The draft Declaration of Covenants and Restrictions that was
submitted on August 20, 1992 has been reviewed by staff. The
following changes must be made before the Planning Board will
forward the document to the Town Attorney for review.
As per the Planning Board's resolution dated
September 9, 1991, Number 1 must be amended to read:
No lot line shall be changed in any manner at any
future date unless authorized by the Town of
Southold Planning Board.
As per the Planning Board's resolution dated July 15,
1991, a covenant was required that there shall be no
further subdivision of any lot in perpetuity.

and designated on a certain map entitled "Minor Subdivision for BARRY
S. SAVITS" a minor subdivision situate at Peconic, Town of Southold,
Suffolk County, New York, to be filed in the Office of the Clerk of the
County of Suffolk, said premises described in "Schedule A" annexed hereto
and
WHEREAS, the SOuthoId Town P~anning Board is requiring the filing of
certain Covenants and Restrictions as a condition to its approval;
NOW THEREFORE, BARRY S. SAVITS, declares that the aforesaid ]and is
held and shal! be subject to the following Covenants and Restrictions:
No lot shall be subdivided or its lot lines changed in any manner
at any future date unless authorized by the Town of Southold
Planning Board.

Clearing and grading within each lot shall be limited to that
necessary for siting and constructing a house with the intent of
preserving as much of the natural vegetation on the site as
possible, and to minimize stormwater runoff and erosion.

Ali stormwater runoff resulting from the development and
improvement of this subdivision or any of its lots sha]! be
retained on the site by adequate drainage structures so that it
will not flow out onto the right-of-way of Goldsmith's Inlet
County Park.
A buffer or conservation easement at least 50 feet in width shall
be established along Soundview Avenue except for access driveways
to help preserve the natura! vegetation along the road, particularly
ground cover, so as to enhance the aesthetics of the road,
contribute to the preservation of residential amenities from
traffic activities and noise, and to help minimize the erosion
potential.
No vegetation shall be destroyed, cut, or removed, except
as required for disease control, within the seventy-five (75)
foot buffer area adjacent to the wetland area.

There ~hall be no construction of any kind within the seventy-
five (75) foot buffer area adjacent to the wetland area.
The dwelling unit on lot #3 shall be located in a manner so
that construction of this unit and any accessory structures
such as a tennis court, swimming pool, garage, etc., shall not
necessitate intrusion into the buffer a~ea.
The seventy-five (75) foot buffer area a~jacent to the wetland
is to be delineated by snow fencing prior to the development of
lot #3.
Haybales arelto be staked end to end adjacent to the snow fence
and left in place until permanent groundcover is established.
All roof runoff is to be directed into the gmound by means of
gutters, downspouts and drywells.
The setback of the septic system for lot # 3 shall not be less
than 100 feet from the wetland line.
These covenants and restrictions can be modified only at the
request of the then owner of the premises with the approval of
a majority plus one of the Planning Board of the Town of
Southold after a ~ublic hearing. Adjoining property owners
shall be entitled to notice of such public hearing but their
consent to such modification shall not be required.

Dear Mr. Olsen:
The Planning Board has reviewed the file for the above
mentioned proposed subdivision in response to your inquiry as to
the status of the application.
On July 16, 1991, the Planning Board granted conditional
sketch approval to the subdivision. Sketch approval is valid
for six months unless an extension of time is requested by the
applicant, and granted by the Planning Board. Although
extensions of the sketch approval were not requested, the Board
will grant a retroactive extension of the sketch approval at
their next public meeting. Such extension will expire on January
16, 1993 unless the Planning Board receives all of the items
required to complete the final submission before that day.
On September 10, 1991, the Board adopted the Suffolk County
Planning Commission report which required both a Declaration of
Covenants and Restrictions and revisions to the map. The revised
map was submitted, but to this date, the Board has not received
the Declaration of Covenants and Restrictions.
The final submission must include final maps that contain a
valid stamp of Health Department approval and that have been
revised in accordance with all previous requests of the Planning
Board, as well as a draft Declaration of Covenants and
Restrictions, again in accordance with all previous requests of
the Planning Board.

