed order of the Superintendent.
d. A survey map of the property which shall show the actual location of the highway area
within the highway right-of-way.
e. An attorney's certificate of title and an abstract of title certified to the Town Board by
an attorney or a 2,000. title policy issued in the name of the Town of Southold.
f. A bargain and sale deed with covenant against grantor's acts in the proper form for re-
cording in the County Clerk's Office.
The foregoing six documents shall be fastened together in one folder and the dedication and
release shall include the signatures of all fee o~vners, easement owners, mortgages and so forth, and
the attorney's certificate shall certify to such.
2. All highways, accepted by the Town as Town Highxvays must be at least fifty (50) feet in
~-idth; such width shall hereinafter be known as the bounds of the highway.
3. All proposed highways shall be properly surveyed, monumented with concrete monuments
on all points, curves and intersections. All roads shall be laid out in a "station mark" system showing
elevations, percentage of grade distances betxveen station marks, all drainage pipes, drainage struc-
tures, recharge basins, etc. to be clearly shown on both map and profile map of each road. All profile
maps to be on a large scale, clearly and legibly printed with not more than one (1) road on one page
or sheet. Name of highway, name of all adjacent owners, if any, drainage rights of way or leaching'
areas, width and length of highway, scale of map shall not be more than 1" to 200'. An additional
survey map of the property other than the one in the folder shall also be submitted.
4. All highways terminating at tidewater slmll have a ~vidth of not less than I00 feet back from
the mean high water mark. All highways on water front property must have the same access to the
water as above required. Each dead-end shall have a stop sign on a 10 foot steel U type sign post.
5. All dead-end highways must have a width of not Iess than 100 feet for a distance of 100 feet
back from the dead end to provide for a turn-around, all of which must be free of trees, bushes, and
stumps. A guard rail shall be installed along the entire dead-end line. Such guard rail shall be of gal-
vanized steel (flex-beam type) 18M2 inches in width mounted on 6" x 6" x 4' posts dipped in creosote
to a depth of 30" and placed in the ground to a depth of 30". A standard stop sign shall be placed
in the center of the dead-end in the rear of the guard rail.
6. The name of such highway may be proposed by the owner or owners of property dedicating
such highways but the name of such high~vay shall be subject to the approval of the Town Board.
7. A width of 36 feet shall be hereinafter known as the highway area from which all trees,
brush, rocks, stumps and other obstructions shall be thoroughly cleared and all such material shall be
removed from the bounds of the highway, the remaining distance from the curb line to the property
line, shall be raked and seeded.
8. The portion known as the high~vay area shall be plowed, disc-harrowed, rolled and graded
to a uniform surface to the longitudinal grade as shown on the final map.
9. Six inches of Bank Run Base Material ~vith a gravel content of 20% or more will be install-
ed below the finished grade of the road section if the existing material is not satisfactory, and shall
be free of all vegetable matter.
10. Where cuts and fills are necessary in order to bring the highway to the proper grade and
cross sections, the cut or fill shall meet the abutting surface with a 1 on 2 slope. Where the slope
or fill extends beyond the fifty feet, the necessary- releases, easements or deeds must be obtained
[toni the property owner or oxvners.
11. Concrete curbs, ~vhen deemed necessary hy the Superintendent of Highways, storm servers,
leaching basins, leaching areas and gutters, shall be installed in accordance with the requirements aml
under the supervision of the Superintendent of Highways. When leaching basins and gutters are re-
quired, the same shall be constructed as follows:
a. Leaching basins: Only inset type basins shall be used. All basins within fifty (50) feet of
each other shall be connected to each other with eighteen (18) inch corrugated pipe, or 14 inch
asbestos cement pipe.
b. Concrete curbs: Curbs shall be installed on ail streets within the subdivision or develop-
ment. All intersections shall have a curve with a radius of not less than twelve (12) feet. The distance
between curb faces on both sides of the highway shall be 36 feet. Curbs shall be 6 inches wide, 16
inches deep, 6 inches above road surfaces.
c. Full length concrete curb on both sides of all roads are required unless ~vaived by the
Superintendent of Highways and the Planning Board. Integral curb and gutter shall be installed at
all intersections for at least ten (10) feet each side of the curve and at least ten (10) feet each side
of a drainage inlet structure intake. Integral curb and gutter on both sides of any road having a
grade of 5% or more.
12. After the highway area has been properly graded, rolled, and shaped to the approval of the
Superintendent of Highways, the thirty-six (36) foot section in the center of the highway area (here-
inafter referred to as the "road section") shall be stabilized with an application o~ three (3) gallons
of MC-250 (bituminous cut-back) per square yard mixed to a depth of (6) inches in two (2) separate
applications. Within two (2) months and not less than one (1) month after stabilization, the road
section shall be rolled and properly prepared and an application of one-half (1/'2) gallon of RC-250
(bituminous cut hack) per square yard shall be applied with sufficient sand to absorb the excess oil.
In case of dry weather, the sub-grade shall be wet-down before the application of oil. Before the
highway is accepted by the Town of Southold, the Superintendent of Highways shall examine the
same and thereafter a final application of .3 gallons of RC-250 (bitnminous cut back) per square
yard, shall be appIied and shall be covered with three eighths (3/8) inch blue stone, which shall be
roiled with a roller having a minimum weight of (5) tons. Where curbs are installed, the road section
shall be deemed to be the entire area within the curbs.
13. On both sides of the oiled surface or road section of the highway area, there shall be a six
(6) foot shoulder which shall be graded and free from all trees, brush, rocks, stumps, and other ob-
structions, and raked and seeded.
14. Before any highway shali be accepted by the Town of Southold, as a town highway by
dedication, the assessed value of the buildings and structures on the land on both sides of such high-
way (as shown on the current tax roil of the Town of Southold) shall have an assessed vaiue of not
less than forty thousand ($40,000.00) dollars per miIe proportioned at that rate if more or less than
a mile.
15. Where it is necessary to have a drainage area located beyond the fifty (50) foot bounds
of the highway, fee title to such area shall be conveyed to the Town of Southold, together with the
necessary land to connect such area to the bounds of the highway. Corrugated pipe having a mini-
mum diameter of eighteen (18) inches extending from the drainage area to the bounds of the highway
shall be installed with clean out boxes at 150 foot intervals.
16. Sidewalks shall be standard font foot in xvidth, four inches thick, except in driveways
where they must be not less than six inches thick. All curbs and gutters to be built to standard forms
as may be directed by the Superlntedent of High~vays. On existing Town Highways the Town will
furnish the necessary engineering, grading, fill and labor; the property owner or o~vners shall furnish
the necessary ready mixed concrete and shall deliver such concrete to the site as directed by the
Superintendent of Highways. The amount of sidewalk construction throughout the Town shalI be
determined by the Town Board.
17. Whenever in the opinion of the Superintendent of Highways he feels that for the best in-
terest of the Town, alterations or modifications should be made to the above specifications, rules and
regulations, such alterations or modifications may be made on the recommendation of the Super-
indent of Highways to and with the approval of the Town Board.
18. These specifications shall be effective on and after November 7, 1968.
