The original parcel consisting of 22 acres was the subject of a minor subdivison by the same parties in April , 1986 at which time the parcel was divided into four (4) parcels . Parcels 1 and 2 on the 1986 subdivison map were set apart for construction of single family homes for Salvatore and Jeanne Catapano and their daughter. Lot 3 consisting of five (5) acres was conveyed to the Church of the Open Door. Lot 4 consisting of 13 . 73 acres remained agricultural and is now the subject of this application. Covenants and Restriction were filed in 1986 as part of the Planning Board process which provided that any further subdivision of lot 4 could only be done with approval of this Board. Salvatore and Jeanne Catapano now wish to further subdivide lot 4 so that two lots each consisting of two (2 ) acres _ can be conveyed to their sons , Neal Catapano and Salvatore Catapano, Jr . Catapano has elected to move all of the trees three feet south (3') of his property line so that all of the trees are well within his own property and not within the New York State Right of Way. On April 22, 1991, the Planning Board granted conditional final approval to the above mentioned subdivision. one condition of approval was that "The site is to be brought into conformance with the December 11, 1990 Landscape Plan. A letter is to be submitted to the Planning Board at such time that the improvements have been completed." A copy of this resolution is enclosed for your convenience. The Landscape plan contained two proposed items which have yet to be completed; the construction of a 30' wide curb cut, and the planting of trees. Although the Planning Board has received correspondence from you in regard to the trees, you have not advised the Board as to the status of the curb cut construction. The Planning Board understands your concern regarding the planting of the Bradford Pear trees. The Planning Board will allow your client to substitute either pin oaks or sugar maples for the pear trees. If horticultural practice allows pear trees to be planted in late fall, your client may choose to continue with the planting of this type of tree. The requirement of "street trees" along Main Road as set forth in the very last paragraph of your letter presents a very serious problem. Perhaps it was an oversight but it appears to be a violation of the Right To Farm Act. First of all, the area where the trees are to be planted would severely restrict Mr. Catapano's ability to plow. It would also be a - . tis n problem 1^. that the trees would regtricr y us ; d the air flow and any change in temperature between 10-15 degrees within the greenhouses would destroy the crop. Mr. Catapano advises me that he is not aware of any such requirement concerning any of the other greenhouse in the Town of Southold. Mr. Catapano has already planted a row of junipers along the perimeter of his property which will give the needed definition but will not restrict visibility. As far as I know, the faded plastic is being replaced with rigid plastic on the front of the greenhouse and the store portion of the greenhouse is going to be sided with wood. The heating system in the greenhouse is also being converted to gas which will eliminate the existing stove pipes. The parking area is also to be improved with additional bluestone and I think by taking the above simple measures, that we can possibly effect the desired changes. I await your further advices. The Planning Board has required that proof of access over the right-of-way for the adjacent parcel (owned by Beinert) be submitted for Lot Number 2. In addition, these lots will be required to have a common driveway. The Board has designed the subdivision in this manner to eliminate any additional access points on Main Road. A subdivision with an access road from South Harbor and two lots located at the southeastern side of the lot would not allow Lot Number 3 to be 10 acres in area. Lot number 3 is currently used for agricultural purposes, requiring the 10 acres. MAY 41 �'� Mr. Orlowski May 3, 1990 Page 2 The Covenants and Restrictions read in part as follows: "That any further subdivision of lot numbered four (4) on said subdivision plan shall only be permitted with the consent of the Southold Town Planning Board and shall be limited to a minor subdivision containing not more than four (4) lots. " Our present application is requesting less than the 4 lot minor subdivision provided above. We are asking for only 2 lots with the remaining 10 acres to Continue as a farm. We must maintain at least 10 acres to be eligible for our Agricultural Commitment. We have no intention .to further subdivide the remaining 10 acres and will covenant to that effect. Ms. Spiro seems to be overly concerned about the further subdivision of lot 4 and it is respectfully submitted that her proposal to construct a new access road from South Harbor Road is neither logical nor pratical. By doing so, you would completely eliminate lot 1 from the sketch plan insofar as you would be creating a lot with less than a 175 foot frontage. All the new lots would then be interior lots. The most logical plan would be to allow the subdivision map as presently submitted or to allow lot 2 to be placed on the Main Road where originally planned. Mr. Catapano and I would like the opportunity to have a conference with the Board so that we can express our concerns and listen to any comments you might have. I await your reply.