If a complete final submission is not received within the
time frame established above, the conditional sketch approval
will expire and a new application and application fee will be
required to proceed with the subdivision of the property.

Southold Planning Board affecting premises located on the easterly
side of Soundview Avenue, 932 feet north of Mill Lane, Peconic in the
Town of Southold, New York, and
said referral was considered by the Suffolk County Planning
Commission at its meeting on August 6, 1991 and
the Commission has voted to approve with certain changes said
referral, Be It Therefore
That the Suffolk County Planning Commission hereby approves and
adopts the report of its staff, as modified, as the report of the

That said proposed plat is approved subject to the meeting of the
following conditions deemed necessary for good planning and land use.
No lot shall be subdivided or its lot lines changed in any manner
at any future date unless authorized by the Town of Southold
Planning Board.

by itself, of accommodating emergency and service vehicles. It
is acknowledged that a common driveway is planned, however, such
an easement could conceivably be extinguished in the future by
court or other action.
All stormwater runoff resulting from the development and
improvement of this subdivision or any of its lots shall be
retained on the site by adequate drainage structures so that it
will not flow out onto the right-of-way of Goldsmith's Inlet
County Park.

necessary for proper maintenance and removal of diseased,
decayed, or dead material and obnoxious plant species. Such
clearing and cutting shall be subject to review by the Town to
insure proper maintenance and preservation of the natural buffer.
Conditions 1-6, inclusive, shall be filed as covenants and
restrictions in the office of the County Clerk on or prior to the
granting of approval to this subdivision.
These covenants and restrictions can be modified only at the
request of the then owner of the premises with the approval of a
majority plus one of the Planning Board of the Town of Southold
after a public hearing. Adjoining property owners shall be
entitled to notice of such public hearing but their consent to
such modification shall not be required.
The final map shall bear the following note: A Declaration of
Covenants and Restrictions has been filed in the Suffolk County
Clerk's office which affects lots in this subdivision.
The Com~ission offers the following comment on the map:
It is suggested that before approval is granted to this
Subdivision that the subdivider be required to submit this
proposal to the Suffolk County Department of Health Services for
review to insure that the proposed subdivision will meet the
requirements and standards of that agency.
While the present arrangement is considered acceptable an
alternate cluster design that would concentrate the three parcels
towards the northerly section of the property with 2 acre lot
areas using the existing driveway for access to all parcels may
be more acceptable. This arrangement would provide for 50% of
the property to be left natural and undisturbed in a Homeowner's
Association or dedicated to the Town of Southold.
The map of this minor subdivision should be filed in the office
of the County Clerk. This is to insure the validity of the
subdivision map and that the subdivision map will be available to
the general public in a central office of official records.

4. According to a map that was received from the State of New York
this property appears to be located within an area that is
considered to be archaeologically sensitive. Many sites contain
material and/or buildings that are of prehistoric or historic
value. These sites should be preserved or developed with a
sensitivity for historic or cultural values that can be available
for the appreciation of future generations.

the Commission has voted to approve with certain changes said

That the Suffolk County Planning Commission hereby approves and
adopts the report of its staff, as modified, as the report of the
Eommission, Be It Further
That said proposed plat is approved subject to the meeting of the
following conditions deemed necessary for good planning and land use.
No lot shall be subdivided or its lot lines changed in any manner
at any future date unless authorized by the Town of Southold
Planning Board.
Clearing and grading within each lot shall be limited to that
necessary for siting and constructing a house with the intent of
preserving as much of the natural vegetation on the site as
possible, and to minimize stormwater runoff and erosion.
3. There shall be no further subdivision of any of these lots in
perpetuity.
The angular bends in the panhandle of Lot 3 shall be modified by
a horizontal curve to insure that the panhandle will be capable,
by itself, of accommodating emergency and service vehicles. It
is acknowledged that a common driveway is planned, however, such
an easement could conceivably be extinguished in the future by
court or other action.
All stormwater runoff resulting from the development and
improvement of this subdivision or any of its lots shall be

As I discussed with you on March 8, 1991 I have reviewed the Planning
Board letter of February 25, 1991 with Dr. Savits. My client is not
agreeable to changing the property line between lots 2 and 3 by moving
same to the northwest by approximately 100 feet for the following
reasons:
1. Said lot line change would bring the line into substantial
rhododendron beds.
2. There are presently under ground sprinkler systems on lot 2.

