RESOLVED that whereas, a formal application for the approval of a subdivision plat entitled "James W. Dawson" located at Southold was submitted to the Planning Board on March 23, 1984 and, filing fee was paid on March 29, 1984, and WHEREAS, a public hearing was held on said subdivision application and plat at the Town Hall, Southold, New York, on May 20, 1985, at 7:30 p.m., and WHEREAS, the requirements of the Subdivision Regulations of the Town of Southold have been met by said subdivision plat and application, NOW, therefore, be it RESOLVED that the application of "James W. DAWSON is improving the afore- described premises as a planned residential community and contem- plates that lots in said residential community are to be conveyed to individual purchasers; and WHEREAS, JAMES W. DAWSON is desirous of placing certain restrictions upon said premises which shall be binding upon all purchasers and mortgagees of individual lots, their heirs, execu- tors, administrators and assigns, or other successors in interest; WI T NE S S ET H : WHEREAS, JAMES W. DAWSON declares that the aforesaid land is held and shall be conveyed subject to the following covenants and restrictions, which shall run with the land: (1) with garage(s) No building other than a one-family dwelling shall be erected on any one lot. Each dwelling must have a two-car attached garage, and that any garage must conform in exterior architectural design with the d~{elling. (2) A one-story dwelling erected shall have a first floor area of not less than 1500 square feet and a two- story dwelling shall have a first floor area of not less than 1200 square feet, not including porches or garages. (3) Every garage must have a driveway. The drive- way must have a stone, concrete or asphalt surface. (4) The premises shall not be used for the manufac- ture or sale of merchandise or goods of any kind, for any trade or business whatsoever, or for the 'display of any advertising or commercial signs. (5) No fowl, poultry, animals or livestock shall be kept on the premises other than two domestic pets which shall be confined exclusively to the owner's property. (6) No mobile type homes, modular homes, unlicensed motor vehicles and trailers shall be allowed on any lot regard- less of their size with the exception of boat trailers which must be kept in the rear of the premises. - 2 - rear yard. (11) JAMES W. DAWSON has set aside, as indicated On the subdivision-map, an area consistihg of 7.459 acres as "open space" for the use of the owners of lots and their guests'and invitees. Said common land shall be limited to "open space uses". (12) All owners of lots are hereby granted the right to use, iD common with others, space" area. (13) Each lot owner at their own risk, the "open shall be responsib.le for one- seventh (1/7) of the real estate taxes attributable to the "open space" area. All decisions as to the upkeep and main- tenance of the "open space" area shall be in the exclusive - 3 - discretion of JAMES W. DAWSON, or his successors in interest, or an association of property owners as hereinafter provided. (14) While JAMES W. DAWSON holds title to the "open space" area, he will pay the taxes and expenses mentioned in paragraph (13) above, and will submit bills to the individual lot owners for their respective contributions. Such bills will be paid in full to JAMES W. DAWSON by the then present lot owners within fifteen (15) days after said bills have been mailed. In the event that said bill is not paid when duel the same shall become and remain a lien upon the premises of said owner(s) until paid, and JAMES W. DAWSON, his successors or assigns, shall have the right to collect same and to enforce the lien thereof by any means authorized by law. (~5) After a majority of the lots have been con- veyed by JAMES W. DAWSON, said JAMES W. DAWSON, at his cost and expense, shall form, organize and transfer title to the "open space" area to an incorporated non-profit property owners' organization, to be known as the NORTH BAYVIEW ROAD PROPERTY OWNERS' ASSOCIATION, INC. (16) After conveyance is made to the Property Owners' Association pursuant to paragraph (15) above, then: (a) All costs and expenses associated with the "open space" area shall thereafter be borne entirely by the Property Owners' Association; the by-laws of said Association, and any amendments thereto, shall be subject to approval by the Town Board of the Town of Southold. - 4 - (b) The owners of all lots purchased from JAMES W. DAWSON shall be members of the Property Owners' Association; (c) Each member of the Property Owners' Asso- ciation shall be liable, on a per lot basis, for a share of the cost and expenses of.the Property Owners' AssociatiOn; (d) Each