Orlowski , Mr. Steven Fuchs of 4 Knolltop Road, Stony Brook and myself are contract vendee for the above referenced subdivision. I would like at this time to reactivate the file for final approval . This project received conditional final approval on July 14, 1980 which has since expired. On April 1 , 1988 a memo was written by Town Attorney James Schondebare outlining the requirements and procedures for refiling for final approval . Please find attached our check for $2188 . 55 as refiling fee. ( 33 .771 acres x$50. 00 + $500 . 00) This was computed from the formula used for August Acres (SCTM #1000-53-4-44 .4) of $500 +$50 per acre. We will be submitting the plat in its final form after minor revisions to take into account revisions to the road specifications and to design a more sensitive buffer to the northern portion of the property . I would hope to meet with staff to discuss these changes prior to resubmission. We have met with the Utility comittee of the Village of Greenport to supply public water to this project . Proposed Major subdivision SCTM #1000-79-2-7 Dear Mr. Nemiroff: As stated in our correspondence to you on May 12, 1988, the above mentioned subdivision is not considered an active file at this point in time. In order to re-activate this subdivsion a new final .application must be submitted. As is the Planning Board' s policy the fee that must accompany this application is half that which is currently asked for a major subdivison. Upon submission of a new application and fee, the Planning Board will proceed with their review of the final maps. One condition that must be met before the Planning Board will grant final approval is that the terms of the water contract with the Greenport Utility Company must be met to the Village' s satisfaction. Other than the water contract, this subdivision will also have to go through the Planning Board' s subdivision review process, which will also include going through the State Environmental Quality Review Act. The subdivision received preliminary approval with conditions on February 13 , 1979. Conditional final approval was granted on July 14, 1980. However, that approval expired one hundred and eighty (180) days after that date. A new final application must be submitted and final approval must be obtained before this proposed map can be filed. The issue is important since each of the three subdivisions are one acre lots. Section A106-24 F ( 2) of the Town Code and Section 276 ( 4) of the Town law states: "Conditional approval of a final plat shall expire within one hundred eighty ( 180) days of the date of the resolution granting conditional approval unless such requirements have been certified as completed" In the three subdivisions we discussed, the conditions were never met and the 180 days expired years ago. The question presented is whether or not with the loss of final approval does the applicant have to start from square one with the result that he has lost the one acre and now must file anew under 2 acre, or does the applicant need only file again with the Planning Board for final approval and have a hearing on same. You will note that each stage of the subdivision procedure is separate and distinct , each with its own time frame. After approval for the preliminary plat, the owner must submit the plat in final form to the Board within six months of the approval. (Section A106-23E( 4) . If this is not done then the preliminary approval may be revoked. However, once this is done then the preliminary approval cannot be revoked. Hence, if the applicant can not lose his preliminary approval, provided he filed the plat in final form, then can he still lose the preliminary approval because his final approval was conditional and he lost it after 180 days? I think not. However, the Board need not rubber stamp the three subdivisions at the time of a new final hearing since under A106-24F ( 1) you have the power to conditionally approve, conditionally approve with or without modification, disapprove or grant final approval. Also, you must consider SEQRA since, I believe , the three subdivisions were prior to the act. If this is so then final approval would be considered an "action" triggering SEQRA. Bruer, your input is requested. First, I advised the potential buyer of this subdivision, Larry Zimmerman, that one acre zoning still applied to this property as per Robert Tasker's letter to the Planning Board (August 12,1986) . I also told him he had to apply for preliminary as well as final approval. Mr. Nemiroff's letter is a request for written confirmation of the one acre zoning. Question; should Planning Board send letter or should we repeat past actions and send a letter from the current Town Attorney? Second, Mr. Bruer's letter poses a stickier question, inasmuch as the subdivision is not considered active and ongoing judging from the file. Again, should the Planning Board respond to the letter regarding inactive status of file at a public meeting? I am not comfortable with sending out a Town Attorney's memorand& —My experience elsewhere has beEhthat such correspondence was for the staff file; and not to be used as a substitute for a letter. You have asked my opinion on two questions, to wit: (1) Does the one acre requirement of the Zoning Code apply to this subdivision? (2) What procedure should be followed to reactivate this dormant subdivision? In answer to the first question, Section 100-31B(3) of the Zoning Code provides that one acre zoning (column A-40 of the Bulk Schedule) shall apply to "all lots shown on major subdivision maps upon which the Planning Board has held a hearing for preliminary map approval prior to May 20, 1983." From the documents submitted with your letter, it appears that the Planning Board held a hearing for preliminary map approval of this subdivision on January 9, 1979, and accordingly it is my opinion that the one acre zoning requirement applies to this subdivision. With respect to the second question, i.e. the procedure to be followed, I have the following comments. On July 14, 1980, the Planning Board adopted a resolution granting conditional final approval of the subject Plat, subject, however, to (1) the receipt of the report of the Highway Superintendent; (2) receipt of the bond for improvements; (3) receipt of the inspection fee by the Town Clerk, and (4) endorsement of the plat by the chairman, after compliance with conditions (1) , (2) and (3) . You have indicated that of the four conditions, only the first has been complied with. C 1 1 Mr. Bennett Orlowski -2- August 12, 1986 Section A 106-24F(2) of the Subdivision Regulations provides that "conditional approval of a final plat shall expire within 180 days after the date of the resolution granting conditional approval, unless such requirements have been certified as completed. " This provision of the Regulations authorizes the Planning Board to extend the time for not more than two additional periods of 90 days each. Since more than six years have elapsed since the Planning Board granted conditional final approval, under the provisions of Section A106-24F(2) , final plat approval has expired. In my opinion, the subdivider must file a new application for final plat approval, together with the required application fee, and a new hearing must be held thereon before final approval. I would also suggest that a new estimate of the cost of improvements be made since costs of installing the same have no doubt increased over the last several years, which revised cost estimates will probably change the amount of the required bond and inspection fees. Two of the board members 'tied visited the site to make a visual inspection. They expressed concern that due to the heavy rainfall this past winter which has raised the ground water table somewhat, that a portion of the proposed park and recreation area adjacent to the wooded marsh may be flooded and therefore could not be included i.n the calculation of the required park area. Based on my knowledge of the topography adjacent to the wooded swamp, I was not concerned and assured the Board that we could and would provide the required park and recreation area. One of the Planning Board' s duties is to promote the proper layout of streets, blocks rnd lots as they may relate to future developments of adjacent properties. A discussion was held in an attempt to determine the necessity for a street connection from your property westerly to the land now or formerly of Harry Schumacher. 1 endeavored to point out that due to the size of the adjacent parcel and the topography of the land that the orderly development of this area would not require a connecting; street to the above mentioned land. The Planning Board decided to for- ward a copy of the proposed subdivision map to Mr. Lawrence Tuthill the Planning Board' s Engineer, for his comments regarding this matter.