The Planning Board reviewed the status of the above
mentioned file at their last work session. The Board apologizes
for the delay in their review of the revised maps.
The Board is in favor of the layout as shown on the maps
last dated August 28, 1990. However, the following changes must
be made:
The property line between Lot 2 and Lot 3 should be
moved to the northwest approximately 100 feet. This
will create two more equally sized lots. It will also
allow the building envelope for Lot 3 to be located
further away from the wetland area as suggested in the
Trustees report.
Ail items listed in the March 30, 1987, Conditional
Negative Declaration must be shown on the map. These
were shown on the previous maps, but are not shown on
the current map.
The upland and wetland areas for each lot must be
stated on the map.

Minor Subdivision
Subject parcel is partially developed and contains a
single family dwelling, green house, stable area, and two
barns. Vegetation was at one time cleared and replaced by
lawns and gardens in and around the dwelling extending south
of the dwelling some 400 feet. Based upon the size of the
ornamental rhododendrons found within this area, clearing
must have taken place many years ago.
South of the dwelling by a distance of approximately
100 feet, two ponds connected by a narrow sluiceway are
found. These ponds appear to be man made. Except for three
clumps of sedges, rooted wetland vegetation is absent from
the pond edge. The ponds appear to receive considerable
runoff from the surrounding lawn as a result of
percipitation and the use of undergrown sprinklers installed
nearby. (The pond level in the southern portion of the pond
closest to the sprinkler head was higher than the northern
portion of the pond complex). The surface of the pond was
covered with duckweed. While the pond contains a sedge and
is covered with duckweed, I regard the pond as a landscape
feature rather than as a wetland and see little benefit in
its regulation.
I have reviewed the above referenced map and find
general agreement with the wetlands line as flagged by the
NYSDEC. Subject wetland consisists of a small central area
characterized as a wet meadow. While a detailed floral
inventory was not performed, this area of the wetland
contains a variety of rushes and a growth of phragmites.
Lands immediately surrounding the wet meadow consists of a
red maple swamp. Growth within the red maple swamp is quite
thick and consists of primarily, red maple (Acer rubrum),
sour gum (nyssa sylvatica), sweet pepperbush (Clethra
alnifolia), cinnamon fern (Osmunda cinnamomea), highbush
blueberry (Vaccinium corymbossum), swamp azalea
(Rhododendron viscosum), and spicebush (Lindera benzoin).
Two temporary vernal pools were observed within the red
maple swamp.
Upgradient from the red maple swamp portion of the
wetland is a transitional area where flags were placed by
the NYSDEC. Within this area, the undergrowth consists of
sweet pepperbush while the overstory contains red oak.
Sweet pepper bush and red oak is classified by the US Fish
and Wildlife Service as facultative wetland and upland,
respectively.
Recommendations
The designation of a 75 foot setback from the building
envelope as depicted on the survey prepared by Roderick Van
Tuyl amended last on August 10, 1989 will result in the
preservation of the wetland transitional area described
above. However, the building envelop is small and may
result in accidental or intentional clearing of this area.
Since this subdivision is still in the planning stages it
may be prudent to move the northern property line northwards
to allow for a larger building envelope. The movement of
the property line northwards will also result in the
eventual construction of a shorter road. The reduced length
of the road will reduce the amount of stormwater generated
during rains and snow melt, reduce maintenance and
construction costs, and will result in less clearing of
natural vegetation. As the planning process matures, I
recommend that such line be moved north an additional 100
feet. In doing so, the risk of overclearing, and impacts to
vegetation found on site will be substantially mitigated.
The eventual development of lot #3 will be regulated by
the Southold Board of Trustees. The major environmental
concerns will likely include the control of runoff to the
wetland, siltation, placement of the septic system, and the
inadvertent or intentional clearing of vegetation within the
75 foot setback. It is recommended that the setback radius
from the wetland be delineated by snow fencing prior to
clearing, that haybales be staked end to end adjacent to the
snow fence and left in place until permanent groundcover is
established, that all roof runoff be directed into the
ground by means of gutters, downspouts and drywells, and
that the setback of the septic system be not less than 100
feet from the wetland line.

