WHEREAS, the proposed site plan, to be known as the Bill Fox Grounds Maintenance Site Plan, is for the conversion and alteration of an existing residence with a 351 sq. ft. office on the first floor and a 2nd floor apartment on a 0.24 acre parcel in the HB Zone; and WHEREAS, Bill Fox Grounds Maintenance, Inc. is the owner of the property known and designated as 2595 Peconic Lane, located approximately 725' s/o County Road 48 on the w/s/o Peconic Lane, SCTM#1000-74-5-4; and WHEREAS, on May 4, 2004, a formal application for approval of this site plan was submitted; and WHEREAS, on June 15, 2004, the Southold Town Planning Board, acting under the State Environmental Quality Review Act (6 NYCRR), Part 617.5, makes a determination that the proposed action is a Type II and not subject to review; and WHEREAS, on June 17, 2004, the Southold Town Fire District found adequate fire protection for this site plan and the Planning Board has accepted this recommendation; and WHEREAS, on June 28, 2004, the Suffolk County Department of Health Services reviewed and granted a variance under Reference Number C-10-03-0015; and WHEREAS, on July 15, 2004, Suffolk County Department of Health Services approved a new office and apartment under Reference Number C-10-03-0015 on the plan created and certified by Michael Mapes, P.E. dated 5/28/04; and r • • Bill Fox Grounds Maintenance— Page Two—8/10/04 WHEREAS, on August 3, 2004, the Southold Town Engineer reviewed and approved the proposed drainage and the Planning Board has accepted his recommendation; and WHEREAS, on August 3, 2004, the Architectural Review Committee reviewed the architectural drawings and associated site plan materials in accordance with its recommendations of May 27, 2004 and determined they were satisfactory; and WHEREAS, on August 9, 2004, the Southold Town Building Inspector reviewed and certified the site plan; and WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of Public Hearing, has received affidavits that the applicant has complied with the notification provisions; and WHEREAS, the following two items are incorporated and included in the site plan: 1. All outdoor lighting shall be shielded so that the light source is not visible from adjacent properties and roadways. Lighting fixtures shall focus and direct the light in such a manner as to contain the light and glare within property boundaries. The lighting must meet the Town Code requirements. 2. All signs shall meet Southold Town Zoning Codes and be subject to approval from the Southold Town Building Inspection; and WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold have been met; be it therefore RESOLVED that the Southold Town Planning Board grant final approval on the site plan prepared and certified by Michael D. Mapes, Professional Engineer, dated August 01, 2004, and authorize the Chairperson to endorse the final site plans subject to a one year review from the date of the building permit. My comments are as follows: 1. The Site Plan indicates a proposed concept of providing two access points from the parking area to Peconic Lane. This concept has been approved by the Highway Superintendent with the condition that each Curb Cut must be constructed with a new concrete driveway apron and the continuation of the existing Town sidewalk. Any and all reconstruction of the existing sidewalk fronting the property should be the Owners responsibility. Plan&Section details of the concrete aprons should be shown on the final drawings. 2. The Site Plan indicates an existing Stone Drive traversing the South Westerly corner of the Site and exiting onto Peconic Lane. Will the Site Plan review provide for or require a permanent easement for access at this location or will the stone drive need to be relocated? 3. The handicap parking area and the walkway to the dwelling is indicated as having a new asphalt surface. This narrow asphalt strip of pavement will be traversed by every vehicle entering the site and will be difficult to maintain. It is recommended that Flush Concrete Header Curbing be installed on each side of the walkway to maintain a safe, stable surface for handicap accessibility. 4. The utility pole shown within the parking area appears to be in a hazardous location. This pole should be relocated outside of the parking area. If relocation of the pole is not possible, other safeguards such as steel or concrete bollards should be installed to protect the pole. Plan & Section details should be shown on the final drawings. 