Planning Board
Ferend property. David J. Driscoll appeared.
Mr. Driscoll presented a drawing of a cluster concept major
subdivision. Mr. Raynor said there is a private right-of-way
to this property and for a major subdivision there has to be a
50 foot road. The Planning Board will not approve of any major
subdivision unless it has highways to town specifications. Mr.
Driscoll has several options. To have five lots, he must
determine if he can get the 50 feet necessary up to the property.
If that avenue is closed, then a different map has to be drawn
up to show a four lot minor with the garage on it and go to the
Board of Appeals and say it has living quarters over it and you
have a hardship. Mr. Driscoll will discuss the matter with his
colleagues.
Schriever change of zone application. The following letter is to
be directed to the cemetery association. "We have a petition for
a change of zone of property of William and Barbara Schriever
presented to this board by the Town Board for our recommendations
and we note that it is adjacent to the Orient Cemetery. We would
appreciate having any comments from your association."
Mr. Wickham would like all copies of correspondence from Mr.
Schriever forwarded to the Planning Board.
Bitses subdivision.
Mr. Bitses is to be asked for more information on his proposed
cluster concept subdivision. His meadowland must show on the
map. Dikes, if any, must show on the map. Any land s~bject to
flooding cannot be used in computation. Article XIII ~100-136 A (1)
In computing the maximum number of lots that may be created, any
lands which are subject to flooding or which are occupied by
public utility easements in such a manner as to prevent their use
and development shall not be considered part of the total gross
area.
On motion made by Mr. Gorden, seconded by Mr. Raynor, it was
RESOLVED to authorize the chairman to sign the maps of the
subdivision of D. T. and G. H. Smith.

Dear Mr. Wickham:
The Suffolk County Planning Commission at its regular meeting February 2, 1977,
reviewed the above captioned proposed subdivision plat referred to it pursuant to
Section 1333, Suffolk County Charter. After due study and deliberation, it did take
the following action:
The Map of ~linor Subdivision - D.T. and G.H. Smith, as submitted, was approved
subject to the meeting of the three following conditions:
1. No residential building or sewage disposal facility is to be constructed
within 100 feet of the shoreline.
2. No storm water runoff resulting from the development and improvement of
the lots shall be directly discharged into the adjoining body of water.
3. The subdivision is to be made subject to any requirements imposed under
the "Tidal Wetlands Act" if such act is applicable to this site.
The Commission also offers the following comments on the map:
It is suggested that an alternate lot layout be made in order to provide
better building sites.

Petition for Moratorium Permit
Dear Mr. Smith:
The above petition has been forwarded to this office by the Local Tidal
Wetlands Permit Administrator who has made a review and site inspection.
As a result we have determined that construction of two single family
dwellings on two lots off North Bayview Road, near Goose Creek, Town of
Southold, Suffolk County, will have no adverse affect on adjacent tidal
wetlands.
Therefore, pursuant to Section 25-0202 of tbe Environmental Conservation
Law and the Commissioners Directive dated November 12, 1913, you are hereby
notified that no permit will be necessary.
Please keep a copy of this letter at the project site, available for
inspection at all times, during the period of construction.

After receiving your letter of 6/26/75. refusing me:
the use of my two lots at GOOg~ Creek.. ][ spoke- to Mr..
Wickham,. he suggested that Nr. Roth was planning a sub-
division and that you had told him he lIOuld hawe. to hawe
City water. therefore city water would possibly be
available to me in the near future. He advised that I
contact Mr. Roth's engineer or Attorney.,
I have had a talk with his attorney and he tells me
that he had no knowledge that you had said he had to have
city water. He has contracted with a well driller to put
in test wells and said that if they are approved by the
Dep't. he canuse them legally as the cost to bring city
wate~ to his property would be absoutely unfeasable
financially for the number of lots involved. Therefore
it does not appeB,r that there 1~iJ.l be any cha..nce of me
getting city water in the forseeable future.
As I already have two wells drivenend tested near
the corner of Oabrood Drive. I feel that I should. be
allowed to use them for these two lots. I am sure the
water consumed by two future homes would not be detrimental
to the water supply of OaID~ood Park.
Therefore it seems that you are denying me the use of
these two lots only on the ground that in the minutes of
the original meeting it mentioned only city water.
Truthfully I was under the impression that the minutes
should have read city water or good well water.

In spite of the fact that it mentions only city water
I can see no reason why a fgir minded Board cannot change
it's decision, due to a change in circumstances such as I
h~ve with two good wells and a deeded easement to the lots.
Gentlemen, if you will please carefully reconsider
this matter, I ~ sure that you cen see you are being
grossly unfair and in fact discriminating against me for
some reason as I cannot find where you have required this
for any two lots in South old Town.
I eID writing this as I don't feel it is to your
advantage or mine to argue this before an audience
without first stating my facts privately. Also I do not
want to ask you to take any time from your business to
discuss this with me.
Please advise if you wish me to attend another
meeting (Date and Time) or may I receive a more specific
reason for your decision..

The above petiLion ha~ been forwarded to this office by the Local Tidal
Wetlands Permit Administrator who has made a review and site inspection.
As a result we have determined that construction of two single family
dwellings on two lots off North Bayview Road, near Goose Creek, Town of
Southold, Suffolk County, will have no adverse affect on adjacent tidal
wetlands.
Therefore, pursuant to Section 25-0202 of the Environmental Conservation
Law and the Commissioners Directive dated November 12, 1973, you are hereby
notified that no permit will be necessary.

The Planning Board was presented with final maps for the
minor subdivision of Southold Development Corpo, property located
at south side of North Road to Bayview, Southold, New Yorko The
map showed 3 lots containing from 22,800 to 23,000 sqo fto of area,
a 50 fto right-of-way, a reserved section at the westerly end of
the property, and a large parcel on the easterly end which was
labeled "Southold Development Corp. II, being the area on which they
could not secure good water. The Chairman questioned the reserved
area on the westerly end of the property. Mr. Smith stated that it
was part of Oakwood Development, he did not give them rights to it,
but he told them he had property on which they could put a boato

Dan Smith.w1l1 be in to see you in the next day or so
regarding his property on Goose Creek. 1 spoke to you about
this quite awhile ago but 1 want to clarify the situation.
The lots in question are noted as lots 4 and 5 on the
enclosed copy of subdivision map. On October 26, 1970, the
,.Planning Board approved :lots 1, 2 and 3 and, according to
the minutes, told Mr. Smith they would not approve the
la&ther two lots until such time as public water is avat~~
in that area.
On June 23, 1975 Mr. Smith appeared at a regular meeting
. and requested a Jllight. change in the lot line which he says
the Health Department and D.E.C. requested. It was the
consensus of the Planning Board at that meeting that they
reaffirm the position they took in 1970. John repeatedly
insists that the rules and regulations state that the
Planning Board can only consider buildable land in the
40,000 square feet required for each lot.
1 didn't know what else to do with Mr. Smith but
. sUggest that he speak to you about it. 1 enclose letter
which he sent to the Planning Board the beginning of August.
