State Environmental Quality Review
FULL ENVIRONMENTAL ASSESSMENT FORM
Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a proj
or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequ_
ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determ
significance may have little or no formal knowledge of the environment or may be technically expert in environmen
analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affect
the question of significance.
The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determinati
process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit a project or acti.
Full EAF Components: The full EAF is comprised of three parts:
Part 1: Provides objective data and information about a given project and its site. By identifying basic prof:
data, it assists a reviewer in the analysis that takes place in Parts 2 and 3.
Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provic
guidance as to whether an impact is likely to be considered small to moderate or whether it is a potential
large impact. The form also identifies whether an impact can be mitigated or reduced.
Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not t
impact is actually important.

Purpose: The fuil EAF is designed to help acchcari and agencies determine, in an orderly manner, whether a project
or ac-nor may be significant. The question of whether an action may be significant is not always easy to answer. Frequent-
ly, there are aspects or a project that are suciectwe or unmeasureable. It is also understood that those who determine
significance may have little or no formal :kno•.viedge of the environment or .may be :echr icaily expert in environmental
analysis. In addition, many who have knowledge in one Particular area may not be aware of the broader concerns arecting
the question or significance.
The rull EAF is intended to Provide a method whereby applicants and agencies can be assured that the determination
process has been orderly, comprehensive in nature. yet Flexible to allow introduction of information to fit a project or action.
Full EAF Components: The full EAF is comprised or three parts:

• In completing the form the reviewer should be guided by the question: Have my responses and determinations beer
reasonable? The reviewer is not expected to be an expert environmental analyst.
• Identifying that an impact will be potentially large (column 2) does not mean that it is also necessarily significant.
Any large impact must be evaluated in PART 3 to determine significance. Identifying an impact in column 2 simply

The following resolution was adopted by the Southold Town Planning Board at a
meeting held on Monday, September 14, 1998:
BE IT RESOLVED, that the Southold Town Planning Board authorize the
Chairman to endorse the final surveys dated October 21, 1997. Conditional final
approval was granted on August 10, 1998. All conditions have been fulfilled.
Enclosed please find 2 copies of the approved site plan; one for your records
and one to be submitted to the Building Department when you apply for your
building permit.

The following resolution was adopted by the Southold Town Planning Board at a
meeting held on Monday, August 10, 1998:
The final public hearing which was held at 5:35 p.m. was closed.
The following resolution was adopted:
WHEREAS, Riverhead Building Supply, Corp. is the owner of the property
known and designated as Riverhead Building Supply, Corp., located on Rt. 25 in
Greenport, SCTM# 1000-46-1-1 &2.1; and
WHEREAS, a formal application for the approval of this site plan was submitted
on June 18, 1997; and
WHEREAS, the Southold Town Planning Board, pursuant to the State
Environmental Quality Review Act, (Article 8), Part 617, declared itself lead
agency and issued a Negative Declaration on August 11, 1997; and
WHEREAS, a variance was granted by the Board of Appeals on June 23, 1998;
and
WHEREAS, this approval is for the construction of a 50,425 square foot lumber
yard supply building; and

WHEREAS, the applicant agrees to implement the drainage design
recommendations by the Town Engineer dated August 5, 1998, a copy of which
was sent to the applicant's agent on August 10, 1998; be it therefore
RESOLVED, that the Southold Town Planning Board grant conditional final
approval on the survey dated October 21, 1997 and authorize the Chairman to
endorse the final surveys subject to fulfillment of the following conditions. All
conditions must be met within six (6) months of the date of this resolution.

