Koehler, Jr. is the owner of the property known and designated as Osprey's Dominion Vineyards, located at 44075 Main Road, Peconic; and WHEREAS, this amended site plan is for an agricultural storage building; and WHEREAS, in a letter dated February 27th, 2002, Suffolk County has granted approval for the location of this building on land from which the County purchased the development rights, with the understanding that it will used for equipment storage and not be used for wine storage, and further, will be subject to local ordinances; and WHEREAS, this amended site plan was certified as an agricultural storage building by the Building Department on June 24th, 2002; and WHEREAS, the Planning Board has accepted the Town Engineer's recommendations and as a term of this conditional approval require the applicant to conform to the report dated July 30th, 2002; and WHEREAS, the Southold Town Planning Board, on June 24th, 2002, determined that this action is classified as Type II and not subject to review under the State Environmental Quality Review Act (Article 8), Part 617; and . . Osorev's Dominion - Paae Two - 13 Auaust 2002 WHEREAS, a final public hearing was closed on the Osprey's Dominion application at the Town Hall, Southold, New York on August 12th, 2002; be it therefore RESOLVED that the Southold Town Planning Board ~rant final approval on the surveys, dated January 31st, 1996, and last revised on May 17 ,2002, subject to fulfillment of the following condition: All requirements of the Town Engineer's report, dated July 30th, 2002, must be satisfied before the Building Department can issue a building permit. The plans for this project indicate an 8,000 square foot building that will be insulated and have mechanical equipment installed to condition the space. This building may be classified as a commercial structure by the Building Department and may be in conflict with the fact that the development rights have been sold to Suffolk County. I am aware of the County's letter with regard to this matter but I am confused why such a large building would be allowed on property where development rights have been sold. It appears that there is ample room left on the 4.5 acre section where development rights have not been sold to facilitate construction of a building of this magnitude. My office has completed a drainage review of the proposed project in the event that the Planning Board approves this site plan. The construction indicated by the plans should require the installation of leaching pools to contain the roof run-off generated by the development. Four (4) - eight (8') foot diameter by eight (8') deep pre-cast concrete leaching pools should be located at each corner of the proposed building. A system of gutters and leaders should be installed to deliver roof run-off directly to these leaching pools. Two (2) additional eight (8') foot diameter by eight (8') deep pools (with cast iron inlet grates & frames) should be installed at a low point adjacent to the proposed asphalt driveway. In addition, the top of slope between the existing wetlands and the proposed construction will need to be protected by sediment barricades. This installation should be situated in a manner that will prevent silt & erosion soils from entering the wetland areas during construction. The plans for this project indicate an 8,000 square foot building that will be insulated and have mechanical equipment installed to condition the space. This building may be classified as a commercial structure by the Building Department and may be in conflict with the fact that the development rights have been sold to Suffolk County. I am aware of the County's letter with regard to this matter but I am confused why such a large building would be allowed on property where development rights have been sold. It appears that there is ample room left on the 4.5 acre section where development rights have not been sold to facilitate construction of a building of this magnitude. My office has completed a drainage review of the proposed project in the event that the Planning Board approves this site plan. The construction indicated by the plans should require the installation of leaching pools to contain the roof run-off generated by the development. Four (4) - eight (8') foot diameter by eight (8') deep pre-cast concrete leaching pools should be located at each corner of the proposed building. A system of gutters and leaders should be installed to deliver roof run-off directly to these leaching pools. Two (2) additional eight (8') foot diameter by eight (8') deep pools (with cast iron inlet grates & frames) should be installed at a low point adjacent to the proposed asphalt driveway. In addition, the top of slope between the existing wetlands and the proposed construction will need to be protected by sediment barricades.
