RESOLVED that whereas a formal application for the approval of a subdivision plat entitled'Vine View Associates" c/o Breslin Appraisal Co, Inc.located at Southold, tax map no. 1000-69-1-4 was submitted to the Planning Board on August 12, 1985 and, filing fee of $550 was paid on August 12, 1985, and WHEREAS, a public hearing was held on said subdivision application and plat at the Town Hall, Southold, New York, on August 4, 1986 at 7:30 p.m., and WHEREAS, the requirements of the Subdivision Regulations of the Town of $outhold have been met by said subdivision plat and application, NOW, therefore, be it RESOLVED that the application of "Vine View Associates" c/o Breslin Appraisal Co. for approval of said subdivision plat prepared by Rod Van Tuyl dated as last amended June 23, 1986 be approved and the Chairman be authorized to endorse approval on said subdivision plat, subject to the following conditions to be completed within six months from the date of this resolution: 1. PERMIT UNDER SECTION 136 of ARTICLE VI of HIGHWAY LAW Whereas, Section 136 of Ar[icle Vi of the Highway Law provides: Permits for work within the county road right of way ~Except in connection with the construction, reconstruction, maintenance or improvement of a county road or operations of a corporation pursuant to the provisions of section twenty-seven of the transportation corporations law or sections twenty-one, eighty-nine, ninety-one, ninety-three, ninety-~hree-aand ninety-three-b of the railroad law, no person, firm, corporation or m unicipal~ty shall cor~st ruct or improve, within the county road right of way an entrance or connection to such road, or construct within the county road right ol way any works, structu re or obstruction, or any overhead or underground crossing thereof, or lay o; maintain therein underground wires or cond nits o' d rainage, sewer Or water pipes, except in accordance with the terms and conditions of a work permit issued by the county superintendent or his duly designated agent, notwit hsta riding any consent o r franchise g ranted by any town superintendent, or by any other municipal authority. Any munlcipal corporation may enter upon a ny country road for the purpose of widening the pavement or for any other purpose authorized by this section, but only after sec uriflg a ~ermit as provided herein. Notwithsta nding the llmitations in any general or special la w, eve ry municipal corporation shal~ have and is hereby given authority to deposit with the county superintendent such a sum of money or a security bond as may be required as a condltion precedent to the granting of the permit p revided in this section The county superintendent shall estabrish regulations gover nirlg the issuance of highway work permits, including the fees to be charged therefor, a system of deposits of money or bonds guaranteeing the perlormance Of the work and requirements of insurance to protect the interests of the county during performance of the work pursuant to a highway work permit With respect to driveway entrance permits, the regulations shall take into consideration the prospective character of the development, the traffic which wi{l be generated by the facility within the masonaDiy foreseeable tutu re, the design and frequency of access to the facility, the effect of the facility upon drainage as related to existing drainage systems, the extent to which such facility may impair the safety and traffic carrying capacity of the existing county road a nd any proposed improvement thereto within the reasonably fo reseeable tutu re, and any standards governing access, nonaccess or ~imited access which have been established by the county superintendent. Upon completion of the work within the county road right of way. authorized by the work permit, the person, llrm corporation, m u nicipality, and his o¢ its Successors m interest, shall be responsible for the maintanance and repair of such work or portion of such work as set forth within the term $ and conditions of the work permit An advertising sign. display or device, or any part thereof, erected in violation of this section shall be removed from the con nty road right of way by the owner or the par[y responsible for its erection. NOW, THEREFORE, permission is hereby granted to said Vi~ Y~.~V ~so~i~t~ea to do said work upon the following conditions: CONOITIONS AND RESTRICTIONS 1. When concrete is removed, cut concrete with concrete saw two feet outside the limits of the proposed excavation and for the full panel width. When the cut is made in pavement within 10 feet of the panel joint, the pavement shall be removed for full panel width from the cut on the far side of the excavation to the panel joint. 2. Backfill and thoroughly compact fill using POWER TAMPER, placing soils so that various types of soil are In same relative position as before excavating. Grade to original suHace. 3. Replace pavement, sidewalk or surface same as existing; if concrete, replace using 1:1 3/4:3 1/2 mix stone mix concrete; if bituminous material, replace using same type as removed. 