Once again I write concerning the roads in the West Creek
Estates subdivision in Southold. This time I write in behalf
of, and at the direction of, The West Creek Estates Property
Owners Association in accordance with a motion passed at
their July 8th meeting. I attach a copy of your reply to my
previous letter. Acting on your advice, and on your recommend-
ation to Bill Pfeffer-then our president~the association re-
tained the services of Richard Lark to represent them in
forming a road district, thus enabling the Town of Southold
to upgrade the roads and assume responsibility for maintenance.
A petition signed by forty five property owners in the sub-
division was submitted to your office on August 19, 1986 by
the attorney. However the attorney failed to make an agreement
with the developers and owners of the roads, Ernest and Harold
Wilsberg, and the road properties were purchased by Suffolk
County ~t tax sale in November, 1986. The developers, with the
sale of their last remaining lots ~everal years ago, ceased
paying property taxes as well as having aabandoned maintenance
of their roads. They, however, continued to accept payment of
yearly fees mandated in the covenants filed by them.
Needless to say, the association was extremely disappointed
with the outcome and requested an explanation from the attorney.
Mr. Lark responded: "At -the time Mr. Pfeffer asked me to
handle this matter for the association, i was unaware of the
Wiisbergs~desire to ektract money from mhe association, and
~outhold Town's unwillingness to acquire the roads because of
their condition~:~ The latter part of Mr. Lar~'s statement is
difficult to understand in view of your offer of assistance
on behalf of the town.
It is now known that the county filed the tax deed to the roads
on February 23rd of this year, and that after six months have
elapsed, the Wilsbergs will have lost all rights to redeem
ownership of the roads-if indeed they wish to do so. It is also
understood that the county, rather than putting the roads up

for sale, will in all liklihood-since the roa~s constitute
the only acess to forty seven of the fifty one lots-offer the
roads to the town.
The association, in an effort to find how this situation could
have developed, reviewed the files of the Southola Town Plan-
ing Board and made some interesting findings. The minutes of
the May 7, 1963 board meeting contains a resolution by the
board to forward a letter to the town board requesting they
be I'urnisned wit~ the cost of the 'considerable length' of high-
way in West Creek Estates for which the town had paid for the
construction as a pilot project.~'rom what is known the con-
siderable length amounts to approximately eighty percent of
the roads in the subdivision. It would appear that the town
had already authorized, constructed, and paid for the roads
by the time o~ this meeting. At the subsequent meeting on May
El, i963 where the subdivision was granted final approval, the
board resolved to waive rules and regulations requiring park
and playground or cash equivalent; and to waive the require-
ment for a performance bond. Interestly the roads w~re not
being'dedicated to the town. There is no mndlca%ion why this
unusual and generous arrangement was being given the developers.
Other town records may provide further information.
It is with this background that the property owners~in 5his
subdivision now find themselves in limbo, devo.ia of many town
services for which taxes are paid, They must contend by them-
selves wit~ potholes~ storm cleanup,snow removal, and the
road and drainage conditions pose a safety hazard to young and
old. Attempts to ~ave the town assume the roads have previous-
ly met with rebuff from both town and developers. The only
good news-if we can call it thav~is that t~e d~velopers may
finally be out of the picture. Therefore, in view o~' the un-
usual and generous cooperavion given the developers by a pre-
vious town administration, the association requests the same
cooperation be given the property owners in this subdivision;
and that the town expedite the subdivision roads from county
to town ownership. The assocmation stands reamy to meet with
you, and the town boar~ if necessary, to solve this long
s%anming problem. Thank you.

I am in receipt of your letter in reference to the roads
in West Creek Estates.
We are aware of the conditions of the roads in your area
and have been working with Bill Pfieffer, Mr. Raymond Dean and
our town attorney for a long time trying to solve the problem.
Mr. Dean has agreed to do the work, which will save the resi-
dents quite an expense. However, before anything can be done,
a district will have to be formed. This has been explained to
the association on several occasions. The association should
have their own attorney as our town attorney cannot do this for
them. Mr. Tasker has set up procedures for the association to
follow in order to form this district and has forward~d copies
to them.
We have always tried to help and will continue to do so.
If we can be of any further assistance please do not hesitate
to call.

the undersigned, being the owners of real estate fronting

gutters, culverts, and other improvements for necessary and proper

It is respectfully requested and petitioned that said improve-

The maximum amount proposed for the improvement aforesaid to be

A "street" is a street improved to the satisfaction of the
Planning Board 100-13 Page 10014. Therefore, either the

The sub-division was approved in 1963 end the sub-division
map on file in the Building Dept. shows a proposed beach and a
proposed marina. All residents and lot owners that we have
contacted feel that when completed they would have beach rights
and, if not on the creek, an opportunity to moor their boat in
the marina.
It has recently come to our attention that the owners,
Wilsberg Brothers of Mattituck are planning to sell the marina
with an adjoining lot for which they still have title. Now,
we realize that no one has anything to support the second para-
graph in their deeds. Up to now we felt the the marina could
not be sold without submitting a new sub-division map because
the owners have been taxed $100.00 on one entity: the roads,
proposed beach, and proposed marina.
We searched the minutes of the Planning Board meetings
held from 1961 to 1964 and found nothing in the minutes speci-
fically dealing with such rights.
The following items are in the minutes:
1-Glenn Road was built with Tow~ equipment, materials and labor
so as the Commossioner of Highways could get some gauge of the

Board the minutes simply stqte that there was "considerable
discussion."
3-The Town regulations requiring Parks and Recreation areas or
a cash reimbursement was waived without stating the reason.
Our feeling is that perhaps these considerations were so
favorable to Wilsberg Brothers because they were to provide by
their plauning, a beach and a marina.

by the Southold Town Planning Board at their meeting of
N(wember 19, 1962:
In the matter of the application of Ernest and Harold
Wilsberg for the approval of a proposed town highway to be
known as Glenn Road at Southold, New York, Map by Otto W.
Van Tuyl & Son dated August 16, 1962, the Planning Board
is unwilling to approve the plans for this proposed town
highway until such time as a subdivision map is filed.
The Planning Board has been advised by Mr. Price that
this road was constructed by the Town of Southold, men and
equipment, to establish the cost of construction of a highway
of this type at this time, and the Planning Bgard requests
that the Town Board furnish the figures on this project which
would be of great value to the Planning Board in figuring
subdivision highway costs for performance bond purposes.

In behalf of my clients, Ernest and Harold Wilsberg, of Mattituck,
application is hereby made for your approval of a proposed Town Highway.
The Wilsbergs own a large tract of land in Soutnold bordering on the
south on West Creek and on the west by Main Bayview Road. They wish to
develop this tract of land and desire to dedicate to the Town of Southold
land for Town Highway purposes running from east to west in said tract.
Pursuant to the Town Highway's specifications, I file with this letter
of application three prints of said survey.
Your prompt consideration of this application and its approval as
soon as possible would be greatly appreciated. For your information, it
