A. For new building or new use:
I. Final survey of property with accurate location of all buildings, property lines, streets, and unusual natural or
topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal (S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains less than 2/1 0 of I % lead.
5. Commercial building, industrial building, multiple residences and similar buildings and installations, a certificate
of Code Compliance from architect or engineer responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
B. For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and "pre-existiug" laud uses:
1. Accurate survey of property showing all property lines, streets, building and unusual natural or topographic
features.
2. A properly completed application and consent to inspect signed by the applicant. If a Certificate of Occupancy is
denied, the Building Inspector shall state the reasons therefor in writing to the applicant.

SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II category of the
State's List of Actions, without an adverse effect on the environment if the project is implemented as
planned,
PROPERTY FACTS/DESCRIPTION: The applicant's 20,011 sq. ft. parcel has 155 feet along the north
side of Mathews Lane and is improved with a 1-112 story, single-family dwelling with garage, accessory
swimming pool and shed as shown on the November 15, 1991 survey prepared by Roderick VanTuyl,
P.C., amended by Mark Kevin Schwartz, A.I.A. to show the proposed addition.
BASIS OF APPLICATION: Building Department's December 13, 2004 Notice of Disapproval, citing
Sections 100-242A and 100-244 in its denial of a building permit to construct a proposed sunroom
addition, in a location that was determined to constitute an increase in the degree of nonconformance
with a new rear yard setback less than the code required 50 feet. The applicant proposes 44+- feet from
the rear lot line to the new construction.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on March 31, 2005 at which time
written and oral evidence were presented. Based upou all testimony, documentation, personal
inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and
relevant:
AREA VARIANCE RELIEF REOUESTED: The applicant wishes to construct a 14' x 22.5' addition as
a new sunroom at the northwesterly corner of the existing dwelling, approximately 44 feet from the rear
property line, as shown on the undated floor and elevation diagrams, and November 15, 1991 survey
prepared by Roderick VanTuyl, P.c., with sketch, all prepared by Mark Kevin Schwartz, A.I.A.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:
1. Grant of the variance will not produce an undesirable change in the character of the neighborhood
or a detriment to nearby properties. The applicant propose a single-story addition, and according to

the floor diagram prepared by the applicant's architect measures 14' x 22.5' iu size, in the northwest
corner of the dwelling, and at not less than 43 feet (44+-) feet from the rear property line.
2. The benefit sought by the applicaut cannot be achieved by some method, feasible for the applicant to
pursue, other than an area variance. The addition will be built in an existing notch of the house and will
utilize the west side of the room to maximize the sun's heat (for a new sunroom).
3. The variance granted herein is minimal and represents a six-ft. reduction from the code, which
requires a minimum of 50 feet for a minimum rear yard setback.
4. The difficulty was self-created and is related to the need for a sunroom, which is proposed in a
location that does not meet the minimum rear yard setback requirement of the zoning code.
5. No evidence has been submitted to suggest that a variance in this residential community will have an
adverse impact on the physical or environmental conditions in the neighborhood.
6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to
enjoy the benefit of an addition, while preserving and protecting the character of the neighborhood and
the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing
test under New York Town Law 267-B, motion was offered by Member Orlando, seconded by Member
Simon, and duly carried, to
GRANT the variance as applied for (with not less than 43' from the rear line), as shown on the
undated floor and elevation diagrams, and November 15, 1991 survey prepared by Roderick
VanTuyl, P.c., with sketch/amendment, prepared by Mark Kevin Schwartz, A.I.A.
This action does not authorize or condone any current or future use, setback or other feature of the
subject property that may violate the Zoning Code, other than such uses, setbacks and other featnres as
are expressly addressed in this action.
Vote of the Board: Ayes: Members Oliva (Chairwoman), Orlando, Goehringer, Dinizio, and Simon.
This Resolution was duly adopted (5-0).

c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
· shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18, months from such date. If no zoning antendments or other regulations affecting the
property have been enacted in the iriterim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required. : .

CONSTRUCTION NOTES:
1) TIle inlonrolion within this sel of conslrucllon documellls Is related 10 basic design
tnlent and framing details. They are intended as a construction aid . nol a substitute
for generally accepted good building pradice and compliance with current New York
State building codes. The General Contractor Is responsible for providing standard
construction details and procedures to ensure a profeasionally finished, structurally
sound and a weatheqJroof completed pl'tldud.
2). The Genefal Contractor Is responsible for ensuring that all work and construction
meels current federal, state, county and local codes, ordinances and regulations. etc.
These codes are to be considered as part of the specifications for this building and
should be adhered lo even if in variance with the plan.

FOUNDATION NOTES:
1). The General Contractor and Mason to review plans, elevations. detaila and notes to
detennine intended heights of finished ftoor(s) above typical grade.
2). All footings to resl on undlSlurbed (virgin) soil.
3). Provide 1/2~ expansion joint materiaS between concrete slabs and abutting
concrete Of masonry walls occuring In exterior or unheated inlerior areas.
4). Any new concrete walls being attadled 10 existing concrete structure shall
be installed with #4 re-bar, 1S- long at 1T o.c.. Use approved epoxy for Installation.

bottom plate, 3 'Inch square washes shall be used wilh the 8hChor bolls. Anchor bolt

anchor bolts are to be spaced between 6-'12 Inches from the end of a sin plate and all

5). TYPE I EXTERIOR SHEARWALL CONNECTIONS:
Type I exterior shear walls with a minimum or 7/16 inch wood structural panel on the exterior
attached with 8d common nails at 6- o.c. al the panel edges and 12" o.c. in the field. and
1/2 indl gypsum wallboard on the interior attached with 5d cooler nails al 7~ o.c. at panel
edges and 10~ O.c. in the lield.shall be in accnrdance with the length requirements specified
In table 3.15a-b.
6). TYPE 11 EXTERIOR SHEARWAlL CONNECTIONS:

DECKAND COVERED PORCH NOTES:

approved equal. Flat roofs shall be applied with 8 Fiberglas base sheet with an EPDM

13). All sill plates and wood In contact with concrete to be pressure treated. Sill plates 10
be installed wilh a foam sill gasket and cop-r-tex termite shield or approved equal.
2). Verify septic system with the Engineer for Suffolk County Health Department approval.
3). If wall studs, plates or joists are cut out during Installation for any plumbing related work,
provide adequale brBclng and plates to protect and secure the struclure. Verify with the
