Dear Mr. Bruer:
The following resolutions were adopted by the Southold Town
Planning Board at a meeting held on Monday, March 26, 1990.
The final public hearing, which was opened on February 13,
1990 was closed.
WHEREAS, Imogene Dickinson Thompson is the owner of the
property known and designated as SCTM* 1000-78-9-30.2 and Wesley
R. Dickinson and Agnes P. Dickinson are the owners of the
property known and designated as SCTM* 1000-78-9-30.1, located
at the northwest side of Main Bayview Road and Cedar Lane,
Southold; and
WHEREAS, this set-off is to be known as Wesley Dickinson
and Jean D. Thompson set-off; and
WHEREAS, a variance for approval of insufficient area was
granted by the Zoning Board of Appeals on January 22,1990; and
WHEREAS, the Southold Town Planning Board, pursuant to the
State Environmental Quality Review Act, (Article 8l, Part 617,
declared itself Lead Agency and issued a Negative Declaration on
January 18, 1990; and

WHEREAS, a final public hearing was closed on said
subdivision application at the Town Hall, Southold, New York on
March 26, 1990; and
WHEREAS, all the requirements of the Subdivision
Regulations of the Town of Southold have bee~ met; and

RESOLVED, that the Southold Town Planning Board approve and
authorize the Chairman to endorse the final survey dated
February 8, 1990.
Enclosed please find a copy of the map which was endorsed
by the Chairman.

Dear Sirs:
We enclose herewith a copy of a July 13, 1989 letter from the Town
Building Inspector. Our clients, Imogene Dickinson Thompson and
wesley R. Dickinson are the respective owners of the above referenced
lots and are anxious to legitimize the separation of their properties.
There is a long history to this property. It has been owned by the
Dickinson family since 1906, except for one three-month period
(Oct. 1930 - Jan. 1931), and has been passed down through the family
to, and including, the present owners (brother and sister) who
acquired joint title in 1956. The westerly residence dates back to
circa 1726; the easterly residence, circa 1940.
The two lots, as shown on the enclosed survey, were thought to have
been created by deed transfers in Sept. 1977. The owners have, since
that time, received separate tax bills and the lots were designated by
Suffolk County under separate tax map numbers. Until just recently,
the owners remained unaware that the Town of Southold did not
recognize this property separation.
We believe that the enclosed application measures favorably against
the guidelines set forth in Article I, Section AI06-13 of the Town
Code for consideration by the Planning Board as a set-off and request
that it be processed as such.

southeast corner of Main Bayview and Cedar Drive in Southold.

Mr. Bruer: May I please interrupt once more, this is my final
interruption. Mr. Chairman and the board. The applicant would
like relief from the board's letter of February 14, 1990,
paragraph one. It said "require revised maps on a scale of one
inch equals a hundred feet as requested in the Planning Board's
January 19, 1990 correspondence. We would request that there
would be a undue hardship under the circumstances that this is
really just a lot line and the map is not going to be filed with
the County and it will require resurveying of the property
because Mr. VanTuyl said he could not take this particular map
and reduce it, he would have to go out and resurvey it. The
zoning board has granted the release requested as set forth in
your file based upon this map. The maps that are being
presently approved, hopefully, by the Health Department are of
this map. Your requirements under Section A106-42 sets forth
that the maps must be on a scale of not more than 100 feet to
the inch. That is dealing with major subdivision, it doesn't
say it has to be. The reason you would probably want it is that
most of it, if not all, of your files are of that Standard but
we ask that the board make an exception in this case.

Department?

Mr. Orlowski: 7:50 p.m. Thompson/Dickinson - This set off
is on the southeast corner of Main Bayview and Cedar Drive in
Southold.
SCTM ilOOO-78-9-30.1 & 30.2. We have proof of publication in
the Long Island Traveler Watchman and also the Suffolk Times.
Everything is in order order for a final hearing. I'll ask if
there are any objections to this subdivision? Hearing none, are
there any endorsements of this subdivision?
Mr. Rudolph Bruer: On behalf of the applicant. This is a
set-off of property located in Southold and rather than take a
great deal of the board's time I'm sure that you all read the
letter in the file from myself to the board on September 21,
setting forth the history of this set-off noting that the two
buildings were constructed in 1726 and the other in the 1940's
time frame, on the property and the adjoining neighbors have
consented or expressed their approval which I think is part of
the boards file. We have been getting separate tax bills since
1977 and we request that the application to divide the property
be granted.
Mr. Orlowski: O.K., I don't think the board will close this
hearing because we need the revised maps and also the Suffolk
County Health Department stamp on those maps.
Mr. Bruer: The preliminary work to the Health Department is on
its way to them.
Mr. Orlowski: O.K., we'll just leave it open until we get those.

that is going to be the result of the Health Department rather
than some type of Article VI approval, I think they are going to
say it's exempt from the requirements. At least that is my hope.

Mr. Orlowski: 7:55 p.m. Maior's Terrace - This minor
subdivision is for two lots on 13.87 acres located on the
southwest corner of King Street and Douglas Street, Orient.
SCTM #1000-26-2-42. We have proof of publication in the Suffolk
Times and the Long Island Traveler Watchman. Everything is in
order for a final hearing. I'll ask if there are any objections
to this subdivision? Hearing none, are there any endorsements
of this subdivision?
Mr. Henry Raynor: I'm representing Major's Terrace. This is a
two lot subdivision on 13 plus acres and we have eliminated the
ten foot right-of-way which runs parallel to the Major's pond on
the northerly end of this property. This was at the request of
the Southold Town Trustees for fear that there might be
additional (inaudible). These covenants and restrictions are on
file with your board and in the law office of Michael Hall.
This map has been amended to request the Suffolk County Planning
Board's recommendations on the 6th of November. We have also
created a 100 foot observation easement as requested from the
board in a resolution on the 7th of July. I would like to
request approval of this subdivision and will be happy to answer
any questions.
Mr. Orlowski: As of yet we don't have all the covenants and
restrictions with the County.
Mr. Raynor: I can't speak for the County but I believe the
covenants and restrictions were filed with this board on the
11th of October.

Uncoordinated Review, take Lead Agency, and in that capacity
make a determination of non-significance, and grant a Negative
Declaration.
Enclosed please find a copy of the Negative Declaration for

RESOLVED that the Southold Town Planning Board grant sketch
approval on the map dated August 17, 1989 with the following
condition:
1. Scale of the map must be 1" = 100' and key map must
be 1" = 500'
Sketch plan approval is conditional upon submission of
final maps within six months of the date of sketch approval,
unless an extension of time is requested by the applicant, and

The Planning Board will proceed with this subdivision as a
minor subdivision, not as a set-off.