Dear Mr. Orlowski :
As per your request, I have reviewed the drainage design for the above referenced
project. My comments are as follows:
1. Drainage calculations: the drainage schedule does not include the gravel road
surfaces. This area should be included within the calculations and a run-off
coefficient of 0.6 should be used. The remaining calculations are adequate for the
construction proposed.
2. The drainage design indicates leaching pools varying in both width and depth. For
this reason, the individual pools should be numbered on the plan and in the drainage
schedule to eliminate confusion during construction.
3. Test Hole: The Test Hole indicates that ground water elevation is approx. Elev. 36'.
If this ground water elevation is constant throughout the site, the proposed pools at
the southern portion of the site will be constructed in the water table. The County
Health Dept. Requires that all pools be a minimum of three (3') feet above ground
water. The depth of the pools should be lowered and the number of pools should be
increased accordingly to provide the required volume and still meet this Health Dept.
requirement.
4. The Grading proposed adjacent to the South East corner of the building will be
subject to potential erosion problems. If the adjacent low lying wooded area is to act
as additional drainage for the site, it will be necessary to provide control structures
that would prevent silt and debris from washing into this wooded section of the
property. One example would be the installation of a catch basin that is connected
to the low lying area using drainage pipe that has rip-rap in front of a pipe end section.

This is in regard to the site plans for the referenced project which were submitted to this office for
review.
The Department's review of this project is being coordinated by Mr. Gary Hills of my staff. Upon
review of the proposed work,we find that the plans are acceptable as submitted. Prior to issuing a
Highway Work Permit,you must submit the required permit fee and Surety Bond(sample enclosed).
It is also mandatory that protective liability insurance be provided by the permittee. This must be
accomplished by either submitting a completed Perm 17,Certificate of Insurance,in accordance with
Option A (form enclosed), or by submitting the fee specified below to be covered under the
NYSDOT Blanket Policy. Both the completed PERM 17 and the Surety Bond must be secured by
the same party. Also enclosed is a Highway Work Permit Application to be completed and returned
to this office.
All checks issued to the State of New York must show a Federal Identification Number.
Permit Fee (Payable to "State of New York"): $550.00
Bond Amount: $15,000.00
Insurance Fee: $175.00

approved plan. A copy of the approved plan must be kept at the
construction site.
The storage facility installation contractor is strictly
prohibited from substituting items of equipment clearly listed on
the plan without the written consent of the Department. The con-
tractor must also advise the owner that equipment substitutions
are being made.
The storage facility will be used in the service specified in the
Permit to Construct and the associated plans and specifications
as approved by this office.

The storage facility and all monitoring devices will be main-
tained in accordance with Article 12 requirements and best
industry practice.
Any changes in the use of the storage facility or modifications
to the storage facility must be approved by the Department.

The facility owner or their agent must contact this office at
854-2524 at least 48 hours prior to commencement of any work to
arrange for the required construction inspections.
The storage facility cannot be placed into service until this
department performs a final installation inspection and issues an
interim permit to operate.
The documents submitted in support of this application for a per-
mit to construct pursuant to section 760-1206 of Article 12 of
the Suffolk County Sanitary Code were reviewed for compliance
with Articles 7 and 12 of the Sanitary Code only.
Please contact the local building department and any fire safety
enforcement office for additional requirements that may apply to
your project.
Construction Permits issued by the department are valid for one
year from the date of approval . The facility owner or their
agent can apply to renew the permit any time up to one year after
the construction permit expires . There is currently a $110 .00
fee for filing a renewal application.
If the Department does not receive a renewal application for this
project within one year after the construction permit expires,
the permit will become void. The Department`s job file will be
purged and permanently closed.
The one year period for construction under this permit does not
supercede any other agreements that the facility owner has
entered into with the Department nor does it supersede any man-
dates placed upon the facility by the Department.

The Department's review of this project is being coordinated by Mr. Gary Hills of my staff. Upon
review of the proposed work,we find that the plans are acceptable as submitted. Prior to issuing a
Highway Work Permit,you must submit the required permit fee and Surety Bond(sample enclosed).
It is also mandatory that protective liability insurance be provided by the permittee. This must be
accomplished by either submitting a completed Perm 17,Certificate of Insurance,in accordance with

Manager, described the proposed 50,000 square foot building to replace the
present lumber yard. The ARC will meet on the site at 4:30 on July 1Ei to
consider the proposal.
The discussion revolved about Increasing the roof pitch and using the
light panels and color to make the storage section of the structure more
architecturally pleasing. The retail section and the signage were acceptable.
Those making the presentation indicated that they had received no
notice of the meeting and had to make last minute changes In their schedules
to attend.
BURT'S RELIABLE (SOUTHOLD). The Committee needs to know If the
applicant plans to cover the old and new sections of the building with #16 same
new siding and asks the colors of the roof, siding and trim.

