SOUTHOID TOWN BOARD OF APPEAT~
June 18, 1970
A regular meeting of the Eouthold Tow~n Board of Appeals was
held at 7:30 P.M., Thursday~ June 18, 1970, at the Town Office,
Main Road, Southold, New York.
There were present: Messrs. Robert W. Giltispie, Jr., Chairman;
Robert Bergen; Charles Grigonis, Jr.; Serge Doyen, Jr.; Fred Hulse, Jr.
Also present: Howard Terry, Building Inspector
PUBLIC NEARING: Appeal No. 1311 - 7:30 P.M. (E.D~S.T.), upon
application oF Je~seph D. Zaiser, Mill Creek Drive,-Somthold, New
York, for a variance in accordance with the Eoning Ordinance,
Article ZZI, Section 300, Subsection 6, For permission to locate
carport (accessory use) in front yard area. Location of property:
east side of Mill Creek Drive, ~outhold, New York, bounded north

The Chair~ opened the hearing by rea~ing the application for
a variance, legal notice of hearing, afFida~vit attesting to its
publication in the official newspapers, '-~d notice to applicant.
THE CHAIR~: Is there anyone present who wishes to speak for
this application?
~R. EAISER: Tes, I am Joseph Eaiser. I built the carport.
THE CHAIR~: You apparently applied £er a building permit
on Nove~oe~ l, 1969.
i~R. EAISER: I built the carport not knowing that a permit
was necessary. An inspector came around and asked if I had a
permit. I did not know I had to have one. I built it earlier.
He came by in October.
TEE C~IR~N: T~e Board of Appeals reviewed your application
for a variance to build a carport in your front yard area and
wrote you that inasmuch as you would not return to Southold until
May 1970, the Board agreed to hold this ~atter over ~til you~
return. Tou have built a carport in the front yard area without
a permit or variance. This requires a variance. The space between
the building and the road is regarded as the front~ yard° I~gally,
whether the house is on the water or not is beside the point. For
legal purposes, the area between the building and the public high-
way, or access, is the front yard area~
~. ZAI~EE: This is a circula~ drive.., almost a private
street. There~s very little traffic.
THE CHA~M~: Y~ you attached this carport to yo~r house and
kep. t oF£ the~ side yards, all you would need would be a Building
Permit. ~e have a ~equirement: 2~ side yards- lO~ on one side
and l~~ on the ~other side, with an open space between you and yeu~
neighbo~ at the house line. If you w~nt te build a garage and put
it in you~ rea~ yard ~ea, there would be no p~oblem. Ym o~de~
Fo~ the Boa~d of Appeals to g~ant a structure in your front yard
a~ea, you have to show unusual hardship - unique hardship~- and
that it will not eha~ge the charzcter of the neighbez~hood. I
don.~t think that you show unusual hardship or unique hardship
because you are the same as everybody else. You are the ~me~ of
a pie-s~a~d lot ~ud it seems to me that a carport in the fren~
yard will change t~e character of the neighborhood°

We granted a.garage on that~street.

, TEE OHA~RNAN: (Referring to map) We have a street here and
berets the water. You a~e concerned about the water view, the
people across the way looking at a backyard. You believe a carport
is acceptable and a garage is not.
MR. ZAL~ER: A garage would block everybodyls view.
THE CHAIRMAN: Many people will be living there year round.
~R. ZAi2~ER: The people di~ectly across the street are living
there year round now. I asked them how they felt about-it when I
built the carport, llve been here since Spring of 1947. Thatts,~
quite a while. I wanted to be considerate of the neighbors. If
you look out of a window you can see underneath the carport.
THE CEAIRNA~-: Eoning is not a popularity contest.
MR. ZAI~ER: Would it be all right if i got permission from
everyone in ~the Circle? (Mr. Zaiser submitted pieties to the
Board members),
TEE CH~IRNAE: Identify the-pictures for the record. Exhibits
A & B. Those are of-your carport. You only have erie car, You
donlt want a double carport. You are on public property.
MR. ZAI~ER: I am l0g over. I can rectify that. I'm sure
I could get signatures from everybody over at Grove Road.
TR~ CHAIRMAN: i would believe that a carport is less dis-
tressing than a garage. People across the street would not be
able to see the water at all.
2~R. ZAISER: I tried to line the carport up with the house.
THE CHAIP~: Suppose your neighbor wants to sell his house
and the ne~ people want a two-car garage?
MR. GRIGONIS: If the fellow on the next lot wants a two-car
garage, you would.have to take the case on it's merits as it stands
right here. You canlt stipulate. I can~$ see how it would change
the character of the neighborhood. I am inclined to agree with the
applicant, if he move~ the c~vport off the road.
~. BERGEN: I am looking at the-pictures and I see your
neighbor has curbing around the place. You donlt have any c~rbing.

