PERMIT UNDER SECTION 136 of ARTICLE VI of HIGHWAY LAW Whereas,section 136 of Article VI of the Highway Law provides'.Permits for work within the county road right of way.Except in connection with the construction,reconstruction. maintenance or Improvement of a county road or operations of a corporation pursuant to the provisions of section twenty-seven of the transportation corporations law or sections twenty-one,eighty-nine,ninety-one,ninety-three,ninety-three-a and ninety-three-bof the railroad law,no person firm,corporation or municipality shall constructor Improve,within the county road right of way an entrance or connection to such road or construct within the county roatl right of way any works,structure or obstruction,or any overhead or underground crossing thereof,or lay or maintain therein underground wires or conduits or drainage,sewer orwater pipes,except in accordance with the terms and conditions of a work permit issued by the county superintendent or his duly designated agent,notwithstanding anyconsent or franchise granted by anytown superintendent,or by any other municipal authority.Any municipal corporation may enter upon any country road for the purpose of widening the pavement or for any other purpose authorized by this section,but only after securing a permit as provided herein.Notwithstanding the limitations in any general or special law,every municipal corporation shall have and is hereby given authority to deposit with the county superintendent such a sum of money or a security bond as maybe required as a condition precedent to the granting of the permit provided in this section.The county superintendent shall establish regulations governing the issuance of highway work permits,including the fees to be charged therefor,a system of deposits of money or bonds guaranteeing the performance of the work and requirements of insurance to protect the Interests of the county during performance of the work pursuant to a highway work permit.With respect to driveway entrance permits,the regulations shall take into consideration the prospective charecterof the development,the traffic which will be generated by the facility within the reasonably foreseeable future,the design and frequency of access to the facility,the effect of the facility upon drainage as related to existing drainage systems,the extent to which such facility may impair the safety and traffic carrying capacity of the existing county road and any proposed improvement thereto within the reasonably foreseeable future,and any standards governing access,nonaccess or limited access which have been established by the county superintendent.Upon completion of the work within the county road right of way,authorized by the work permit,the person,firm corporation,municipality,and his or its successors In interest,shall be responsible for the maintenance and repair of such work or portion of such work as set forth within the terms and conditions of the work permit.An advertising sign,display or device,or any part thereof,erected in violation of this section shall be removed from the county road righted way by the owner or the party responsible for its erection.The county superintendent shall make a demand by mail,to the last known address of the owner,apparent owner or party responsible for the erection of such ativertising sign,display or device,for its removal and,if it is not removed within twenty(20)days from the career the mailing of such demand,the county superintendent may remove any such advertising sign,display or device,or any part thereof,from the county road right of way.The term'county road right of way'shall,for the purposes of this section. mean the entire width between the boundary line of all property which has been purchased or appropriated by the county for county road purposes,all property over which the county superintendent or his predecessors has assumed jurisdiction for county roatl purposed,all property over which the county superintendent has assumed jurisdiction during the period of construction,reconstruction or improvement and all property which has become part of the county road system through dedication or use.Any person,firm or corporation violating this section shall be liable to a f ine of not less than twenty-five dollars nor more than one thousand dollars for each day of violation,to be recovered bythe county superintendent and paid in to the county treasury to the credit of the county road fund created under this article for the construction,reconstruction and maintenance of county roads on the county road system In accordance with the provisions of this article,and may also be removed therefrom as a trespasser by the county superintendent upon petition to the county court of the county or to the supreme court of the state. NOW,THEREFORE, permission is hereby granted to said Tartan Oil to do said work upon the following conditions: SEE ATTACHED NOTE CONDITIONS AND RESTRICTIONS 1. When concrete is removed,cut concrete with concrete saw two feet outside the limits of the proposed excavation and for the full panel width.When the cutis made in pavement within 10 feet o1 the panel joint,the pavement shall be removed for full panel width from the cut on the far side of the excavation to the panel joint. 