The comments, made on the site plan review of this
project, are those based on a check list I developed from
section 100-134 of the code book. This is titled "Site
development plan elements" and are required where applic-
able.
I refer now to the Garrett Strang, Architect, letter,
to the Planning Board, with reference to the comments made,
by me, in reviewing the submitted site plans.
I. Rear yard flooding area. I am presently satisfied
that the work done by the highway department, has
apparently resolved the storm water runoff. Again,
it is not my decision to make. This was an element
in 100-134.
Set back requirements, on existing building, do not
pertain because of pre-existing status.
Public water was not indicated. Again a part of the
site plan element as required in 100-134.
No screening indicated. Because of change
and contiguous property being residential,
the discretion of the Planning Board as to
or not screening would be required.
Today's requirements are that all outdoor lighting
shall be so designed as to be shielded to the pro-
perty. I just reminded the Planning Board of this.
Outdoor signs should be indicated as an element of
a site plan 100-134.

be based on a true picture of intended use within
code requirements. Again, when the Planning Board
addresses these comments to their satisfaction,
the site plan can be considered certified.

Dear Hr. Orlowski,
It has come to my attention that at the January 25th
meeting, the Board reviewed a survey for the above par-
cel, which was submitted on behalf of my client, R.& R.
Associates. It was my understanding that the Board
would be reviewing this survey at a work session, (per
your office) to determine the need, if any, for filing
a site plan, inasmuch as there is neither change in the
building configuration, nor its use.
Had your office informed me, upon inquiry, that this
matter would be on the agenda of the 25th, I would have
been present to answer the following questions raised by
Mr. Lessard:
1. The rear yard has not flooded this season, and it
appears that the previous flooding condition has been
resolved, by the Town's installation of a recharge basin
to the west of the property. Furthermore, if minor
flooding were to occur, it would not affect pUblic ac-
cess to the property from the Main Road.

If any are to be added, they will be

6. There will be a small ground sign installed to the
east side of the entry steps, immediately in front of
the building, between the building and the paved area.
A separate permit will be filed with the building de-
partment for this sign.
It is my understanding that the Board requires a copy of
a survey, showing existing conditions, for their
records. For the record, the property was previously
used for business and will continue to be used as a
business (retail sales of antiques), as per my letter of
January 5th, 1988.
I trust the above information is adequate to answer any
questions that the Board may have and look forward to
receiving approval as soon as possible.
Thank you for your courtesy and cooperation.

7. My interpretation is a site plan should not only
show what is existing, but should also show what
is proposed, otherwise any judgement made cannot
be based on a true picture of intended use within
code requirements. Again, when the Planning Board
addresses these comments to their satisfaction,
the site plan can be considered certified.

Dear :lr. Orlowski,
It has come to my attention that at the January 25th
meeting, the Board reviewed a survey for the above par-
cel, which was submitted on behalf of my client, R.& R.
^ssociates. It was my understanding that the Soard
would be reviewin(j this survey at a work session, (per
your office) to determine the need, if any, for filing
a site plan, inasmuch as there is neither change in the
huildinq configuration, nor its use.
'lad 'lour office informed Jne, upon inquirv, that this
natter would be on the agenda of the 25th, I would have
~een present to answer the following questions raiced ~y

anpears that the previous flooding condition has been
resolved, by the Town's installation of a recharge basin
to the west of the property. Furthermore, if minor
floodinq were to occur, it would not affect public ac-

Dear Mr. Orlo.vski:
I thank you for your letter of October 9, 1987, a ccpy of Which is enclcsed,
relative to the aboITe rratter.
My clients, Rose arrl Richard Sahm, purdlased the aboITe premises on August 26,
1987. At the closing we were advised that a certificate of occupancy existed
for the premises pennitting the same to be used as a a business buildin:l, etc.,
in ac=rdance with the prOlTisions of Article VII of the Zoning Ordinance of t11e
To.vn (SeC"tion 100-700 et seq of the To.vn Code). A copy of the certificate of
OCOlpmcy is enclosed. My clients prcpose to use arrl OCOlpy the premises for a
use specifically autlorized by the certificate of OCOlpmcy, to wit, a retail
antiJ:jue sbJp. Such bein:l the case, I don't believe that Article XIII of the
Zoning Ordinance relatin:J to site plan apprOlTal (Section 1OG-130 et seer of the
To.vn Code) is applicable, as nothin:J is bein:l done to the prcperty, nor is the
prcperty bein:l used for a purpose different fran that pennitted by the certifi-
cate of occupancy. No wildin:l pennit is or has been requestal, arrl no chan;je
different fran the use autlorized by the certificate of occupancy is cont~
plated.
I sent a ccpy of a survey of the premises to Ms. Scopaz for confinnation by the
Planning Board that ny clients did not need site plan apprOlTal. I am rrost
reluctant to have ny clients go through the not insignificant expense of havin:l
a survey arrl site plan prepared for the prcperty so that they may use the it for
a purpose already specifically pennitted. If, at any t:irre in the future, a use
is prcposed to be made of the prcperty Which is not within the ambit of the
certificate of OCOlpmcy already issued, application to the Planni!l3 Board for
site plan apprOlTal will be made. I enclose a larger, more detailed ccpy of the
survey of the prcperty made by Robert Van Tuyl on January 8, 1970, for your
