The ~ollowing action was taken by the Southold Town Planning
Board at a regular meeting held January 7, 1980.
WHEREAS, a ~ormal application ~or the approval o~ a subdivision
plat, entitled Minor Subdivision o~ Joseph Shipule was submitted to
the Planning Board on November 9, 1979, and an application ~ee o~
$20 was paid on November 9, 1979, and
WHEREAS, a public hearing was held on the said subdivision
application and Plat at the Town Hall in Southold, New York, on
January 7, 1980 at 8:30 p.m., and
WHEREAS, the requirements o~ the Subdivision Regulations of
the Town o~ Southold have been met by said subdivision Plat and
application,
Now, there~ore, be it RESOLVED, that the application o~ Joseph
Shipule ~or approval o~ said subdivision plat prepared by Roderick
Van Tuyl, P.C., and dated November 1, 1979, be approved and the
chairman be authorized to endorse approval on said subdivision Plat.
This approval is based on the condition o~ locating the drive-
way on the northeasterly portion of the lot designated as number 2.
As we discussed I will bring the matter o~ the condition before
the Board at the next regular meeting. I also enclose the negative
declaration on this matter.

NEGATIVE DECLARATION
January 7, 1980
Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review Act and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that Southold Town Planning Board as lead agency
for the action described below has determined that the project will
not have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of Joseph Shipule is a two-lot residential
subdivision of 2.520 acres located at Bayview at Southold.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project be
implemented as planned.
Because it is more than 300 feet from tidal wetlands,
it is not under the jurisdiction of the New York State
Department of Environmental Conservation.
The Suffolk County Department of Health Services has
indicated that a precursory review of the project indicates
that conditions are adequate for individual water supply
and sewage disposal facilities.
The project will meet all requirements of the Code of the
Town of Southold Subdivision of Land regulations.
