When concrete is removed, cut concrete with concrete saw two feet outside the limits of the proposed excavation a nd for the full pa ne l width. When the cut is made in pavement within 10 feet of the pa riel joint, the pavement shall be rem oved for full panel width from the cut on the far side of fhe excavation to the pa riel join t. 2. Backfill and thoroughly compact fill using POWER TAMPER, placing soils so that various types of soil are in same relative position as before excavating. Grade to original surface. 3. Replace pavement, sidewalk or surface same as existing; if concrete, replace using 1:1 3/4:3 1/2 mix stone mix concrete; if bituminous material, replace using same type as removed. 4. If concrete curb is removed, replace with similar curb 1:1 3/4:3 1/2 mix. 5. Edge of Jacking Pits or any other excavation shall be not less than 5 feet from Edge of Pavement· No undercutting allowed in Pit. 6. Notify the Department at Yaphank 924-3451 when the work is to begin so that an inspection can be made of the operation. This permit shall not be assigned or transferred without the written consent of the Commissioner of Public Works, The work authorized by this permit shall be performed under the supervision and to the satisfaction of the Commissioner of Public Works or his representative. Particular attention is called to the necessity of thoroughly compacting the back fill, which will be required by the Commissioner of Public Works. The Commissioner of Public Works shall be given one week's notice by said applicant of the date when it intends to begin the work authorized by this permit, and prompt notice of its completion, The said applicant hereby agrees to hold the State, County and Town harmless on account of damages of any kind which may arise during the progres~ of the work authorized by this permit or by reason thereof, Applicant certifies all persons concerned with actual work under this permit are duly covered by Workmen's Compensation Insurance and the State, County and Town shall be held harmless on account thereof, The Commissioner of Public Works reserves the right to at any time revoke or annul this permit should the said applicant fail to comply with the terms and conditions upon which it is granted. The applicant agrees to pay all necessary expenses incident to supervision and inspection by reason of the granting of such permit as certified by the Commissioner of Public Works, such payment to be made within ten days from the rendering of the certified account, Work under this permit to be commenced within thirty days from the date of permit and continued in an expeditious manner, The applicant shall submit a detailed plan of structure to be built, with a description of proposed method of construction. It is understood that should future changes in the alignment or grade of the highway require changes in the work covered by this application and permit, the applicant shall on reasonable notice from the Commissioner of Public Works make such necessary changes at his own expense within the time so specified in notice. We also request that you override the disapproval of the Suffolk County Planning Commission for the following reasons: 1. The first objection as to the landlocked parcel is misplaced because access will be provided over a 25 foot right-of-way which will comply with Mr. John W. Davis' recommendations as set forth in his memo dated April 18, 1987 (Report No. 584) in that the right-of-way will provide suitable access for emergency and service vehicles. Mr. Sepenoski intends to deed the right-of-way for the back parcel. There should not be any dispute over the use of the right-of-way. With respect to the Planning Commission's specific suggestions: 1. Parcel 2 will have access to Old North Road pursuant to a right-of-way to be granted across Parcel 1. By requiring compliance with 280-A of the Town Law, the Town is assured that access to Parcel 2 will be suitable for emergency vehicles. 2. The subdivision was submitted to Suffolk County Department of Health Services and was approved by correspondence dated February 27, 1987. 3. The present plan shows three access points. In actuality, there are two access points, because the east end of the "U" and the driveway from the garage merge into one. The eventual owner of lot 2 will have a right-of- way across what will be the paved driveway. It does front on an eastbound exit lane to Bowery Lane not shown throughout. This exit lane noted as Old North Rd. is a County road. The owner should contact the County to find out if an entrance permit and any other installations are required. No contours are shown on the map but from observation the area (Lot No. l) appears to be fairly level. There is a farm road in the 25 ft. R.O.W. width where the improved access will be constructed. The present elevation of the farm road is about 15" higher than the County road where the roads will intersect. There is a thin layer of sandy material on what appears to be the original ground in the farm road. Test holes verified no substantial depth of bank- run. Recom~endations: Width of road (280-a) ~5 ft. 2. Road section to be crowned %"/ft. and to consist of a base course of 6" of compacted bankrun containing 15% or more of gravel, 10% of loam and a top course of 3/4" stone blend. The top course depth to be 3" L.M. to obtain a 2" compacted measure. 3. Remove topsoil - Depth ~2"~ for ]5 ft. width. 4. Replace topsoil excavation with compacted clean fill to a depth so that the road section - 2" top with the 6" base will be 2''± above the adjacent ground. 5. The road profile can follow the existing O.S. except for the entrance where a short minus grade is necessary to meet the County road. 6. Do not foresee any drainage problem. However, drainage problems incurred due to improvements on existing subdivision roads shall be corrected by the applicant and/or the owner. John W. Dear Mr. Orlowski: The Suffolk County Planning Commission at its regular meeting on April 1, 1987 reviewed the proposed subdivision plat, entitled, "Minor Subdivision - John Sepenoski" referred to it pursuant to Section 1333 of the Suffolk County Charter. After due study and deliberation it resolved to disapprove said map for the following reasons: The proposed subdivision will result in the creation of a landlocked parcel; that is, a parcel that does not have frontage on an existing or proposed public road. The creation of such a lot is contrary to good subdivision layout principles and creates problems as far as access by emergency and service equipment is concerned. This lack of access could result in health, safety and welfare problems for the future residents of a landlocked lot, not to mention potential disputes over the use and maintenance of any right-of-way over an adjacent parcel that may be created for the purpose of access. Creation of a landlocked lot also places the Zoning Board of Appeals in the awkward position of having to grant a building permit for a lot under Section 280-a of the Town Law as the future owner of a landlocked lot cannot be held responsible for the landlocked nature of their parcel. It is suggested that the right-of-way across Parcel No. 1 be included as part of Parcel No. 2 as a panhandle. This will provide Parcel No. 2 frontage on a public road and eliminate the need to obtain relief under Section 280-a of Town Law. It is suggested that before approval is granted to this subdivision that the subdivider be required to submit this proposal to the Suffolk County Department of Health Services for review to insure that the proposed subdivision will meet the requirements and standards of that agency. Only one driveway for each lot should be permitted to minimize the number of vehicular access points on North Road. The map of this minor subdivision should be filed in the office of the County Clerk.