The right-of-way location must be revised so as to be

requested in the Planning Board's correspondence dated May 30,
1989.
The Board has reviewed your concerns as to the construction
of the road and the posting of a performance bond or letter of
credit. The Planning Board will be requiring that a performance
bond, letter of credit, or the equivalent be submitted and
approved by the Town Board prior to any endorsement of the final

The Planning Board reviewed the above mentioned subdivision
and had the following comments:
The right-of-way location must be revised as shown on
the enclosed map. The access point must be located at
the high point on Sound View Avenue as previously
requested in the Planning Board's correspondence of
November 17, 1987. The right-of-way must be fifty feet
(50') as per Sections A106-33C and A108-42 of the
Town Code, and must terminate in a cul-de-sac. Access
to Lot ~1 can remain as it is shown. Road profiles
must be submitted to the Planning Board for drainage
review purposes.
The building envelope for Lot ~3 must be shown. The
envelope should be located on the high area of the
lot, and must be at least seventy-five 175) feet from
the N.Y.S.D.E.C. flagged wetlands line.
The subdivision map should state clearly that the flag
line denotes fresh water wetlands.
The terms of the Conditional Negative Declaration of
March 30, 1987 (copy enclosed) have yet to be
fufilled. The Planning Board cannot proceed until they
are met.

that there are no comments or objections from that agency.
The Suffolk County Department of Health Services, Office
of Ecology, has no objection to our designation of lead
agency. An application has been filed with the Health
Department. The proposed action appears to conform to

The Suffolk County Department of Health Services (SCDHS) has
received your letter of January 22, 1987 regarding the above-refer-
enced application and has no objection to your designation as lead
agency.
We have reviewed the information provided with your letter and
submit the following comments regarding Sanitary Code Compliance and
natural resources concerns.
I. Sanitary Code
A subdivision application was filed with our office in November
of 1986. Test-well and test-hole data and a typical cross-sectional
diagram of proposed subsurface sanitary disposal systems are required
prior to final action by the Health Department.
The proposed action appears to conform with the minimum lot size
requirements of Article 6 of the Suffolk County Sanitary Code.
However, the SCDHS does not allow underwater lands to be included in
property yield. Therefore, precise calculation of density cannot be
made until the underwater lands of the pond (indicated on the site
survey) are delineated and omitted from this parcel's yield. Please
require the applicant to show wetlands and open water on the survey.
(~ The SCDHS maintains jurisdiction over the final location of the
_~%sanitary disposal system. The applicant, therefore, should not
undertake the construction of the system without Department approval.

A. Wetlands
The property contains portions of a large wooded wetland (with
standing water). Its boundary appears to correspond approximately
with the 10-foot contour line on the project survey. The wetlands on
and adjacent to this property are connected by a culvert to Peconic
Inlet. The freshwater wetlands provide water quality and stormwater
control benefits for the creeks that drain towards the Inlet.
As a result of public hearings held in ~985, the New York State
Department of Environmental Conservation (DEC) received many
nominations of freshwater wetland' areas for addition to their wetland
regulatory maps. According to the DEC the large freshwater wetlands
adjoining the Goldsmith's Inlet County Park were nominated as
wetlands of "unusual local importance". As we understand it, DEC is
determining which nominations should be added to the maps, through
field inspections, prior to finalization ("Filing") of the freshwater
wetland maps for Suffolk County.
If DEC adds this wetland to the regulatory maps the subject
parcel could be affected by Article 24 (Freshwater Wetlands Act)
regulations. We suggest the applicant plan for such a contingency.
The wetland serves as a natural drainage basin for much of the
site and could suffer sedimentation and pollution impacts as a result
of inappropriate residential development. Whereas the wetlands on
the subject parcel are connected to the wetlands of Goldsmith's Inlet
County Park, we believe that these areas should be protected to
ensure the sustained water quality of the County's adjacent wetlands
and Peconic Inlet.
III. Conclusions
The freshwater wetlands on and adjacent to this parcel provide
water quality benefits to the immediate project area and the Peconic
Inlet. Improper development could reduce these benefits.
We, therefore, recommend that the applicant provide information
regarding the following concerns:
1. Test hole and test well data
2. Cross-sectional subsurface sanitary disposal system diagram
3. DEC-approved delineation of all freshwater wetland boun-
daries on the parcel
4. Discussion of freshwater wetland protection,
control, and landscape plans
5. Building envelope shown for lot #3
erosion

