SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions,
without an adverse effect on the environment if the project is implemented as planned.
PROPERTY FACTSIDESCRIPTION: The applicants' 10,872 sq. ft. parcel has 60 feet along the.
north side of Aquaview Avenue, East Marion, and is improved with a two-story frame house as
shown on the November 2,2004 survey, amended November 18, 2004 by John T. Metzger, L.S.
BASIS OF APPLICATION: Building Department's September 2, 2004 Notice of Disapproval,
amended December 7, 2004, citing Sections 100-242A and 100-244B, in its denial of a building
permit to construct additions with alterations to the existing single-family dwelling. The reasons
stated for disapproving the application are that the addition as proposed at less than 10 feet on a
single side yard and less than 25 feet total side yards, which will be an increase in the degree of the
existing nonconformance.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on January 20, 2005 and
March 3, 2005, at which time written and oral evidence were presented. Based upon all testimony,
documentation, personal inspection of the property, and other evidence, the Zoning Board finds the
following facts to be true and relevant:
AREA VARIANCE RELIEF REQUESTED: The applicants wish to construct a 5' x 30' porch
addition, and to extend a 3 ft. (wrap) at both corners, after removing the existing masonry entry
porch. The side yards are proposed at 3.6' and 8.7' for a total of 12.3' for both side setbacks, as
shown on the diagram date-stamped 11/30/04, with lot coverage calculations, and survey revised
November 18, 2004 prepared by Peconic Surveyors, P.C.
ADDITIONAL INFORMATION: The lot coverage has been recalculated and included in this review
determination, at a total of 20.33% (without the 64 sq. ft. brick platform and 35 sq. ft. platform on
stairs).

REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:
1. Grant of alternative relief will not produce an undesirable change in the chalJl<f~: of the
neighborhood or a detriment to nearby properties. The alternative relief increases both side yards
from their original request from 3.6 feet to 8.9 feet on the west side and from 8.7 feet on the east
side to 13.5 feet, while allowing a two-story porch addition to be placed at the front of their bome,
with 20.3% lot coverage
2. The benefit sought by the applicants cannot be achieved by some method, feasible for the
applicants to pursue, other than an area variance, and is related to the dimensions of the lot with a
narrow width, varying between 40.16 feet at the north end to 60 feet wide at the southerly end
adjacent to the road, and with the layout and location of the dwelling in an existing nonconforming
footpri nt.
3. The alternative relief granted is substantial. The code requires a minimum of 25 feet for both side
yards and lot coverage not exceeding 20%. The alternative relief for the porch addition, after
removing the proposed extended 3 ft. wraps at both ends, results in setbacks at 13.5+- feet at the
south/east side, 8.9 feet at the south/west side, for a total of 22.4+- feet for both yards at the
southerly corners, and lot coverage at 20.3.
4. The difficulty has been self-created. For the record, the Board has considered relief under
Appeals 4248 and 4098 concerning this property and allowing side yard relief for extended decks
from the existing glass sliding doors that overlook the rear yard toward the waterfront (sound). The
applicants are aware of the code's limitations on the side yard setbacks and lot coverage maximum
for new construction.
5. No evidence has been submitted to suggest that alternative relief (area variance) in this
residential community will have an adverse impact on the physical or environmental conditions in the
neighborhood.
6. Grant of alternative relief is the minimum action necessary and adequate to enable the applicants
to enjoy the benefit of a porch addition, while preserving and protecting the character of the
neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing
test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by
Chairwoman Oliva, and duly carried, to
DENY the relief requested, and to
GRANT alternative relief for an open two-story ft. x porch addition and 6x6' step entry at the
front of the existing dwelling, after removina both ends of the porch addition that wrap (removing
these encroachments into both side yards, with porch construction open on three sides, as proposed
and shown on the rough diagrams #7 and #8, prepared by Regi Weile, R.A. and date stamped by

ZBA November 30, 2004, subject to the following conditions:
1. The applicant shall provide the Board with a new survey, or map updated by a licensed
surveyor, prior to issuance of a certificate of occupancy, confirming the lot coverage
details for all raised decks, shed and other building areas (accessory and principal
structures) as required by code, including the proposed addition shown on the 11/2/04
survey prepared by Peconic Surveyors, P.C.;
2. The lot coverage shall not exceed the 20.3% for the building area (re-calculated using the
information shown on the 11/2/04 survey, including the proposed 30.3 ft. by 5 ft. porch
with 6 ft. x 6 ft. entry stoop at the front of the house).
This action does not authorize or condone any current or future use, setback or other feature of the
subject property that may violate the Zoning Code, other than such uses, setbacks and other
features as are expressly addressed in this action.

Dear Mr. Fish,
In response to the attached letter I would like to offer the following by way of information:
1] Lot Coverage was reviewed and approved by the BSA under GM21-2-13 and approved on
10 March 2005. While the Permit was for the addition of the front porch, this involved
permission for the proposed Lot Coverage slight increase. Please consult ZBA files.
2] Documents submitted and approved, Dwgs.1 thru 12, to the building department include on
Page 11 ,item #1 "Remove exisang steps at rear porch to allow for new walk and installaaon of
Hot Tub and modifications as per drawings. .. This was done, and since there needed to be
steps from the residence these were installed with 6" risers. The original Deck, south of the bank,
stepped down with 12" step increments. Please see photos and Architects submission. The
6"x6" members laid on grade [as per photo] needed to be extended as they ended short of
the decking.
3] The existing Deck, north of the bank edge, was not modified in size as demonstrated by the
first SUNey and the final SUNey. The only modification was to eliminate 3 feet of decking on the
west side and the installation of new mahogany deck material on the existing framing, as the old
material was badly deteriorated. See photos.
The framing of the decking projecting out over the bank was not modified as claimed by the
Inspector. The Contractor added blocking at existing beams to stabilize existing.