5. Drainage calculations should be revised. Calculations for the stone parking areas should also include the area of the asphalt pavement area using a runoff coefficient of one. (1.0) 6. Drywells indicated on the Site Plan should be numbered. The proposed design criteria provides for the installation of new drywells that will have different depths. Each numbered pool should be referenced to indicate the size of the pool. If the proposed Block Curbing has a 5" reveal than the gravel surface of the parking area is proposed relatively flat. These inlet grates should be lowered 'slightly to provide for a minimum pitch that will allow the gravel surface to properly drain to prevent standing water throughout the parking area. 8. Parking lot specifications indicate an 8" RCA Base with a ''/z" gravel top. It is recommended that the top surface be a minimum of 2" thick Blue Stone Blend to meet Town Code. To accomplish this,the proposed RCA base material may be reduced bytwo inches of thickness. 9. Conceptual Building Code and Town Zoning compliance should be reviewed by the Town Building Department prior to site plan approvals. The applicant is proposing installing the sanitary system less than 150 feet from a private well. Findings and Facts 1. The subject property is a 10,583 square feet (sf) parcel with an existing fire- damaged dwelling. The applicant is proposing to demolish the existing dwelling, replace the dwelling, and install a new sewage disposal system. The proposal is to replace the dwelling with a dry retail business and a second-floor accessory apartment. 2. The parcel is in Groundwater Management Zone 4 and is depicted as one lot on the 1981 tax map. 3. The existing dwelling is connected to public water, supplied by Suffolk County Water Authority. 4. The design flow for the project is 289 gallons per day (gpd). The project conforms to the density provisions of Article 6. 5. The proposed sewage disposal system has been designed to, meet current department construction standards and will include a septic tank,', leaching pool, and an expansion area for a future leaching pool addition. 6. Soil conditions are good with pale brown sand to 3 ft. below grade, then brown fine to coarse sand below. 7. Groundwater is greater than 17 ft. below existing grade. 8. Even though public water is available and is installed on site, some of the surrounding neighbors are still using wells for their water supply. The location of the proposed leaching pool is 136 feet from an existing drinking water well on the lot to the east of the property(Beltz). Brian L. The distance to surrounding wells has been maximized. Moving the leaching pool from the proposed location would put the pool within 150 ft. of wells on other lots that adjoin the parcel. 10. The sewage disposal system for the existing dwelling consisted of a single leaching pool (cesspool) with no septic tank and was 106 feet from the Beltz well. 11. The direction of groundwater flow is estimated to be southeast by',the applicant's engineer and northeast by the department's hydrogeologist. It', is difficult to determine the actual groundwater flow direction without precision) drilling due to the location of the site being very close to the groundwater divide. 12. The applicant's engineer plotted the capture zone for the B61tz well with groundwater flow to the northeast and has stated that there is 61 feet of clearance between the capture zone and the proposed leaching pool. 13. According to the engineering report submitted with the variance'request, offers were made to the two neighbors (east and west of the site) that are using well water to connect them to public water with all costs paid by the applicant. Both offers were refused. Determination It was a 3 to 0 determination of the Board of Review (Board) to grant the'request for the variance to construct the sewage disposal system at the proposed location provided that the applicant maintains the offer to furnish and install a public water connection to the Beltz dwelling at no cost to Beltz. This offer shall remain open until such time as the department grants final approval to the subject application. The new disposal system is larger with respect to storage and leaching capacity than the previously existing system. The proposed septic tank will provide a greater amount of sewage treatment before discharge than the previous single-cesspool (no septic tank) system. As per §760-609 of the Suffolk County Sanitary Code (Sanitary Code), the approval of the variance is in harmony with the general purpose and intent of the Sanitary Code to protect groundwater and drinking water supplies, surface water and, other natural resources, and public health, safety and welfare. In compliance with §760-609(l)(a), the proposed variance is in general conformity with the Sanitary Cade. The uses of groundwater, surface water, and drinking water supplies will not be impaired, taking into account the direction of groundwater flow and, as such the granting of the variance is in compliance with §760-609(1)(b).
