The committee feels strongly as to the importance of viewing this elevation given the fact that the proposed work will extend substantially beyond the limits of the existing building and be visible from the Main Road. However, I was led to believe that perhaps we could move through the SEQRA process to an extent, and hopefully get the sketch plan approval and then maybe the County would take a more serious look at buying the property. And I know that you have some experts who have communicated with you in the past, but I would like to perhaps by the next worksession or next meeting, perhaps get out of SEQRA with regard to that subdivision. We did allow Dr. Lamont, I think his name is, a botanist, onto the site to let him collect whatever (inaudible) he wanted to look at, and we did. do some e~tra field work. One thing we didn't want to do was star~ huge archeological digs all over the site, especially with the view that we had already done some archeological work and if the County is going t~ buy it, it Wouldn't serve any purpose. So, I was hoping that by the next meeting perhaps, this Board could end SEQRA and get us into a sketch plan. I will, after tonight's meeting, send some (inaudible)< information to the Board. I spoke to Mr. Fisher at the Building Department today and he said probably the only one that could help me was to ask the Board. The problem that I have is that we were required by the Health Department to put a new well in, 150 foot. Krei~er Well Diggers went in and we tested it and the water wasn't 3ust right, it had some impurities in it. So we drove the hole deeper and it still didn't test 100%. Bob's not here, but where we are at on that is you filed, we did approve a site plan, when the conditions of the site plan are met a certificate of occupancy could be issued then by the Building Department after inspection by the Planning Board. Mr. Tyree: But how can he issue me a CO, this is where I say the catch 22 is, when I only have an interim approval from the Health Department, to use bottled water until my proposed system that they approved is put in and installed and the water is tested to use? Mr. 0rlowski: Ail the criteria that this Board wanted has been met already. Mr. Tyree: It will be finished by Thursday. I wouldn't be here I couldn't finish all of that, some paving and underwriters electrical, that's all. if Mr. Orlowski: And you talked to the Department. The Board of Review has bottled water? Board of Review at the Health told you that you can use Mr Tyree: Yes. Mr. 0rlowski: If you got a letter just stating that and gave it to the Building Department, I'm sure you could be able to get your CO then. Mr. Tyree: Can he issue a permit? In other words, I don't think he'll issue me a permanent CO with a temporary approval to use bottled water, that's my dilemma. Mr. Ward: I tend to think you're right, but a temporary may allow you to at least get started, for a certain period of time. Mr. Tyree: If I could get that...I'm not trying to put words in your mouth, but if I could get a letter from the Health Department, or something similar to that, that the Building Department would be able to issue me a temporary CO. Mr. Ward: We need something from the Health Department stating that the water and sewer is adequate. Mr. Tyree: The sewer is no problem, that's all been approved. It's just the problem with the water. Mr. Ward: The best thing to do is get something from the Health Department that would say they would allow this as a temporary measure for a certain period of time, then I think that you may be able to get a temporary CO out of the Building Department, but I can't talk for the Building Department. Mr. Tyree: I know, but I need to go somewhere. Mr. Fisher told me to appear before you, so that's my quandary. Thank you very much. There were one or two additional elements concerning drainage to be addressed by the Planning Board. Other than that, the Planning Board seems to feel favorably the changes that we have made concerning parking, the buffering, the lighting schedules. We have also reviewed and changed on recommendation of the Town Engineer the drainage at the intersection of the highway. We have since secured the State Department Transportation (too noisy - inaudible) that entrance. As the Zoning Board of Appeals request we have supplied additional site plans to the neighbors to the east have requested us and the parking that was the subject of discussion at the prior hearing has been moved to the north. That will be west of the tasting building. I understand it concerns pertaining to traffic. This is not a large wine tasting facility. Approximately one-tenth the size of Pindar which was mentioned earlier. I would be happy to answer any requests of the Board and any questions in any way I can be of help. I'm still very concerned about the amount of traffic. Now I understand there's going to be another winery with the same thiug that's within a very relatively short distance which is going to further complicate that traffic situation, and in looking, I did receive the site plans but I only see 14 spaces of parking and certainly that does not seem adequate. Where are the employees going to park if you have only have 14 spaces and if your entertaining the thought of having wine tasting, perhaps buses? I see one space for a bus. Is that adequate? I don't think so. MR. CHAIRMAN: That may be a question thai the Planning Board might have to address but we will ask Mr. Raynor to address it and if need be again, further explain it to you and then you can come back again and you know we'll discuss it again tonight. Is there anything that you have any further cmnment? VIRGINIA D ' RAPER: Now the septic tank that's over near the wetlands, .... MR. CHAIRMAN: You mean the pond? VIRGINIA DRAPER: No, there's the septic tank over on the east side I believe that is to the rear. It's very close to the edge of the wetlands. Mr. CHAIRMAN: This is on the steel building? I'm concerned about the wetlands and with septic tanks being close to that area would there be any contamination of the wetlands? MR. CHAIRMAN: Well, to my knowledge, it's quite a height there or a difference in height and I can understand your concern. MEMBER VILLA: Topo doesn't make a difference. It's horizontal separation that's usually req~ired. If there are wetlands in the area these plans have to be approved by the Health Department. They would require it to be moved. They have certain requirements. It's at least 100 feet. VIRGINIA DRAPER: Does this mean because I'm not well adverse to the blueprints. MEMBER VILLA: I don't know if this plan has gone to the Health Department or is going to the