Planning Board at a regular meeting held November 18, 197~.
On motion made by Mr. Moisa, seconded by Mr. Raynor,
it was
RESOLVED that the Southold Town Planning Board approve
the map of the subdivision known as ,,Soundview Meadows"
subject to the receipt of the filed vovenants and restrict-
ions corrected and i~ltialled by the owners.
Vote of the Board: Ayes: Wick~am, Moisa, Raynor, Coyle
and Grebe.
Enclosed find the original of the Declaration of
Covenants and Restrictions. Upon receipt of same as being
filed in the County Clerk's Office, your map will be signed.

Hubbard Avenue, Riverhead, New York; GEORGE L. PENNY IV, residirg

are the owners and fee-simple of certain premises in the Town of
Southold, Suffolk County, New York, known and designated as i,

NOW, THEREFORE, permission ~s hereby granted to said

CONDITIONS AND RESTRICTIONS
1. When concrete is removed, cut concrete with concrete saw two feet outside the limits of the proposed
excavation and for the full pa nel width. When the cut is made in pavement within 10 feet of the panel joint, the
pavement shall be removed for full panel width from the cut on the far side of the excavation to the pa nel joint.
2. Backfill and thoroughly compact fill using POWER TAMPER, placing soils so that various types of soilare in
same relative position as before excavating. Grade to original surface.
3. Replace pavement, sidewalk or surface same as existing if concrete, replace using 1:1 3/4 3 1/2 mix stone
m~x concrete; if bituminous material, replace using same type as removed.
4. If concrete curb is removed, replace with similar curb 1:1 3/4:3 1/2 mix.
5. Edge of Jacking Pits or any other excavation shall be not less than 5 feet from Edge of Pavement. No
undercutting allowed in Pit.
6. Notify the Department at Yapnank 924-3451 when the work is to begin so that an inspection can be made of
the operation.
This permit shall not be assigned or transferred without the written consent of the Commissioner of Public Works
The work authorized by this permit shah be performed under the supervis¢on and to the satisfaction of the Commissioner of Public
Works or his representative
Particular attention is called to the necessity of thoroughly compacting the back fill, which will be required by the Commissioner of
Public Works.
The Commissioner of Public Works shall be given one week's notice by said applicant of the date when it intends to begin the work
authorized by this permit, and prompt notice of its completion.
The said applicant hereby agrees to hotd the State, County and Town harmless on account of damages of any kind which may arise
during the progress of the work authorized by this permit or by reason thereof.
Applicant certifies all persons concerned with actual work under this permit a re duly covered by Workmen's Compensation Insurance
and the State, County and Town shall be held harmless on account thereof
The Commissioner of Public Works reserves the right to at any time revoke or annul th is permit should the said applicant fail to comply
with the terms and conditions upon which it is granted.
The applicant agrees to pay all necessary expenses incident to supervision and inspection by reason of the granting of such permit as
certified by the Commissioner of Public Works, such payment to be made within ten days from the rendering of the certified account
Work under this permit to be commenced within thirty days from the date of permit and continued in an expeditious manner.
The applicant shall submit a detailed plan of structure to be built, with a description of proposed method of construction.
It is understood that should future changes in the a~ignment or grade of the highway require changes in the work covered by this
application and permit, the applicant shall on reasonable notice from the Commissioner of Public Works make such necessary changes at
his own expense within the time so specified in notice

of the tax map of my home with a rough sketch of my proposed split. As I
mentioned to you, there were covenants and restrictions put on the property
by the town when it was originally sub-divided. If you could check into the
possibility of having these C & Rs removed. I have reached a point where I
find the care and maintainence of my property is becoming overwhelming but
I do not wish to sell my home to achieve less work.

pursuant to Section 1333, Suffolk County Charter. After due study and delib-

The Map of Soundview Meadows, as submitted, was approved subject to the
meeting of the two following conditions:
1. That only one access point to Middle Road, C.R. 27, from Lot 4 be
permitted and no additional access point be requested by the lot owner in the
future in order to protect the traffic carrying capacity and safety of the
county road.
2. That steps be taken to protect the stream from the adverse effects
of clearing, grading, and erosion on the tract as this stream flows through
County Park property and discharges into Goldsmith Inlet.

Dear Sirs:
At your request I have examined the proposed Declaration of
Covenants and Restrictions relative to the above minor subdivision.
I have the following comments with respect to the Declaration:
I would recommend that a metes and bounds description of the
area embraced within the subdivision be made a part of the
Declaration to insure that there is no question as to the area
effected by the Declaration.
A paragraph should be inserted in the Declaration to the effect
that the entire tract embraced within the subdivision cannot be
subdivided into more than four lots. and that each lot shall
comprise an area of no less than four acres.
I am returning to you herewith the original Declaration, subdivision
map and letter of the Department of Public Works sent to me by
Mrs. Brush.

re the above subdivision.~'' The Planning:Board has asked
me to send them to You for ~our approval..
This particular piece of property is approxtm-tely
twenty acres in area and the principles have chosen to
go in for a minor subdivision into four lots. I enclose
a copy of the map. The Suffolk County Department of
Public Works has authorized a 1~' curb cut contingent on
this being a single family estate. I enclose a copy of
that letter also.
The only question I had/was in Section 3 where they
chose to add 'without the consent and apl~roval of the
Southold Planning Board'.
