Dear Mr. Orlowski:
The Suffolk Courity Planning Commission at its regular meeting on October
10, 1984, reviewed tkie proposed subdivision plat entitled, "'Minor Subdivision -
Daniel E, & Patricia Stegner", referred to it pursuant [o Section 1333 of the
Suffolk County Charte�r. After due study and deliberation it resolved to dis-
approve said map for the following reasons:
1. Lot 1 is not: a viable lot as 75Y of its area is reserved as a private
road to se nre as access for Lot 2.
2. There is no room to place a sanitary disposal facility within the
actual area of Lot l. The facility would have to be located within
the area corisidered as a private road to insure the placement of
the sanitar}� disposal facility at least 100 feet back from the shore-
line of the dredged basin. Should the private road become a public
road in the future any sanitary disposal facility located within its
rights-of-way will be a problem.
3. Lot 2 is a ].andlocked parcel without any frontage on a public road.
The Commission also offers the following comments on the map for your use
and consideration:
Creatoin of a subdivision with substandard lots, that is, lots whose areas
are considered less t:han the minimum required by the zoning classification of
the property, constit:utes an overintensification of land use in a groundwater
sensitive area in wh<tt is meant to be a low density area. Such action could
establish a precedence for future subdivisions of this kind which would essen-
tially be a circumvention o£ the Town Board's action taken over the past years
to upzone these groucidwater sensitive areas. The Cov�ission feels that the Town

Dear Benny:
By letter dated July 10, 1984, you enclosed a survey map relative to
the above application and the Planning Board's records and other
information, and asked whether the Planning Board may handle this
matYer as a set-off pursuant to Section A106-13 of the Rules and
Regulations for the Subdivision of Land.
In reviewing this anatter, I note that the attorney for the applicant
indicated that prior to 1966, all three parcels were owned by Thomas F.
Rolleston and Virginia M. Rolleston, his wife. Accordingly, at that time
the entire three parcels were in one ownership and each lot was not
singly and separately owned as indicated by the Board of Appeals,
since the conveyan<:e of all lots to the Rollestons' affected a merger.
Accordingly, for zc�ning purposes, i believe that the Planning Board
should view all three parcels as one parcel. This being the case, the
Planning Board may handle this matter as a set- off of Lot No. 1
containing 8,033 sq. ft.
It would appear that although the 50 foot private road is shown as Lot
No. 2, I do not believe that it can be considered as a buildable lot
since it appears that all of the owners abutting the same have a right
of way over the same: for the full SO foot width.
If you wish to discuss this with me further, please so advise me.

Dear Mr. Orlowski:
Please let this letter confirm the fact that, as agreed upon
last Monday night, the application should be amended to reflect
that Lots No. 1 and 2, as shown on the subdivision map, be
considered as one lot known as Lot No. 1 and the lot with the
existing house on it be considered as Lot No. 2.
It was always the intent of the applicant to only have two lots
out of this division of property--the road and vacant lot was to
be considered as �one lot and the house as a separate lot.
Also, I would like to amend our petition in this matter. The
pet5.£a.Qn should be considered a set-off rather than a tnue minor
subdivision. Please be further advised that the lot designated
as Lot No. 2 will be given, of course, access to Main Bayview
Road.

The public hearing concerning this application was held on March 2 ,
1984 , at which time the hearing was declared closed pending receipt of
a road inspector ' s report concerning this right-of-way .
Upon application for PATRTCIA STEGNER, by Rudolph H. Bruer , Esq . , Main
Road , Southold , NY for a Variance to the Zoning Ordinance , Article III ,
Section 100-31 , and for approval of access , New York Town Law Article 16 ,
Section 280 (A) [3] concerning premises having insufficient area and width
and located on the west side of a private right-of-way off the south side
of Main Bayview Road , Southold , NY ; County Tax Map Parcel ID No . 1000-
78-6-5 and 10 . 2 .
The board made the following findings and determination :
By this application , appellants seek : (a ) approval of access
pursuant to New York Town Law , Section 280-A, and (b ) approval of
a parcel of land which was contiguous to the subject private road and
which contains insufficient area and width .
In researchinq the history of this property , it is noted that
the parcel in question is vacant and has been in single and separate
ownership since prior to the town ' s change in zoning from quarter-acre
to 40 ,000 sq . ft . l:t is also noted that the right-of-way in question ,
indicated on the survey dated February 13 , 1984 as "No . 2 , " is and
has since prior to 1966 been used as an access road to the existing
houses and parcels in the neighborhood and is not considered to be
a building lot . The Parcel indicated as "No . 3" contains an exist-
ing one-family seasonal dwelling and has been a single and separate
parcel quite some tiime before 1966 .
For the reason�s stated above , and in considering the character
of the neighborhood „ the board determines : (1 ) that the relief as
granted will be consistent with the precedents set by the courts � �
under similar circumstances , (2 ) that the character of the neigh-
borhood will not be adversely changed , (3 ) that the circumstances � �Q�
are unique , and (4 ) that the interests of justice will be served �
by allowing the variance as indicated below.
Accordingly , on motion by Mr. Sawicki , seconded by Mr. Douglass ,
it was

