Southeasterly side of Middle Road approximately 1,300
feet northeasterly from Carroll Avenue, Peconic, New
York.
Dear Mr. Orlowski:
The Suffolk County Planning Commission at its regular meeting on April 1,
1987 reviewed the proposed subdivision plat, entitled, "Minor Subdivision -
Helmut Hass" referred to it pursuant to Section 1333 of the Suffolk County
Charter. After due study and deliberation it resolved to disapprove said map
for the following reasons:
1. Creation of a subdivision with substandard lots, that is, lots whose
areas are less than the minimum required by the zoning classification
of the property, constitutes an overintensification of land use in a
groundwater sensitive area in what is meant to be a low density area.
Such action could establish a precedence for future subdivision of
this kind which would essentially be a circumvention of the Town
Board's action taken over the past years to upzone these groundwater
sensitive areas. The Commission feels that the Town Planning Board
should have the prerogative to review this type of application rather
than it being left to the sole discretion of the Zoning Board of
Appeals.
2.
The proposed subdivision will result in the creation of a
landlocked parcel; that is, a parcel that does not have
frontage on an existing or proposed public road. The creation of
such a lot is contrary to good subdivision layout principles and
creates problems as far as access by emergency and service
equipment is concerned. This lack of access could result in
health, safety and welfare problems for the future residents of
a landlocked lot, not to mention potential disputes over the use
and maintenance of any right-of-way over an adjacent parcel that
may be created for the purpose of access.

Creation of a landlocked lot also places the Zoning Board of Appeals
in the awkward position of having to grant a building permit for the
lot under Section 280-a of the Town Law as the future owner of a
landlocked lot cannot be held responsible for the landlocked nature of
their parcel.

Dear Mr. Hass:
At the hearing held on November 7, 1986, your appeal of the
department's ruling on the subject application was presented to
the Board of Review.
In accordance with the provisions of Article 2, Section 220,
of the Suffolk County Sanitary Code, the determination of the
Board of Review is as follows.
Based on the information submitted, the Board will grant the
request for a waiver to allow the land division which creates two
undersized parcels. The site is now developed and there would
not be any increase in density due to the division. This
approval is subject to the applicant obtaining town approval of
the land division.
The granting of this waiver does not imply that your
application will be automatically approved. It is your
responsibility to ensure that your application is complete;
otherwise, your approval will be subject to unnecessary delay.

After investigation and inspection the Board finds that the
applicant requests permission to store boats on the premises,
west side Wickham Avenue, Mattituck, New York. The findings of
the Board are that the Board is in agreement with the reasoning
of the applicant.

PUBLIC HEARING: Appeal No. 2244 - 10:40 P.M. (E.S.T.)
upon application of Helmut Hass, North Road; peconic, New York
for a variance in accordance with the Zoning Ordinance, Article
III, Section 100-30 and Bulk Schedule for permission to set off
lot with insufficient area. Location of property: south side
CR27, Peconic, New York, bounded on the north by CR27; east by
Cornell Construction; south by Suffolk County; west by other land
of applicant.
The Chairman opened the hearing by reading the application
for a variance, legal notice of hearing, affidavits attesting
to its publication in the official newspapers, and notice to the
applicant. The Chairman also read statement from the Town Clerk
that notification by certified mail had been made to: Joseph C.
Cornell Construction Corp.; Suffolk County; Richard Foster and
Margaret Foster. Fee paid - $15.00.
THE CHAIRMAN: The application is accompanied by a survey
indicating that there is a one-story, framed shop on this parcel
which the applicant proposes to sell. It's a long parcel, SOl'
on the west and 100' on CR27 on which there's a one-story shop,
a one-story, framed house and a two-story framed house. The

'- property of Helmut Hass. Is there anyone present who wishes to
speak for this application?
RICHARD CRON: This is an application that was brought by
Samuel Glickman for the applicant, his office dropped the file
off to me today and asked if I'd come down on it, so I would
like to speak in his behalf on the application. I would point
out to the Board that uhe property in question is a residential
zoned parcel of land. It's being used in a non-conforming basis
in that there is a business on the premises. The land itself,
in terms of residential use, falls about 632' sq. ft., I believe,
short of having 40,000 sq. ft. in terms of a residential zone
parcel. I would point out that if this property were, in fact,
business zoned, either in a "B" or a "B_1", the maximum area
use is 30,000 sq. ft. with respect to a "B_1" area. That's
basically what the property is being used for.
THE CHAIRMAN: Does anybody live in the house?
RICHARD CRON: I don't know. The documents that were
mitted to me don't indicate whether it's occupied or not.

THE CHAIRMAN: I don't think it matters, I was just wondering.
RICHARD CRON: I would point out that, as you can see, the
land to the south is owned by the County of Suffolk. Had they
left him a little bit more land, he would have had his 40,000 sq.
ft. to begin with. While the survey itself doesn't show the drive-
way on the premises immediately to the west, I assume it exists
because it says it does, and to get 40,000 sq. ft. or the addi-
tional square footage for the parcel in question, you'd have to
not only take away the driveway that exists to the west, but
you'd make a rather irregular piece out of that portion of_ land,
which doesn't seem to make a great deal of sense. Certainly I
don't think that a variance or a shortage of 632' would be in
violation with the spirit of the law and probably would be such
that this Board is constituted to grant a variance in terms of
this type of situation. Finally, I would point out that what we're
dealing with is, I'm sure this Board is familiar with it, is an
area variance rather than a use variance. Nothing is going to
change as a result of this because the area is insufficient to
meet the residential requirements, not withstanding the fact that
the property is really being used for business purposes.
THE CHAIRMAN: A use variance is much more critical.
RICHARD CRON: Actually, I think the practical difficulties
of the situation speaks for itself. You're talking about a shortage
of 632 sq. ft. You're talking about prohibiting a sale of the
parcel if you can't give it, and in this case, while we don't have
to establish undue hardship, the practical difficulty of this