4. If concrete curb is removed, replace with similar curb 1:1 3/4:3 1/2 mix. 5. Edge of Jacking Pits or any other excavation shall be not less than 5 feet from Edge of Pavement. No undercutting allowed In Pit. 6. Notify the Department at Yapnank924-3451 when theworklstobeginsothat aninspection can be made of the operation. This permit shall not be assigned or transferred without the written consent of the Commissioner of Public Works. The work authorized by this permit shall be performed under the supervision and to the satisfaction of the Commissioner of Public Works or his representative. Particular attention is called to the necessity of thoroughly compacting the back fill, which will be required by the Commissioner of Public Works. The Commissioner of Public Works shall be given one week's notice by said applicant of the date when it intends to begin the work authorized by this permit, and prompt notice of its completion. The said applicant hereby agrees to hold the State, County and Town harmless on account of damages of any kind which may arise during the progress of the work authorized by this permit or by reason thereof. Applicant certifies all persons concerned with actual work under this permit are duly covered by Workmen's Compensation Insurance and the State, County and Town shall be held harmless on account thereof. The Corn missioner of Public Works reserves the right to at any time revoke or annul this permit should the said applicant fail to comply with the terms and conditions upon which it is granted. The applicant agrees to pay all necessary expenses incident to supervision and inspection by reason of the granting of such permit as certified by the Commissioner of Public Works, such payment to be made within ten days from the rendering of the certified account, Work under this permit to be commenced within thirty days from the date of permit and continued in an expeditious manner. The applicant shall submit a detailed plan of structure to be built, with a description of proposed method of construction, It is understood that should future changes in the alignment or grade of the highway require changes in the work covered by this application and permit, the applicant shall on reasonabre notice from the Commissioner of Public Works make such necessary changes at his own expense within the time so specified in notice. Davis Re: Plans Dated Amended August 26, 1986 - Profile dated September 26, 1986 - Vine View Associates (Minor Subdivision) Comments: Note on profile "Existing grade with topsoil removed." Do not believe any field survey elevations were taken - nothing shown - apparently contours were used. Do not see how a proper road profile can be designed without correct information on existing surfaces. No vertical curve corrections shown. Corrections should be shown on Stations 5 and 8. Correction at Sta 5 would raise the low point by 0.56 ft with a 100 ft. V.C. and 0.28 ft. for a 50 ft. V.C. 3. Stations should be shown on the plans. 4. No elevation shown for bottom of pond. 5. No type of C.B.'s, manhole, castings, etc. indicated 6. No length or direction of pipe from manhole to pond area shown. 7. No invert for pipe end at pond area. 8. The drainage easement location apparently has to be changed. October 17, 1986 Made field inspection of site. Grade stakes have been set with cuts and fills referenced to profile. From observation the road centerline profile will be below the adjacent surface in most of the length. Also, grade stake at end of road is marked "2 L.B.'s". This not shown on plan or profile but would be acceptable as the road ends on a minus grade. Davis Date: June ]8, ~986 Re: Vine View Associates at Southold - Minor Subdivision - Access Road - Map dated May 30, ]986 Comments: The property is overgrown with thick weeds and brush. Plan contours indicate a low point vicinity of the irrigation pond. Position of 25 ft. width of R.O.W. was estimated and a few test holes made. Depths of topsoil were 12"~ which agrees with test hole by VanTuyl. The elevation of the 0.S. along the frontage at C.R. 48 is approximately ~ ft. higher than the paved shoulders. Recommendations for access: ~. The R.O.W. to be cleared of all growth for the 25 ft width. 2. Owners should find out if a permit is required for entrance into C.R. 48. 3. VanTuyl to submit a road profile showing existing ground elevations and also the bottom elevation of the irrigation pond. The proposed grades should be above the existing ground. 4. Road width 16 ft. with 4 ft. shoulders. 5. Remove ~2" of topsoil or as necessary to sand and loam for a width of 20 ft. 6. Replace topsoil with bankrun containing gravel, sand and loam to meet the profile elevations. Gravel content to be 30%. 7. Bankrun backfill to be compacted. 8. Place a crowned compacted top course of recycled concrete or 3/4" stone blend on the 16 ft. width. This material should be spread, at depths to obtain 2" after compaction, say 2~" to 3" L.M. Drainage: The map indicates drainage easement at the irrigation pond. Contours in most part show the ground higher on the east side than the west side. Installation of a cross drain pipe under the road should be shown on the submitted profile. ~0. Emergency vehicles will have to turn via driveways. ~1. The center line of this access road is curved in most part and should be staked out accurately as it is a common property line between lots. ]2. As I have previously advised you, since this is a minor subdivision, it will not be recorded in the Suffolk County Clerk's Office. A reference to the parcel by merely referring to the minor subdivision map will not give notice to the world of the existence of the covenants. This is so because all documents affecting real property must be recorded in the Suffolk County Clerk's Office. A reference to an unfiled map is not adequate. Accordingly, the area of the senic easement must be described in the declaration by a metes and bounds description. The declarant in the declaration is Vine View Estates.
