Dear Mr. Kovac:
In your letter of February 29, 1996, you state that Bayway no longer
publishes their gasoline prices and you propose to use a different index.
My information shows that the Bayway gasoline prices are available, as per
the attached example from February 29, 1996.
As per our contract, we ask you to provide the Bayway rack price
verification of the gasoline prices so that we can process your invoices.
If you wish to further discuss Bayway rack prices, please call
Superintendent of Highways, Raymond Jacobs at 765-31~0.

As per our telephone conversation this date, I have sent
a letter to Connie Solomon, along with our print out and
verification of our pricing. As I explained, Bayway no
longer publishes their gasoline prices in the Journal of
Commerce, so that we have indexed your pricing to the
NYC Average gasoline prices as published daily in the
Journal of Commerce.
I am enclosing for your inspection a copy of letter to Ms.
Solomon, copy of page of Journal of Commerce showing
Bayway pricing, and a page of the Journal of Commerce
showing the daily gasoline prices.

send you verification of deliveries, along with an explanation of how' ,we arrived
at our pricing. I therefore enclose our print out showing invoice nUmbers, date

As I explained to Ms. Dowd, Bayway no longer publishes gasoline prii:es, so that
we have taken the daily average NYC gasoline price on date of delivery plus the
same differential, .0733 to .arrlve at our price. This is presentl}'.:' done. We
have, however, during the period Jan. 2, 1996 to Jan. 31, 1996 usiad our rack
posting (not published) plus the .0733 to arrive at our price. If you note the
first 27 Invoices, (Jan. 2 to Jan. 31) do not match up perfectly,: but overall
the Town of Southold is getting a better price. As indicated before, as of Feb. 3,
1993 we now index 'your pricing to the gasoline post!!;!g NYC on datej of delivery

Re: Fuel Oil Contract with Town of Southold
Dear Mr. Kovac:
There is a contract between the Town of Southold and All American Fuel
for the supply of fuel to the Town. Nick, in the Accounting Department of
RAD Oil Inc., has advised the Town that he intends to breach the
contract by refusing to provide fuel after February 20. Be advised that
the Town objects to any discontinuation of service and will treat any such
action by All American as a breach of contract, and will obtain fuel
elsewhere.
The following is a summary of the Town's position. The Town was not
billed for the fuel delivered in January. On February 8, Town Account
Clerk, Connie Solomon, called All American to request an invoice. She was
told they would make inquiries. On February 13, Nick of RAD Oil called
for payment of the bill. He appeared unaware of the prior request to All
American and asked for written confirmation of the request for a bill.
Ms. Solomon confirmed that request in a letter to Nick dated February 13.
On February 1~, an invoice was received by Federal Express delivery.
The invoice was incomplete since it failed to provide verification of the
rack price used. On February 15, Ms. Solomon requested Nick to provide
that verification. He said that the Town was responsible for getting that
information. Ms. Solomon called Jay at All American, and was told that it
would take time, but the information would be provided. On February 20,
Nick from RAD called and threatened to discontinue service if the bill was
not paid immediately. Be advised that the fourth paragraph of the Bid
Specifications clearly provides that "verification of the rack price used
by the bidder must be supplied by the bidder to the Town upon request."
Until All American complies with this requirement, the Town will not make
payment.

We are puzzled by the involvement of RAD Oil in this matter, although
they claim to be an affiliate of All American. I suggest you consult with
your billing department to correct this error and to ensure proper
communication in your internal accounting procedures. Any refusal to
provide service in the interim will be treated as a termination of the
agreement between the Town and All American.

SPECIFICATIONS FOR THE PURCHASE OF
GASOLINE FOR THE TOWN OF SOUTHOLD
FOR CALENDAR YEAR 1996

Under these specifications, the Town of Southold seeks bids for the I
I
gasoline requirements for the 1996 calendar year for alii
purchase of all its
Town Departments.
The Police Department maintains
Police Headquarters at Peconi<;:, New
gallons of unleaded gasoline annually.
The Highway Department maintains aI, 000 gallon tank for unleaded
gasoline, and aI, 000 gallon tank for unleaded plus gasoline. All tanks
are located at the Highway Department premises at Peconic Lane, Peconic,
New York. The Highway Department uses approximately 12,000 gallons of
unleaded gasoline annually, and approximately 24,000 gallons of unleaded
plus gasoline annually.
In submitting bids, the bidder must either submit a fixed price per
gallon to be charged throughout the term of the contract, or a price which
is based on a rack price at the bidder's source of supply. If a rack price I
is used, the lowest rack price within five (5) days of each delivery to the
Town must be used. Verification of the rack price used by the bidder
must be supplied by the bidder to the Town upon request.
Vendor receiving the award must check tanks twice weekly and fill
a 2,500 gallon capacity tank

Bid prices are not to include any Federal, State, or Local Tax, from
which the Town of Southold is exempt.
The Town of Southold reserves the right to reject any and all bids
if it is deemed in the best interest of the Town of Southold to do so. I
Bids must include a non-collusive bid certificate and be submitted in
sealed envelopes and addressed to the Town Clerk, Town of Southold, Town
Hall 53095 Main Road, Southold, New York 11971, and have plainly marked
on the outside of the envelope "GASOLINE BID".

SPECIFICATIONS FOR THE PURCHASE OF
GASOLINE FOR THE TOWN OF SOUTHOLD
FOR CALENDAR YEAR 1996
Under these specifications, the Town of Southold seeks bids for the
purchase of all its gasoline requirements for the 1996 calendar year for all
Town Departments.
The Police Department maintains
Police Headquarters at Peconic, New
gallons of unleaded gasoline annually.
The Highway Department maintains a 1,000 gallon tank for unleaded
gasoline, and a 1,000 gallon tank for unleaded plus gasoline. All tanks
are located at the Highway Department premises at Peconic Lane, Peconic,
New York. The Highway Department uses approximately 12,000 gallons of
unleaded gasoline annually, and approximately 24,000 gallons of unleaded
plus gasoline annually.
In submitting bids, the bidder must either submit a fixed price per
gallon to be charged throughout the term of the contract, or a price which
is based on a rack price at the bidder's source of supply. If a rack price
is used, the lowest rack price within five (5) days of each delivery to the
Town must be used. Verification of the rack price used by the bidder
must be supplied by the bidder to the Town upon request.
Vendor receiving the award must check tanks twice weekly and fill
a 2,500 gallon capacity tank
