Dear Mr. and Mrs. Pacelli:
The following actions were taken by the Southold Town
Planning Board, Monday, October 6, 1986.
RESOLVED that the Southold Town Planning Board declare
themselves lead agency under the State Environmental Quality
Review Act for the set-off of Joseph and Ann Pacelli located
at Southold. An initial determination of non-significance
has been made. Tax map no. 1000-78-9-1 and 16.
RESOLVED that the Southold Town Planning Board approve
the set-off of Joseph and Ann Pacelli located at North Bayview
Bayview Road, Southold to set off 22,058 square feet from
39,177 square feet, survey dated as amended September 12,
1986.
When the Chairman has endorsed the surveys, we will forward
a copy to you.

WHEREA~, a public hearing was held and concluded on May 22,
1986 in the Matter of the Application of JOSEPH AND ANN PACELLI under
Appea 1 No. 3485; and
WHEREAS. the board members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, at said hearing a1 J those who desired to be heard
were heard, and their testimony was recorded; and
WHEREAS. the board has carefully considered all testimony
and documentation submitted concerning this application; and

WHEREAS, the board made the following findIngs of tact:
1. The premises in question is shown on the Fi led Map of
"Bayside Terrace, filed March 11, 1953, No. 2034, as Lots #1, 9
and 10; and is more particularly identified on the Suffolk County
Tax Maps as District 1000. Section 78, Block 9, Lots 1 and 16.
County Tax Map Lot #1 comprises only one subdivision lot, #1,
containing an area of 17,119 sq. rt. and lmproved wlth a sing1e-
fami Iy dwelling. County Tax Map Lot #16 comprises two subdivision
Lots~ '9 and 10, presently vacant and containing an area of
2z ,058 sq . ft.
2. The total lot area of the entire premises is 39,17/ sq.
ft. and frortts along three streets: (a) 132.08 feet along the
east side of Cedar Lane; (b) 243.70 feet along the south side of
North Bayview Road; (C) 194.40 feet along the west side of
Summer Lane.

3. ~y this application, appellants request approval of
the insuff1cient lot area, depth and width of three parcels as
eX1sted during 1953 and shown by the Subdivision Map of Bayside
Terrace, as fOllows: (a) Lot #1 of 17,11~ sq. ft. in area,
lJ2.08' along Cedar Lane, and 121.85 feet along North Bayview
Road [a corner 10tJ; (b) Lot #2 of 12,q58 sq. Tt. 1n area,
121.85 feet along North Bayview Road and 114.qO feet along
Summer Lane La corner lot]; and (c) Lot #3 of 9,600 sq. ft.
in area, 80 feet alon9 Summer Lane, and 120 Teet deep.
4. Submitted for the record are: (a) copies of the
County Tax Map highlighting simi lar circumstances of at least
two other properties on this block, although identified on
the Suffolk County Tax Maps as one merged lot; (b) copy of
Health Department accepting three parcels as existed on the
Bayside Terrace Subdivision Map; (c) response from the
Southold Town Planning Board.
5. Article III, Section 100-31, Column A-80 requires a
minimum lot area of 80,000 sq. ft.; Column A-40 requires a
minimum lot area of 40,OUO sq. ft. The parcel as a whole
containing 39,177 sq. ft. meets 50% of the lot area require-
ment. The parcels as proposed herein vary meeting between
12% and 22% of the lot area requirement, which 1S in the
board's opinion requires a substantial variance (of 88% to
78%) .
6. It is the board's determination that the relief
for three parcels is denied; however, as an alternative,
the board approves two lots with insufficient area as shown
on the Suffol k County Tax Maps: (a) 1 00U-78-9-1, or Lot
#1 of 17,119 sq. rt. in area, 121.85 feet of lot depth,
132.0H feet ot lot width; and (b) 10UO-78-9-16, or Lot #2,
of tl,998 sq. tt. in area, 120.:t feet lot depth, 194.40 teet
in width.
In considering this appeal, the board finds and
determines that in reducing the number of lots requested
from three to two: (a) the rel ief requested wi 11 be the
minimum necessary; (b) the circumstances are unique;
(c) there are practical difficulties sufficient to warrant
the granting of this relief; (d) there wi 11 be no substan-
tial change in the character of the neighborhood or
detriment to adjoining properties; (e) the difficulty
cannot be obviated by some method feasible for appellant
to pursue other than a variance; (f) the variance wi 11
not in turn cause a substantial effect of 1ncreased
population density or be adverse to the safety, health,
welfare, comfort, convenience and order of the town; (g)
that in view of the manner in which the difficulty arose
and 1n consideration of all the above factors, the inter-
ests of justice wi 11 best be served by allow1ng the varlance,
as conditionally noted below.
Accordingly, on motion by Mr. Sawicki, seconded by
Mr. Grigonis, it was
