Dear Mr. Bruer:
The foll~wing action was taken by the Southold Town Planning
Board at a regular meeting held October 1, 1979.
WHEREAS, a formal application for the approval of a
subdivision plat, entitled Minor Subdivision of Celia Vitale was
submitted to the Planning Board on July 27, 1979 and an application
fee in the amount of $20 was paid on July 27, 1979, and
WHEREAS, a public hearing was held on the said subdivision
application and plat at the Town Hall in Southold, New York, on
October 1, 1979 at 8:00 p.m., and
WHEREAS, all requirements of the Subdivision Regulations of
the Town of Southold have been met by said subdivision plat and
application,
Now, therefore, be it RESOLVED, that the application of Celia
Vitale for approval of said subdivision plat prepared by Roderick
Van Tuyl and dated July 24, 1979 and amended August 22, 1979 be
approved and the chairman of the Planning Board is authorized to
endorse approval on said subdivision plat.

NEGATIVE DECLARATION
Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that Southold Town Planning Board as lead agency
for the action described below has determined that the project
will not have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of Celia Vitale is a two-lot minor
residential subdivision consisting of 2.212 acres located at
Southold.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should, the project
. ,
be lmplemented as planned;
Lack of response in the allotted time from the New
York State Department of Environmental Conservation
indicates that there is no objection by that agency;
The Suffolk County Department of Health Services has
indicated that a precursory review of the project
indicates conditions are suitable for individual sewage
systems and water supply facilities;
The project will meet all requirements of the Code of
the Town of Southold Subdivision of Land regulations.

After investigation and inspection, the'Board finds that the
applicant wishes approval of access in the proposed subdivision,
and the property involved has more than the minimum required square
footage for each proposed lot, and the proposed rear lot does not
have frontage on a public or private road and therefore requires
access by right-of--way for which applicant is requesting for 25 feet
in ',;idth. It is understood that the applicant also proposed to
remove th.e existing cottages on the premises.
The Board finds that strict application of the Ordinance "ould

dated July 24, 1979.
RESOLVED that the Southold Town Planning Board declare
itself lead agency in regard to the State Environmental
Quality Review Act in the matter of the minor subdivision
of property of Celia Vitale.
The Board will require an affidavit of ownership and
that the right-of-way show 150 foot frontage for Lot #1.
There will be no construction required on this 150 feet.