2. Backfill and thoroughly compact fill using POWER TAMPER,placing soils so that various types officiate in same relative position as before excavating.Grade to original surface. 3. Replace pavement,sidewalk or surface same as existing;if concrete,replace using 1:1 3/4:31/2 mix stone mix concrete;if bituminous material,replace using same type as removed. 4. If concrete curb Is removed,replace with similar curb 1.:1 3/4:3 1/2 mix. 5. Edge of Jacking Pits or any other excavation shall be not less than 5 feet from Edge of Pavement. No undercutting allowed in Pit. 6. Notify the Department at Yaphank 924-3451 when the work is to begin so thatan inspection can be made of the operation. This permit shall not be assigned or transferred without the written consent of the Commissioner of Public Works. The work authorized by this permit shall be performed under the supervision and to the satisfaction of the Commissioner of Public Works or his representative. Particular attention is called to the necessity of thoroughly compacting the back fill, which will be required by the Commissioner of Public Works. The Commissioner of Public Works shall be given one week's notice by said applicant of the date when it intends to begin the work authorized by this permit,and prompt notice of its completion. The said applicant hereby agrees to hold the State, County and Town harmless on account of damages of any kind which may arise during the progress of the work authorized by this permit or by reason thereof. Applicant certifies all persons concerned with actual work under this permit are dulycovered by Workmen's Compensation Insurance and the State, County and Town shall be held harmless on account thereof. The Commissioner of Public Works reserves the right to at anytime revoke or annul this permit should the said applicant fail to comply with the terms and conditions upon which it is granted. The applicant agrees to pay all necessary expenses incident to supervision and inspection by reason of the granting of such permit as certified by the Commissioner of Public Works,such payment to be made within ten days from the rendering of the certified account. Work under this permit to be commenced within thirty days from the date of permit and continued in an expeditious manner. The applicant shall submit a detailed plan of structure to be built,with a description of proposed method of construction. It is understood that should future changes in the alignment or grade of the highway require changes in the work covered by this application and permit,the applicant shall on reasonable notice from the Commissionerof Public Works make such necessary changesat his own expense within the time so specified in notice. Traffic shall be maintained by the applicant on this section of the highway while the work is in progress and until its final completion. This is a referral of the Town prior to obtaining a building permit. r Unico Corp. (Bill Suter) referred a site plan of Tartan Oil to the County and they commented on it. The County wants ✓' the westerly most ingress Qal-y and the egress will be on the side road. A copy of this comment will be forwared to the r' Town. Upon receipt of a 239K form in triplicate and 3 site plans the County will expedite the issuance of a permit for the curb cut. They were very understanding of the oversight. Diane M. Kassner, Site Plan Reviewer RE: Former Mobile station Peconic Lane & CR 48, Peconic SCTM# 1000-74-4-7.1 As a result of a complaint to the Building Department and a referral from the Building Department to the Planning Board an inspection of the above premises was made on this day. The complaint concerned the placement of a storage trailer on the property and light shining off the property. The inspection reveled that a habitable trailer has been parked on the rear of the property. An inspection of the trailer revealed a kitchen, bunk beds and some stored material. Special Exception # 3596SE approved by the Zoning Board on March 5, 1987, (attached), said, "no additional structures with out re-application to the ZBA." The lighting had been previously inspected and a determination had been made that if did not shine off the premises. I could not find any new lighting that had been installed. The Board recommends that you inform the applicant that they have to reapply to the ZBA to change the conditions of their Special Exception. It shall be understood further that this project must comply with those conditions set by the Board of Appeals June 29 , 1972 under Application No . 