DATE OF PUBLIC HEARING: March 23, 1998, May 14, 1998 and
June 11, 1998
PROPERTY FACTS/DESCRIPTION:
The above-identified property is located on the south side of Main Road,
Greenport, and contains a total combined lot area of 5.938 acres. The
"re-zoning plan" site layout map RZ-1 dated July 18, 1996 prepared by
Donald A. Denis, Architect, has been submitted to show the land area
and footprints of the two existing buildings. Also submitted are
drawings dated June 11, 1997 for a proposed principal building, with
retail area at the northerly front portion, and remaining areas
consisting of vestibule, design center, receiving and office areas,
inside storage areas, accessory lunchroom and mechanical room. Buffer
areas are shown around the perimeter of the property, and an outside
uncovered storage area of 15,000 sq. ft. located in the easterly side
yard.
Also shown on the plan is an outside storage area which is proposed to
conform to the current accessory use regulations for this LIO Zone
District. No building or canopy area is proposed over this storage area
and there was no basis addressed in the Building Inspector's Notice of
Disapproval with respect to this part of the plan.
BASIS OF APPEAL: Building Inspector's January 2, 1998 Notice of
Disapproval which reads as follows: "...1) the proposed structure being
located in an LIO District is permitted to have a maximum of 60 feet of
frontage on one street. The proposed building is approximately 115 ft.
facing Rt. 25. Pursuant to Article XIII, Section 100-133C; 2) When
fences are located in or along side and rear yards, they shall not exceed
6-1/2 feet in height, pursuant to 100-231B... ."
AREA VARIANCE RELIEF REQUESTED BY APPLICANT: The applicant
Is requesting variances regarding: 1) an increased width of principal
building from code limitation of 60 feet to 115 feet wide facing Route 25
(a/k/a Main Road) in this Light-Industrial-Office (LIO) District; and
(2) Fencing up to 8-ft. in height along side and rear property lines.

REASONS AND BOARD ACTION:
Based on all testimony, documentation, personal observation of the board
members, the Zoning Board finds the following facts to be true and
relevant:
1. Applicant proposes to construct a metal drive-thru warehouse with a
showroom/building supply store at the front. The total square footage
is approximately 50,424 sf. The 115-foot width is proposed to allow
vehicles to enter to east side of the building to pick up drywall,
roofing, lumber and similar supplies, and then pay at the exit on the
west side. The smaller store in the front would contain a showroom and
smaller supplies.
2. The applicant has submitted an extensive landscaping plan for the
entire property and has agreed to help mitigate the visual impact of the
width of the building by moving it back to a distance of 110 feet from
the Main Road in order to provide an additional 10-foot landscape buffer.
3. The property contains a total of 5.9 acres and has 325 feet of
frontage on Main Road. The adjacent properties are commercially zoned
and developed property, with the exception of a residential condominium
complex to the east.
FOR THESE REASONS, the Board determines as follows:
In considering this application, the Board finds that a variance for an
8-foot high fence, and a variance for a building width of 115 feet are
the minimum necessary and adequate and at the same time will preserve
and protect the character of the neighborhood, and the health, safety
and welfare of the community. /� ?
1. Grant of an area varian a will not produce an undesirable change in
the character borhood or detriment to nearby properties.
The proposed lumber yard supply building is a permitted use in the LIO
District. the use is compatible with adjacent commercial uses, and the
large size of the property and extensive landscape plan will provide a
sufficient buffer from the residential/condominium complex. The 8-foot
high fence will provide security and protection of the public as well.
(2) The benefit sought by the applicant cannot be achieved by some
method, feasible for applicant to pursue, other than an area variance
because the 60-foot code limitation would not permit room for storage of
material and for vehicles to have sufficient clearance to maneuver safety
in the drive-thru operation proposed.
(3) The requested area variance is substantial and represents a 95+-
percent reduction in the code required 60 ft. minimum width. However
the specific location, large size of the property and extensive
landscaping proposed help mitigate the degree of the variance.
(4) The difficulty situation has been self-created and relates to the
applicant's desire to establish a drive-thru type of lumber business that
requires a large-width structure in order to operate.

