In order to set the record stralght In regard to
Irs. Bachrach's and Mr. Vll1a's letters in the AprIl 1
issue of lour paper, the property In question near
the Goos. Creek bridge at Southold waa not exactlT
wetlands at the tlme of appllcation, having been filled
by the CountT of Suffolk in connection wlth the dr9dg-
ing of Town Creek.
Knowlng the circumstanoen, the Plannlng Board re-
qu1red the developer to secure approval of the .ater
supply as a conditlon of ac~eptance, and approval was
granted by the County Board of Health many months ago.
Slnoe thls is the only Town In the County wlth
our type of minor subdlvislon develop~nt,it Is to be
expected that there wl11 be prOblems to be lroned out.
We are glad to have comnents and suggestlons for
Ughter control, because 1t strenethens our hand In
working wlth developers.
It 1s also important that people see both slde.

Dear Sir:
I wrote to the Suffolk County Department of Health
questioning how the Town Board could grant a permit on a
minor subdivision bordering Goose Creek, which fits the
description of wetlands and where there is imminent danger
of cesspool contamination of the oreek at such close prox-
imity to it. I further inquired whether the Health Depart-
ment sanctioned suoh construction. Since the reply is so
clearly of publio concern I hope you will print both letters.

Dear Mrs. Bachrach:
We have reoeived your letter of March 16, 1971 conoerning
the minor subdivision located on North Bayview Road just
west of the Goose Creek Bridge. Upon checking our files,
.e found we did not have applioations for a permit to con-
struot for the home under construotion on the site in ques-
tion. Investigating further, we contaoted Mr. Howard Terry,
southold Town Building Inspeotor. Mr. Terry supplied us with
a map of the minor subdivision as approved by the Planning
Board on October 26, 1970 with a cover letter saying that
since the town had no rule. against building on these lots,
a permit had to be issued.
This situation brings out two major areas of concern to this
offioe. The first is that southold Town is the only town, (oth-
er than Shelter Island where building is very limited,) that
does not require Health Department aFproval prior to the issu-
ance of a building permit. This means that a house is usually
under construction and possibly almost oompleted before the
builder or owner applies to this office for approval of his
sewage disposal and water supply facilities. In a number of
instances we have been confronted with an almost oompleted
house in land areas where it is not possible to obtain fresh
water or the soil conditions are suoh that a sewage disposal
system can not be installed so as to oomply with Health Depart-
ment standards. It then becomes a difficult task to find some
compromise solution that is often a stop gap measure at best.
The second area of concern is this building is on mar~1nal land.
Everyone reads about saving our wetlands but no one s.ems to do
anything about it. S1noe minor subdivisions and individualllots
are not submitted to our office for approval prior to building
there is little we oan do to prevent this type of building. It

This is not an isolated instance, as a similar project now
exists on Eugene's Road in Cutchogue.

What we have tried to point out is that the responsibility for
the development or preservation of this type of land is a town
function, and you and other concerned citizen. of the town mU8t
take the necessary actions to see that town officials take
appropriate steps to prevent this practice from continuing.

Ihe 'lewn does not have any rules against building on these
lots, so a permit had to be issued to buHd the Albinson house.
