The subdivsio ad only sketch approval, which has since e~pired. No forma application was ever made for a major subdivision. If you wish to proceed with obtaining approvals for either a minor or a major subdivision you must submit a new application form, the fee and a set of maps. with regard to the right-of-way, the Planning Board's indication to you that the proposed relocation of the right-of-way was unacceptable, should not be construed as meaning that any relocation is unacceptable. There are several other relocation options that you and Mr. Brady can and should consider. The specific relocation that you proposed routed the right-of-way through the steepest, most difficult terrain on the site. The right-of-way should be placed in the more level portion of the property, So as to avoid the need to regrade existing slopes. -"", tlnallY, it seems clear from the information submitted with your last letter of April 18, 1988, that the whole right-of-way issue is a private matter that must be resolved to the satisfaction of all parties to the right-of-way prior to review of this application by the Planning Board. It is suggested that a written agreement as to the relocation of the right-of-way be' submitted with the new application. . . Please be aware that the Planning Board can not take any action on this application until they are in receipt of an agreement of ownership or a contra~t vendee. We have had the Commonwealth Title Company research this matter and they have traced it back to a deeding in 1927 (see copy) which SPECIFICALLY PROVIDES THE RIGHT TO RELOCATE THE RIGHT-OF_WAY. Thus, the Gatz' from whom we are buying the property continue to have this right, in Commonwealth's opinion. We absolutely must take issue with Ms. Scopaz' suggestion that a rough- hewn pathway, given to owners who really do not need it, and only for purposes of meeting the relocation requirement, would invite usage as a short-cut, given the rough terrain - an axle-breaking ride! You will note in the next to last paragraph of Ms. Rive's letter her suggestion to seek a Court action, if necessary, with regard to the Southold Town's "prohibition" of relocation of the ROW. In light of this and our ability to connect to an extension of the Captain Kidd water system (which would be accomplished by a well-site donation to Suffolk County Water), we would like some guidance on how to get this long-stalled development onto a path of progress. I would greatly appreciate it if you could review this matter at your Friday work session, which possiblility was suggested by Melissa, and give us some determination. I think the file will reveal that we have tried to accomodate ourselves to all suggestions, such as the total redesign of the minor sub-division. Y. 11947 RE: Maunsbach from Gatz Dear Mr. Raynor: Please find enclosed two overlays, one which runs across from Lot 20 through to the cuI de sac to the northwest of Lot 9 and the other which runs to the East of Lot 1 and reconnects with the present dirt road north of Lot 2. The purpose of these dirt roads is to re-Iocate the present existing dirt road (right of way) so that it will utilize the two proposed road systems, namely from Bergen Avenue, northerly along the proposed road and then we would construct a dirt road to replace the existing one along the easterly border of the outparcel and along the northerly border of the outparcel and then contnuing north to the temporary cuI de sac to the west of Lot 9. The relocated right of way would then continue over the north proposed road to a point east of Lot 1 at which point a new dirt road would be reconstructed along the east and northerly lines of Lot 1 until it intersects the existing right of way north of Lot 2. I have passed along to Mr. Brady an overlay with a copy of your letter and, upon his agreement to allow the relocation of this right of way as I have outlined, peconic Surveyors will have to locate it on the survey to be a right of way 25 feet in width as it presently exists but the actual dirt road could be less than 12 feet in width for it appears to be a little less than 12 feet in width now. We understand Mr. Brady's concerns pertaining to the right-of-way on this proposed subdivision and have asked our attoreny, Mr. Alan Birtwhistle, to proceed immediately in resolving this problem. There is some indication that this may take a reasonable amount of time to consumated and I do not want to jeopardize in any way the processing of the major subdivision portion of the property. I would, therefore, request the proposed plan be placed for sketch approval on the October 19 agenda, as all paperwork has been filed with your office and the Planning Board has already field inspected this property during its initial submisstion. It is paramount that we receive sketch approval on this major subdivision so that we may proceed with the Suffolk County Department of Health Services in an expeditious manner. MEMORANDUM TO: FILE FROM: RE: DATE: Valerie Scopaz, Town Planner Minor Subdivision of The Fields of Mattituck by Maunsbach and Leeds Nls Bergen Avenue, 440' W/of Cox Neck Road, Mattituck June 16, 1987 At the Planning Board's request, I met with Henry Raynor, representa- tive of the applicants (Mausnsbach and Leeds). We discussed the Board's concerns about the inadequacy of the traffic c~rculation in the sketch. The Board would prefer to see the new road dedica- ted to the Town and to see it connect with both Rosewood Drive and Stanley Road. The Board had also requested that there be a 100' buffer along Bergen Avenue, with the proposed lots facing the new road, rather than Bergen Avenue. Henry_ was agreeable to asking his clients to revise the layout, and further,to change the road layout so that road access to the westerly proper- ty could be provided as well. Due to the steep terrain just northwest of Rosewood Drive, it would not be feasible to place a road through what now functions as a natural drainage swale. Placing a road through this area would result in either a road that exceeds Town grading standards or a filling of the bottom of the swale to level out the grade. The north-south connection of Stanley Road with Bergen Avenue can best be accomplished when the westerly property (Cooper or others) is developed. Henry will also research the Brady right of way question and inform us of the situation. The Board will still have to make a determination how to work this right of way into the development proposal. After Henry submits the new sketch, the Board will have the information it needs to make this determination. At this point, Henry is not sure how his clients will wish to proceed. The last sketch, with the three lots on Bergen Avenue, represented an attempt to obtain seed money to proceed with the rest of the development. Now that we have made it clear that we wish a road dedication, hence a road built to Town standards, it may make more sense for them to subdivide the property as a whole during the preliminary application.
