Box 1179 Southold, New York 11971-0959 CONSERVATION ADVISORY COUNCIL TOWN OF SOUTHOLD MINUTES Wed., May 10, 2006 Down's Farm Preserve 6:00 PM A meeting of the South old Town Conservation Advisory Council was held Wed., May 10, 2006 at Down's Farm Preserve. Present Were: Don Wilder, Chairman Jack McGreevy, Member James Eckert, Member Peter Young, Member Jacob Smith, Student Member Dave Bergen, Trustee Lauren Standish, Secretary James McMahon, Director of DPW Bob Ghosio, Guest Absent Were: Tom Schlichter, Member Jennifer Mannino, Member Joyce Grigonis, Member CALL TO ORDER Chairman Don Wilder called the meeting to order at 6:00 PM CHAIRMAN'S ANNOUNCEMENTS Chairman Don Wilder opened the meeting by introducing James McMahon, Director of DPW and Community Development, who was invited in to discuss the open space management plans for the Town. Jim provided each of the council members with trail guides and explained the need for a steering committee to assist his department with the 2 management of the trails, including the management of the recently acquired parcels along Laurel Lake. Peter Young volunteered to be on the stewardship committee when the plans for the new committee become finalized. Bob Ghosio, former chairman of the CAC, attended the meeting and announced that he is running for Trustee to fill the vacancy left by AI Krupski. REPORTS None APPROVAL OF MINUTES Moved by Don Wilder, seconded by Jack McGreevy, to Approve the Minutes of April 12, 2006. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by Peter Young, seconded by Don Wilder, it was RESOLVED to recommend to the South old Town Board ofTrustees APPROVAL WITH CONDITIONS of the Wetland Permit application of VINCE FISCHETTI to renovate and add a second-story to the existing single-family dwelling. Located: 650 Spring Lane, Peconic. SCTM#86-5-6 The CAC recommends Approval of the application with the Condition gutters and drywells are installed to contain the roof run-off, a pervious patio, and a berm is installed on the northeast side of the property. Vote of Council: Ayes: All Motion Carried FISHERS ISLAND UTILITY CO. to remove the existing dilapidated bulkhead and place boulders along the shore, remove the existing dilapidated dock and replace with a 4'X 90' fixed dock, 4'X 15' ramp with railings, and an 8'X 20' floating dock. Located: Private Rd. ofThe Gloaming, Fishers Island. SCTM#10-9-13 The CAC did not make an inspection, therefore no recommendation was made. Moved by Peter Young, seconded by James Eckert, it was 3 RESOLVED to recommend to the Southold Town Board of Trustees APPRVOAL of the Wetland Permit application of JULIE TSAI to construct a single-family dwelling and driveway. Located: 310 Lake Dr., Southold. SCTM#59-1-21.1 The CAC recommends Approval of the application, as applied for, however the Council does have concerns with the overall impact. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Peter Young, it was RESOLVED to recommend to the Southold Town Board ofTrustees APPROVAL WITH A CONDITION of the Wetland Permit application of PARIS KONST ANTINIDIS to construct a second-floor addition to the existing dwelling. Located: 2500 Sound Dr., Greenport. SCTM#33-1-13 The CAC recommends Approval of the application with the Condition hay bales are placed along the top of the bluff during construction and the top of the bluff is replanted. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by James Eckert, it was RESOLVED to recommend to the Southold Town Board ofTrustees APPROVAL WITH A CONDITION of the Wetland Permit application of THOMAS O'NEILL to replace the existing bulkhead inkindfinplace, repair the existing dock fin-place with vinyl, dredge approx. 60 cy. from area to -3.5', and construct a low-sill bulkhead ramp with (2) 12' returns. Located: 1420 Smith Dr. South, Southold. SCTM#76-3-10.1 The CAC recommends Approval of the application only to repair the existing bulkhead within 18" with the Condition this will be the one-time repair within 18". Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board ofTrustees APPROVAL WITH CONDITIONS of the Wetland Permit application of JOHN CHAPMAN to install an in- ground swimming pool 75' north of the wetlands. Located: 2700 Arrowhead Lane, Peconic. SCTM#98-2-20.1 4 The CAC recommends Approval of the application with the Condition drywells are installed to contain the pool backwash, the installation of a 30' non-turf buffer, and new trees are planted to compensate for the trees cut down for the pool installation. Vote of Council: Ayes: All Motion Carried Moved by Peter Young, seconded by Jack McGreevy, it was RESOVLED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of PRINCIPI PROPERTIES, LLC to construct a new restaurant with second story living space over the existing foundation of what was also a restaurant with second story living space; reconstruct two small outbuildings in their original locations; install 24 floating docks yielding a total of 48 slips; existing fencing and gate along the eastern property line; and remove ACQ decking inadvertently installed on floating docks and replace with non-treated wood. Located: 64300 Main Rd., Southold. SCTM#56-7-2 The CAC recommends Approval of the application with the Condition all areas between the structures and the water are pervious, and drywells and gutters are installed to contain all roof run-off. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Peter Young, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH CONDITIONS of the Wetland Permit application of CHARLES MCEVIL Y to construct a deck addition to the waterside of an existing one-family dwelling and install drywells for dwelling. Located: 1795 Bayview Ave., Southold. SCTM#52-5-6 The CAC recommends Approval of the application with the Condition 5' is added to the existing buffer and drywells and gutters are installed to capture all roof run-off. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Peter Young, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit and Coastal Erosion Permit applications of VISHNUDAT SEODAT to reconstruct (in-place) approx. 129 linear ft. of previously authorized bluff terrace retaining walls, which collapsed during washout event; repair or replace (in-place) adjacent, damaged sections of terraces as necessary; re-grade vertical 5 lip at bluff crest and use approx. 15 cy. resultant material, along with approx. 115 cy. clean sand to be trucked in from an upland source, to re-fill washed out portion of bluff face; and replant washed out portion of bluff face and non-turf buffer landward of bluff crest (as needed) with beachgrass, bayberry, and rugosa rose. Located: 580 Lloyd's Lane, Mattituck. SCTM#99-3-4.2 The CAC recommends Approval of the application with the Condition of a non-turf buffer 50% of the distance between the pool and the top of the bluff. Vote of Council: Ayes: All Motion Carried Moved by Peter Young, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit & Coastal Permit applications of MARIA & MARK KA TSIGEORGIS to replace inkind/inplace 50 If. of timber bulkhead and 12' returns at each end; the existing rock armor to be placed at the seaward toe of the new bulkhead above high-water to deflect wave energy; reconstruct the existing deck; and place 100 cy. backfill, obtained from an approved upland source, landward of the bulkhead and plant approx. 12'X 50' non-turf buffer with 4' wide path to bulkhead. Located: 55455 County Rd. 48, Southold. SCTM#44-1-12 The CAC recommends Approval of the application with the Condition the plan is reviewed by an Engineer. Vote of Council: Ayes: All Motion Carried Moved by Peter Young, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board ofTrustees APPROVAL WITH A CONDITION of the Wetland Permit & Coastal Erosion Permit applications of JOHN & JOANNE GOUVEIA to replace inkindlinplace of 10 If. of timber bulkhead; the existing rock armor to be placed at the seaward toe of the new bulkhead above high-water to deflect wave energy; repair the existing stairs; place approx. 20 cy. of backfill obtained from an approved upland source, landward of the bulkhead and plant approx. 12'X 12' non-turf buffer with 4' wide path to bulkhead. Located: 55405 County Rd. 48, Southold. SCTM#44-1-11 The CAC recommends Approval of the application with the Condition the plan is reviewed by an Engineer. Vote of Council: Ayes: All Motion Carried 6 Moved by Don Wilder, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of ROBERT PETERS to construct a 4'X 50' fiberglass grid dock, 2' above grade, with 4" dia. piles. Located: 801 Maple Ave., Southold. SCTM#64-1-30.2 Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Peter Young, it was RESOLVED to recommend to the Southold Town Board ofTrustees APPROVAL WITH CONDITONS of the Wetland Permit & Coastal Erosion Permit applications of ANGELO & JOSEPHINE PADOVAN to repair the existing shed. Located: Soundview Ave., Southold. SCTM#135-1-23 & 24.1 The CAC recommends Approval of the application with the Condition the repair is inkindlinplace only, no treated lumber is used, and no plumbing. The inkind/inplace is limited to the existing footprint of the shed only and does not include the deck. Vote of Council: Ayes: All Motion Carried DISCUSSION AND RECOMMENDATION OF APPLICATIONS TO AMEND PERMITS Moved by Jack McGreevy, seconded by Peter Young, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Amendment application of ROGER STOUTENBURGH to Amend Permit #1613 to include a 4'X 20' floating dock. Located: 4640 Skunk Lane, Cutchogue. SCTM#138-2-35 The CAC recommends Approval of the application with the Condition the overall length of the dock and the boat does not exceed 1/3 across the width of the creek. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Amendment application of KAREN & RICHARD SEELIG to Amend Permit #6065 to authorize the removal of steps; construction of 3'X 33' inclined section of walk from dock to lawn; and construction of (2) 4'X 4' steps to beach to maintain access along shoreline. Located: 1515 Calves Neck Rd., Southold. SCTM#63-7-37 7 The CAC recommends the use of a fiberglass grid. Vote of Council: Ayes: All Motion Carried The next meeting of the Conservation Advisory Council has been set for Wed., June 14, 2006 at 6:00 PM at Down's Farm Preserve.