(5) The proposed variance will not have an adverse effect or impact on
the physical or environmental conditions in the neighborhood or district
because the property is a large commercially zoned parcel, and the
proposed use is in keeping with many others in the vicinity. The
applicant has submitted extensive landscaping plan for the entire
property and has agreed to help mitigate the visualieM of thewidth
of the building by moving it back to a distance o 10 f from the Main
Road in order to provide an additional 10-ft. Ian cape fee . o
RESOLUTION/ACTION: On motion by Member Dinizio, seconded by
Member Horning, it was
RESOLVED, to GRANT the variances requested subject to the following
CONDITIONS:

This is in response to your memo of March 4, 1998, requesting comments
on the width of the above building, eight foot high fence and traffic
concerns.
The Board does not have concerns with the eight foot fence as it is
located 185' south of the property line and Route 25.
The Board feels that this type of enclosed lumber warehouse is unique in
design and requires this size (width) building.
The Long Environmental Assessment Form, LEAF, was originally submitted
with the Change of Zone Request sent to the Town Board and reviewed
by the Town's Consultant, (report attached) .
In discussing the traffic considerations with our consultant, it was felt
that the major customer traffic would be local, as there is a similar
building in Riverhead. The North Fork customer base would be split
between Riverhead and Southold (Greenport). The Board does not
feel that the traffic to the Greenport location would increase
materially.
old Pluming Board reviewed the subject application and recommended a negative
declaration for the change of zone for the following reasons:surrounding properties are mostly
commercial,the nature of the use will not require large volumes of water nor generate large volumes of
wastewater,and the change of zone to LIO is in keeping with the commercial 7-11 store to the north and
LIO zone to the west.
2. Through inspection and consultation of environmental references it has been determined that the site
does not contain sensitive environmental resources.
3. The proposed action will not set significant precedent,as it represents a unique scenario.
4. The size and location of the subject site makes it less desirable ID residential uses, in consideration of
adjacent land uses (including the Riverhead Building Supply facility to the west,7-11 convenience store
to the north and the LIRR tracks to the south) and in view of the inability to provide adequate on-site
buffers.
5. The existing Riverhead Building Supply facility is considered to be pre-existing and non-conforming with
respect to building setbacks. Approximately 330 linear feet of existing structures on the existing
Riverhead Building Supply property are within 5 feet of the common property line with the subject site.
The current Town of Southold Zoning Code requires a minimum side yard setback of 30 feet in the LIO
zoning district,25 feet of which must be landscaped when adjacent to parcels zoned HD. If residential
development on the subject site were to occur it may be adversely impacted by the lack of adequate
buffering on the adjacent site to the west.
6. The proposed action would permit the expansion of the existing building materials storage and sales use
and would allow for the better design of the facility,with side yard buffers from adjacent residential sites
to the east,allowing for a more appropriate transitional zone.
7. In consideration of site characteristics and surrounding land uses,LIO zoning would permit the highest
and best use of the subject site.
8. Although the action was not specifically recommended in recent master plan updates,the action appears
consistent with Town comprehensive planning in consideration of site specific issues.
9. The proposed action is for a change of zone and further review under the Planning Board site plan
review process will be necessary prior to development of the subject site. At that time,various aspects of
the project may be addressed including buffered setbacks,site layout,and locations of sanitary and
stormwater structures.
10. Proposed project is not of significant magnitude or impact to warrant the preparation of a Draft EIS,and
will not cause a significant burden on natural or community resources.

This project involves the construction of a 50,425 square foot lumber yard supply
building. A variance application is before the Board of Appeals for building
width. The building width must be approved by the Board of Appeals before site
plan approval. A full environmental impact statement was reviewed by the
town's consultant in conjunction with the zone change application to the Town
Board. A lumber yard supply building is a permitted use in this Light Industrial
Park/Planned Office Park (LIO), thus the proposed action is consistent with
zoning.
An Environmental Assessment Form has been submitted and reviewed,
and it was determined that no significant adverse effects to the
environment were likely to occur should the project be implemented
as planned.
There has not been any correspondence received from the New York State
Department of Environmental Conservation in the allotted time.
Therefore, it is assumed that there are no comments or objections
from that agency.
The applicant will have to comply with the requirements of the Suffolk
County Sanitary Code (SCSC) and all relevant standards of water supply
and sewage disposal systems. Design and flow specification, subsurface
soil conditions and site plan details will have to be approved by the Suffolk
County Department of Health Services (SCDHS). This impact is not
considered significant due to the anticipated project compliance with
established requirements of the SCSC and the SCDHS and the required
relevant permits.

