restrictions hereinafter set forth, and that every purchaser of
said premises so purchased shall be held subject to the covenants,

Purpose: Th~ full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a proiect
or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent-
ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine
significance may have little or no formal knowledge of the env ronment or may he technica[IY~a~e~t,-in,~,~ironmental
analysis. In addition, many who have knowledge in one particular area may not be aware of the I~]~c~ ~)r~L~s affecting
the question of significance.
The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination
process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit a project or action.
· Full EAF Components: The full EAF is comprised of three parts:
Part 1: Provides objective data and information about a given project and its site. By identifying basic project
data, it assists a reviewer in the analysis that takes place in Parts 2 and 3.
Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides
guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially-
large impact. The form also identifies whether an impact can be mitigated or reduced.
Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the
impact is actually important.

to order. First order of business is public hearings, final
subdivisions. 7:30 p.m. Donald Osani - This subdivision is
for two lots on 68,604 square feet located at the northwest
corner of North Bayview Road and Reydon Drive in Southold.
SCTM ~ 1000-79-5-10 & 11. We have proof of publication in the
local papers and at this time everything is in order for a final
hearing. I'll ask if there are any objections to this
subdivision? Hearing none, are there any endorsements of this
subdivision? Hearing none, is there anyone out there neither
pro nor con but may have information pertaining to this
subdivision that would be of interest to the Board? Hearing
none, any questions from the Board?

Asper the your request we have completed a preliminary review of the above
referenced project. Tasks and completed activities are identified as follows:
Review Part I LEAF
The parcel has been field inspected by CVPh and the LEAF has been reviewed and
amended as necessary. A copy of same is attached.
Prepare Part II LEAF
The Part II LEAF checklist has been completed and is also attached. Additional
information concerning our findings is included below.
Advise as Necessary
The parcel has been inspected and environmental references concerning the site and
area have been consulted. Overall, we find the site to be a mixture of bracken, shrubs
and first, growth trees, voth older, mature trees ~nternnttantly bordenng Reyso Road
on the east side of the parcel. The appearance of the site and the vegetation
contained on it indicate that the site was probably cleared at one point; this is the
reason that briar and other low-growing species have been able toproliferate. Along
the eastern border there is a minor depression that extends about 50', but no
vegetation or soil type indicates that this is a wet area; it is most probably due to
settlinn afte~ the road was originally graded. Directly east of the site and across
Revso~ Road is vacant land of the same character as the parcel. Adjoining the site on
the'north and west boundaries are two single family residences that are ranch style
homes. Directly to the south across Bayview Road is another such residence. Due to
the fact that the local community is rural in nature, the local wildlife probably utilizes
the site for fond and forage during the fall and winter months.
The proposed minor subdivision would be in keeping with the present local lan~ use.
Although the homes will be set on slightly smaller parcels, they conform to the Fowns'
provisions for setbacks, etc., under the conditions of the issuedvariance, which shoukl
be incorporated into the Planning Board approval. We would also recommend that
s~me of the larger trees along Reynor Road be left und'~sturbed so as to provide a
natural road buffer and to preserve the present character of the site.

Long EAF Review
It is .noted that the proposed lot sizes will not conform to SCDHS lot size
requirements established pursuant to Article 6 of the Suffolk County Sanitary Code;
however, the non-conformity is not expected to alter the recommendation for a
Determination of Signficance as to whether an En.vi.'ronmental Impact Statement
should be required. It is re. commended that land division approval be held until a
Board of Review variance ~s secured from the Health Department.
A~. a result of our review and field investigation, we recommend a Negative
Declaration based upon this review and the reasons outlined in the accompaning LEAF.
If there is any further information that the Board requires in order to make a final
determination, we would be happy to supply any other details deemed neccessary. Please do

BRUDERMANN, JR.). Variance to the Zoning Ordinance, Article

ACTION OF THE BOARD OF APPEALS
Upon Application of DONALD L. OSANI (Owner: GEORGE
BRUDERMANN, JR.). Variance to the Zoning Ordinance, Article
IIIA, Section 100-30A.3 for approval of re-separation into two
separate parcels as shown by separate deed conveyances, each lot
having insufficient area and proposed construction to meet
setback requirements for this R-40 Zone District. Location of
property: North Side of Bayview Road and the West Side of
Reydon Drive, Sothold, NY; County Tax Map Parcel Nos.
1000-79-5-10 and 11.
WHEREAS, a public hearing was held on November 1, 1990
and all those who desired to be heard were heard and their
testimony recorded; and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question is located in the "Low-Density
Residential R-40" Zone District and is referred to as District

The following is in response to your request of September 20,
1990 for comments on:

grant of this variance; (c) there will be no substantial
change in the character of the neighborhood, and a precedent
would not be set since adjoining properties have not been hel4
in single and separate ownership at any time since the enactment
of zoning in 1957 {except as an entire tract of 65,000+- squaze
feet); (d) that on May 1, 1986, two lots immediately north of
the subject premises were subdivided from 2.5 acres into two 1.2
+- acre lots, which may not be further divided; (e) the
difficulties cannot be obviated by some method feasible to t~e
appellant to pursue, other than a variance; (f) that in view
of the manner in which the difficulties arose, and in con-
sidering all the above factors, the interests of justice will be
served by granting the variance, as conditionally noted below.
Accordingly, on motion by Mr. Goehringer, seconded by
Mr. Doyen, it was

1000, Section 079, Block 05, Lots 010 and 011 on the Suffolk
County Tax Maps, with frontage along the westerly side of Reydon
Drive, Southold and frontage along the north side of North
Bayview Road.
2. The subject premises as exists:
ft;
(a) contains a total combined lot area of 68,604 sq.
(b) was conveyed by separate deeds to George
Brudermann, Jr. as follows: (1) County Tax Map Lot No. 10 was
conveyed on May 4, 1959 by deed at Liber 4623 cp 325 from
Dorothy W. Brudermann and Joseph A. Brudermann; (2) County Tax
Map Lot No. 11 was conveyed on July 12, 1978 by deed at Liber
8462 cp 298 from George H. Brudermann;
(c) the minimum lot area requirement in effect during
the 1978 conveyance and merger due to common ownership was
40,000 sq. ft. per lot, and which increased in 1983 to require a
minimum lot area of 80,000 sq. ft. per lot;.
3. Article IIIA, Section 100-30A.3 of the current zoning
code (as amended January 9, 1989) requires a minimum lot area
per lot of 40,000 square feet.
4. The relief sought by this application is a variance for
approval of:
(a) proposed southerly {vacant} lot referred to
herein as Lot #1 with a lot area of 33,607 sq. ft. and lot width
of 219.85 feet along Bayview Road;
(b) proposed northerly {vacant} lot referred to
herein as Lot #2 with a lot area of 34,997 sq. ft. and lot width
of 150 feet.
5. For the record, it is noted that the area of the lots as
proposed are not out of character with those existing in the
immediate and general neighborhood. These lots meet at least
80% of the zoning requirements.
6. In considering this application, the Board also finds
and determines: (a) the relief as granted is not substantial
in relation to the requirements; (b) the evidence submitted
and practical difficulties claimed are sufficient to warrant a
