Re: Property division for DiCkinson/Thompson Main Bayview Rd., Southold, NY SCTMi 1000-78-9-30.1 & 30.2 Dear Sirs: We enclose herewith a copy of a July 13, 1989 letter from the Town Building Inspector. Our clients, Imogene Dickinson Thompson and wesley R. Dickinson are the respective owners of the above referenced lots and are anxious to legitimize the separation of their properties. There is a long history to this property. It has been owned by the Dickinson family since 1906, except for one three-month period (Oct. 1930 - Jan. 1931), and has been passed down through the family to, and including, the present owners (brother and sister) who acquired joint title in 1956. The westerly residence dates back to circa 1726; the easterly residence, circa 1940. The two lots, as shown on the enclosed survey, were thought to have been created by deed transfers in Sept. 1977. The owners have, since that time, received separate tax bills and the lots were designated by Suffolk County under separate tax map numbers. Until just recently, the owners remained unaware that the Town of Southold did not recognize this property separation. We believe that the enclosed application measures favorably against the guidelines set forth in Article I, Section AI06-13 of the Town Code for consideration by the Planning Board as a set-off and request that it be processed as such. . .. Southold Town planning Bd. -2- September 21, 1989 Accordingly, we enclose the following: 1. 9/11/89 Notice of Disapproval 2. Twelve (12) copies of proposed map 3. Set-off Application & attached schedules: A - Legal description of property C - Maintenance of existing roads 4. Filing fee of $250.00 5. Planning Board Questionnaire 6. Name of Owners and adjoining owners 7. Filing fee of $250.00 8. Form letter re drainage, etc. 9. Part I of Short EAF 10. Owner authorizations (2) 11. Supporting letters from adjoining owners (2) 12. Copy of 1981 Suffolk County Tax Map indicating separate lots and, thereby, this property's exempt status with the Suffolk County Dept. of Health. We request that this application be scheduled for the Board's consideration, as soon as possible. udolph H. Bruer RHB/df Enc. cc: Mrs. Imogene D. Thompson Mr. Wesley R. The applicant would like relief from the board's letter of February 14, 1990, paragraph one. It said "require revised maps on a scale of one inch equals a hundred feet as requested in the Planning Board's January 19, 1990 correspondence. We would request that there would be a undue hardship under the circumstances that this is really just a lot line and the map is not going to be filed with the County and it will require resurveying of the property because Mr. VanTuyl said he could not take this particular map and reduce it, he would have to go out and resurvey it. The zoning board has granted the release requested as set forth in your file based upon this map. The maps that are being presently approved, hopefully, by the Health Department are of this map. Your requirements under Section A106-42 sets forth that the maps must be on a scale of not more than 100 feet to the inch. That is dealing with major subdivision, it doesn't say it has to be. The reason you would probably want it is that most of it, if not all, of your files are of that Standard but we ask that the board make an exception in this case. Mr. Orlowski: O.K.. Those maps are also at the Health Department? Mr. Bruer: Yes. Mr. Orlowski: What is the pleasure of the board? Do you want to keep the hearing open and discuss his comments? Board: Yes. C~ ( L P~ANNING BOARD ~ 11 MARCH 5,~90 n Mr. Orlowski: I'll entertain a motion to keep the hearing open. Mr. Edwards: So moved. Mr. Latham: Second. Mr. Orlowski: Motion made and seconded. So ordered. **************************************** Mr. Orlowski: James Bailey - This lot line change is located on Fishers Island. SCTM *1000-12-2-6.10. What is the pleasure of the board in regard to the Planning Commission's Report? Mr. Edwards: to adopt the Commission's Mr. Chairman, I would like to entertain a motion following February 8, 1990 Suffolk County Planning Report (numbers correspond to numbers in report): 1, 2, 3 are to remain as written. 4, 5, 6, 7, 8, and 9 are to be omitted. The application before the board is for a lot line change, not a subdivision. No new dwelling units are proposed. 10. Is to be revised to read: These Covenants and Restrictions can be modified only at the request of the then owner of the premises with the approval of a majority plus one of the Planning Board of the Town of Southold after a public hearing. Adjoining property owners shall be entitled to notice of such public hearing but their consent to such modification shall not be required. 11. To remain as written with the addition that the Liber and page number of the filed document be included on the final map. Numbers 1, 2, and 3 must be presented in a Declaration of Covenants and Restrictions in proper legal form. A copy of the draft Declaration of Covenants and Restrictions must be submitted for review by the Planning Board and the Town Attorney. I'll ask if there are any objections to this subdivision? Hearing none, are there any endorsements of this subdivision? Mr. Rudolph Bruer: On behalf of the applicant. This is a set-off of property located in Southold and rather than take a great deal of the board's time I'm sure that you all read the letter in the file from myself to the board on September 21, setting forth the history of this set-off noting that the two buildings were constructed in 1726 and the other in the 1940's time frame, on the property and the adjoining neighbors have consented or expressed their approval which I think is part of the boards file. We have been getting separate tax bills since 1977 and we request that the application to divide the property be granted. Mr. Orlowski: O.K., I don't think the board will close this hearing because we need the revised maps and also the Suffolk County Health Department stamp on those maps. Mr. Bruer: The preliminary work to the Health Department is on its way to them. Mr. Orlowski: O.K., we'll just leave it open until we get those. Mr. Bruer: Thank you. Mr. Orlowski: Any other endorsements of this subdivision? Hearing none, is there anyone out there neither pro nor con but may have information pertaining to this subdivision that would be of interest to the board? Hearing none, any questions from the board? Board: No questions. Mr. Orlowski: Ms. Scopaz? Ms. Scopaz: We need the revised maps. Mr. Bruer, do you have the revised maps? Mr. Bruer: Mr. Chairman, I believe you should receive a letter from the Health Department saying it's exempt from Article VI ( ( l PLANNING BOARD FEBRU~13, 1990 "" 8 ~ " due to Article VI coming in in 1981 and the property as far as the tax maps are concerned were split off as of 1977. I think that is going to be the result of the Health Department rather than some type of Article VI approval, I think they are going to say it's exempt from the requirements. At least that is my hope. Mr. Orlowski: O.K., no further questions, does the board want to close this hearing or leave it open?
