NOW, THEREFORE, in consideration of the peemises, the
Declarant declares that the above described real property is held
subject to the following covenants and restrictions:
(1) No lot shall be subdivided or changed in any
manner unless authorized by the Planning Board of the Town of
Southold.
(2) ~ll stormwater runoff created by the development
and improvement of this tract shall be retained within the site by
adequate drainage structures and shall not be discharged directly
into the waterways of Goose Creek.
(3) No new sanitary disposal facilities shall be
located within one hundred (100) feet of the waterways of Goose
Creek.
(4) No residential structure shall be located '.vitllin
100 feet of the dredged canal bordering the northerly side of the
parcel.
(5) These covenants and restrictions shall run with
the land, subject to the right of the Planning Board of the Town
of Southold to amend, annul or repeal any or all of the foregoing
covenants and restrictions at any time.

Pursupnt to your letter of December 15, 1982 please be advised
that in order to obtain a building permit you will have to
contact the Zoning Board of Appeals for their determination on
the right-of-way in question. The right-of-way is outside the
metes and bounds of the property in which the Planning Board
has no jurisdiction on its approval.
I have forwarded a copy of the subdivision map, and a copy of
your letter to the Board of Appeals. Please contact them for
further information.

AND RESTRICTIONS
This Declaration made and dated the
day of December, 1981,
by ROBERT NELSON, JR.. residing at 608 Fifth Avenue, New York, New
York, hereinafter referred to as the Declarant:
WIT N E SSE T H :
WHEREAS, Declarant is the owner in fee simple of the following
described real property:
ALL that certain lot, piece or parcel of land beginning at
a concrete monument set on the boundary line between land of the party
of the first part and land of "Goose Bay Estates", as shown on a map
entitled "Map of Goose Bay Estates at Southold, Long Island,. filed in
the Suffolk County Clerk's Office Nov. 13, 1934 as Map No. 1176; being
the northwesterly corner of land conveyed by the party of the first
party to Rix McDavid by deed dated June, 1949; from said point of
beginning running along boundary line North 17 degrees 34 minutes 30
seconds East 330 feet, more or less, to a dredged canal leading to
Goose Creek; thence in a general easterly direction along said dredged
canal about 250 feet; thence in a general southerly direction along the
westerly edge of another dredged canal leading to Goose Creek, about
250 feet, to land now or formerly of Howard A. Toedter; thence along
said land of Toedter, (now or formerly) South 17 degrees 40 minutes 30
seconds West 190 feet, more or less; thence along the northerly line of
a certain 30 foot right of way (#3 as hereinafter described) and along
said land now or formerly of McDavid, North 72 dgrees 25 minutes 30
seconds West 320.39 feet to the point of beginning.
1) Together with a right of way 30 feet in width from a point on the
southerly boundary of the property hereinabove described at the
northeasterly corner of said land now or formerly of McDavid, southerly
about 760 feet, thence easterly at right angles to said 30 foot right
of way (#2) as described below).
2) Also with a right of way 30 feet in width over said land now or
formerly of Toedter and adjoining the westerly boundary thereof, from
North Bayview Road northerly about 1620 feet to said dredged canal
leading to Goose Creek.
3) Also with a right of way 30 feet in width, the northerly line of
which is said southerly boundary of the property hereinabove
described, from said point on said southerly boundary at said
northeasterly corner of McDavid; (now or formerly) easterly about 170
feet to said land now or formerly of Toedter and to said 30 foot right
of way (#1) as described above).
4) Also with a right of way beginning at a point about 35 feet
southerly from said dredged canal along the easterly line of said 30
feet right of way #(2) described above; and running northeasterly
about 1400 feet to the "North Road to Bayview".

WHEREAS, Declarant has applied for approval of a
subdivision plat entitled "Minor Subdivision of Robert C. Nelson
Jr." of the above described real property; and
WHEREAS, Declarant, pursuant to the recommendation of the
Planning Board of the Town of Southold, deems it advisable to
impose certain covenants and restrictions upon the said real
property.
NOW, THEREFORE, in consideration of the premises, the
Declarant declares that the above described real property is
held subject to the following covenants and restrictions:
(I) No lot shall be subdivided or changed in any
manner unless authorized by the Planning Board "of the Town of
Southold.
(2) All stormwater runoff created by the
development and improvement of this tract shall be retained
within the site by adequate drainage structures and shall not be
discharged directly into the waterways of Goose Creek.
(3) No new sanitary disposal facilities shall be
located within one hundred (100) feet of the waterways of Goose
Creek.
(4) No residential structure shall be located
within 100 feet of the dredged canal bordering the northerly
side of the parcel.
(5) 'rhese covenants and restrictions shall run with
the land, subject to the right of the Planning Board of the
Town of Southold to amend, annul or repeal any or all of the
foregoing covenants and restrictions at any time.

