The following resolution was adopted by the Southold Town Planning Board at a
meeting held on Monday, September 14, 1998:
BE IT RESOLVED that the Southold Town Planning Board authorize the
Chairman to endorse the final surveys dated November 1, 1997. Conditional
final approval was granted on April 6, 1998. All conditions have been fulfilled.
Enclosed please find a copy of the map which was endorsed by the Chairman.
The mylar maps, which were also endorsed by the Chairman, must be picked up
at this office and filed in the office of the County Clerk. Any plat not so filed or
recorded within sixty (60) days of the date of final approval, shall become null
and void.

State Environmental Quality Review
FULL ENVIRONMENTAL ASSESSMENT FORM

Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project
or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent-
Iy, there are aspects of a project that are subiective or unmeasureable. It is also understood that those who determine
significance may have little or no formal knowledge of the environment or may be technically expert in environmental
analysis. In addition, many who have khowledge in one particular area may not be aware of the broader concerns affecting
the question of significance.
The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination
process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit a proiect or action.
Full EAF Components: The full EAF is comprised of three parts:
Part 1: Provides objective data and information about a given project and its site. By identifying basic project
data, it assists a reviewer in the analysis that takes place in Parts 2 and 3.
Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides
guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially-
large impact. The form also identifies whether an impact can be mitigated or reduced.
Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the
impact is actually important.

WHEREAS, this proposed major subdivision is for 3 lots on 2.727 acres; and
WHEREAS, since the subject property was involved in prior land divisions and
the current proposal involves creating an overall total of more than 5 lots, this
proposal is classified as a major subdivision; and
WHEREAS, the Zoning Board of Appeals, in Appeal Number 4391, granted
approval of proposed Lot #3 to be a total of 38,795 square feet including the flag
portion of the lot, and approval of a front yard setback for proposed Lot #3 of the
existing building at 30 feet from its closest setback to the property line; and
WHEREAS, the Southold Town Planning Board, pursuant to the State
Environmental Quality Review Act, (Article 8), Part 617, declared itself lead
agency and issued a Negative Declaration on July 29, 1996; and

WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice
of Public Hearing, has received affidavits that the applicant has complied with
the notification provisions; and
WHEREAS, a final public hearing was closed on said subdivision application at
the Town Hall, Southold, New York on April 6, 1998; and
WHEREAS, all the requirements of the Subdivision Regulations of the Town of
Southold will be met upon fulfillment of the conditions of approval; be it therefore
RESOLVED, that the Southold Town Planning Board grant conditional final
approval on the surveys dated May 30, 1997, and authorize the Chairman to
endorse the final surveys subject to fulfillment of the following condition. All
conditions must be met within six (6) months of the date of this resolution:
1. Submission of the $4,000.00 Park and Playground fee.
The driveway to Lot 3 and the adjacent property owned by Mrs. Stigliani
are presently shared, however neither party makes any claim of right to

Statement of Problem
Parcels served by individual sewage systems in Groundwater Management Zone IV must have a
minimum lot area of 40,000 square feet, or equivalent yield, in accordance with Article 6, $760-
605, paragraphs A.4 and B.2 of the Suffolk County Sanitary Code. The applicant is proposing
lot sizes less than 40,000 square feet.
1. Proposed development of a 78,795 square foot parcel into two lots with an area of 38,795
square feet and 40,000 square feet.
2. Site is in Groundwater Management Zone//IV.
3. Area is zoned residential ('R40).
4. Public water is not available.
5. Depth to groundwater is approximately 12 feet.
6. Soils are poor above groundwater and acceptable below the groundwater table.
7. Average lot size is 39,598 square feet.
Proposal is 99% of department standards.
9. Proposed division is part of a four-lot subdivision known as Zebroski which was divided into
lots of 40,000; 40,284; 78,795 and 81,069 square feet each.
Determination
It was a 3 to 0 determination of the Board to grant the request for the variance. Article 6 is
intended to protect surface and groundwater quality by establishing limits on population density.
Approval of the requested variance should not have any substantial adverse effect on water
quality.

