Thereafter, a new permit shall be required. Metzger, dated March 18, 2004, is beyond Article 25 (Tidal Wetlands Act) jurisdiction. The parcel is more than 100 feet from regulated freshwater wetlands and is beyond Article 24 (Freshwater Wetlands Act) jurisdiction. Therefore, in accordance with the current Tidal Wetlands Regulations (6NYCRR Part 661) and Freshwater Wetlands Regulations (6NYCRR Part 663), nb permits are required under the Tidal Wetlands or Freshwater Wetlands Act (Articles 25 and 24, respectively). Please be advised, however, that no cpnstruction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands or freshwater wetlands jurisdictional boundaries, as indicated above, without a permit. It is your responsibility to ensure that all precautions are taken to prevent any sedimentation or other alteration or disturbance to. the ground surface or vegetation within Tidal Wetlands or Freshwater Wetlands jurisdiction which may result from your project.