The request to file with the ZBA and DEe is puzzling. I would therefore like to request a meeting
with you to discus exactly what I am to request from each Agency. The new decl<ing material?
The placement of small sections of 6x6's that vvere laid on grade? And what is referred to as "as
built" in this letter?

Construction Notes
1 . Removals
Remove existing front porch and second floor pediment. Remove existing siding and trim and
prepare for installation of cedar shingles and trim and new porch structures on first and second
floor. Underlayment shall be heavy duty building paper. No plastic sheet.
Remove existing Belgan Blocks at entry as per Drawings.
Remove existing finish materials where required to tie new structure into existing both at exterior
and interior.
Remove existing lighting at entry.
Remove existing west sliding doors at First Floor rear. Remove existing wood steps at rear porch
to allow for new work and installation of Hot Tub and deck modifications as per drawings.
Protect all work to remain, especially interior finishes.
Remove all materials from site and dispose of legally.
2. New Work
All work shall be in compliance with Governing Codes of New York State.
Supply and install all hurricane related clips required for tie down of rafters to plate, plate to
stud, stud to plate as required by code. See connector schedule.
Protect existing Residence and all its appurtenances securely from the elements when removing
and replacing work of this contract.
3. Framinq
All lumber shall meet Westem Wood products Association Standards for material. All plate stock
shall be DF#2 or better. All horizontal structural members shall be DF#1 or better.
Framing Lumber to be DF F=1400psi
All deck framing to be CCA or equal.
Double all sill plates where extending vertical partitions.
New Porch at second floor to be waterproof to protect lower Porch, and second floor
mezzanine. Pitch deck floors to side scuppers for drainage. [E;W1
All soffits to be Cedar. Exterior ceiling at second floor porch to be cedar wainscoting.
4. Doors and Windows
Window catalogue numbers refer to Anderson. To conform to requirements of ASTM E 1996
and ASTME 1886.
Door Type A: FWG6068R
Window B: To match existing in manufacturer and dimension thus modifying existing
Slider to be removed.
5. Fasteners. nailing and connections to be as per NYSBC 1609.1.4

7. Electrical
All Electrical work, both new and modification to existing shall comply with the National Electric
Code.
Work to include new interior receptacles and switches, exterior waterproof receptacles and
fixtures, new hook up for Hot Tub installation, as per Drawings and manufactures specifications.
8. Plumbinq
All Work shall comply to the NYS Plumbing Code Section 802.
Work shall include drainage and fill lines for new self contained Hot Tub, with protection against
backflow, flooding, fouling, contamination, freezing and stoppage of drain.
Hot Tub shall comply with ASTMF 1346-91 and supplied with an automatic cover.[power safety
cover]
All work shall also comply with section AG1 01 of the NYSBC, for Spas and Hot Tub Installation.
Spa to be of type defined as SPA, PORTABLE "a Non permanent structure intended for
recreational bathing, in which all controls, water-heating and water circulating equipment are an
integral part of the product."
As per AG1 05.5 Barrier exceptions: Spas and hot tubs with a safety cover which complies with
ASTM F 1346, as listed in section AG107, shall be exempt from the provisions of this appendix.

Porch Addition/Alterations
Amendment to Permit Installation fo Mahogany decking material over existing framing.
Rear Porch decking material was to be removed and replaced by Mahogany decking material.
Upon removal of existing rotted decking material, it was found that in a few locations the
substructure was badly rotted or in a configuration that was untenable. [See Photo #1,2,3,4]
Substructure was altered and new material added to receive decking.
Rear Porch Area at new Hot Tub was in need of'modification to accept the tub and
seating/steps. At east portion the existing was found to be constructed on an abandoned
concrete slab, [See Photo #7,9]. Reconfiguration was required at this location.
Photos #14,15,16,17 demonstrates the substructure under the upper portion of the deck that
was reused for the installation of the mahogany deck material. Posts and framing under the
northerly lower deck were existing and remain existing with no alteration. A facia beam was
added to the edge to receive railing above.
Photo #9.10,11,12 shows completed deck that is within the same confines as that which was
existing and modified under this Architects supervision. See attached Plans.. This is to certify that
I approve this work.

a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location oflot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

until permits for the "as built" deck reconstruction have been issued.
We will not amend the existing permit until the following information has been submitted
to this office:
I.) A variance from the Southold Town Zoning Board of Appeals: Based on
the "as built" deck's distance to the top of the bank, as well as lot coverage
issues on the property, a variance is required for the construction. A notice of
disapproval has been issued and a $35 fee is required.
2.) Approval from the Southold Town Trustees and the New York State
DEe: Because of the "as built" deck's proximity to the water, approval is
required from each of these agencies.
3.) Full construction drawings noting all work done without a permit.
