Southold, NY 11971 Re: Proposed major subdivision for Bayview/South Harbor Partnership - Phase 2 SCTM # 1000-75-4-8 & 22.1 Dear Mr. Croteau: The following resolution was adopted by the Southold Town Planning Board at a meeting held on Monday, October 6, 1997: The final public hearing, which was held at 7:30 p.m. wes closed. The following resolution was adopted: WHEREAS, Bayview South Harbor Partnership is the owner of the property known and designated as SCTM# 1000-75-4-8 & 22.1, located on the east side of South Harbor Rd. and the west side of Main Bayview Rd. in Southold; and WHEREAS, the Planning Board has classified the current application as a major subdivision since there have been prior subdivisions on the subject lot and the current application brings the total number of lots to 5; and WHEREAS, Lot Number 2 of the subdivision approved by the Planning Board on October 24, 1994 included a total area of 12.5472 acres of which 9.3741 acres is located within a conservation easement and 3.1731 acres is located within a development area; and WHEREAS, the subdivision before the Planning Board is for a clustered Page 2 Proposed major subdivision for Bayview South Harbor Partnership October 7, 1997 subdivision of 3 lots within the 3.1731 development area; and WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental Quality Review Act, (Article 8), Part 617, declared itself lead agency and issued a Negative Declaration on November 25, 1996; and WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of Public Hearing, has received affidavits that the applicant has complied with the notification provisions; and WHEREAS, a final public hearing was closed on said subdivision application at the Town Hall, Southold, New York on October 6, 1997; and WHEREAS, all the requirements of the Subdivision Regulations of the Town of Southold have been met; be it therefore RESOLVED, that the Southold Town Planning Board approve and authorize the Chairman-to endorse the final surveys dated September 25, 1997. Enclosed please find a copy of the map which was endorsed by the Chairman. The mylar maps, which were also endorsed by the Chairman, must be picked up at this office and filed in the office of the County Clerk. The question of whether an action may be significant is not always easy to answer. Frequent- ly, there are aspects of a project that are subjective or unmeasureable. It is also understood t~at those who determine significance may have little or no formal knowledge of the environment or may be technically~expert in environmental analysis. In addition, many who have knowledge in one particular area may not be aware of the broader c~ncerns affecting the question of significance. The full EAF is intended to provide a method whereby applicants and agencies can be assur;d that tho determination process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit a project or action. Full lEAF Components: The full EAF is comprised of three parts: Par~ 1: Provides objective data and information about a §ivan project and its site. By identifying basic project data, it assists a reviewer in the analysis that takes place in Parts 2 and 3. Part 2: Focuses on identifying the range of possible impacts that may occur from a project-or action. The variance sought is to amend the required rear yard from 50 feet to 20 feet. In reviewing the Planning Board subdivision file for this cluster minor subdivision, I seamhed for specific reasons for the Planning Board's imposition of alternative setback requirements on the lots in this subdivision. The setbacks that were imposed by the Planning Board are equivalent to the setbacks normally required in the R~40 zone. The subject lot (of this application before the ZBA) fronts on South Harbor Road. The other two lots in this subdivision front on Grange Road. Therefore, the rear yard of this lot is adjacent to the side yard of the adjacent lot to the east. Given that there don't seem to be any specific environmental constraints on this lot prohibiting construction within 20 feet of the rear property line, this appears to be a matter that where the Zoning Board of Appeals must determine the potential impact of such a variance on the neighborhood (specifically the adjacent lot to the east). The proposal preserves agricultural lands and will be below the allowed density under existing zoning. The location of the homes in the northwestern corner of the site will minimize impacts to ground water and the Goose Creek ecosystem, which would likely be impacted if the eastern half of the site were developed. Visual impacts are also minimized by the proposed cluster plan. Correspondence has been received from the Department of Health Service. The SCDHS has no objection to the planning Board's designation as lead agency. Correspondence has been received from the New York State Department of Environmental Conservation. Environmental and Planning Considerations The parcel has been inspected and cnviromncntal references concerning the site and area have been consulted. The site consists of 12.49 acres of land and is located in the hamlet of Southold in the Town of Southold. The property is located between South Harbor Road and Bayvicw Road to the north of the Fire Department substation- The subject parcel has 804 feet of frontage on South Harbor Road, 423 feet of frontage on Bayview Road, and 72 feet of frontage at thc end oftha Grange Road cul-de-sac. Only