PLANNED in the March 4, 1998 issue of NORTH FORK SUFFOLK LIFE. (see exhibit

As a director and on behalf of the members of THE PHEASANT RUN HOME
OWNERS ASSOCIATION, I submit for your review several of our major concerns
relative to the captioned application.
First let me state, we have been monitoring subject application since it's inception.
Please refer to NOTICE OF DISAPPROVAL dated January 2, 1998 TOWN OF
SOUTHOLD BUILDING DEPARTMENT. (see exhibit#2)
PHEASANT RUN CONDOMINIUMS are located on Moore's Lane in Greenport. This
road has become a heavily traveled corridor connecting County Road 48 to Route 25.
Moore's Lane currently services commercial vehicles,passenger cars and pedestrian
traffic. We feel confident the you and THE DOT share our concern over the negative
impact that a 50,000 square commercial "DRIVE THROUGH FACILITY" would create.

To encourage increased consumer traffic in this region, where there are already existing
businesses, near by Public School and various tourism attractions and events sends a
clear message of CAUTION.
Additional concerns include those of an environmental nature. The magnitude and
design of a warehouse (see exhibit#3) of the proposed project within 300 feet of Tidal
Wetlands is a"RED FLAG".
Public Officials and residents of the area MUST remain dedicated to the preservation of
the scenic park like concept as a GATEWAY TO GREENPORT.
We are recommending that the Board Of Appeals and Southold Planning Board reject
this application.

SUBJECT: Riverhead Building Supply Project
We have received inquiries with regard to Route 25 in the area of
the above project, Moore's Lane, 7-11, and other business/industrial
uses, and whether or not information was requested about the
frequency of trailer trucks entering, exiting, loading and unloading
as well as other vehicles. Attorney Patricia Moore, as agent for
the applicant, furnished a copy of the SEQRA determination of
non-significance for this project today, and there is no indication
whether the traffic issues were addressed or requested by the
Planning Board as lead agency for consideration.
The Board of Appeals hearing regarding the building width and
fence height will be held on March 23, 1998. We would like to
provide the Planning Board with an opportunity to furnish comments
to us under the site plan pending for a 115 ft. wide building and
8-ft. fence height. Also, please furnish reasons supporting your
comments (or site plan preference) with respect to these site
planning considerations, and with respect to the paragraph above.

This is in regard to the site plans for the referenced project which were submitted to this office for
review.
The Department's review of this project is being coordinated by Mr. Gary Hills of my staff. Upon
review of the proposed work,we find that the plans are acceptable as submitted. Prior to issuing a
Highway Work Permit,you must submit the required permit fee and Surety Bond(sample enclosed).
It is also mandatory that protective liability insurance be provided by the permittee. This must be
accomplished by either submitting a completed Perm 17,Certificate of Insurance,in accordance with
Option A (form enclosed), or by submitting the fee specified below to be covered under the
NYSDOT Blanket Policy. Both the completed PERM 17 and the Surety Bond must be secured by
the same party. Also enclosed is a Highway Work Permit Application to be completed and returned
to this office.
All checks issued to the State of New York must show a Federal Identification Number.

Dear Mr. Weber:
This is in regard to the site plans for the referenced project which were submitted to this office for
review.
Prior to issuing a New York State Highway Work Permit,the following items must be addressed:
1. Show the existing shoulder to be repaved with traffic bearing asphalt in front of both
proposed driveways and for 20'0"either side of the driveways. Show pavement cross-section
with NYS Item Numbers (see attached).
2. The existing drainage structure must align with the new curb. Install a curb inlet box as per
NYS specs.
3. The plan must show all existing traffic signs along the site's frontage (route markers, ferry
signs). Note that these signs are to be replaced if moved or damaged during construction.
4. To accommodate the truck traffic anticipated for this site,the proposed driveways should be
30'0" wide.
5. The plan must show NYS Standard Drawings and Item Numbers for all work on Route 25
(see attached).

