Dear Mr. Lark:
The following action was taken by the Southold Town Planning
Board at a regular meeting held May 5, 1980.
RESOLVED that whereas, a formal application for the approval
of 'a subdivision plat, entitled Minor Subdivision of Edith M. Terry
#191 was submitted to the Planning Board on March 5,1980, and an
application fee of $20 was paid on March 5, 1980, and
WHEREAS, a public hearing was held on the said subdivision
application and plat at the Town Hall, South old , New York, on
May 5, 1980 at 7:30 p.m., and
WHEREAS, the requirements of the Subdivision Regulations of
the Town of Southold have been met by said subdivision plat and
application,
Now, therefore, be it RESOLVED, that the application of Edith
M. Terry for approval of said subdivision plat prepared by Young &
Young and dated February 25, 1980 and amended April 1, 1980, be
approved and that the Chairman of the Planning Board be authorized
to endorse approval on said subdivision plat.
I enclose copy of negative declaration in regard to the State
Environmental Quality Review Act.

COVENANTS AND RESTRICTIONS
That only one single family dwelling house for residential
purposes, and a private garage for family use only, shall be
built on these premises. No trailer, tents or camping shal~
be permitted, and no occupancy of any such dwelling house
shall be permitted until the outside and the roof shall be
fully and completely finished and painted.
That no building, structure or structures shall be erected or
maintained at a height in excess of one and one-half stories
and that all roofs shall be of the hip, gable or pitch roof
type construction. All buildings shall be erected on closed
foundations of poured concrete or cement blocks, and no build-
ings on posts shall be permitted. No flat roofs or lean-to
roofs shall be permitted. All construction shall be done i

with new material and no existing structure may be moved there-i

on. I
That no dwelling house, exclusive of garage, shall be erected
on said premises which shall contain less than one thousand
(1,000) square feet of living area on the ground floor. All
roofs shall be of asbestos, cedar or composition shingle and
no roof shall be laid down with rolled roofing. All plans
and specifications shall be subject to the approval of the
partyof the first part, and in writing.
No trade, craft, business, manufacture, industry, commerce or
profession (medical and dental professions permitted), includ-
ing hotels, boarding and rooming houses, shall be conducted on
said premises.
No nuisances nor noises of any kind, unwholesome and offensive
to the neighborhood, shall be permitted to exist on said prem-
ises, nor shall any accumulation of rubbish, garbage, junk or
materials of any kind be permitted to remain on said premises.
No advertising signs, billboards or other sign devices shall
be permitted on any of said lots, excepting a developer's
sign or a "For Sale" or "For Rent" sign of reasonable dimen-
sions.
No fowl, poultry, animals or livestock shall be kept on said
premises, except domestic household pets.
There shall be no outside toilets or outhouses erected upon
said premises~ An adequate,septic tank or cesspool shall be
erected and maintained on said premises for sewage disposal
in conformity with the requirements of the Suffolk County
Health Department.

Said premises shall be subject to electric light, gas and
water and telephone easements on the surface or below the
surface along the roadway or lane adjacent to said premises.

9. No sand, earth or sod shall be removed from the premises, or
excavation be allowed to remain open thereon, except as may
be necessary during building construction periods.
,10. No fence shall be erected or maintained on any lot over four
feet in height. Fences shall be picket, ranch type or privete

No outside boat storage shall be permitted.
The said covenants and restrictions are hereby declared to be
covenants and restrictions attached to and running with the
land, and shall expire on January 1, 1983, except that any or
all of the above covenants and restrictions may be modified,
altered or annulled as to the premises described herein or
as to any other neighboring property now or formerly owned by
the grantor at any time by written agreement by and between
the grantor, his distributees or assigns, and the then owner
for the time being of the premises upon which it is agreed to
amend, alter or annul such covenants and restrictions and
such agreement shall be effectual to modify, alter or annul
such restrictions as to said premises without consent of the
owner or owners of any adjacent premises or any other neigh-
boring premises, now or formerly owned by the grantor, or of
any other party or mortgagee holding any interest in the said
premises. Nothing herein contained shall require the grantor,
his successors or assigns, to restrict any of the balance of

NEGATIVE DECLARATION
May 5, 1980
Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review Act and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that Southold Town Planning Board as lead agency
for the action described below has determined that the project will
not have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of Edith M. Terry is a two-lot residential
subdivision of 2.49 acres located at Southold in the Tovm of
Southold.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project be
implemented as planned.
Because there has been no response in the allotted time
from the New York State Department of Environmental
Conservation it is assumed that there is no objection
nor comments by that agency.
The Suffolk County Department of Health Services has
indicated that a precursory review of the project indicates
conditions are suitable for individual sewage systems
and water supply facilities; however, their records
indicate that the possibility of extending public vmter
to service the subdivision should be explored.
The project will meet all requirements of the Code of
the Town of Southold Subdivision of Land Regulations.