(a ) Fill pot holes at intersection with Bayview Road with
a black top mix ;
(b ) Fill all the depressed areas , water-filled and others ,
with the same type of gravel as used in the original road (which is a
mixture of small and medium- sized gravel at 70q , with 30% sand and

the uses are not to be greater in number than exists ; (b ) that the
abutting premises are also being used for multiple-dwelling purposes
and therefore the relief requested will not produce a change in the

indicating this property of approximately 8 ,033 sq . ft . and lot
width of approximately 88. 92 feet , depth 89. 85 feet approximately.

RUDOLPH H . BRUER, ESQ . : Rudolph Bruer. Main Road , Southold ,
New York . I represent Mr. and Mrs . Stegner who purchased this
property as stated in the application in 1976 . They did so with the
idea in their minds that they had three separate pieces of property.
I don ' t know if it ' s before the board , I didn ' t hear that it was
mentioned. Surveys had been prepared showing the three pieces of
property that they purchased. (Mr. Bruer submitted copies of an
updated November 22 , 1983 survey prepared by R. VanTuyl , P . C. )
As you can see , the property in question where they would like
to build is on a canal . They do have a residence which is across a
private road as you can see on the map , and is owned by Mr. Stegner.
The road is owned b,y both of them, and I believe the property here
is owned by Patricia Stegner .
What we would like to do basically is to make the road and the
property that we would like to build on into one lot , and to increase
the square footage of the subject premises . To document the fact
that at the time they purchased the property , I submit here deeds
that conveyed the three pieces of property to them as separate
parcels . The problem that arose is that the grantor of this property
purchased the property on three separate occasions but took the
property in one name as a husband and wife , Thomas and Virginia
Rolleston . They purchased the property , the piece where there is
presently a house located , on that survey , back in 1966 as you can
see by this deed. They purchased the lot across the street with
is the subject of this application in 1970 , and they got the road
from Julius Zebroski also in 1970 but at a different date .
So this is mostly to substantiate the fact that when they pur-
chased it and up until they went for a building permit , they
honestly believed they had three separate lots and had the ability
to be able to build on it. As a matter of fact , at the time of
purchase and I guess since the time of the acquisition , they do
get three separate tax bills ; one for the road , one for the house
and one for the lot . � -
As the application states , the Health Department has approved
the location of the well . I have a copy of their map showing the
pool and the well location . Also you have before you the D. E. C .
approval . Granted , there ' s no question about it--it ' s a very small
lot . But it fits in with the neighborhood .
The property as it is used now is bulkheaded and in the summer
they do keep their boat there , but they find that , Number One , it
is quite inconvenient because it is across a road , and they also
find from their own experiences and from complaints from the neighbors

