Dear Mr. Diller:
The following action was taken by the Southold Town Planning
Board at a regular meeting held December 17, 1979.
WHEREAS, a formal application for the approval of a subdivision
plat, entitled Minor Subdivision of John C. and Frank J. Diller, was
submitted to the Planning Board on October 12, 1979, and an
application fee of $20 was paid on October 12, 1979, and
WHEREAS, a public hearing was held on the said subdivision
application and Plat at the Town Hall in Southold, New York, on
November 14, 1979 at 8:30 p.m., and
WHEREAS, the requirements of the Subdivision Regulations of
the Town of Southold have been met by said subdivision Plat and
application,
Now, therefore, be it RESOLVED, that the application of John
C. and Frank J. Diller for approval of said subdivision plat
prepared by Roderick Van Tuyl, P.C. and dated October 17, 1979 be
approved subject to the following modifications, and that the
Chairman of the Planning Board be authorized to endorse approval
on said subdivision Plat upon compliance by the applicant with such
modifications as noted below.

1. All stormwater runoff resulting from the development and
improvement of either lot shall be retained on-site by
adequate drainage structures so that the stormwater does
not flow out into Middle Road or into the recharge basin.
2. All existing driveways shall retain and all proposed
driveways shall have a turnaround provision, such as a
"T"-shaped shunt, so that vehicles leaving the property
will not have to back out into the traffic stream on Middle
Road.
3. No residential structure shall be located within 100 feet
of the top of the bluff nor shall any sanitary disposal
facility be located or constructed within this setback
area.
4. No grading shall be permitted within 50 feet of the top
edge of the bluff except that necessary to control or
remedy erosion or divert stormwater from flowing over the
top of the bluff.
5. Clearing and cutting within 50 feet of the top of the
bluff shall be limited to that necessary for maintenance.
6. No stormwater runoff resulting from the development and
improvement of the property shall be discharged down the
face of the bluff in any manner.
7. Access to the beach shall be by means of a suitable
structure designed and constructed in a manner that will
result in the least disturbance of the stability of the
bluff.

NEGATIVE DECLARATION
December 17, 1979
Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that Southold Town Planning Board as lead agency
for the action described below has determined that the project
will not have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of John C. and Frank J. Diller is a
two-lot residential subdivision of 53.649 acres located at Peconic,
New York.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project be
implemented as planned.
The New York state Department of Environmental Conservation
has stated that since the subdivision of land is further
than 300 feet from the tidal wetlands this proposal is
beyond state jurisdiction.
The Suffolk County Department of Health Services has
indicated that a precursory review of the project indicates
conditions are suitable for individual sewage systems and
water supply facilities.
The project will meet all requirements of the Code of the
Town of Southold Subdivision of Land Regulations.

Tbe Suffolk County Planning Commission at its regular meeting on December 5,
1979, reviewed the proposed subdivision plat entitle~ "Minor Subdivision _ John C.
and Frank J. Diller", referred to it pursuant to Section 1333 of the Suffolk
County Charter. After due study and deliberation it resolved to approve said map
subject to the following 7 conditions deemed necessary to help preserve the existing
traffic safety and carrying capacity of Middle Road, C.R. 27, and the natural and
aesthetic attributes of the shoreline along the Long Island Sound:
1. All stormwater runoff resulting from the development and improvement of
either lot shall be retained on-site by adequate drainage structures so
that the stormwater does not flow out into Middle Road or into the re-
charge basin.
2. All existing driveways shall retain and all proposed driveways shall have
a turnaround provision, such as a "T"-shaped shunt, so that vehicles

Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review Act and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of Southold, notice is
hereby given that Southold Town Planning Board as lead agency for
the action described below has determined that the project will not
have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of John C. Diller is a 4 lot subdivision
52 acres, located at Peconic.
The project has been determined not to have a significant
effect on the environment for the following reasons:

An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned.
Because there has been no correspondence from the Department
of Environmental Conservation in the alotted time it is deemedn
that there are no concerns or comments from that agency
regarding this .matter.
The Suffolk County Department of HEalth Services has no objection
to our designation of lead agency, they are in agreement with
our initial determination, they have received an application
and it is incomplete. Their primary environmental concern pertaining
to development is that the applicant comply with the requirements
for Article V and VI and tqe relevant construction standards
for water and sanitary sewage disposal. The health department
maintains jurisdiction over final location of disposal and
well systems and the applicant should get their approval prior to

Dear Mr. Orlowski:
I bave been informed by two separate sources tbat during Monday evening's
Planning Board bearing regarding tbe Simon subdivision tbat you inquired of the
Simons' attorney, Abigail A. Wickham, as to whetber any communication had taken
place witb the Di11ers regarding a joint right of way to access tbe Sound lots
of our subdivisions.
I understand tbat Ms. Wickbam responded to tbe effect that the communications
had been one-sided in that her office had contacted the Di11ers regarding the
proposed joint right of way but bad received no response from the Di11ers. If
the foregoing correctly describes Ms. Wickbam's response, I wish to inform you
that she is totally mistaken and she bas seriously misled you and other members
of the Planning Board.
In fact, upon receiving the attached letter from Bill Wickbam, who I believe is
Ms. Wickham's father and partner, I immediately responded by telephone
indicating discussions regarding the joint rigbt of way had a1readv commenced
between us and his clients, tbe Simon family. Tbose discussions have continued,
with our next meeting scheduled for January 15th. I will state for the record
that the Di11ers are interested in working out a joint right of way and I have
been informed by tbe Simons that they share that desire.
I hope that the foregoing will dispe11 tbe effects of any misrepresentation to
the Board and will confirm our intention to pursue the joint right of way
suggested by the Board at its August 27, 1984 meeting.

The Health Department's primary environmental concern
pertaining to development is that the applicant comply with
the requirements of the Suffolk County Sanitary Code especially
Article V and VI, and relevant construction standards for
water supply and sanitary sewage disposal. These considerations
are to be reviewed completely at the time of application. Full
consideration in placement of water supply wells and disposal
systems is given to state and town wetland requirements. The
Health Department maintains jurisdiction over final location
of disposal and well systems and the applicant should not
undertake to construct any water supply or disposal system
without Health Department approval.
Other portions of the Suffolk County Sanitary Code also
apply to commercial development such as Article XII. The
Lead Agency is requested to forward a copy of this form to
the applicant with its findings.

Gentlemen:
The following statements are offered for your consideration
in the review of the above-mentioned minor subdivision and its
referral to the Suffolk County Planning Commission:
(1) No grading, other than foundation excavation for a
residential building is proposed.
(2) No new roads are proposed and no changes will be made in