THE CHAIR~: Can you move the carport back a car~s length
for safety sake? .You are backing out on the highway. You have
a lot big enough~ that you can back out-on your own property.
You can locate your carport differently. You could put it in the
middle. You could back cut amd ge into the road head-on.
MR. ZAP: Hew about backing into the carport?
THE CHAIRMAN: Is there anyone present who wishes to speak
against this~ application?
(There was no response. )
T~E C~A_IRMAN: The carport should be moved 20~ from the road.
Otherwise, the whole road is going to be a row ef shanties.
MR. ZAI~ER: All the ether driveways are there now. ~People
back out on-to the road.
~R. BERGEN: That is what we are trying to overcome. You
all realize that traffic is getting-much heavier. ~e are trying
te overcome backing out on to roads.
THE CHAIR~AN: We cantt chamge what has happened in the past.
MR. EAISER: Ne are talking about a Circle that, s like a
dead-end street. Ttls a quarter of a mile around the Circle. You
can,t ge fast.
THE CHA]I~L~N: if there are ne ether questions, I am going
to propose that this~¢arport be permitted as accessory ~se in
the front yard ef Mr. Zaiserls home b~t that it be relocated
20t back from the read. You have not indicated hardship.
(The hardship would be a topographical one).
I~R. ZAI~ER: If I move it back it will be in the way of
ne ighb ors.
THE~ CHAI~j~Y: ~e think it is safer 20.~ back before it hits
the highway. Another reason is that people live on the ether
side of the street. The Eoning Ordinance calls for front yard-
40', backyard 30~, sideyamd 3%~. '%~nere are places where people
value open space.
MR. ZALEER: Rather than move it, I will take it down.

THE CHAIRMAN: I' am going to make a resolution that the
application be granted providing the carport is located no
closer than 20 ft. from Mill Creek Drive. Motion seconded
by Mr. Bergen.
I~. GRIGONiS: You might live here all year round. You
might want-to put siding on the carport. Y~ it,s on the road,
you would be blocking it badly.
THE CHAIRtVAN: I am going to withdraw my resolution. There
is no unnecessary hardship. I am going to move that the applica-
tion be denied and that the applicant resubmit his application
stating what the hardship is and hew it will not change the
character of the neighborhood. I donTt believe this application
is in proper form~
After investigation and i~spectien the Board finds that the
applicant requests a variance for permission, to locate carport
(accessory use) in front yard area located at Mill Greek Drive,
Southold, New York. The Board finds that the applicant has
built his carport too. close to the highway. There is ne legal
reason for the applicant not to move ~he carport 20 ft. back
from the road.
The Board finds that strict application of the 'Ordinance
will not produce practical 'difficulties or unnecessary hardship;
the hardship created is not unique and would be shared by all
properties alike in the immediate vicinity of this property and
in the same use district; and the variance would, change the
character of the neighborhood and would not observe the spirit
of the Ordinance.

JANES WARNER: Yes, I am James Warner.
HOWARD TERRY, BUIIDING INSPECTOR: Your address shows 'a
Post Office Box number. The-correct address is 4055 Oregon Read.
OW~iR ~MA~: Let the corrected record indicate No. 4055.
~. WARI\~ER: Before we put in an application, we talked to
our adjoining neighbors amd the gentleman across the. street. The
land he farms is adjacent to Red Riding Farm, north side of Oregon.
They have all agreed we can use ~he back reads for trail ridi~g~
TW~ CHAIRMAN: I would suggest you get permission in writing.

~. ~/ARNER: t/e are going to take precautions. There are 37
acres of trail and .graziug lead. ~ge have access to the beach.
White sand is good for horses feet, Mark Madaio, my partner,
has been in the horse business for seven or eight years. ! have
been in Florida, worked at a' stable in Florida. Mark worked in
Arizona. ~ The other fellow has been an instructor~ in training horses.
THE CHAIR/MAN: There is a slight discrepancy. 'You say you will
have 15 to 25 horses but I believe you told us you might take on
some trotters.
I~R. ~ARNER: 15 to 25 horses is an over-amount. I don~t feel
that the location warrants that many horses°

THE CHAIRMAN: Isn't a riding stable a seasonal buszness.
MR. WARNER: We have a sleigh for winter. We might have five
or six rental horses in the winter and three or fou~ trotters to
cover expenses. I have two private horses of my own. One, I am
training- a Palomino; one is show material.
THE CHAIRMAN: What is your interest in the property?
MR. ~ARNER: We hav~ a three yea~ lease. We have an option
to buy. All monies we pay into the leasing of the property will
apply as an equity into the property.
THE CHAIRMAN: The property is not in top-notch shape now.
How will you confine-the horses?
/~R. WARNER: ~$ith electrified wire inside the rail. %Se have
a corral 20~ x 60~. It cost $170.00 to build. We will board up
the front entrances of the barns. The winter barn will have an
entrance on the rear.
THE CEAIRI~u~: I suggest you get letters from your neighbors.
Each neighbor who gives you permission to use an amount of acres.
All ho~ses for hire must be ridden north of Oregon Road.
I~l~. ~;AI~ER: We will not cross the roadl Stalls will be
cleaned out daily.
THE CHA/RMAN: Whenever a horse and rider leaves your stable
an experienced rider will be with them?