member agrees to comply with the regu- lations for the use of the "open space" area enacted by the Property Owners' Association. A majority vote shall be re- quired for the enactment of each such ~egulation; (e) Title to the "open space" area shall be held in perpetuity by the Property Owners' Association. (f) The owner(s) of each lot shall have one vote for each lot owned, whether improved· or unimproved. DAWSON, his successors or assigns, shall have the right to collect same and to enforce the lien thereof by any means authorized by law. (15) After a majority of the lots have been con- veyed by JAMES W. DAWSON, said JAMES W. DAWSON, at his cost and expense, shall form, organize and transfer title to the "open space" a~ea to an incorporated non-profit property owners' organization, to be known as the NORTH BAYVIEW ROAD PROPERTY OWNERS' ASSOCIATION, INC. (16) After conveyance is made to the Property Owners' Association pursuant to paragraph (15) above, then: (a) All costs and expenses associated with the "open space" area shall thereafter be borne entirely by the Property Owners' Association; the by-laws of said Association, and any amendments thereto, shall be subject to approval by the Town Board of the Town of Southold. 4 (b) The owners of all lots purchased from JAMES W. DAWSON shall be members of the Property Owners' Association; (c) Each member of the Property Owners' Asso- ciation shall be liable, on a per lot basis, for a share of the cost and expenses of the Property Owners' Association; (d) Each member agrees to comply with the regu- lations for the use of the "open space" area enacted by the Property Owners' Association. A majority vote shall be re- quired for the enactment of each such regulation; (e) Title to the "open space" area shall be held in perpetuity by the Property Owners' Association. (f) The owner(s) of each lot shall have one vote for each lot owned, whether improved or unimproved. (g) The area designated "open space" shall remain as such in perpetuity. I believe that such a provision would permit the modification, amendment or revocation of the requirements that the open space remain as such in perpetuity. Paragraph 10 provides that the covenants and restrictions terminate on January 1, 1998. It is the usual practice that the covenants and restrictions as to open space will endure in perpetuity. Dawson Subdivision North Bayview Road Southold Dear Mr. Orlowski: During the course of the public hearing on the Planning Board Agenda of May 20, 1985, relative to the above captioned subdivision, the subject of the letter of the Suffolk County Department of Planning, dated April 11, 1985, wherein it was stated that the Suffolk County Planning Commission, at its meeting on April 3, 1985, disapproved the captioned subdivision with five grounds stated therein for its disapproval, was dis- cussed. With the permission of the Planning Board, I addressed each of the grounds set forth in the April 11, 1985 letter of the Department of Planning, a recapitulation of which I shall set forth herein. With respect to Item #1 therein, I should like to bring forth the following facts to the attention of the Board, to wit: (a) On December 7, 1983 the Planning Board submitted the proposed cluster subdivision to the Southold Town Board for its approval, which approval was subsequently given to the project; (b) On May 9, 1984 the Southold Town Planning Board, by Resolution, approved the sketch map of the proposed cluster subdivision; Bennett Orlowski, Jr. Chairman Southold Town Planning Board May 21, 1985 Page two (c) On September 14, 1984 the Suffolk County Department of Planning reviewed the pre- liminary map of the proposed cluster sub- division and stated in its letter of that date, to the Southold Town Planning Board, that the proposed layout of the proposed subdivision appeared to be satisfactory. The only suggestions made by the Suffolk County Department of Planning dealt with the corner of the intersection of Lot ~4 on the proposed subdivision and the access road used by the Goose Creek residents; (d) On December 3, 1984 the Southold Town Planning Board fixed the date of December 17, 1984 as the date for a public hearing on the approval of the preliminary map of the cluster subdivision; (e) On January 9, 1985 the Planning Board ap- proved the preliminary map for the cluster subdivision, subject only to the request of the Suffolk County Planning Department for the proposed dedication; (f) On May 6, 1985 the Planning Board set May 20, 1985 as the date for a public hearing on the approval of the final map of the proposed cluster subdivision. As can be readily seen from the foregoing, this matter has been before the Southold Town Planning