Nick, in the Accounting Department of RAD Oil Inc., has advised the Town that he intends to breach the contract by refusing to provide fuel after February 20. Be advised that the Town objects to any discontinuation of service and will treat any such action by All American as a breach of contract, and will obtain fuel elsewhere. The following is a summary of the Town's position. The Town was not billed for the fuel delivered in January. On February 8, Town Account Clerk, Connie Solomon, called All American to request an invoice. She was told they would make inquiries. On February 13, Nick of RAD Oil called for payment of the bill. He appeared unaware of the prior request to All American and asked for written confirmation of the request for a bill. Ms. Solomon confirmed that request in a letter to Nick dated February 13. On February 1~, an invoice was received by Federal Express delivery. The invoice was incomplete since it failed to provide verification of the rack price used. On February 15, Ms. Solomon requested Nick to provide that verification. He said that the Town was responsible for getting that information. Ms. Solomon called Jay at All American, and was told that it would take time, but the information would be provided. On February 20, Nick from RAD called and threatened to discontinue service if the bill was not paid immediately. Be advised that the fourth paragraph of the Bid Specifications clearly provides that "verification of the rack price used by the bidder must be supplied by the bidder to the Town upon request." Until All American complies with this requirement, the Town will not make payment. . . Mr. Ivan Kovac, President February 21, 1996 Page 2 We are puzzled by the involvement of RAD Oil in this matter, although they claim to be an affiliate of All American. I suggest you consult with your billing department to correct this error and to ensure proper communication in your internal accounting procedures. Any refusal to provide service in the interim will be treated as a termination of the agreement between the Town and All American. 'Very truly yours, G1 Laury L.