THE CHAtRNAN: I would suggest that yom talk with a lawyer
to see that you are adequately protected. The Board of Appeals
is obligated to say that the area permissible for riding is all
north of Oregon Road.
THE GRAY, MAN: A~e YOu willing to remove ma~ure once a week?
MR. ~ARNER: We put menure in bags. Ne are not going to
have more .than a 100 lb bag per week.
THE CHAIRMAN: I believe that would be under the jurisdiction
of the Board of Health.
MR. T~Y: People will come looking for it.
THE CHAIRMAN: Is there anyone present who wishes to speak
against this application.

After investigation amd inspection the Board fimds that the
applicant requests permission to establish a~d maintain stables
for boarding and riding horses under~thename of Royal Flush ~tables
on land of Dominick Mavellia, north side of~ Oregon Road, Mattituck,
New York. The facilities will consist of and include the following:
15 to 25 horses; sufficient stall areas; 37 acres trail and grazing
land; capable staff on premises at all times.
The Board finds that the public convenience and welfare and
justice will be served and the ·legally established or permitted
use of neighborhood property and adjoining use districts will not
be permamemtly-or substantially injured a~d the spirit of the
Ordinance will be observed.

2~R. DOv~I~: The adjacent land owners-are opposed to any
increase of buainess activity ef any type. However, they are
generailynet opposed to a marine supply store. They feel it
would be advantageous to have the building renovated and cleaned
up, and if the business would net create a parking problem. The
applicant states this is his intention and he would be satisfied
to be limited to this usage.

THE CHAIRI~kl~: Whether parking is adequate is a point to be
considered. Offhand, it doesnlt look as though it is.
MR. TERRY, BUILDING INSPECTOR: There is room between the
building and the street. _Y_f you took. the fence off you could
aceomodate three more cars.
THE CHAIRNAN: I would think that one condition should be
that the use of this renovated property, which would be 20~ x
30t, b.e confined to ma~ine supplies, not general hardware;
strictly related to marine supplies and marine hardware.
Two: that the renovated area be limited to 20~ x 30~ existing
outline of building. Three: that additional offstreet parking
be provided.
MR. DOYEN: Ym other words, the outlined conditions-are what
the majority of the surroumding property owners could live with.
Beyond that, they would be opposed.

applicant requests Permission to reconstruct men-conforming

The applicant is the owner of a non-conforming use property.-

railway. The applicant Proposes to renovate the area, formerly
used as an. apartment, for the purpose of selling ma~ine supplies
and marine hardware in connection with his boat business. Approxi-
mate size of renovated apartment would be 20! x 30! requiringaddzt:zonal'
parking area for three cars under the present Ordinance. The Board
finds that this space can be created by eliminating a small picket
fence on the north side. 'The applicant owns two adjacent lots to
the east of the property under application. The east lot being
leased, while he, himself, lives on the adjacent lot to the east.
The Board finds that strict application of the O~dinance will
produce practical difficulties or unnecessary hardship; the hardship
created is unique and would be shared by all properties alike in
the immediate vicinity of this property and in the same use district;
and the variance does-observe the spirit of the Ordinance and will not
change the character of the district.

New York, and use same For business purposes and create off-street

The following conditions are required by the Board in granting this
applic at ion:
1. The renovated apartment shall be used solely for the
sale of marine supplies and m_~ine hardware.
2. The renovated area be limited to the existing size of
the vacant apartment.
3. That three additional parking spaces be provided to the
north side of the building as described in our findings.
4. That this permission be g~anted for a period of two years
subject to review by the Board of Appeals.
Vote of the Board: Ayes:- Messrs. Gillispie, Bergen, Grigonis,
Doyen, Hulse.
On motion by M~. Bergen, seconded by Mr. Gillispie, it was
RE~0~VED that the decision on Appeal No. 1338, Frances ~eewald,
Nassau Point Road, Cutchogue, New York~ be postponed ~until July 9,
1970 in order to give Nassau Point Property Owners Association an
oppo~tunity to file brief supporting their decision in the matter.