the northwestern 3.12 acres of the site will be developed; and thc remaining 9.37 acres of the property has been set aside as an Agricultural Reserve Easement Area under the Peconic Land Trust. Thc area to be developed has 287 fcct of frontage on South Harbor Road and 72 fect of frontage on Grange Road. The project site is zoned R-80 Residential, requiring lot sizes of 80,000 square feet. The proposed action involves division of thc land into four lots, including three clustered residential lots and thc 9.37 acre conservation parcel. The sizes of the three proposed residential lots are as follows: Lot 1, 48,977 s.f.; Lot 2, 43,721 s.f., and Lot 3, 43,126 s.f. Two of the lots will be accessed from Grange Road, while the other will be accessed from South Harbor Road. Although there are no slopes over 10 percent on site, the property slopes steadily eastward from a high of approximately 21 feet above mean sea level (msl) in the northwestern comer of LOt 1 to a low of approximately 7 feet above msl near Bayvicw Road. The proposed residential area is relatively fiat. The overall property drains toward Southold Bay via Goose Creek, which is located across Bayview Road. There is a small recharge area at the end of Grange Road adjacent to proposed Lot 3 which handles runoff from the cul-de-sac. The entire site appears to have been under cultivation until recently, and the western portion of the agricultural easement area is currently in use for vegetable crops. A cover crop of clover has been planted in a bed encompassing most of the three development parcels, and the remainder of the site is mown tuff. A narrow edge of black locust and other early successional species is present along the northern boundary of the site, and top soil and farm equipment is stored near the fire house. The eastern portion of the site is adjacent to Goose Creek, which is recognized as a Critical Environmental Area. The proposed residential parcels ave over 600 feet from the wetlands associated with the creek, and thus construction should not impact this area. Continuing management of the agricultural easement area might inehide leaving an uncultivated buffer along Bayview Road to minimize runoffofpesticides and fertilizer into the creek. The elevation of groundwater beneath the site is at approximately 2 feet above mean sea level (msl) and the topographic elevation ranges from 7 feet above msl to 21 feet above mean sea level. Thus the depth to groundwater ranges from approximately 6 feet to 19 feet. The minimum depth to water on the three residential lots is approximately 11 feet, which should not present constraints for sanitary system location and design. The subject site is located in outside the Water Budget Area as mapped by the Suffolk County Department of Health Services (SCDHS). The Water Budget Area includes those locations where there is sufficient groundwater to develop large public water supply wells. Outside the budget areas, there is only sufficient supply to allow the development of smaller home well systems. The subject site is also located in SCDHS Groundwater Management Zone IV, which covers the North Fork and portions of the South Fork. According to the North Fork Water Supply Plan (ERM-N0rtheast, Camp Dresser & McKee, 1983), the subject site is in an area significantly impacted by both nitrogen and aldicarb, with concentrations over 8 mg/I and 7 ug/l, respectively. Land use in the immediate vicinity of the site is established in single-family residential use, with a fLre house immediately south of the site. The area surrounding the site is zoned R-40 and R-80 Residential, although there are some pre-existing undersized lots in the area. The proposed project would create a duster of three undersized residential lots in exchange for preservation of a large agricultural easement. As the allowable yield on the property is up to six lots, the proposed plan will be beneficial. Furthermore, the proposed one acre lots will be consistent with the surrounding land use and the conservation easement will provide open space and align with a similar existing easement to the northeast. Thc location of the proposed cluster is adjacent to other homes which will also help to minimize impacts. The additional homes will create a slight increase in demand for community services, including police, fire and school districts, although these impacts will be minimal. In conclusion, there arc no significant sensitive cnviromncntal resources on the subject site that would will be impacted by the proposed cluster development. The proposal preserves agricultural lands and will be below thc allowed density under existing zoning. The location of the homes in thc northwestern corner oftbe site will minimize impacts to ground water and the Goose Creek ecosystem, which would likely be impacted if the eastern half of thc site were developed. Tasks and completed activities are identified as follows: 1. Review Part I LEAF The parcel has been field inspected by CVA, and the LEAF has been reviewed and amended as necessary. A copy of same is attached. 2. prepare Part II LEAF The Part II LEAF checklist has been completed and is also attached. Additional information concerning our findings is included below. 