1584 for the construction of a gasoline service station , including but not limited to items (b) , (c ) and (f) thereof: (b ) Vehicle lifts or pits , dismantled automobiles , and all parts or supplies shall be located within a building ; (c ) All service or repair of motor vehicles other than such minor servicing as change of tires or sale of gasoline and oil , shall be conducted in a building ; (f ) No motor vehicle sales , used car lots , gasoline services or repair shops , or similar businesses ,_ are to be located within 300 feet of a church , public school . . . or within 300 feet of any residence district . In considering this application , the board also finds and determines : (a ) the use requested will not prevent the orderly and reasonable use of adjacent properties or of properties in adjacent use districts ; ( b) the use will not adversely affect the safety , welfare , comfort , convenience or, order of the town ; (c ) the use is in _harmony with and will promote the general purposes and intent of zoning . It is also noted for the record that it is the understanding of this Board that the service building will be used for office and sales area incidental to this gasoline service station and will not be operated as a separate business use or entity . By letter dated December 23 , 1986 , the Town is assured that no foodstuffs requiring a food-service permit from the County Health Department will be offered for sale . 7 . It shall be understood further that this project must comply with those conditions set by the Board of Appeals June 29 , 1972 under Application No . 1584 for the construction of a gasoline service station , including but not limited to items (b) , (c ) and ( f) thereof : ( b ) Vehicle lifts or pits , dismantled automobiles , and all parts or supplies shall be located within a building ; (c ) All service or repair of motor vehicles other than such minor servicing as change of tires or sale of gasoline and oil , shall be conducted in a building ; ( f) No motor vehicle sales , used car lots , gasoline services or repair shops , or similar businesses , are to be located within 300 feet of a church , public school . . . or within 300 feet of any residence district . In considering this application , the board also finds and determines : (a ) the use requested will not prevent the orderly and reasonable use of adjacent properties or of properties in adjacent use districts ; ( b) the use will not adversely affect the safety , welfare , comfort , convenience or order of the town ; (c ) the use is in harmony with and will promote the general purposes and intent of zoning . I counted 24 individual outdoor lighting fixtures so far on this small Property. The sight of this much candlepower will be breathtaking to traffic on Rt. 42, especially east: bounders coming around the curve. As You approach this intersection at night Your vision Will be completely Captivated by this much I i ght, concentrated on one Small area, creating a haZard to Pedestrians and vehicles. The town owned streetlisht on this corner Will be Useless. Just as in towns to our West the town will be forced to install 1, 000 watt street l i ghts on every Pole to compete with off street lighting until we reach a saturation Point. When a business decides on the amount of outdoor lighting needed, one of the chief factors considered is surrounding business lighting. I questioned whether the lighting designer ever visited this Site? in Pecolnic no other business near this gas Station is 'illuminated so that minimal lighting is needed. The next business to come along derides that if 24 fixtures are gond at this station then TG would be better (for business) . If YOU doubt this a short ride to Rt. 25 Huntington, etc. , etc. , will confirm this. To bring attention to Your business on Rt. 25 in Huntington some -bus-inesses have gone to maximum - multiple 1, 000 watt mercury vapor dusk to dawn lights. There is no such thing as "ori sight lighting" the glow from this station will be visible throughout town„ in my opinion this gas station should be limited to a very minimal amount of low keyed, soft, down lighting sufficient for safe handling of gasoline etc. This lighting should be measured in lumens or candlepower vs. wattage and - measured with ordinary light metering instruments, cuff sight and on sight. It should be brought to the attention of new businesses that the conservation of our limited energy resources should also be a consideration. The Previous "Pauls Gas Station" occupied this site for Years with minimal lighting and should be a prime consideration now, as our rural Community slips into history. The new proposal eliminates the front entrance on Public Road to allow for more landscaping and turns the building 90° with an increased setback from 35 ' to 47 ' . It was noted that the pumps will be moved from an