Board at the regular meeting of Monday, July 9, 1984 with
regard to the above mentioned application.
It was the consensus of the Board that the original
determination of 24 parking spaces for lot No. 1 will
remain as the Planning Board's requirement for parking.

Dear Mr. Goehringer:
In response to your request for the number of parking
spaces the Planning Board would require on Lot No. 1
of the above IT.entioned set-off; we have reviewed the
application and determine that we would require 24 parking
spaces for the establishments on this lot.
It is obvious that lot No. 1 has insufficient area for
this parking and the Planning Board does not see any
way to obtain the parking requirement.

Dear Henry:
After much consideration in reviewing the above variance
request and advice from counsel, it is a must for our board
to know how many parking spaces your board would require for
the numerous uses on the northerly parcel, which after personal
inspection are found to be: (a) laundromat, (b) post office,
(c) grocery store, (d) second floor-storage only.
Kindly inform us as to the number of required parking
spaces. Enclosed for your perusal is a proposed parking plan.

Dear Gerry:
Regarding your letter of April 18, 1984 concerning the above
mentioned appeal before your Board, we direct you to Chapter
Al06 of the Code, Article XI, specifically Section 100-112
C, F. and G.
It is apparent that under no circumstances would it be possible
to have substantial parking for the use of the 3 establishments
currently at the location.
After a physical inspection of the premises, it does not conform
to the parking spaces indicated in your enclosure.

At a Special Meeting of the Board of Appeals held on
January 10, 1984, the following action was taken pursuant
to the town's January 1982 set of procedures concerning
applications before the Z.B.A. and Planning Board:

RESOLVED, that Appeal No. 3206, application for HENRY P.
SMITH be temporarily held in abeyance pending review by and
receipt of comments from the Southold Town Planning Board
concerning the lot line layout of this proposed subdivision

AFFIDAVIT IN SUPPORT OF APPLICATION TO ZONING BOARD OF APPEALS
STATE OF NEW YORK:

Henry P. Smith, being duly sworn, deposes and says:
1. That strict application of the zoning ordinance would produce practical
difficulties 01' unnecessary hardship because the single lot has existed in its present.
I state fOl' approximately 30 years, and contains two entirely separate buildings, each
being used separately and independently from the other.

'I 2. The northerly building is and has been used to house a grocery store, post
" office, laundromat, and upstairs apartment. These separate units in that building have
Ii been rented out by applicants' father, and predecessor in title, Henry J. Smith, for
approximately 40 years, and are still reated out by applicant.
3. The southerly building, which was expanded to its present size approximately
30 yeal'll ago, was OI'iginally used as a plumbing shop, and then for a garage and
equipment stOl'age and repair. While leased to Dickerson Excavating for such use until

recently, it is now once again being used by applicant as a garage and for equipment
stOl'aae.
4. Applicant being in the plumbing and heating business wishes to keep and
continue to use the garage buildinl in the same manner that it has always been used.
On the other hand, applicant wishes to divest himself of the northerly bl,lilding with
the rental units beoause that building is in need of . Ireat deal of repair and applicant
does not have the time, inclination, or physical and mental fortitude to be a landlord.

5. Dividing this single parcel into two smaller parcels, as proposed, would not
bring about any physical change on either parcel, nor would it bring about any change
, in the use of either parcel. The sub-division would merely allow applicant to continue

the existing use of the garage building, while at the same time allowing the existing use
of the northerly building to also continue, but under the ownership of another owner.
6. Applicant would emphasize that the granting of these variances would not
i bring about any physical change on either parcel of land nor would it bring about any
I change in the use of either parcel. The variances requested would do nQ,thing more
I than allow for a change in ownership of the northerly building.

7. These two buildings being used for totally separate and independent businesses
that in no way relate to each other, the granting of these variances would in no way
change the character of the district. Furthermore, the hardship that applicant is
presently faced with is unique to this applicant and this piece of property in that
I applicant wishes to divest himself of ownership of the grocery store, post oCCice,
I laundromat, and apartment, all contained in the northerly building, but cannot do so
I without also giving up the garage, which while unrelated to the northerly building, is
a necessary adjunct to applicant's plumbing and heating business.

With respect to the above matter and pursuant to your telephone request I have
enclosed herewith a copy of the Short Environmental Assessment Form dated 12/27/83.
I have also enclosed the five additional copies of the survey print which you requested.
I would appreciate it if you would please forward me a duplicate copy of your
"Application for Approval of Platt" as I have made notations all over the face of
the one I had when preparing the application that I submitted to you.
You will note that the application I did submit followed the same form and outline
as the form I received from the Town. The only difference is that I omitted those
statements which were inapplicable to this application, i.e. who is going to install
'the gas mains.
Be that as it may, if you would forward me an additional copy of your own form I
will be happy to complete it for you.