Reasons Supporting This Determination:
An Environmental Assessment Form has been submitted and reviewed,
and it was determined that no significant adverse effects to the
environment were likely to occur should the project be implemented
as planned.
The proposed project is in effect an infill in an established residential area. The
proposed lot sizes are consistent with the size of surrounding lots, although one
is smaller'than allowed under existing zoning and has received a variance from
the Zoning Board of Appeals.
The Suffolk County Department of Health Services has responded in a report
dated July 12, 1996. The applicant must comply with all requirements of the
Suffolk County Sanitary Code and relevant construction standards for water
supply and sewage disposal.
There has not been any correspondence received from the New York State
Department of Environmental Conservation in the allotted time.
Therefore, it is assumed that there are no comments or objections

effect the existing drainage problems that currently exist. The intersection of Main Bayview
and Waterview Drive has a very iow ground elevation and would not be good locations for
leaching pools or drainage basins. Even if drainage structures were provided, the flooding
problems during heavy rains and extreme high tide conditions would still exist. I have
reviewed this matter with Mr. Jacobs and he has agreed with my observations.

require a variance from the density requirements of Article 6 (Board of Review).
The applicant must comply with the requirements of the Suffolk County Sanitary Code and
relevant construction standards for water supply and sewage disposal. Design and flow

Environmental and Planning Considerations
The parcel has been inspected a~.d envir.onmental references concerning the site and
area have been consulted. The sxte consists of 2.727 acres of land and is located in
the hamlet of Bayview in Southo~t.. The subject site, which is located at the
northeast corner of Bayview Road and Waterview Drive, has 369.86 feet of frontage
on Bayview Road and 190 feet of frontage on Waterview Drive.
The area of the site is zoned R-40 Residential, requiring lot sizes of 40,000 square
feet. The proposed action involves division of the land into three (3) lots, one of
which wo .uld be smaller than allowed under the current zoning; however, the Town of
South old Board of Appeals granted a variance for this undersized lot on 6/26/96.
The pro_posed lot sizes on the site are as follows: Lot 1, 40,000 square feet (0.92
acres); Lot 2, 40,000 square feet (0.92 acres) and; Lot 3, 38,795 square fe. et (0.89
acres). The western-most lot, Lot 1, has 211.28 feet of frontage on Baymew Road,
and 190.00 feet of frontage on Waterview Drive. Lot 2, the central lot, has 142.76
feet of frontage on Bayview Road. Lot 3 is a flag lot, with 15.00 feet of frontage on
Bayview Road for lot access..There !s an existing house on Lot 2 and a barn and
large shed on Lot 3. The apphcants mtend to convert the barn as the primary
structure on Lot 3 at some t~me in the furore. Thus, only Lot 1 would require a new
dwelling.
The site was inspected and found to have soils conducive to leaching, including Cut

and Fill Soils and Plymouth Loamy Sand. The site slopes westward from a high of 45
feet above mean sea level (msl) to a low of 4 feet above msl, with steep slopes of over
15percent on Lot 3. More than two thirds of Lot 3 had slopes of over 10 percent
under natural co.nditions, .although these slopes have been altered. The barn is built
into the slope, w~th retaining walls to the north and south parallel to the front of the
barn. The topography has been leveled to the front and rear of the barn, with large
gravel areas. Further to the rear along the eastern property line is a steep, artificnal
embankment.
The entire site was cleared at some time in the past, and the vegetated area consists
of Successional Woodland habitat dominated by locust, red maple,.aspen, sassafras
and cherty. The understory is a dense growth of shrubs and vines, mc.luding rose,
poison ivy and bittersweet. There are no wetlands located on the subject property,
although the woodland on Lot 1 is quite moist, with facultafive wetland species such
as willow and red maple.
Successional Woodland vegetation ispresent throughout Lot 1 and as a buffer along
the north and eastern property line of Lots 2 and 3..The remalnde.r, of Lot 3 is
predominantly gravel lot. Lot 2 has been recently disturbed, and pile of clean fill has
been stored to the rear of the house. The area aro .un.d the house has some specimen
trees, but there is no lawn. The ground is barren vflth scattered weeds, and appears to
have been allowed to become overgrown in ~e past but was recently cleared. The
site would be expected to support many species of avian wildlife and small mammals,
particularly the dense growth on Lot 3.
The elevation of groundwater beneath the site is approximately at mean sea level
(msl) and the topographic elevation ranges from 4 feet above msl to 45 feet above
mean sea level. Thus the depth to groundwater ranges from approximately 4 feet to
45 feet. The easternmost lots have more than adequate depth to groundwater;
however, the depth to groundwater on the weste, rn lot (Lot 1) ra~.ges from 4 .to 14 feet
above msl. This will present constraints for samtary system location and desxgn.
The subject site is located in outside the Water Budget Area as mapped by the
Suffolk County Department of Health Services (SCDHS). The Water Budget Area
includes those locations where there is sufficient gro.undwater to.develop large public
water supply wells. Outside the budget areas, there ~s only sufficient supply to allow
the development of smaller home well systems. The subject site is also located in
SCDHS Groundwater Management Zone IV, which covers the North Fork and
portions of the South Fork. According to the North Fork Water Supply Plan (ERM-
Northeast, Camp Dresser & McKee, 1983), the subject site is in an area significantly
impacted by aldicarb (concentrations over 7 ug/1), but not impacted by nitrate
contamination. There is an area of nitrogen contamination to the east of the site.
Land use in the immediate vicinity of the site is established in sin$1e-family
residential use. The area surrounding the site is zoned "R40 Residential", although
there are some preexisting undersized lots in the area. The proposed project would
create three residential lots, including one flag lot with access on Baywiew Road.
The division of the subject site would in effect be an infill in an area presently
established in single-family residential use. The proposed lot sizes are all consistent
with the existing R-40 Residence zoning in the area. Based on conditions on the site