Planning Board would not sign the map until a Road Performance Bond is filed with

for as long as possible, he would like to file covenants and restrictions that would
run with the land to advise future purchasers that no building permit would be
granted by the Building Department until such time as the road is constructed.
He has suggested filing said covenants and restrictions as an alternative to posting
the bond and having to actually construct the road as long as he retains title to
the ]pts.

The Planning Board reviewed the above mentioned subdivision
and had the following comments:
The right-of-way location must be revised as shown on
the enclosed map. The access point must be located at
the high point on Sound View Avenue as previously
requested in the Planning Board's correspondence of
November 17, 1987. The right-of-way must be fifty feet
(50') as per Sections A106-33C and A108-42 of the
Town Code, and must terminate in a cul-de-sac. Access
to Lot 91 can remain as it is shown. Road profiles
must be submitted to the Planning Board for drainage
review purposes.
The building envelope for Lot ~3 must be shown. The
envelope should be located on the high area of the
lot, and must be at least seventy-five ~75) feet from
the N.Y.S.D.E.C. flagged wetlands line.
The subdivision map should state clearly that the flag
line denotes fresh water wetlands.
The terms of the Conditional Negative Declaration of

After reviewing the file and inspecting the site the following
changes are requested:
Access to three of the four lots shall be over a
relocated right-of-way. The right-of-way access to
Sound View Avenue should be worked to a high point
on Sound View so to improve traffic safety.
The existing driveway to Lot 2 (as proposed) shall be
eliminated, again for traffic safety reasons. Access
to Lot 2 as well as 3 and 4 shall be over the
relocated right-of-way. Lot 1 may have a separate
driveway.
The right-of-way shall be 50' wide with 22' of paving
as per Town Highway Specifications.
Because of this property's close proximity to Goldsmith's
Inlet and the presence of wetlands on the site, the
wetland must be shown pn the subdivision map, as
requested in our previous correspondence to your office
of July 1st. The Suffolk County Department of Health
Services letter which was sent to you on March 3, 1987;
is self-explanatory.

The above mentioned proposal was reviewed by the Board
at the February 9, 1987 meeting.
The Board questions if the existing drive way will be
used and maintained for Lot No. 2. If so, the plotting of
Lot No. 1 may not be favorable.
The Board also questioned if covenants and restrictions
would be submitted regarding no further subdivision of Lot
No. 2.
In the Planners review, it was recommended that Lot No.
1 be re-designed to use the existing sand pit as a recharge
basin. Runoff should be stopped from crossing the road into
the creek. Prior to any approvals, a sedementation and erosion
control measure should be submitted, as well as, a drainage
control plan.

1. Culvert from property to wetlands across Sound View
2. There are a number of pockets of standing water that should
be put on the map.
3. The southeast corner of lot~appears to have standing water
and phragmites. The property lines should be staked so that
a determination can be made to whether or not these areas
are on the subject parcel.
4. If according to SCDHS letter of 2/18/87 the area of wetlands
connected to Goldsmiths' Inlet is put on the list of "unusual
local importance" set backs and other restrictions may be
modified. This area should be put on the survey/minor

subdivision and the towns set back of ~J~5 should be shown
_from it.
5. Once these areas are shown it is recommended that building
envelopes be shown using the most restrictive set backs to
allow for any future changes.
6. Erosion and sedimentation control measures should be established
prior to any construction or work on site. These measures
(staked hay bales) shall remain until all work is completed
and re-seeding has established.

