WHEREAS, this proposal is to relocate the building envelope on Lot 3 of the approved subdivision map of Hanoch and Watts (filed map number 9059, February 1, 1991) to the location shown on the survey prepared by John T. Metzger, dated January 24, 2006 and last revised on February 9, 2006; and WHEREAS, in a letter dated February 22, 2006, the applicant formally requested that the building envelope on Lot 3 of the approved Subdivision Map of Hanoch and Watts be relocated into a new location 80' from the southwest property line, 25' from the northwest property line and 160' from northeast property line, as shown on the survey prepared by John T. Metzger, dated January 24, 2006 and last revised on February 9, 2006; and WHEREAS, the Southold Town Planning Board considered the applicant's request to relocate the building envelope and determined that no impacts to the site or the surrounding properties will result; be it therefore RESOLVED~that the Southold Town Planning Board, acting under the State Environmental Quality Review Act (6 NYCRR), Par[ 617.5 © (7), makes a determination that the proposed action is a Type II and not subject to review; and be it further Sannino Amendment Page Two March 14, 2006 RESOLVED, that the Southold Town Planning Board hereby approve the new location of the building envelope on SCTM# 1000-101-1-14.4 (Lot 3 of the approved Subdivision Map of Hanoch and Watts) as shown on the survey prepared by John T. This approval is for the relocation of the building envelope only and does not constitute an approval for any of the structures shown on the plan. It was RESOLVED that the Southold Town Planning Board authorize the Chairman to endorse the final surveys dated September 15, 1988, with the following conditions affixed to the final map: Street trees are to be planted in conformance with Section 108-41 of the Town Code. Street trees must be planted prior to the issuance of any building permits by the Building Department. The fire well must be installed prior to the issuance of any building permits by the Building Department. A permit from the Department of Public Works is necessary for the common access to Lots numbered 2 and 3. This permit must be submitted to the Building Department prior to the issuance of any building permits by the Building Department. The mylar maps, which were also endorsed by the Chairman, must be picked up at this office and filed in the office of the County Clerk. Any plat not so filed or recorded within sixty (60) days of the date of final approval, shall become null and void. The draft is not acceptable. On November 17, 1988, and again on May 1, 1989, the Planning Board requested a covenant and restriction stating that there will be no further subdivision of any of the lots in perpetuity. This statement has not been included in the recently submitted document. In addition, the draft document states that the subdivision consists of four lots. The subdivision proposal which received conditional final approval is for three lots. The following paragraph must also be included in the Declaration of Covenants and Restrictions: "These covenants and restrictions can be modified only at the request of the then owner(s) of the premises with the approval of a majority plus one of the Planning Board of the Town of Southold after a public hearing. Adjoining property owners shall be entitled to notice of such public hearing but their consent to such modification shall not be required." In addition, Numbers 1, 3, and 6 of the November 20, 1989 conditional final approval, have not been fulfilled. As stated in the November 20th resolution, all conditions were to be fulfilled within six months of the Planning Board's conditional approval of the map. Since the conditional final approval has expired, the Board considers this proposal as having only preliminary approval. ~ If your clients wish to proceed with this proposal, final maps, in accordance with all conditions of the expired conditional final approval, must be submitted. Enclosed, you will find a copy of section 101 of the tax map for Southold which I have marked to show my findings. It appears that the exsiting facilities are adequate to protect the limited development which my clients pro- pose for their property. The well which your board has proposed would be in a loca- tion where it would be of value only to protection of the house that will eventually be built on lot #1. Please note on my enclo- sure that there is an existing fire well on Alvah's lane that is only marginally more distant from the building envelope on lot #1 than that proposed by the board. Due to the foregoing, it is difficult to see where my clients' property would benefit from or create the need for proposed well. the Finally, it should be noted that lot #1 is currently planted as a vineyard and any other use of the site is not contemplated in the near term.