3. Environmental and Planning Considerations The parcel has been inspected and environmental references concerning the site and area have been consulted. The site consists of 12.49 acres of land and is located in the hamlet of Southold in the Town of Southold. The property is located between South Harbor Road and Bayview Road to the north of the Fire Department substation. The subject parcel has 804 feet of frontage on South Harbor Road, 423 feet of frontage on Bayview Road, and 72 feet of frontage at the end of the Grange Road cul-de-sac. Only the northwestern 3.12 acres of the site will be developed; and the remaining 9.37 acres of the property has been set aside as an Agricultural Reserve Easement Area under the Peconic Land Trust. The area to be developed has 287 feet of frontage on South Harbor Road and 72 feet of frontage on Grange Road. The project site is zoned R-80 Residential, requinng lot sizes of 80,000 square feet. The proposed action involves division of the land into four lots, including three clustered residential lots and the 9.37 acre conservation parcel. The sizes of the three proposed residential lots are as follows: Lot 1, 48,977 s.f.; Lot 2, 43,721 s.f., and Lot 3, 43,126 s.f. The proposed residential lots are entirely Haven Loam, which is conducive to leaching and should not constrain development. Although there are no slopes over 10 percent on site, the property slopes steadily eastward from a high of approximately 21 feet above mean sea level (msl) in the northwestern corner of Lot 1 to a low of approximately 7 feet above msl near Bayview Road. The proposed residential area is relatively flat. The overall property drains toward Southold Bay via Goose Creel which is located across Bayview Road. There is a small recharge area at the end of Grange Road adjacent to proposed Lot 3 which handles runoff from the cul-de-sac. The entire site appears to have been under cultivation until recently, and the western portion oftbe agricultural easement area is currently in use for vegetable crops. A cover crop of clover has been planted in a bed encompassing most of the three development pamels, and the remainder of the site is rnown tuff. A narrow edge of black locust and other early successional species is present along the northern boundary of the site, and top soil and farm equipment is stored near the fire house. The eastern portion of the site is adjacent to Goose Creek, which is recognized as a Critical Environmental Area. The proposed residential parcels are over 600 feet from the wetlands associated with the creek, and thus construction should not impact this area. Continuing management of the agricultural easement area might include leaving an uncultivated buffer along Bayview Road to minimize runoffofpesticides and fertilizer into the creek. The elevation of groundwater beneath the site is at approximately 2 feet above mean sea level (msl) and the topographic elevation ranges from 7 feet above msl to 21 feet above mean sea level. Thus the depth to groundwater ranges from approximately 6 feet to 19 feet. The minimum depth to water on the three residential lots is approximately 11 feet, which should not present constraints for sanitary system location and design. The subject site is located in outside the Water Budget Area as mapped by the Suffolk County Department of Health Services (SCDHS). The Water Budget Area includes those locations where there is sufficient groundwater to develop large public water supply wells. Outside the budget areas, there is only sufficient supply to allow the development of smaller home well systems. The subject site is also located in SCDHS Groundwater Management Zone IV, which covers the North Fork and portions of the South Fork. According to the North Fork Water Supply Plan (ERM-Northeast, Camp Dresser & MeKee, 1983), the subject site is in an area significantly impacted by both nitrogen and aldicarb, with concentrations over 8 mg/l and 7 ug/1, respectively. Land use in the immediate vicinity of the site is established in single-family residential use, with a fire house immediately south of the site. The area surrounding the site is zoned R-40 and R-80 Residential, although there are some pre-existing undersized lots in the area. The proposed project would create a cluster of three undersized residential lots in exchange for preservation of a large agricultural easement. As the allowable yield on the property is up to six lots, the proposed plan will be beneficial. Furthermore, the proposed one acre lots will be consistent with the surrounding land use and the conservation easement will provide open space and align with a similar existing easement to the northeast. The location of the proposed cluster is adjacent to other homes which will also help to Ininimi?g impacts. The additional homes will create a slight increase in demand for community services, including police, fare and school districts, although these impacts will be minimal. In conclusion, there are no significant sensitive environmental resources on the subject site that would will be impacted by the proposed cluster development. The proposal preserves agricultural lands and will be below the allowed density under existing zoning. Thc location of the homes in the northwestern corner of the site will minimize impacts to ground water and the Goose Creek ecosystem, which would likely be impacted if the eastern half of the site were developed. Visual impacts are also minimized by the proposed cluster plan. Thus, the proposed action is well designed and is not expected to result in significant environmental impacts.