Health Department. It has gone? HENRY RAYNOR: It has gone. MEMBER VILLA: Has it gotten it approved? HENRY RAYNOR: We're waiting for it any day and that's says 175 feet. MEMBER VILLA: If it's 175 feet that's more than adequate. VIRGINIA DRAPER: OK, because I know there's lateral drains from a septic tank and you know it has to drain somewhere. MEMBER VILLA: No, it's ( pool is generally ( ). MR. CHAIRMAN: Good point Certainly most of the activity does occur towards the westerly portion of the property. I mean, you certainly have a legitimate concern. There's no doubt about it. The remaining hill area is going to be what, grass Mr. Raynor? So the area that these nice people would be looking at basically will be primarily lawn. HENRY RAYNOR: (Speaking too low cannot hear his response.) VIRGINIA DRAPER: Because I did note when we came the last time there was water created over the easterly side almost at the property line. I don't know whether it was due to the erosion where they were bulldozing or whatever they were doing with that land there. It created a water. MR. CHAIRMAN: Well, I think that was the thought that there might have been an additional pond wanting to be created there and i think that was ruled out totally at that point. VIRGINIA DRAPER: Yes, I realize that that was where the pond was going to be but we had water standing there which had been standing there for a period of time that had not been there. MR. CHAIRMAN: Well for all intensive purposes I sincerely understand with what you're saying but I don't think there']l be any concern on that basis there. I realize, I really honestly do, realize how difficult it is sometimes to visualize this because it's somewhat difficult for us to visualize it also and that's most of the reason why we go back two and three times to look and it's a difficult thing sometimes to deal with because it is certainly affecting you because it is a little more than an aquarium type of use but at the same token I think it's probably the least intensive use that you can have apart from a major housing subdivision which I Page 44 - Hearing Tra~nscript Regular Meeting of December 7, /1994 Southold Town Board of Appeals think would cause a lot more activity with houses going in and out, cars going in and out of houses I should say, so aud so forth. But, if you have any other concerns we are going to or we are anticipating closing this hearing tonight. You're welcomed to write to us. We cannot necessarily make it part of the hearing, just so you're aware of that. If you have any specific concerns of Mr. Raynor, again, I'm sure that he would meet with you out in the hall and you can come back and talk to us. It's entirely up to you. I'm not trying to put any words in your mouth honestly. MEMBER VILLA: Jerry! MR. CHAIRMAN: Yes. MEMBER VILLA: If this becomes a water problem which I can understand can breed mosquitoes or what have you in the summer, would your client agree sometime if this does become a problem, to go back and regrade and eliminate it? HENRY RAYNOR: I don't see where that would be any problem, at all, really. MEMBER VILLA: Because I mean they did change that slope going down there and it could, all that runoff could puddle down there. If it becomes a standing water proble~n we have an agreement between us that it will be corrected. HENRY RAYNOR: this. There's been a standard water problem prior to MEMBER VILLA: It has? A winery is a permitted use in this agricultural conservation (A-C) zone, thus the proposed action is consistent with zoning. An Environmental Assessment Form has been submitted and reviewed, and it was determined that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. There has not been any correspondence from the New York State Department of Environmental Conservation in the allotted time. Therefore, it is assumed that there are no comments or objections from that agency. The applicant will have to comply with the requirements of the Suffolk County Sanitary Code (SCSC) and all relevant standards of water supply and sewage disposal systems. Your agency should be aware that such conditions frequently require the use of fill or the excavation of subsurface soils to accommodate subsurface sanitary disposal systems constructed in conforntance with the requirements of the SCSC. The department is also significantly concerned with areas where access to potable water may he constrained by unacceptable groundwater quality and the lack of an available public water supply. All private water supply systems must be consh~ucted in conformance with requiretnents of the SCSC. II. NATURAL RESOURCES: 1. The SCDHS fully supp°rts all effor'~s to maxiruize protection of natural resources which may he impacted upon by construction and development activities. It is the position of the department that the SEQRA review process provides the greatest opportunity for comprehensive consideration of these resources, and that all practicable planning measures should he employed to help ensure their protection. Of particular concern to department is the adequate protection of wetlands, surface waters, natural communities, contiguous natural habitats, and rare, threatened and endangered species. In addition, efforts to protect sensitive physical resources such groundwaters, dunes, bluffs, shorelines, natural drainage channels, groundwater recharge areas, and steep slopes are fully supported and encouraged by the SCDHS. In general, the department encourages the following land use measures he considered (where appropriate) to actions being reviewed pursuant to SEQRA. 1. Maximum practicable setbacks from all wetlands, surface waters, dunes, and bluffs. 2. Non-disturbance buffers between wetland limits and required structural setbacks. 3. Clustering of subdivision lois to provide for maximum preservation of large contiguous areas of dedicated open space. 4. Stringent clearing limitations which can reduce potential impacts to wildlife habitats, vegetative communities, and unconsolidated soils. 5. Maximum practicable confinement of development to areas with slopes of less than 10%. 6. Maximum use of native species for landscaping purposes. Constmcaon of recharge areas, so as to ra~mmtze the amount of disturbance and structural modification to the site. 8. Maximum use of land-banked parking on commercial sites. 9. Minimal use of fertilizer-dependant tuff slid landscaping. 10. Employment of stormwater runoff control measures necessary to maintain runoff on-site. At a meeting on this day at the winery, Mr. Lessard told me and Mr. Thomas Fisher, Senior Building Inspector, that unless the stop work and appearance tickets are withdrawn, a lawsuit would be filed.