There are no significant sensitive environmental resources on the subject site that

Steep slopes are present on Lot 3, and would present some constraints for new. cons ,t,ructi,on.
As long as the barn is converted to the. prmaary residencq, and erosion c. ontrot as empioyeu
durine any construction, these constraints should be mimmal. In addition to steep slopes,
the li~ite'd depth to groundwater on LOt 1 is o.f co.ncerm A test hole shg, uld be pe,rfo ,treed on
this portion of the site to.determine the exact depth to grounawater, as me test hote ShOWn
on the survey is on an adjacent property and did not !ntersect groundwater. It should be
possible to locate a sanitary system on the eastern third of the property where the
topographic elevation is over ten feet. This should allow for adequate protection of
groundwater.
If the Board is in agreement with this review, the proposed action does not. appear to
warrant .the preparation or an environmental impact statement, the. refore a nega[ve
declaraUon would be appropriate. The Board should ensure that site use and design are
addressed to their satisfaction through deliberation and hearings on the project.

RELIEF REQUESTED: (1) Request for approval of proposed Lot #3 of a size
38,795 sf, including the flag portion included in the ownership of Lot #3, all
as depicted oil the map completed May 8, 1996, prepared by Roderick VanTuyl,
surveyor, AND (2) request for insufficient front yard setback of larger barn
(as a principal structure on this proposed Lot #3 (rather than as an accessory
building to the existing main house, which house is now located on proposed Lot
#2), and, if applicable, this 30-ft. front yard setback may be extended to a
future building permit application if proposed to be converted as a dwelling,
with one dwelling per lot (as regulated by zoning code use provisions).

ACTION/RESOLUTION ADOPTED: Approved as applied (concerning proposed
Lot #3 of a total lot area of 38,795 sf and frontyard setback of existing
building at 30 feet from its closest setback to the property (south} line.
REASONS / FINDINGS:
1. Total lot area of proposed Lot #3 is minimal, for a variance of 1205 square
feet, or 3% of the 40,000 sq. ft. requirement.
2. This plan is basically laid out consistent with that reviewed (without noted
objection) in a minor subdivision application, presently pending with the
Planning Board, will consist of 38,795 square feet while the rellmining proposed
lots will consist of 100% of the lot size requirement in this R-40 Zone District.
3. The former Certificate of Occupancy for Nonconforming Premises issued to
Julius Zebroski (former owner) on ?[6[88 under #Z-17062 indicated that the
nonconforming setback of the dwelling which exists (and now is shown on
proposed Lot #2) has been nonconforming since the effective date of the zoning
code(s). The other barn and shed buildings shown on the 1996 survey also
preexisted the zoning code(s).
4. No u'her alternative is available to afford relief since there is no other
syllable land area.
5. The difficulties are related to the layout of the land, and are not personal
to the landowners.
6. The character of the neighborhood will remain significantly unaffected by
this 1205 sq. ft. deficiency.

Dear Mrs. Moore:
As we discussed, the Planning Board reviewed the above mentioned
subdivision at the April 29th work session. Since the subject property was
involved in prior land divisions, the current proposal involves creating
an overall total of more than 5 lots. Therefore, the Planning Board will
be processing this application as a major subdivision. The fee for a major
subdivision is $1,300.00. Please have your clients pick up the check
submitted with the application materials and replace it with a check for
the above mentioned amount.
The proposal as submitted does not meet the minimum requirements for the
R-40 zone. If the layout cannot be redesigned to meet the minimum
requirements, approval from the Zoning Board of Appeals will be required
in order for the Planning Board to proceed with the application.