Board and the Suffolk County Department of Planning for more than one year and it is only recently that the question of yield has arisen with respect to this proposed cluster subdivision. At the hearing on May 20, 1985 I submitted to the Board the sketch map of a conventional subdivision which clearly sets forth that, under such proposed layout, seven lots could be secured under the provisions of the Southold Town Zoning Ordinance. The yield map so submitted would clearly fall within the requirements of ~281(b) of the Town Law. In the light of the foregoing, it would be grossly unfair and would cause substantial hardship and economic loss to the applicant to have to revise these maps at this time in accordance with the recommendation of the Suffolk County Department of Plan- ning. In the light thereof, I do hereby request that the Southold Bennett Orlowski, Jr., Chairman Southold Town Planning Board May 21, 1985 Page three Town Planning Board, pursuant to its variance powers under §106-50 of the Code, override Item #1, as set forth in the letter of the Suffolk County Department of Planning dated April 11, 1985. As concerns Items #2 and #3 set forth in the letter of April 11, 1985, the Board has sufficient data and information before it to respond to those items to the satisfaction of the Suffolk County Department of Planning. In regard to Item #4, the applicant acknowledges that the point is well taken and that provision will be made to provide such a means of access over Lot #5 for the benefit of said Lot #4. While the Board indicated at the public hearing that a right-of- way of 20 feet is suggested, upon further analysis it would appear that since this right-of-way will be limited to "foot" access only, it is requested that the Board reconsider the 20 foot requirement and reduce same to 10 feet. In the latter instance, it would cer- tainly discourage the use of the right-of-way for any purpose other than foot travel. As concerns Item #5, as indicated to the Board, I do not believe that the Suffolk County Department of Planning, or the Suffolk County Planning Commission, has the leqal right %o compel the applicant to dedicate any part of his land~ for the use of a private right-of-way. It is clear from the record that the right- of-way adjacent to the applicant's property and to the extent that it encroaches thereon, is owned solely by a private group known as the Goose Creek Lane Association. In the light of the foregoing, I would also respectfully request that the Board override this recommendation of the Suffolk County Planning Commission. If there is nothing further that the Board requires, I would request that the Board act expeditiously in accordance with the mat- ters herein set forth and approve the final map of the above cap- tioned subdivision. There was no information provided to show that the open space would be restricted against future subdivisions and that measures will be taken to insure that the County of Suffolk would not have to ac- quire the parcel because of failure of the lot owners of this sub- division to pay the taxes due on the parcel. The layout negates the use of the open space by the owner of Lot 4 who does not have any access to the open space except possibly by Goose,Creek Lane, a ri~ht-of-~'ay that the owner of Lot 4 may not have the right to use. Section 100-36J provides that the developer shall file with the Town Board a maintenance bond "to insure the proper maintenance of all common lands until the homes association is established." Section 100-136E provides that the Town Board shall have the right to review and approve the articles of incorporation and charter of said homes association and to require whatever conditions it deems necessary to insure that the intent and purpose of this chapter is carried out. With respect to this provision, it has been required in the past that the covenants should also provide that the Town Board reserves the right to approve the by-laws of the homes association and any amendments thereto. With respect to the items raised in the Department of Planning letter, I should like to respond as follows: While I do not believe that pursuant to §277 of the Town Law the applicant could be com- pelled to dedicate a portion of the property with respect to proposed Lot #4 to the Town of Southold for highway purposes, as suggested by the Department of Planning and set forth in your Resolution adopted January 7, 1985, in the interest of sound planning and the spirit of cooperation by the applicant, the proposal for dedication is satisfactory. In furtherance of same, I shall have the final map amended to reflect that the corner of Lot No. 4 be reserved for highway purposes, by way of dedication.