Pursuant to Article 8 of the Environmental Conservation Law
state Environmental Quality Review Act and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of Southold, notice is
hereby given that Southold Town Planning Board as lead agency for
the action described below has determined that the project will not
have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of Robert C. Nelson, is a two-lot subdivision
located at Bayview, Southold.
The project has been determined not to have a significant effect
on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project be
implemented as planned.
Because there has been no response in the allotted time
from the New York State Department of Environmental
Conservation it is assumed that there is no objection
nor comments by that agency. Applicant should be aware
that a permit may be required because of the proximity
to the wetlands.
The Suffolk County Department of Health Services has
indicated its agreement with the lead agency designation.
Prior to commenting on the water supply or septic system, a
test well and a determination from the State DEC concerning
wetlands would be necessary.
The project will meet all the requirements of the Code of
the Town of Southold Subdivision of Land Regulations.

Dear Mr. Raynor:
We are submitting, on behalf of the applicant in connection with
the above subdivision, an estimate as to the cost to widen the
access way to the subdivision. This was prepared by Young & Young
under date of September 25, 1981 after an on site consultation
with a general contractor. As you are aware, the owner simply
seeks to divide the existing parcel into two parcels and, thus,
the use of the access way would be increased only by the travel of
an additional vehicle or vehicles to the second parcel. Under
this circumstance, to cause the applicant to spend an additional
$4000,00 is burdensome.
The general contractor who examined the roadway felt that adding
two feet of gravel would be an impractical solution to upgrading
the road. The loose gravel that would be placed along side the
existing track would have no compaction value. Furthermore, the
use of trucks and other heavy equipment on and over the existing
surface during the course of the upgrading would tend to destroy
the present stabilized surface and diminish the quality of the
road.
We also point out that there are other lot owners as well as
existing dwellings between N. Bayview Road and the beginning of
the subdivided parcel, all of whom would apparently benefit from
the proposed widening, none of whom would be burdened by it.
The applicant does not object to improving the extended section,
i.e. from the end of the existing road or access way into the
proposed subdivision.

I visited thE3 above captioned site on two occasions, the
latter occasion in the company of General Contractor Edward Bucholz
of Riverhead Cement Block Company,-Inc.
I found the roadway in question
a large quantity of 3/4 inch gravel.

two feet of 3/4 inch gravel would be a most impractical solution
to upgrading the road. The loose gravel that would be placed along-
side of the track would have no compaction value and the destruction
of the existing stabilized surface would diminish the quality of
the surface.
I have, with the aid of Mr. Bucholz, prepared an estimate to
widen the roadway as recommended by the Southold Town Planning Board.

Dear Mr. Raynor:
The Suffolk County Planning Commission at its regular meeting on August 5,
1981, reviewed the proposed subdivision plat entitled, "Minor Subdivision -
Robert C. Nelson, Jr.", referred to it pursuant to Section 1333 of the Suffolk
County Charter. After due study and deliberation it resolved to approve said
map subject to the following six conditions deemed necessary to help preserve
the natural and aesthetic attributes of the waterways of Goose Creek:
1. No lot shall be changed in any manner unless so authorized by the
Southold Town Planning Board.
2. All stormwater runoff created by the development and improvement of this
tract shall be retained within the site by adequate drainage structures
and shall not be discharged directly into the waterways of Goose Creek.
3. No sanitary disposal facility shall be installed or constructed within
100 feet of the waterways of Goose Creek.
4. No residential structure shall be located within 100 feet of the dredged
canal bordering the northerly side of the parcel.
5. Approval of this subdivision shall be made subject to its meeting the
requirements and standards of the Suffolk County Department of Health
Services.

northwesterly corner of land conveyed by the party of the first party

I made an inspection of the existing road in the above R.O.W. as follows:
1. The road is approximately 13::0 ft. in length (speedometer reading) from
North Bayview Rd. to tile driveway at a house on 1he wast side of the road
which is on property adjacent to the south side of till subdivision.
2. The one way road is stabilized with gravel at a depth of 2"-;l; fur a liidth of
8 ft.:! to the last driveway and appears adequate for liftlt traffic.
3. The Van Thyl survey' shows :ili24 ft. from Nortil Bayview Road to the Nelsen
subdivision. The north end of the road should be extended the necessary
distance to the subdivision including the 25 width shom far access to
Subdivision Lot No.1 from the R.O.W.
4. Recommendations:
a. Widen road to 10 ft. in width.
b. Stabilize widening with 3" of gravel.
c. For exterded se,ction, remove topsoil, rq>lace wi th bankrun and stabilize
wi th 3" of grav'el.
d. Clear small trees that are too close to the road.