6. The plan must include a Maintenance and Protection of Traffic scheme for shoulder closure
during construction(see attached).

The Suffolk County Department of Health Services (SCDHS) has received your letter dated July 15, 1997,
concerning the above-referenced application, and has no objection to the Town's designation as lead agency.
Article 6 Application Status:
Our agency has no record of a current commercial application for the proposed action as required by Article
VI of the Suffolk County Sanitary Code (SCSC). We recommend that the project sponsor submit an
application to our agency's Bureau of Wastewater Management at the earliest possible date so that a complete
technical assessment of this proposal can be undertaken.
This correspondence is intended primarily to expedite the procedural requirements of SEQRA pertaining to the
establishment of lead agency.The comments provided below are, therefore, general in nature,representing several of
our most common concerns regarding Suffolk County projects. The department wishes,however, to reserve its right
to provide more detailed information within the comment period(s)established for this action.
I. Suffolk County Sanitary Code(SCSC)
1. The SCDHS maintains jurisdiction over the final location of sewage disposal and water supply systems, pursuant
to the authority and requirements of Articles 4,5,6 and 7 of the SCSC. Applications must comply with all relevant
density and construction standards for water supply and sewage disposal. Applicants should not undertake the
construction of, or connection to, either system without Health Department approval.
2. Where applicable, the department regulates the storage,handling and discharge of restricted toxic and hazardous
materials pursuant to the requirements of Articles 7 & 12 of the SCSC.
3. If an application has not yet been submitted to the SCDHS,one should be filed at the earliest date to allow for the
technical review of the proposed action.Project designs submitted to the department should be fully consistent with

any action currently under review through the SEQRA process.
4. Design and flow specifications, information regarding subsurface soil conditions, water supply information, and
complete design details are essential to the review of this project,and are evaluated fully at the time of application
review. Should the town require additional environmental information (such as a DEIS), discussion of the
compliance requirements of the SCDHS should be required.
5. Of particular concern to the department are those areas which because of elevated groundwater conditions, or soils
which are not conducive to the proper functioning of conventional subsurface sanitary sewage disposal systems.
Your agency should be aware that such conditions frequently require the use of fill or the excavation of subsurface
soils to accommodate subsurface sanitary disposal systems constructed in conformance with the requirements of
the SCSC.
6. The department is also significantly concerned with areas where access to potable water may be constrained by
unacceptable groundwater quality and the lack of an available public water supply.All private water supply systems
must be constructed in conformance with requirements of the SCSC.
The department appreciates the opportunity to participate in the SEQRA review of this proposal. Additional
information may be provided prior to the close of the established comment period. Should you have any questions

Reasons Supporting This Determination:
This project involves the construction of a 50,425 square foot lumber yard supply
building. A variance application is before the Board of Appeals for building
width. The building width must be approved by the Board of Appeals before site
plan approval. A full environmental impact statement was reviewed by the
town's consultant in conjunction with the zone change application to the Town
Board. A lumber yard supply building is a permitted use in this Light Industrial
Park/Planned Office Park (LIO), thus the proposed action is consistent with
zoning.
An Environmental Assessment Form has been submitted and reviewed,
and it was determined that no significant adverse effects to the
environment were likely to occur should the project be implemented
as planned.
There has not been any correspondence received from the New York State
Department of Environmental Conservation in the allotted time.
Therefore, it is assumed that there are no comments or objections
from that agency.
The applicant will have to comply with the requirements of the Suffolk
County Sanitary Code (SCSC) and all relevant standards of water supply
and sewage disposal systems. Design and flow specification, subsurface
soil conditions and site plan details will have to be approved by the Suffolk
County Department of Health Services (SCDHS). This impact is not
considered significant due to the anticipated project compliance with
established requirements of the SCSC and the SCDHS and the required
relevant permits.