Dear Mr. Orlowski:
The Suffolk County Department of Health Services (SCDHS) has
received your letter of January 22, 1987 regarding the above-refer-
enced application and has no objection to your designation as lead
agency.
We have reviewed the information provided with your letter and
submit the following comments regarding Sanitary Code Compliance and
natural resources concerns.
I. Sanitary Code
A subdivision application was filed with our office in November
of 1986. Test-well and test-hole data and a typical cross-sectional
diagram of proposed subsurface sanitary disposal systems are required
prior to final action by the Health Department.
The proposed action appears to conform with the minimum lot size
requirements of Article 6 of the Suffolk County Sanitary Code.
However, the SCDHS does not allow underwater lands to be included in
property yield. Therefore, precise calculation of density cannot be
made until the underwater lands of the pond (indicated on the site
survey) are delineated and omitted from this parcel's yield. Please
require the applicant to show wetlands and open water on the survey.
The SCDHS maintains jurisdiction over the final location of the
sanitary disposal system. The applicant, therefore, should
not
undertake the construction of the system without Department approval.
II. Natural Resources

A. Wetlands
The property contains portions of a large wooded wetland (with
standing water). Its boundary appears to correspond approximately
with the ~0-foot contour line on the project survey. The wetlands on
and adjacent to this property are connected by a culvert to Peconic
Inlet. The freshwater wetlands provide water quality and stormwater
control benefits for the creeks that drain towards the Inlet.
As a result of public hearings held in 1985, the New York State
Department of Environmental Conservation (DEC) received many
nominations of freshwater wetland areas for addition to their wetland
regulatory maps. According to the DEC the large freshwater wetlands
adjoining the Goldsmith's Inlet County Park were nominated as
wetlands of "unusual local importance". As we understand it, DEC is
determining which nominations should be added to the maps, through
field inspections, prior to finalization ("Filing") of the freshwater
wetland maps for Suffolk County.
If DEC adds this wetland to the regulatory maps the subject
parcel could be affected by Article 24 (Freshwater Wetlands Act)
regulations. We suggest the applicant plan for such a contingency.
The wetland serves as a natural drainage basin for much of the
site and could suffer sedimentation and pollution impacts as a result
of inappropriate residential development. Whereas the wetlands on
the subject parcel are connected to the wetlands of Goldsmith's Inlet
County Park, we believe that these areas should be protected to
ensure the sustained water quality of the County's adjacent wetlands
and Peconic Inlet.
III. Conclusions
The freshwater wetlands on and adjacent to this parcel provide
water quality benefits to the immediate project area and the Peconic
Inlet. Improper development could reduce these benefits.
We, therefore, recommend that the applicant provide information
regarding the following concerns:
1. Test hole and test well data
2. Cross-sectional subsurface sanitary disposal system diagram
3. DEC-approved delineation of all freshwater wetland boun-
daries on the parcel
4. Discussion of freshwater wetland protection,
control, and landscape plans
5. Building envelope shown for lot #3
erosion

Dear Mr. Orlowski:
The Suffolk County Department of Health Services (SCDHS) has
received your letter of January 22, 1987 regarding the above-refer-
enced application and has no objection to your designation as lead
agency.
We have reviewed the information provided with your letter and
submit the following comments regarding Sanitary Code Compliance and
natural resources concerns.
I. Sanitary Code
A subdivision application was filed with our office in November
of 1986. Test-well and test-hole data and a typical cross-sectional
diagram of proposed subsurface sanitary disposal systems are required
prior to final action by the Health Department.
The proposed action appears to conform with the minimum lot size
requirements of ArtiCle 6 of the Suffolk County Sanitary Code.
However, the SCDHS does not allow underwater lands to be included in
property yield. Therefore, precise calculation of density cannot be
made until the underwater lands of the pond (indicated on the site
survey) are delineated and omitted from this parcel's yield. Please
require the applicant to show wetlands and open water on the survey.
The SCDHS maintains jurisdiction over the final location of the
sanitary disposal system. The applicant, therefore, should not
undertake the construction of the system without Department approval.

themselves lead agency under the State Environmental Quality

at Sound View Avenue, Southold for 4 lots on 12.4 acres. An
in initial determination of non-significance has been made.
The Board will conduct a field inspection prior to any
further review or action.