that the area where the building is proposed has a tendency to be
used as a park--peaple come_ there using it in the evenings , or
trespassers when people are not around , particularly in the
non-summer periods . We feel that this would , by having a building
there which would eliminate that problem and eliminate an area that
is in :a sense a bit, of a nuisance , to the adjoining landowners .
I believe based on the papers submitted there that you will
agree that there is no problem of the public , health , safety or
welfare created by this . To the contrary the Health Department
has acquiesed in it as well as the D. E . C .
Again , to deny the application you really will be creating
a hardship for these people because they will not be able to use
the property , a practical difficulty , for the purpose for which
they originally bought it. They bought it with the idea as time
went on , when they got some money , they would be able to put a
house that they want on this particular lot .
Again , they w�ould be very happy to make the road part of the
lot , also increasing the size of it . And I think this is a situa-
tion where it ' s unique , not found by other properties in the area .
The property is cut down based upon the way the canal was cut out .
We also happen to have a fresh spring there which eats away at that
area , making it much smaller than say the property to the north and
a little bit to the south . If you look at the overall tax map of
the area , you ' 71 see that most of the houses on the properties to
the south are substantially of the same size , maybe a little bit
bigger , and I think this would be helpful to the community and the
neighborhood .
I have here , if the board would like to see it , pictures of
the subject property.
MR . CHAIRMAN : Mr . Bruer , do you know the approximately square
footage of the road?
MR. BRUER: Just by doing a calculation , it ' s 50 ' wide .
MR . CHAIRMAN : I can figure it--
MR . BRUER : You ' 71 notice that from these pictures , that the
area that is used is only 15 feet , and if I may point out to you ,
where the proposed well would be , there is plenty of property in
the road . The road consists of all this grass area here plus way
over here ( referring to pictures ) . And there is plenty of area here
where to place the well . It ' s 370 ' long by 50 ' wide .
MR. CHAIRMAN : Do you have any idea how large of a house they
- plan to build on this . property?

MR . STEGNER : Eleven-hundred square feet .
MR . BRUER: This is Mr . and Mrs . Stegner here . It would be
1 , 100 sq . ft . By the way , here ' s another picture showing across
the way and the houses next door.
MR. CHAIRMANa Mr. Lessard asked me , he said of course , the
remaining property owners going out to Bayview Road having a
right-of-way over 1;he same parcel , is that correct?
MR. BRUER: Of course , yes . It services the property to the
south of us--there ' s no question about it .
MR. CHAIRMAN : The reason why I asked the question about the
size of the house riormally means would they be returning for a
variance for a side� or rear , or frontyard , in the near future?
MR . STEGNER: The only problem--if we were allowed to use a
portion of the roacl that is not used--let ' s say , 35 ' of it , it
shouldn ' t be a prot�lem.
MR . CHAIRMAN : The other thing , what ' s your timeliness involved
in this? Are you starting construction this spring assuming that
this application wa.s granted? We have asked our town engineer , Mr.
Davis , to go down a,nd inspect the road and he has not gotten back to
us . I really hope that he didn ' t get stuck down there because we
sent him down there on the worst day of the year , which was last
Tuesday .
MRS. STEGNER : And oh was it raining .
MR . BRUER: They were there . Was he there?
MR. CHAIRMAN : At the same time we went down there with Mr.
Lessard ' s car and we didn ' t want any lack of repour , so therefore
we didn ' t venture over the road that very poor day that we were
referring to with Mr. Price before . So there is going to be a
little time involved h.ere in finding out what Mr. Davis would
require in his opinion . As you know , we don ' t necessarily take
his opinion all the time . We have modified his opinion . So there •
will be some time involved here .
MR . BRUER: I would be happy to leave the pictures during
the term of the board ' s determination here- for a period of time
until you make up your mind , if it might be useful .
MR . CHAIRMAN : Yes . Ok . I guess what we would do , after
we go through the group of people here and see if anybody is here
either pro or con concerning this , is close the hearing pending
a receipt of an evaluation from Mr. Davis . And he is usually very

prompt . And as I said , at this time of the year , sometimes people
go on vacations and so on , so it may be a little while before we
get to it . .
MR. BRUER: All right.
MR . STEGNER : Just to mention one thing--there is no yearround
residents off that road , and that if it snows or something , it won ' t
be plowed because there ' s no one living there . There ' s no one using
the road .
MR . CHAIRMAN : What we ' re primarily interested in , Mr . Stegner ,
is support services like fire vehicles so that they would not be
stuck if there was a fire down there--so the road would have to
support them minimally.
MR . BRUER: They ' re aware of your preliminary requirements
with respect to roads .
MR . CHAIRMAN : Al1 right . Does anybody else have any questions
of Mr. Bruer? Mr . Douglass? Anybody? (None ) Did you want some of
these back?
MR . BRUER : Leave it here for the file if you want .
MR. CHAIRMAN : I think you gave me copies of that . Oh , no--
that was the ori9inal . Ok . No , I don ' t have a Health Department
stamped copy.
MR . BRUER : I don ' t have an extra one . It must be in my file .
I ' 71 make a photocopy for you, in case anyone wants to see it .
MR . CHAIRMAN : Wonderful . Is there anything else you would
like to say, Mr. Bruer?
MR. BRUER: No , I thinks that ' s it. Unless there are other