situation would, in fact, establish financial hardship.
THE CHAIRMAN: There's further reasoning in that this is,
I think, zoned "B-1", this strip here.
RICHARD CRON, ESQ.: The adjoining piece? I don't know.
I noted while I was waiting that the lands to the east are
presently subject to an application for a zone change.
THE CHAIRMAN: We had that at the County and it was denied
with the suggestion that the Board of Appeals handle it.
RICHARD CRON, ESQ.: I don't see how you could. It's an
"A" residential area there now.
THE CHAIRMAN: You'd have to handle it under a use variance
application. I don't know what they want to put in there. Which
lot do you refer to?
RICHARD CRON, ESQ.: I don't know, somebody had told me
100' on the road, the one that's immediately to the east there,
that only has a little over 20,000 sq. ft. I don't know how
they're going to get a "B-1" out of it, I could see getting a
"B" possibly. They don't meet the area requirements under the
Bulk Schedule.
THE CHAIRMAN: The County condemned that, I don't remember
the sequence of events.
(The Board and Mr. Cron discussed the property.)

12. If .there be a water meter on the premises, the seller shall furnish a reading to a date not more than thirty days prior
to the time herein set for closing title, and the unfIxed meter charge and the-,unfIXed sewer rent, if any, based the'feon for

bathroom and kitchen cabinets, mantels, door mirrors, venetian blinds, shades, scrcens, awnings, storm windows, window
boxes, storm doors, mail boxes. weathcr vanes, flagpoles. pumps, shrubbery and outdoor statuary.
19. The amount of any unpaid taxes, assessments, watcr charges and sewer rents which the seller is obligated to pay :lnd
discharge, with the interest and penalities thereon to a date not less than two business days after the date of closing title,

WHEREAS, a public hearing was held and concluded on January 8,
1987 in the Matter of the Application of HELMUT HASS under Appeal
No. 3461; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the board has carefully considered all testimony and
documentation submitted concerning this application; and
WHEREAS, the board members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the board made the following findings of fact:
1. The premises in question is located along the south side of
Middle Road (a/k/a C.R. 48), Peconic, NY, having a total area of
49,709 sq. ft. and 100 ft. lot width.
2. The subject premises is identified on the Suffolk County
Tax Maps as District 1000, Section 69, Block 4, Lot 2.1, and is
located in the "B-1" General Business Zoning District.

3. By this application, appellant requests variances from the
Provisions of Article VII, Section: (a) 100-71, Bulk Schedule, for
insufficient lot area of proposed Parcel #1 of 20,774 sq. ft. and
Parcel #2 of 28,935 sq. ft., and insufficient lot width of 100 feet;
(b) 100-70(A) continuing established residential use as principal
use [in the existing two-story building] southerly Parcel (#1); (c)
100-70(A) and 100-71 continuing established residential use in existing

one-story building which also has an insufficient livable floor
area of 774:! sq. ft. [northerly Parcel (#2)].
4. Article VII, Sections lDD-71 and 100-70 of the Zoning
Code require a.minimum of 30,000 sq. ft of lot area and 150 ft.
lot width, per parcel, in this "B-1" General Business Zoning
District. The lowest allowable livable floor area in the "A"
District is 850 sq. ft. The percentages of relief requested
are: (a) 1,065 sq. ft. and 9,226 sq. ft., or .035% and 31%
as to lot area; (b) the lot width is preexisting; (c) the
insufficient livable floor area is preexisting.
5. It is noted for the record that: (a) by letter dated
November 24, 1986, the Suffolk County Department of Health
Services waived Article 6 Review; (b) the Planning Board by
letter dated March 26, 1986 recommended approval.
6. It is the opinion of this Board that there will be
no increase in density since the property is developed, and
the variances requested are the minimal necessary under the cir-
cumstances.
In considering this appeal, the board also finds and
determines: (a) that the percentages of relief requested are
not substantial; (b) the circumstances are unique since the
premises is developed; (c) there will not be a substantial
change in the character of the neighborhood since the variance
will not create any increase in density; (d) there is no
other method feasible for appellant to pursue other than a
variance; (e) that in view of the manner in which the
difficulties arose and in considering all the above factors,
the interests of justice will be served by allowing the
variance, as conditionally noted below.
Accordingly, on motion by Mr. Grigonis, seconded by
Mr. Sawicki, it was
RESOLVED, to approve the variances requested and as
more particularly shown by survey map amended December 29,
1986, prepared by Roderick VanTuyl, P.C., SUBJECT TO THE
FOLLOWING CONDITIONS:
1. Lot areas of each parcel #1 and #2 not be further
reduced or changed in any manner (no lot-line changes or
area adjustments);
2. Conveyance in legal form must be recorded in the
Suffolk County Clerk's Office after receiving appropriate
Town, County and other agency approvals, within two years
from the date hereof (copies of the deeds or other legal
form of conveyance to be furnished to the Office of the
Board of Appeals and the Planning Board).
3. Planning Board final approval;
4. Referral by the Board of Appeals to the Suffolk
County Department of Planning in accordance with the require-
ments of the Suffolk County Charter, Sections 1323, et seq.
Vote of the Board: Ayes: Messrs. Goehringer, Grigonis,
Doyen; Douglass and Sawicki. This resolution was duly adopted.