east/west direction to a north/south direction to allow for better circulation. Mr. Deutzeman, architect, was present. The Board discussed the possiblity of eliminating one of the accesses to County R oute 48 . The Board was in favor of the basic layout and decided they would conduct a field inspection prior to any decision with regard to elminating the additional curb cut on the county road. The Board noted that they could not consider approval until the plan is certified, therefore, by that time, they would have a decision on the • curb cuts . The open space would be put in to the common homeowners association and it would work effectively. Mr. Bryer stated that he had reviewed this proposal and it does satisfy the intent of the code, however, he felt that the open space could be placed so that it is more beneficial to the people of the subdivision. Mr. Orlowski questioned if Lot No. 4 would be covenanted against further subdivision in perpetuity. Mr. Bruer stated that as far as he knew it would be. Mr. Mullen stated that if the covenants and restricitons would be in perpetuity then he was agreeable to the plan. Mr. Bruer stated that the building on Lot No. 4 would most likely be to the North where the other lots are. Mr. Bryer staed that there was no problem with it meeting zoning requirements. On a motion made by Mr. Latham, seconded by Mr. Edwards, it was : RESOLVED that the Southold Town Planning Board grant sketch plan approval to the minor subdivisin of North Road Associates for 4 lots on 16. 8 acres with 3. 377 acres of Open Space, survey dated as amended July 23 , 1986 , located off a right-of-way from Main Road, Orient; subject to: 1. Covenants and restrictions stating that there will be no further subdivisin of Lot No. 4 in perpetuity. Vote of the Board: Ayes : Orlowski, Mullen, Latham, Edwards Mr. William Moore, esq. approached the Board and presented covenants and restrictions with regard to no further subdivision for the minor subdivision for Leander Glover. Mr. Orlowski stated that they must read no further subdivision in perpetuity since this was asked for by the Board. Tostan OiZ - The Board reviewed this proposal for a revised site plan for a gas station located at County Route 48 , Peconic. The Board members had inspected the property and after the inspection it was the consensus of the Board to leave two access roads onto Route 48 . The Board questioned, however, the cooler in the sales kiosk and what items were intended / to be sold. Mr. Tollering and Mr. Leon of Tartan Oil were j present. Mr. Moore stated that the size of the sales area _ /�— would not permit a 7-11 type of operation. Mr. Tollering stated that some of the items they wished to- sell woud be soda and milk. Mr_ Deutzman, the architect, was also present. Mr. Orlowski read a letter which was received by the Board outling certain items which would be sold, however, the letter C stated along with the various items , "etc" . The Board wanted this clarified since etc. meant that absolutely anything could be sold there. Mr. Tollering stated that they would not sell anything that the Board did not want and he did not what that was. Mr. Orlowski stated that if a convenience store developed, Planning Board Page 13 8/25/86 more parking would be required. Mr. Tollering stated that it would not be a 7-11 or Hess type operation. Only incidentals C would be sold and things related to the gas operation. He stated they are not in the food business, they are in the gas business and no prepared food would be sold. Mr. Tollering stated if the Board wished to restrict them, it would not be a problem, and they would have no objection. Mr. Mullen questioned the location of other stores which the principles owned, in the vicinity of Southold Town. Mr. Mullen asked that the names be given to the Secretary after the meeting. Mr. Mullen stated his concern with the term "snack items" since this covered a broad range of items. Mr. Mullen also asked that they specifically list those items to be sold. Mr. ORlowski stated that there would be a problem with policing this. Mr. Lessard stated that this would not be a problem. Mr. Latham stated that he would like to see soda and cigarettes sold only. Mr.Lessard stated that any deviation from what is approved would require an additonal site plan. Mr. Mullen questioned the hours of operation. Mr. Tollering stated that they wished to run the operation from 5 : 00 a.m. to 12: 00 a.m. if there is no objection to it. He stated that if there was objection, they would not do it. Mr. Tollering stated that he would do whatever is required, and he would like to know what the Board would like. Mr. Latham stated that he not concerned with the sale of gasoline, however, he did not want to see the store become a "hang-out" . Mr. Orlowski stated that they board had not objection to the layout, however, they did have a problem with the store.
